INSTRUCTIONS

• Ask participants to work with the person sitting next to them and create a list of every kind of identity document or civil documentation that they know of in Myanmar. (5 minutes)

• Distribute Handout 21.4.1 to all the participants. Ask participants to compare the documents in the Handout with the list they created with their partner. There should seven flipcharts (one for household list, CSC, NCSC, ACSC, NRC, ICNV, FRCs).

• • Now tape the 7 flipchart papers on the wall. • Divide participants into 7 groups. • Give each group a stack of post-its. • Ask each group to go to one of the flipchart papers. • Tell each group that they will have two (2) minutes at each flipchart paper to write the

benefits of each type of identification on a post-it note and put it on the paper. One benefit per post-it note.

• Tell participants that they should not repeat anything that is already written just add the new benefits.

• Tell participants that the facilitator will keep time and ask the groups to move towards the right every two (2) minutes. (15 minutes)

• At the conclusion the facilitator should ask each group to feed back for the flipchart they are in front of and help to identify any missing benefits. (15 minutes total presentation time)

NOTES TO FACILITATORS:

• The Household List is contained in the 1949 Residents of Myanmar Registration Act. • FRC is issued under the 1940 Registration of Foreigners Act. • NRC, WC are issued under the 1949 Resident of Myanmar Registration Act. The card

is issued to a resident of Myanmar. • ICNV can be assumed that issuing under the 1949 Resident of Myanmar Registration

Act. There was the expiry date, 2 years, mentioned previously but now moved since 2016. The holder need to apply for citizenship through citizenship verification process.

• CSC, ACSC and NCSC are issued under the 1982 Myanmar Citizenship Law. It can


confirm the citizenship of the holder.

Myanmar has many different kinds of identity documents based in both the 1982 Citizenship Law and the 1949 Registration of Residents Act. This means that some documents are for citizens and some are for residents. There are also documents issued to foreigners. Each of these types of identity cards entitles people with different rights. For example, some Constitutional Rights are stated as only being afforded to citizens. Sometimes it is unclear whether all categories of citizens have the same rights because the Constitution does not indicate this clearly. It is very difficult to know what rights are afforded to residents as residents are often not included specifically in the law. Because of the gaps in the Constitution and other laws, the rights of all people are not clear all the time. Type of Card

• Divide participants into 5 groups. • Give each group two of the sections from Handouts 21.4.2 and 21.4.3. • Ask groups to discuss their two sections and choose someone to give a short

presentation on these two sections. (5 minutes discussion. 10 minutes total presentation time)

INSTRUCTIONS – Part B

• Tell participants that they are now going to demonstrate how to apply the Handouts to 4 different fact scenarios using role play.

• Ask participants to form 4 groups. • Distribute Handout 21.4.4 to each group and assign them one fact scenario.


• Ask each group to create a short role play to demonstrate what the character in each role play should do and present it to the group. (10 minutes)

• Role plays should be no longer than 3 minutes per group. • At the end of each role play, the facilitator should ask the rest of the group the

following questions: o Which Rule of Law Principles can be found out in this role play? o What were the key challenges faced by the person trying to obtain their

documents? o What could the person have done differently to obtain their documents easier? o What could the authorities have done to make access to documents easier?

NOTES TO FACILITATOR: In each of the Role Play scenarios, the characters may face challenges to access their documentation because they are missing documents, they cannot communicate well with the


authorities or it might be unclear what the procedures are. NOTES FOR FACILITATORS : 1. What types of civil documentation are issued in Myanmar under which law/Act?

o NRC, TIC, ICNV under the Residents of Myanmar Registration Act, 1949 o CSC, ACSC, NCSC under the Myanmar Citizenship Law, 1982


2. Can all types of civil documentation confirm nationality? o No, some are issued under the Residents of Myanmar Registration Act,

1949 and some are issued under the 1982 Myanmar Citizenship Law.

3. Is it clear/easy to know/understand the rights for persons who obtained each type of civil documentation? It is difficult to know what rights are afforded to residents as residents are often not included specifically in the law. Because of the gaps in the Constitution and other laws, the rights of all people are not clear all the time.
