    THE NEW CONGRESSMr. DURBIN. Mr. President, I thank

    the majority leader for those kindwords. I am happy to report the Demo-cratic leader of the Senate, SenatorR EID , is making a speedy recovery fromhis New Years run-in with some exer-cise equipment. His face and ribs arestill sore. He is eager to get back towork. We met with him this morning,and we can expect him back in the Sen-ate very soon.

    In the meantime, it is a privilege onbehalf of the Democratic Caucus to

    welcome our old colleagues back towork and welcome our new colleaguesand their families to the U.S. Senate. Ialso want to wish Leader M CCONNELL ,as he takes up the new duties of themajority leader, the very best. SenatorDirksen was a Senator from my homeState of Illinois who served as a Repub-lican leader of the Senate from 1959 to1969. He famously said, I am a man offixed and unbending principles, thefirst of which is to be flexible at all

    times.That may sound comical, even con-tradictory. But Senator Dirksens abil-ity on flexible tactics and firmness onprinciples helped produce historic leg-islation such as the Civil Rights Act of1964, one of the greatest achievementsin our Nations history. I am sure weall will remember that with fondnessand pride.

    The American people need us to worktogether to solve problems and createopportunities. For their sake, let us alltry to remember that what we areabout is honorable compromise. TheConstitution of the United States andthe Senate itself are the results of just

    such a compromise.One other point. One hundred yearsago this week, an American industri-alist and entrepreneur stunned theworld by announcing he would startpaying his workers double the industryaverage and cut the hours. That man,of course, was Henry Ford. He com-mitted to pay his workers a minimumwage.

    As we begin this new Congress, let usdedicate ourselves to the working menand women across America, the tax-payers of this country, and the menand women which we so proudly serve.I hope that we will show flexibility andprinciple. We cant solve Americas

    challenges with the same old thinking.We have to address the problems withmutual respect and with a positive at-titude.

    I look forward to, on this side of theaisle, working with Senator R EID andmy colleagues to achieve that end.

    REMEMBERING SYLVIA GARCIARICKARD

    Mr. HATCH. Mr. President, it is witha heavy heart that I rise to convey tomy colleagues news of the tragic deathof Sylvia Rickardone of the Nationstop breast cancer advocatesa womanso full of life and joy, so deeply im-mersed in the science of her passion,that it is impossible to imagine thissad, sad occurrence.

    Sylvia was truly an amazing personwho touched many lives. I first metSylvia when she visited my office somany years ago to educate me on theneed for more breast cancer research,for better breast cancer screening, andfor better patient navigation. Sylvia,herself a two-time survivor of breastcancer, and later of ocular melanoma,made sure that my staff and I, and in-deed all of the Utah and Idaho delega-tions, regardless of party, were keptapprised of the latest developments inbreast cancer research. She patientlywalked us through the science behindthe researcha science she made it herbusiness to know in great detail.

    Sylvia was such a good advocate be-cause she had fought this dread dis-ease, and won. Not once, but twice.

    Sylvia made it her business not justto talk the talk, but also to walk thewalk. She was a past president of theWomens State Legislative Council inUtah, a bipartisan group of women whomeet to discuss issues of importance to

    Utah and the Nation. She also was thefounder of the Utah Breast Cancer Net-work, and the president of the HispanicHealth Care Task Force in Utah. Syl-via became involved in building aware-ness at the local level, as well as thenational level. Indeed, she was veryproud to have been selected to be anadvisor to the National Institutes ofHealtha remarkable recognition ofher top-ranked talent. She was in-volved at all levels in advocating forbetter biomedical research, better sup-port for that research, and for a non-partisan, commonsense approach to adisease that is now expected to affectone in eight women over their life-

    times.I recall the twinkle in Sylvias eyewhen top experts at the HuntsmanCancer Center in Salt Lake City soughther knowledge about eye cancer, aftershe was treated successfully. She hadfound a surgeon in another State whocould treat her without the certain lossof her eye, and she helped to connectthe physicians so they could learn fromeach other.

    It was a great loss to Utah when RickRickard built Sylvia the house of theirdreams for retirement in Boise, ID thispast fall. But we were all happy theyhad achieved their dream. I heard shewas absolutely delighted to cook in her

    new kitchen. I am so pleased she atleast got to spend a few months intheir new home, one they had workedfor so hard over so many years finallyto achieve.

    So our hearts go out to the Rickardand Garcia families, to Sylvia andRicks two sons, Richard, Jr. andDavid, and to the many millions of oth-ers whose lives have been made betterby the significant achievements of myfriend, Sylvia Rickard.

