The First Part of the Laws of the Constitution of Selangor, 1959, which in this Proclamation is referred toas the “Laws of the Constitution”, except in Article XXIII,is amended in the English language text by substitutingfor the words “Dewan di-Raja” wherever appearing inthat Part with the words “Council of the Royal Court”.
3. Article XXIII of the Laws of the Constitution of Selangor is amended in the English language text byinserting after the words “Dewan di-Raja”, the bracketand words “(Council of the Royal Court)”.

4. (1) Pemegang permit atau pemegang lesen tidak boleh memulakankerja untuk mendirikan sebuah kuari baru atau menubuhkan semuasuatu kuari lama dan menjalankannya sebelum ia mendapat kelulusan
daripada Merinyu Kanan Kuari ke atas suatu skim yang dikemukakanbagi pihaknya oleh konsultannya. Skim itu hendaklah—
(a) menunjukkan bahawa pertimbangan secukupnya sudah diberikepada keselamatan orang awam dan orang-orang yangterlibat dalam kerja ini;
(b) direkabentuk dengan cara tertentu untuk membuatkannyapraktikal untuk masa hadapan ke atas kawasan kuari yangterlibat oleh skim itu;
(c) bertujuan untuk memberi perolehan yang semaksimummungkin dari bahan bantuan dengan mengambil perhatiankepada amalan kejuruteraan yang wajar;
(d) menyediakan langkah-langkah pembuangan bahan-bahanbuangan dan suatu rancangan pemeliharaan dan perlindunganke atas tempat kerja yang ditinggalkan;
(e) menyediakan langkah-langkah perlindungan alam sekitarmenurut mana-mana undang-undang yang pada masa ituberkuat kuasa berhubung dengan pengawalan alam sekitaratau pencemaran; dan
(f) megandungi apa-apa butiran dan maklumat lain yang
mungkin dikehendaki.
(2) Apabila kegiatan di kuari hendak dimulakan, dimulakan semulaatau berhenti, pemegang permit atau pemegang lesen atau pengurus,melalui konsultannya, hendaklah memberitahu Merinyu Kanan Kuarisecara bertulis, tarikh hal tersebut. Pemberitahuan itu hendaklahdisertakan bersama pemerhatian-pemerhatian konsultan mengenaikeadaan kuari pada masa itu.
5. (1) Setiap pemegang permit atau lesen hendaklah berterusanmempamerkan di pejabatnya di kuari, permit atau lesen yangdikeluarkan kepadanya ke atas kuari tersebut.
(2) mana-mana orang, tanpa alasan yang munasabah, gagalmempamerkan atau menunjukkan lesen atau permit tersebut akandianggap bersalah terhadap suatu kesalahan.
6. Seseorang pemegang permit atau pemegang lesen hendaklah, jika diperlukan ia melakukan oleh mana-mana pegawai diberi kuasa,menggunakan khidmat seorang jurukur atau ahli geologi untuk menunjukkan kepadanya—
7. (1) Pemegang permit atau pemegang lesen hendaklah sebelumsesuatu kerja di sesuatu kuari dimulakan, memberitahu secara bertuliskepada Merinyu Kanan Kuari nama, alamat dan kelayakan pengurus
kuari yang dicalonkan bagi kuari tersebut.
(2) Merinyu Kanan Kuari boleh menolak mana-mana orang yangdicalonkan dan boleh menghendaki pemegang permit atau pemeganglesen mencalonkan orang lain sebagai pengurus.
(3) Jika Merinyu Kanan Kuari meluluskan orang yang dicalonkansebagai pengurus, dia hendaklah membuat satu rekod mengenainyadi pejabatnya, dan orang yang direkodkan itu, untuk tujuan Kaedah-Kaedah ini, menjadi pengurus kuari tersebut.
(4) Jika pengurus yang direkodkan di bawah subkaedah (1) berhentidaripada menjadi pengurus kuari itu, pemegang permit atau pemeganglesen hendaklah dalam masa tiga hari dari tarikh pemberhentian itumelantik pengurus lain dengan kelulusan Merinyu Kanan Kuari.
(5) Kelulusan Merinyu Kanan Kuari di bawah subkaedah (3)kaedah ini akan diberi secara bertulis dan setiap orang yang mendapatkelulusan hendaklah mengemukakan dan membenarkan pemeriksaanterhadap kelulusan tersebut dibuat pada bila-bila masa dikehandakiberbuat demikian oleh mana-mana pegawai yang diberi kuasa.
