Sentencing Options

• Most statutes have a sentencing structure

• Judges have considerable freedom in determining type, length and conditions of punishment

Suspended Sentence

• Sentence is given but does not have to be served at this time.

• May have to serve if rearrested

Probation

• Defendant is released to supervision of probation officer after agreeing to follow certain conditions.

Home Confinement

• Otherwise known as House Arrest• Can only leave home for essential

trips, like school or work.

Fine

Restitution

• Defendant must pay back or makeup for loss or injury to the victim

Work Release

• Allowed to work but must return to prison otherwise

Imprisonment

Purposes of Punishment

• Retribution- “Eye for an eye”• Deterrence- Discourage others• Rehabilitation- helping convicts

change their behavior• Incapacitation- Separating the

offender from the community

Parole

• Parole is the release of a convicted person before their entire sentence has been served.

• Must reach a minimum amount before they can apply.

• Case is then heard and decided by parole board
