LLLT and our Bar In 2012, the Washington State Bar Association (WSBA) Board of Governors recommended that the Washington Supreme Court adopt and create Limited Legal License Technicians (LLLTs) to begin working in the area of family law. LLLTs were a specific response to a studied and documented problem of lack of access of legal representation by low income individuals. As you probably know, the Washington Supreme Court adopted the recommendation and LLLTs are now a reality in our legal world. The WSBA is now looking into whether LLLTs should be allowed to practice in other areas of law and whether their authority should be increased to allow for negotiation on behalf of their clients and court appearances. There are two LLLTs, that I am aware of, that either reside or practice in Snohomish County and they have reached out and asked if they can become members of the Snohomish County Bar Association (SCBA). When the first request came in, the Board decided that it would not be in the best of the Bar as a whole to allow them membership. This decision was revisited and discussion was renewed at the July 2016 Board meeting because a second LLLT sought membership. After receiving input from Mr. Patrick Songy, President of the Family Law Section of the SCBA, the discussion touched on the fees that would appropriate and what rights would be associated with the membership, i.e., whether the membership would be limited. Ultimately, it was decided that the general membership should have a voice in a decision of this import and the Board decided that the By-Laws would need amending if LLLTs were allowed membership.
Although an Amendment has not been formally proposed, the prevailing thought was that they would be non-voting members of SCBA which would permit them to participate in sections and have access to our CLE’s. Considering the benefits bestowed, LLLT dues would be the same as attorney members, but ultimately that is a decision for the Board. Pursuant to Article XI of the By-Laws, an amendment would have to be presented at the annual or any special meeting with 10 days notice to the membership.
The intent of this column is not to advocate for one
position or the other; quite frankly, being a criminal defense attorney and not practicing family law (or other aspects of law where LLLTs may be allowed to practice in the future), I am in a very poor position to know of the benefits or detriments of their practice. From an officer of the SCBA perspective, any extra income to our Association is needed and welcomed. The intent of this column is to advise the membership of potential changes and allow members to research the issue to foster a healthy discussion and come to a common sense position.
At this time, it is not known when a potential Amendment in regards to LLLTs will be proposed and, as always, we will do what we can to ensure we communicate changes and opportunities for discussion.

Podcasts Anything that can be called “new to me” is defined as anything that was developed after 1994 when my last child was born. And it is therefore my children who introduce me to the “new”. In the case of the “new media” called podcasts it was my daughter Rachel who opened my eyes. Initially of course I had no idea what she was talking about. She downloaded I-tunes to my laptop over lunch one day, demonstrated how to select from the thousands of podcasts the masses have uploaded to I-tunes, then showed me how to connect my I-pod to the machine, but it was the salesman at Ford who showed me how to play the thing on the car stereo. It makes for a nice commute. What is a podcast? Think radio show where there is no licensing requirement with the FCC. That’s right folks, there is no gatekeeper, no Big Boss holding the license to a four letter frequency starting with K on this side of the Mississippi river and W on the other who decides if you are on or off. Instead it is just up to the market to decide who stays around or who fades. And it not a market where money necessarily makes this decision. The podcasts themselves are free to listen to. Only the best gain sponsors. Instead, most just start off because someone has an idea, and a little money to put together a studio and they are off exercising the First Amendment. The quality differential is like Donald Trump’s hands, Yhewg, it will make your head spin. Some are slickly produced with voice over music to enhance the story being told, like This American Life. Very entertaining, TAL got a head start as it began as a radio show, much like Fresh Air with Terry Gross. Others enter the field without any pre-existing following at all. Most of these are strictly pitched at a segment such as history or religion. Many fall far short of the mark required for longevity. For example one fellow was reading his grandfather’s diary about being a tail gunner in a B-24 Liberator bomber in World War II. Generally this was good, but the amateur nature of it sometimes made it hard to listen to, for example when he felt he had to mimic the drunken airman or the young lady his grandfather was courting.