(6) Dalam keadaan di mana tiada pengurus diluluskan bagi suatutempoh dan atas apa-apapun alasan, pemegang permit atau pemeganglesen dalam hal ini, akan disifatkan sebagai pengurus.
8. (1) Pengurus mana-mana kuari boleh, dan jika dikehendakisedemikian oleh Merinyu Kanan Kuari hendaklah, mengeluarkanarahan-arahan bertulis untuk dipatuhi oleh mana-mana orang yangdiambil bekerja dalam atau dekat dengan lombong itu sebagaimanayang perlu dalam hal keadaan tertentu untuk memastikan keselamatandan kesihatan pekerjaan mereka:
Dengan syarat Merinyu Kanan Kuari boleh, pada bila-bila masa
mengarahkan pengurus membentuk arahan baru, atau mengubah,menambah atau menggantikan arahan yang sedia ada sepertimanayang diluluskan di bawah kaedah ini.
(2) Satu salinan daripada arahan tersebut hendaklah dengan segeradikemukakan kepada Merinyu Kanan Kuari, dan jika Merinyu Kanan
Kuari dalam masa tiga puluh hari daripada tarikh penerimaan arahan
tersebut tidak membuat bantahan secara bertulis kepada pengurus,
arahan-arahan tersebut akan dikuat kuasakan.
(3) Jika Merinyu Kanan Kuari tidak meluluskan apa-apa arahan
bertulis yang dicadangkan dia hendaklah dalam masa tiga puluh hariselepas menerima arahan-arahan bertulis itu memaklumkan pengurustentang apa-apa pengubahpindaan, penambahan atau penggantianpada arahan-arahan itu yang difikirkannya patut.
14. (1) Tiada seorang pun dibolehkan bekerja atau disebabkan ataudibenarkan bekerja di mana-mana tempat yang tinggi dan curam dimana wujud kegelinciran atau ketidakseimbangan yang bolehmengakibatkan seseorang itu terjatuh, melainkan dia diikat dengantali keselamatan atau dilindungi dengan cara yang lain.
(2) Pemegang permit atau pemegang lesen atau pengurus hendaklahmembuat tingkat atau mencerunkan bahagian permukaan kuari kepadakeadaan tahap tertentu sepertimana yang dikehendaki oleh mana-mana pegawai diberikuasa untuk memastikan kestabilannya.
15. (1) Perkara-perkara yang sesuai untuk melepaskan diri dalamkeadaan kecemasan mestilah disediakan di semua tempat kerja.
(2) Di setiap kuari di mana jalan ke tempat kerja adalah melaluiruang sempit atau permukaan condong, satu laluan jalan kaki yangmencukupi, tali pemandu, rantai atau tangga, yang mana berkenaan,hendaklah disediakan sebagai pilihan. Tali wayar atau beberapa urattali wayar tidak boleh digunakan untuk tujuan memanjat jika iasudah berjerumbai, lusuh atau mempunyai wayar pemancar.
(3) Setiap tangga yang digunakan hendaklah, melainkandikecualikan oleh Merinyu Kuari—
(a) dipasang dengan kemas pada suatu kecondongan antaralima belas dan dua puluh darjah daripada pugak tetapitidaklah dalam keadaan yang tergantung;
(b) mempunyai tepian kayu dengan ukuran keratan lintangtidak kurang daripada lima sentimeter kali sepuluh sentimeter;
(c) mempunyai ikatan anak tangga besi yang bergaris pusattidak kurang daripada enam belas milimeter dan tidak melebihi daripada dua puluh lima sentimeter di antara
titik-titik tengah anak tangga;(d) mempunyai ikatan anak tangga pada sela yang tidak lebih
daripada tiga meter;
(e) tidak mempunyai ketinggian pugak melebihi sepuluh metertanpa tempat perhentian dengan pelantar; dan
(f) melebihi tidak kurang daripada satu meter tinggi daripadabahagian atas pelantar.