    Mr. LEAHY. Mr. President, over thepast few years we have seen remark-able progress in one of the definingcivil rights issues of our eraensuringthat all lawfully married couples aretreated equally under the law. In 2011,when I chaired the first Congressionalhearing to repeal the Defense of Mar-riage Act, only 5 States, includingVermont, recognized same-sex mar-riage. With todays lifting of Floridas

    unconstitutional same-sex marriageban, couples in 36 States and the Dis-trict of Columbia now have the free-dom to marry. This is welcomeprogress, and I hope we will see similaradvancements in even more States thisyear so that all Americans can marrythe one they love.

    Despite this tremendous progress,there is still more to be done to ensurethat no person faces discriminationbased on who they marry or wish to

    marry. As I said when the SupremeCourt struck down Section 3 of the De-fense of Marriage Act, All coupleswho are lawfully married under statelaw, including in Vermont, should beentitled to the same Federal protec-tions afforded to all other married cou-ples. Court challenges will continuethis year in the remaining States thatdo not recognize marriage equality.But in Congress, there are several stepswe can take immediately to help en-sure our Federal laws treat all mar-riages equally.

    Surprisingly, the Copyright Act,which protects our Nations diversecreative voices, still bears vestiges of

    discrimination. A provision in the Actgrants rights to the surviving spouse ofa copyright owner only if the marriageis recognized in the owners State ofresidence at the time he or she dies.This means that a writer who lawfullymarries his or her partner in Vermontor California is not a spouse underthe Copyright Act if they move toMichigan, Georgia, or one of the otherStates that do not currently recognizetheir marriage.

    Congress should close this discrimi-natory loophole to ensure our Federalstatutes live up to our Nations prom-ise of equality under the law. As theSupreme Court recognized in strikingdown key portions of the Defense ofMarriage Act, it is wrong for the Fed-eral Government to deny benefits orprivileges to couples who have lawfullywed.

    Today I am reintroducing the Copy-right and Marriage Equality Act in theSenate to correct this problem. Thebill, which I introduced in the Senatelast Congress and which a bipartisangroup of lawmakers including Rep-resentatives D EREK K ILMER , I LEANA R OS -L EHTINEN , and J ARED P OLIS plansto reintroduce in the House of Rep-resentatives soon, amends the Copy-right Act to look simply at whether acouple is lawfully marriednot wherea married couple happens to live whenthe copyright owner dies. It will ensurethat the rights attached to the worksof our Nations gay and lesbian au-thors, musicians, painters, photog-raphers, and other creators pass totheir widows and widowers. Artists arepart of the creative lifeblood of our Na-tion, and our laws should protect theirfamilies equally.

    When I introduced this bill last year,it failed to get the support of a singleRepublican in the Senate. I hope thatin this Congress, Republicans will con-sider joining this effort to correct

    This Act may be cited as the Copyrightand Marriage Equality Act.SEC. 2. DEFINITION OF WIDOW AND WIDOWER IN

    TITLE 17, UNITED STATES CODE.(a) I N G ENERAL .Section 101 of title 17,

    United States Code, is amended by strikingthe definition of widow or widower andinserting the following:

    An individual is the widow or widowerof an author if the courts of the State inwhich the individual and the author weremarried (or, if the individual and the authorwere not married in any State but were val-idly married in another jurisdiction, thecourts of any State) would find that the indi-vidual and the author were validly marriedat the time of the authors death, whether ornot the spouse has later remarried..

    (b) E FFECTIVE D ATE .The amendmentmade by subsection (a) shall apply with re-spect to the death of any author that occurs

    on or after the date of the enactment of thisAct.

    Mrs. FEINSTEIN. Mr. President,today I rise to introduce the Due Proc-ess Guarantee Act, which passed theSenate in 2012 with 67 votes as anamendment to the Defense Authoriza-tion Act for fiscal year 2013.

    Unfortunately, the amendment wastaken out in the Conference Com-mittee that year. It is my hope thatthe Senate will pass this legislationagain this year, and this time theHouse will support it so that it can fi-nally be enacted into law to protectAmericans from being detained indefi-nitely.

    The bipartisan bill I am introducingtoday, with Senator L EE as the lead co-sponsor, is almost identical to theamendment that passed the Senate inDecember 2012 with 67 votes. The pre-

    vious version of this bill had a hearingin the Judiciary Committee on Feb-ruary 29, 2012.

    This legislation is necessary to pre-vent the U.S. Government from detain-ing its citizens indefinitely.

    Unfortunately, indefinite detentionhas been a part of Americas not-too-distant past. The internment of Japa-nese-Americans during World War IIremains a dark spot on our Nationslegacy, and is something we should

    never repeat.To ensure that this reprehensible ex-perience would never happen again,Congress passed and President Nixonsigned into law the Non-Detention Actof 1971, which repealed a 1950 statuethat explicitly allowed the indefinitedetention of U.S. citizens.