This fellow, like many others, even the most professional (such as Dan Carlin of Common Sense and Hardcore History) feel as if they have to apologize for not generating these things fast enough that is not good showmanship, you have to leave them wanting more. Then, like so many, the B-24 podcast just disappears. No explanation, No goodbye, gone. And it is not just the amateur broadcasters who disappear. Some very engaging history professors just stop. Or in the case of “PO’D” the team of Dennis Miller and Adam Carrolla, both accomplished comedians started off just fine talking about current events and stuff that “PO’d” them, with guests from the public calling in with similar gripes to feed our grievance culture. Soon it was hit or miss; Miller and Carrolla became irregular. Sometimes there were technical difficulties. One might disappear in the middle of a show. I came to realize they were in different locations doing the entire thing remotely. Then, like some forlorn history podcast they just disappeared. Some deserved to die. Take Cold War Radio for example. Slick artwork on the I-tune tile showing a ballistic missile submarine letting loose an ICBM, then upon downloading one hears an engaging back beat that makes one think “SPY” laid over with the sound of a helicopter and auto-wind film camera. The hosts come on pretentiously announcing the activation of “Northern Command”, then “Southern Command”. They launch into a discussion of current foreign policy. The trouble is after just a few minutes the listener recognizes neither host is all that well educated, they tend to get mixed up on who is leading what Middle East country, and they come off like angry old men who seem to yearn for the good old days of the Cold War. I deleted the 6 episodes, and now they too have disappeared. One history podcast about Napoleon Bonaparte I could see on I-tunes was completely finished so I downloaded all 26 episodes. The artwork was “borrowed” from the classic posture of the Emperor astride his rearing white stallion. I started listening to it on the way to work one day and concluded if I hadn’t reached the firm sooner I would have thrown the I-pod from the car in an act of self-preservation. Boring! The two people presenting this history, a man and a woman, were just dreary. It was evident they were not comfortable enough to present the narrative from memory or perhaps a few notes but were reading a script. I had this idea they were in a

hot, drab apartment in Cleveland, Ohio, a single 60 watt bulb hanging from their ceiling, the air is stuffy adding to the sheer weight of the experience. I deleted the 26 episodes. Most are like this, but try Dan Carlin’s Hardcore History. The guy is my hero. He can bring an ancient civilization back to life with the sheer quality of his voice. It is like he was there, is excited about what happened, and can come to our time to tell it in colloquial language. He is not reading from a script. He is not in some center for the recording arts. Instead he is in Eugene. No gatekeeper, remember? Then there are the niche podcasts; LBGTQ, Left Wing, Right Wing, Soccer, Football, Baseball, Catholic, Protestant, Jewish, Islam, all there for anyone to listen to but likely heard only by those already hooked. Some of these niche podcasts reveal a segment of society apparently existing in another dimension of time and space. We wouldn’t know they are among us but for the remarkable number of podcasts these people have generated. I give you, as an example, the Star Trek podcasts, only to name a few: Trek Mate: Ten forward, Previously in the Alpha Quadrant, the Beta Quadrant, The Delta Quadrent A Star Trek Voyager Podcast, Trek Mate: A Star Trek Podcast, Treknologic, Trek Nerds, Dork Trek, Trek Geeks, Trek Companion, Treknobabble, Trek Mate Brace For Impact!, Trek TV, Trek News and Views, First Contact The Next Generation Introcast, The Holodeck, The Battle Bridge, Captains Log, Listen to the Prophets Deep Space Nine and Two to Beam Up. I am sure there are more. Listening to these guys will remind you of the Chris Farley character on Saturday Night Live interviewing Paul McCartney and blowing it. Sort of, Like, remember that time when we all thought Spock was dead. Yeah, that was really cool. These are people who have apparently opted out of reality and have adopted Star Trek as a sort of alternate. Their colloquial speech is at once annoying and at the same time leaves one feeling like we missed something; odd references to religions that were made up at Paramount studios, time measured in star dates, money in gold press latnum, acronyms like TOG, (The Original Series) and the references to races and to relationships mean one must have seen absolutely every episode of every series as well as every movie to know what they are talking about. It is clear they have devoted their lives to a television show.
I said before there is no gatekeeper. There is no committee or strongman who decides who will be broadcast and who will remain in obscurity. One of these days, perhaps sometime soon, Lawyers Road Review will advance into the new media and become a podcast. It would have been there right now but I have been trying too many cases. You all know how that goes.