16. Tiada seorang pun, melainkan diberi kuasa sewajarnya bagitujuan itu, boleh dengan sesuka hati mengalih, mengubah atau
melakukan kerosakan kepada mana-mana pagar, kayu, penutup, gandar,tali, rantai, ukuran tangga, injap keselamatan, atau apa-apa yang didalam atau di sekitar kuari yang disediakan untuk keselamatanseseorang.
17. Alat bantu pernafasan, topi keselamatan dan kasut keselamatanyang diluluskan tahap mutunya hendalah dibekalkan dan digunakanoleh setiap orang yang berada di bahagian tertentu kuari, sepertimana
yang diarahkan oleh Merinyu Kuari.
18. Setiap kuari hendaklah dilengkapi dengan kemudahan pertolongancemas secukupnya.
19. Semua jentera yang digunakan di dalam kuari mestilahmempunyai suatu tahap mutu yang diluluskan oleh Merinyu Kuari.Penggunaan, pengendalian dan pelaksanaan jentera-jentera inihendaklah menurut prosedur yang dipersetujui oleh Merinyu Kuari.
20. Bahan letupan tidak dibenarkan dibawa, disimpan, diletakkan,dialih-alih atau digunakan di dalam mana-mana kuari kecuali bahan
letupan itu mempunyai mutu tertentu, kuantiti yang tertentu dalamkeadaan yang tertentu dan tertakluk di bawah syarat-syarat tertentuyang diluluskan oleh Merinyu Kuari.
21. Tiada seseorang pun boleh bekerja sebagai pembedil di mana-mana kuari kecuali seseorang itu dianggap kompeten oleh InspektorKuari.
22. (1) Tidak dibenarkan sebarang kerja letupan dilakukan di dalammana-mana kuari kecuali rekabentuk letupannya telah diluluskansecara bertulis oleh Inspektor Kuari.
(2) Pemegang permit atau pemegang lesen melalui konsultannyahendaklah menghantar laporan penyeliaan dan laporan penggerudianseperti diarahkan oleh Inspektor Kuari.
(3) Tiada seorang pun dibenarkan melakukan letupan sekunderkecuali mendapat kebenaran bertulis dari Inspektor Kuari.
(4) Semua kejadian batu terbang hendaklah dilaporkan secarabertulis kepada Inspektor Kuari.
(5) Semua kejadian salah cetus hendaklah ditangani dengan
mengikut tatacara dan panduan yang diluluskan oleh Inspektor Kuari.
(6) Inisiasi elektrik tidak dibenarkan jika terdapat bahaya darikilat atau dari lain-lain punca elektrik.
(7) Pengurus hendaklah memastikan sebelum dan semasa kerjaletupan:
(a) jika kerja letupan menggunakan elektrik, papan tanda “KerjaLetupan Beroperasi, Padamkan Radio Transmittor”hendaklah diletakkan di semua jalan masuk ke kawasanletupan; dan
(b) jika kerja letupan tidak menggunakan elektrik, papan tandayang mempunyai perkataan “Kerja Letupan Beroperasi”hendaklah diletakkan di semua jalan masuk ke kawasanletupan.
26. Pengarah Tanah dan Galian Negeri mempunyai semua kuasaMerinyu Kanan Kuari dan boleh membatalkan dengan bertulis apa-apa arahan daripada Merinyu Kanan Kuari.
27. Jika pada bila-bila masa Merinyu Kuari mendapati bahawamana-mana kegiatan di kuari sedang dijalankan dengan menyalahiterma-terma dan syarat-syarat dalam lesen atau permit dan dalamkeadaan tertentu berkemungkinan akan menyebabkan bahaya kepadanyawa dan harta, adalah sah bagi Merinyu Kuari, untuk memerintahkanpemberhentian serta-merta kegiatan tersebut dan memindahkan semuaorang daripada kuari tersebut atau mana-mana bahagian darinyasehingga suatu pengaturan tertentu dibuat, sebagaimana pada pendapatMerinyu Kuari, adalah diperlukan sama ada untuk memastikanpematuhan dengan keperluan tertentu atau untuk mengelakkan bahaya,
atau untuk membenarkan kerja tersebut disambung dengan langkah-langkah pengawasan yang tertentu diambil seperti mana yang padaanggapan Merinyu Kuari adalah perlu.
28. (1) Merinyu Kuari diberi kuasa untuk memberi arahan-arahantertentu sebagaimana perlu untuk mengawal pelupusan semua tanah,selut, kotoran atau bahan yang tidak dikehendaki daripada kuari,peralatan pemecah atau pengasingan, alur air atau tempat lain.
