From the previous classes, you would have been familiar with

the methodology of studying fiqh in Islam, especially on the

importance of going back to the basis (dalil).

Therefore in future, my slides/ hand-outs' will not contain

elaborate explanations, but will be brief but with emphasis on

basis (therefore you are to give special attention to practice,

and to memorize) on the explanation and these basis - Qur'an

or Hadith (especially those which I painstakingly provide with –

or without - the transliteration to ease those new converts).

ashamed of the Truth. Does a woman have to perform

ghusl’ (bathe) if she has a wet dream?” He said, “Yes, if

she sees the liquid.”

[2] The meeting of two circumcised parts (sexual intercourse)

The Prophet s.a.a.w. said, “When anyone sits between the four

parts of her body and exerts himself (has intercourse), bathing-

GHUSL’ becomes obligatory (for both).”

(Hadith reported by Ahmad & Muslim)

Abu Hurairah r.a. narrated that :

[2] The meeting of two circumcised parts (sexual intercourse)

“If the two circumcised parts encountered each other (i.e. sexual

penetration), GHUSL’ (bathing) is obligatory.”

(Hadith reported by Ahmad & Malik)

A’isha r.a. narrated that the Prophet s.a.a.w. said :

[2] The meeting of two circumcised parts (sexual intercourse)

Commenting on the above verse“… and if you are in (JUNUBAN)

sexually impure, purify yourselves.” (Q: 5:6), as-Shafi’ie r.a. said, “In

the Arabic language, sexual impurity “JUNUBAN” refers to any type of

sexual intercourse, regardless of whether sperm was ejaculated or

not. If someone says, “So and so is sexually impure due to so and so”,

it refers to any type of sexual intercourse between them, even if

there was no ejaculation. No one disagrees that the fornication which

requires the prescribed punishment is sexual intercourse even if

there is no ejaculation.”

[2] Women: menstruation (HAIDH ); post-natal bleeding (NIFAS )

And they ask you about menstruation, say “it is a discomfort;

therefore keep aloof from the women during the menstrual

discharge and do not go near them until they have become clean.”

(Qur’an: Baqarah: 2: 222)

[2] Women: menstruation (HAIDH); post-natal bleeding (NIFAS)

“Do not perform swolah (devotional prayer) during your period.

After it has ended, perform ghusl’ and pray.”

(Hadith reported by Bukhary & Muslim)

“NIFAS ” (post-natal bleeding) is treated in similar manner,

according to Ijma’ (consensus of opinion of the Companions).

The Prophet s.a.a.w. spoke to Fatimah binte Abi Hubeish r.a.,

Page 15: [Slideshare] tafaqqahu-(2014)-#4 -daily-application-(ghusl'-obligatory bath)-(1-november-2014)

If the menstruation (which usually takes about 6-7 days to

complete) becomes irregularly prolonged (i.e. longer than

normal),give a grace period of a day, after which the bleeding

is not considered as menstruation, but an ailment.

After this grace period, if there is still bleeding, the woman

can begin to perform Swolah. But each time, she has to take

her obligatory bath immediately before performing her

swolah.

[3] Death

Based on the ijma’ (consensus of the scholars), it is

obligatory to bathe the dead Muslim.

Exception is for those who died as a Shahid (those who

attained martyrdom in war to defend Islam).

The Prophet s.a.a.w. untied him and told him to go to the

garden of Abu Talhah r.a. and perform ghusl’. He performed

ghusl’ and prayed two raka’at. The Prophet s.a.a.w. said

“indeed, your brother (Thumamah) became a fine Muslim.”

[3] TOUCHING OR CARRYING THE QUR’AN

The companions all agreed that it is forbidden to touch or

carry the Qur’an (mushaf) while one is in the state of major

impurity.

As regards to touching parts of it, as used in letters, books,

tafsir, translations etc. where it is not considered as Mushaf,

scholars have allowed the touching of it for those in state of

impurity. *”Mushaf ” literally “the bounded leaves or scrolls”

is in reference to the whole Qur’an in Arabic.

Qur’an save being in Janabah.”

[4] RECITING THE QUR’AN

‘Ali r.a. said, “I saw the Messenger of Allah s.a.a.w. perform

ablution and recited some of the Qur’an, after which he said,

‘This is for the one who is not in Janabat. If one is in Janabat

he may not do so, not even one verse.’”

[4] RECITING THE QUR’AN

Scholars of the Shafi’ie madzhab are of the opinion that

reciting verses from the Qur’an, but as a form of dzikr viz.

basmalah, “innaa-lil laahi wa inna ilai-hi raa-ji-‘uun” etc. is

permissible for those in janabat.

[5] STAYING IN THE MOSQUE

‘Aishah r.a. said, “The Messenger of Allah s.a.a.w. saw that his

companions’ houses were practically (open) in the mosque. He

said, ‘Direct those houses away from the mosque.’

[5] STAYING IN THE MOSQUE

He then entered the mosque, but the people did nothing, hoping

that Allah would reveal to Muhammad s.a.a.w. that what they were

doing was permissible… after he came out, he said, ‘Direct those

houses away from the mosque, for it is not permitted for

menstruating women or those in Janabat to be in the mosque.’”

(Hadith reported by Abu Dawud)