(2) Merinyu Kuari boleh mengarahkan langkah-langkahpengawasan tertentu diambil dan empangan-empangan, alur limpah,aluran-aluran tertentu dan lain-lain kerja tertentu dibina dandiselenggarakan seperti mana pada pendapatanya adalah perlu untuk memastikan tanah, selut, kotoran dan lain-lain bahan buangan daripadamana-mana kuari, peralatan pemecah dan pengasingan, alur air ataulain-lain tempat tidak boleh dibawa atau dihanyutkan oleh air hujanatau air yang digunakan untuk tujuan kerja-kerja dikuari ke mana-mana tempat lain yang bukan tempatnya untuk membuang bahantersebut secara sah mengikut undang-undang.
29. Mana-mana pegawai yang ingin masuk ke dalam kuari di bawahkuasa yang diberi kepadanya oleh Kaedah-Kaedah ini, hendaklahmengemukakan apabila diminta, untuk pemeriksaan, suatu kad kuasa
yang menyatakan jawatan dan kuasanya, dan tiada sesiapapun akandiwajibkan untuk membenarkan masuk ke dalam kuarinya kepadamana-mana orang yang mendakwa dirinya sebagai pegawai tertentukecuali menunjukkan kad kuasa tertentu.
BAHAGIAN V
KESALAHAN DAN DENDA
30. Mana-mana orang yang—
(a) gagal menjalankan kegiatan kuari menurut peruntukan-
peruntukan Kaedah-Kaedah ini;
(b) melanggar atau gagal untuk mematuhi mana-manaperuntukan daripada Kaedah-Kaedah ini;
(c) menghalang atau dalam apa-apa cara menghalang mana-mana pegawai diberi kuasa yang sedang menjalankankuasanya di bawah Kaedah-Kaedah ini;
(d) gagal untuk mematuhi mana-mana arahan yang sah diberioleh seorang pegawai diberi kuasa dalam menjalankan mana-mana kuasa di bawah Kaedah-Kaedah ini; atau
(e) dengan sengaja tidak memberi apa-apa maklumat ataumenyembunyikan atau menghalang atau cuba untuk menyembunyikan atau menghalang mana-mana orangdaripada berjumpa dengan atau disoal-siasat oleh pegawaidiberi kuasa;
adalah melakukan satu kesalahan dan apabila disabitkan dikenakan
denda yang tidak melebihi lima ribu ringgit dan dalam hal kesalahanyang berterusan, denda seterusnya satu ratus ringgit bagi setiap harisepanjang kesalahan itu diteruskan atau penjara bagi tempoh tidak melebihi enam bulan atau kedua-duanya.
31. Mana-mana orang yang bekerja di dalam atau di sekitar kuariyang melakukan apa-apa perbuatan dengan cara yang tidak adakemahiran atau cara bekerja yang tidak sepatutnya yang bolehmenyebabkan bahaya atau kerosakan kepada mana-mana orang yangterdapat di dalam atau di sekitar kuari atau gagal untuk mengambillangkah berjaga-jaga yang sesuai atau berpatutan yang diperlukan
untuk menjamin keselamatan mana-mana orang di dalam atau disekitar kuari adalah melakukan satu kesalahan dan jika disabitkanboleh dikenakan denda tidak melebihi lima ribu ringgit atau dipenjarauntuk tempoh yang tidak melebihi enam bulan atau kedua-duanya.
32. Di mana seseorang itu adalah pemilik, pemegang permit ataupemegang lesen sesebuah kuari atau mana-mana pengurus kuari atauorang yang bekerja di dalam atau disekitar kuari melakukanperlanggaran terhadap mana-mana peruntukan Kaedah-Kaedah iniyang mana mahkamah yang mengambil prosiding tersebut berpendapatadalah dikira munasabah boleh membahayakan keselamatan nyawa
dan harta atau boleh menyebabkan berlakunya kemalangan akibatdaripada keingkaran atau kecuaian tertentu, orang tersebut adalahmelakukan satu kesalahan dan apabila disabitkan boleh dikenakandenda tidak melebihi sepuluh ribu ringgit atau dipenjara untuk tempohtidak melebihi dua belas bulan atau kedua-duanya.
33. Apa-apa pendakwaan di bawah Kaedah-Kaedah ini bolehdijalankan oleh Merinyu Kuari atau mana-mana pegawai yang dilantik oleh Pengarah Tanah dan Galian Negeri.
34. (1) Dengan pengecualian kepada kaedah 32, Merinyu Kuariatau Pengarah Tanah dan Galian Negeri boleh, sebagai ganti kepada
mengambil prosiding ke atas mana-mana orang mengenai mana-mana kesalahan terhadap peruntukan Kaedah-Kaedah ini,mengkompaunkan kesalahan tersebut dengan menerima daripada orangtersebut suatu jumlah wang tidak melebihi lima ratus ringgit.
(2) Cara dan prosedur untuk mengkompaunkan kesalahan tersebutadalah seperti yang dijelaskan dalam Jadual 2.
(3) Komposisi sesuatu kesalahan di bawah Kaedah-Kaedah iniakan memberi kesan sebagai pembebasan terhadap tertuduh.
BAHAGIAN VI
AM
35. Tiada apa pun di dalam Kaedah-Kaedah ini akan memberipengecualian mana-mana orang daripada apa-apa tanggungan sivilatau jenayah.
36. Apabila dibuktikan dengan kepuashatian mana-mana mahkamah
yang mempunyai bidang kuasa bahawa suatu perlanggaran ke atasmana-mana peruntukan kaedah-kaedah ini telah dilakukan oleh mana-mana orang yang bekerja di atas tanah tertentu di mana perlanggarantersebut telah dilakukan, majikan akan dipertanggungjawabkan bagiperlanggaran tersebut, dan denda yang dikenakan atas perlanggarantersebut dan bolehlah dikenakan denda yang diperuntukkan padanya,melainkan dia dapat membuktikan sehingga mahkamah berpuashatibahawa perlanggaran tersebut telah dilakukan tanpa pengetahuandan persetujuan dan dia telah pun mengambil semua langkah-langkahyang munasabah untuk mencegah berlakunya perlanggaran tersebutdan telah pun menguatkuasakan pematuhan peruntukan-peruntukanyang berkenaan:
Dengan syarat bahawa tiada apapun yang terdapat di dalam Kaedah-Kaedah ini yang disifatkan sebagai mengecualikan seseorang yangterdahulu disebut daripada tanggungan berkenaan dengan apa-apadenda yang diperuntukkan oleh Kaedah-Kaedah ini bagi mana-manaperlanggaran yang telah terbukti dilakukan olehnya.
37. Tiada tanggungan dipertanggungkan ke atas mana-mana pegawaidiberi kuasa dalam hal apa-apa perbelanjaan, kerosakan atau kecederaanakibat atau hasil perlaksanaan kuasa-kuasa sah yang diberikankepadanya oleh Kaedah-Kaedah ini dan pegawai tersebut tidak tertakluk
kepada apa-apa tindakan, tuntutan atau permintaan yang timbul akibatatau hasil dari perlaksanaan kuasa-kuasa sah tersebut.
38. (1) Apa-apa endapan mineral berharga yang didedahkan olehoperasi kuari hendaklah dengan segera dilaporkan oleh pemeganglesen, pemegang permit atau pengurus kepada Merinyu Kanan Kuariyang akan memberi keutamaan mengerjakannya ataumelombongkannya.
(2) Dalam hal perlombongan yang diberi keutamaan, pemeganglesen atau pemegang permit akan diberi pilihan pertama untuk melombong dengan syarat ia memohon untuknya dan diberi suatu
hak milik perlombongan di atas kawasan lesen menduduki sementaraatau kawasan permitnya. Lesen menduduki sementara atau permitnyatidak perlu diserahkan balik jika operasi kuari dan kegiatanperlombongan dijalankan serentak.
(1) Jumlah wang yang akan dikutip untuk kompaun kesalahantidak boleh melebihi lima ratus ringgit.
(2) Bayaran hendaklah dibuat dengan wang tunai atau “moneyorder”, “postal order”, “cashier’s order”, “banker’s order”atau “banker’s draft” dibayar kepada Pengarah Tanah danGalian Selangor dan dipalang “Akaun Penerima Sahaja”.
(3) Bayaran boleh dihantar sendiri atau melalui atau melalui poskepada yang membuat tawaran.
(4) Setiap bayaran yang diterima akan dikira sebagai wangkepunyaan Kerajaan Negeri Selangor dan satu resit rasmiakan dikeluarkan untuknya kepada orang yang ditawarkan
kompaun.

“machinery” means engines, earthmoving machines, compressors,drilling equipments, conveyor belts, crushers, grinders and all otherappliances of whatsoever kind used in a quarry;
“manager” means the person for the time being recorded in theoffice of the Quarry Inspector as the quarry manager under rule 7(3)or deemed to be one under rule 7(6);
“monument” means any building, earthwork, standing stone,keramat , cave or other structure, erection or excavation, and anytomb, tumulus or other place of interment or any other immovableproperty of a like nature or any part or remains of the same, thepreservation of which is a matter of public interest by reason of thereligious, historic, traditional or archaeological interest attaching
thereto;
“officer” means a Senior Quarry Inspector, Quarry Inspector orQuarry Assistant;
“permit” means a permit issued under section 71 of the Code;
“permittee” means any person issued with a permit or permits;
“public officer” means a person as lawfully holding, acting in orexercising the functions of a public office as define in section 3 of the Interpretation Acts, 1948 and 1967;
“Senior Quarry Inspector” means any public officer who is aqualified mining or mineral resources engineer or any public officerwho is a qualified engineer of any other discipline and having sufficientknowledge in quarrying as determined competent by the State Authorityand appointed under paragraph 12(1)(b) of the Code;
“quary” when used as a noun, means any open or undergroundexcavation, other than that which is controlled under any writtenlaw, made for extracting and removing rock material from any landand includes the crushing or other treatment works on the site or
elsewhere in the State;
“quarry” when used as a verb, means to break or excavate groundfor the purpose of extracting and removing rock material from anyland and includes the processes of crushing, grinding, dressing orother treatment of such material on the site or elsewhere in the State;
“Quarry Assistant” means any officer for the time being authorisedby the Senior Quarry Inspector in exercising, supervision and controlof quarries;
“Quarry Inspector” means any public officer who is a qualifiedmining or mineral resources engineer or any other public officerwho is a qualified engineer of any other discipline and having sufficientknowledge in quarrying and appointed under paragraph 24(b);
“rock material” means any rock, stone, marble, gravel, sand,earth, laterite, loam, clay, soil, mud, turf, peat, coral, shell or guanowithin or upon any land, and includes any bricks, lime, cement or
other commodity manufactured there from;
“Shotfirer” means the person for the time being recorded in theoffice of the Quarry Inspector as a shotfirer at the quarry; and
“Surveyor” means a qualified surveyor and registered with MalaysianInstitute of Surveyors.
PART II
QUARRYING OPERATIONS
3. The permitee or licensee shall—
(a) carry out all his quarrying operations in a safe, skilful,efficient and workmanlike manner;
(b) not cause any danger, damage or inconvenience to life orproperty;
(c) use all proper precautions in all quarrying operations;
(d) observe and perform all conditions of the permit or l icence,all provisions, orders and regulations made under these
rules; and
(e) comply with all laws, rules and regulations for the timebeing in force.
4. (1) The permitee or licensee shall not start any work to set upa new quarry or to reorganize an old quarry and to run it beforeobtaining an approval in writing from the Senior Quarry Inspectoron a scheme submitted on his behalf by his Consultant. Such schemeshall—
(a) show that sufficient consideration has been given to thesafety of the public and persons involved in the work;
(b) be designed so as to make it practical in the future toquarry zones affected by the scheme;
(c) be aimed to provide maximum possible recovery of rock material having regard to sound engineering practice;
(d) provide measures for dumping of waste materials and aprogram of reclamation and protection on abandonedworking;
(e) provide measures for environmental protection in accordancewith any law currently in force relating to environmentalor pollution control; and
(f) contain any other details and information as may be required.
(2) When an operation in a quarry is to commence, recommenceor stop, the permitee or licensee or manager shall through his Consultantnotify the Senior Quarry Inspector in writing, the date of such event.
The notification shall be accompanied by the Consultant’s observationsof the conditions of the quarry then.
5. (1) Every permitee or licensee shall continuously display in hisoffice at the quarry the permit or licence issued to him in respectof the said quarry.
(2) Any person who, without reasonable excuse, fails to displayor produce such licence or permit shall be guilty of an offence.
6. A permitee or licensee shall, if required to do so by any authorisedofficer, employ a surveyor or geologist to show him—
(a) the boundaries of his permit or licence area;
(b) the volume of rock material excavated; and
(c) any other relevant details pertaining to the quarry.
7. (1) The permitee or licensee shall before an operation in a quarryis to commence, notify the Senior Quarry Inspector in writing thename, address and qualification of the manager nominated for thequarry.
(2) The Senior Quarry Inspector may refuse to approve any personnominated and may require the permitee or licensee to nominatesome other person as manager.
(3) If the Senior Quarry Inspector approves the person so nominatedas manager, he shall make a record of the same in his office, andthe person so recorded, shall for the purpose of these rules, be themanager of the quarry.
(4) If the manager nominated under subrule (1) ceases to be themanager of the quarry, the permitee or licence shall within threedays from the date of cessation nominate another manager with the
approval from the Senior Quarry Inspector.
(5) The approval of the Senior Quarry Inspector under subsection(3) of this rule shall be given in writing and every person so approvedshall produce and permit for inspection such approval whenevercalled upon to do so by any authorised officer.
(6) In the event of there being no manager approved for anyperiod and for whatever reason, the permitee or licensee as the casemay be shall be deemed to be manager.
8. (1) The manager of any quarry may, and if so required by theSenior Quarry Inspector shall, issue written directions to be observedby any person employed in or about such quarry as are necessaryunder the particular circumstances to ensure their occupational safetyand healthy:
Provided that the Senior Quarry Inspector may, at any time orderthe manager to frame new directions or vary, add to or substituteexisting directions so approved under this rule.
(2) A copy of such directions shall be submitted the Senior QuarryInspector, and if the Senior Quarry Inspector has not within thirtydays from the receipt thereof objected to them in writing to themanager, the said directions shall come into force.
(3) If the Senior Quarry Inspector does not approve any of theproposed written directions he shall within thirty days after thereceipt thereof inform the manager of any alteration, addition orsubstitution to such directions as he deems fit.
(4) If the manager objects to any such alteration, addition, orsubstitution he may refer the matter to the State Director of Landsand Mines whose decision shall be final.
(5) Any written directions coming into force under this rule shallcontinue to be in force until the Senior Quarry Inspector orders therevocation thereof with the consent of the State Director of Landsand Mines.
(6) A copy of the written directions shall be posted in one ormore conspicuous places at the quarry.
9. (1) A book in the form approved by the Senior Quarry Inspector,known as the Inspection Record Book, shall be kept by the managerwherein he shall certify, at least once in ten days, that he or anycompetent person appointed by him has personally inspected everypart of the quarry and the facts which, at the time of inspection, hefinds existing in the quarry in regard to the safety of workings andaccessory works, defaults in pollution control equipment or discoveryof any new pollution source, and shall specify any repairs or alterationswhich in his opinion are required to ensure greater safety to thepersons employed in or about the quarry, or to other life and property,and shall as soon as such repairs or alterations have been executed,
enter a record thereof.
(2) Whenever an authorised officer has inspected a quarry oraccessory works thereto, he shall report in the Inspection RecordBook his findings and opinion derived from such inspection, and heshall also record any alteration or requirement he deems necessary.
(3) Notwithstanding anything contained in or omitted from thereport of an authorised officer, such report shall not be held to limitor affect the responsibility of the permitee or licensee or managerunder these Rules.
(4) The Inspection Record Book shall be kept in good order andopened at all reasonable times to the examination of any authorisedofficer and all entries therein shall be clearly and legibly written inBahasa Malaysia or English.
15. (1) Suitable means of escape in case of emergency must beprovided at all working places.
(2) In every quarry where access to a working place is by meansof a shaft, winze, or inclined face, a sufficient footway, guidingrope, chain or ladder whichever the case may be, shall be providedas an alternative. Wire ropes or strands of wire ropes shall not beused for climbing purposes if they are frayed or have projectingwires.
(3) Every ladder used shall, unless so exempted by the QuarryInspector—
(a) be securely fixed at an inclination between fifteen and
twenty degrees from the vertical but not in an overhangingposition;
(b) have timber sides with cross-sections not less than fivecentimetres by ten centimetres;
(c) have iron rungs not less than sixteen milimetres diamaterand not further apart than twenty-five centimetres betweencenters;
(d) have tie rungs at intervals of not more than three metres;
(e) not have a vertical height exceeding ten metres without
terminating at platform; and(f) project not less than one metre above the platform at its
upper end.
16. No person, unless properly authorised in that behalf, shallwillfully, remove, alter or render useless any fencing, timber, covering,
guide rope, chain, ladder gauge, safety valve or anything in or abouta quarry provided for the safety of any person.
17. Respirator, safety helmet and safety boots of approved standardshall be supplied and shall be used by every person in such part of
the quarry as may be directed by the Quarry Inspector.
18. Every quarry shall be equipped with adequate first aid facilities.
19. All machinery used in a quarry shall be of a standard approvedby the Quarry Inspector. Its use, handling or operation shall be inaccordance with procedures approved by the Quarry Inspector.
20. No explosives shall be brought into, stored in, placed in, movedabout or used in any quarry except those of such type and standard,in such places, in such quantities, in such manner, and under such
conditions as shall be approved by the Quarry Inspector.
21. No person shall be employed as a shotfirer in any quarryunless the person is deemed competent by the Quarry Inspector.
22. (1) No blasting work shall be carried out in any quarry unlessits blast design is approved in writing by the Quarry Inspector.
(2) The permitee or licensee through its consultant must submitthe supervision and drilling reports as directed by the Quarry Inspector.
(3) No person shall do any secondary blasting without writtenapproval by the Quarry Inspector.
(4) All incidences of flying rocks must be reported in writing tothe Quarry Inspector.
(5) All misfires must be treated according to the procedures andguidelines issued by the Quarry Inspector.
(6) Electric initiation of blasting is prohibited where there is adanger from electrical storm or other extraneous electricity.
(7) The manager shall ensure that immediately before and duringblasting operation:
(a) if it is an electric blasting operation, notices bearing thewords “Blasting Operation, Turn Off Radio Transmitter”are conspicuously posted on all public roads leading to ablasting area; and
(b) if it is fully non-electric blasting operation, notices bearingthe words “Blasting Operation” are conspicuously postedon all public roads leading to a blasting area.
(8) Notice required by subrule (7) shall have letters not less than0.2 metre high and write on a contrasting background of not lessthan 1 metre high and located at a distance before the blastingarea of:
(a) 100 metres if the speed limit on the road is not exceeding50 km/hour; or
(b) 300 metres if the speed limit on the road is over 50 km/
hour.
23. (1) Whenever any accident causing or resulting in—
(a) loss of life or serious bodily injury to any person; or
(b) serious injury to the property of any person not being thepermitee, licensee or of the State;
has occurred in any quarry or in connection with any work whatsoeverincidental to or connected with quarrying operation, it shall be theduty of the manager or other person for the time being in charge of
the quarry to report to the Quarry Inspector and the Police by thequickest means possible and subsequently with the least possibledelay, in writing to the Quarry Inspector and Police the facts of thematter as far as they are known to him.
(a) fails to carry out quarry operations in accordance with theprovisions of these Rules;
(b) contravenes or fails to observe any provision of theseRules;
(c) hinders or in any way obstructs an authorised officer in theexercise of his powers under these Rules;
(d) fails to comply with any order lawfully given by an authorised
officer in the exercise of any power under these Rules; or(e) willfully withholds any information or conceals or prevents,
or attempts to conceal or prevent any person from appearingbefore or being examined by an authorised officer;
shall be quilty of an offence and shall, be liable on conviction beliable to a fine not exceeding five thousand ringgit and additionallyto a fine of one hundred ringgit for every day during which suchoffence is continued after conviction or to imprisonment for a termnot exceeding six month or to both.
31. Any person employed in or about a quarry who does any actin such unskilled or unworkmanlike manner as to be likely to causedanger or damage to any person in or about the quarry or fails totake such due and proper precautions as may be necessary to ensurethe safety of any person in or about the quarry shall be quilty of anoffence and shall be liable on conviction to a fine not exceeding fivethousand ringgit or to imprisonment for a term not exceeding sixmonth or to both.
32. Where a person who is an owner, licensee or permitee of aquarry or any manager of or person employed in or about a quarry
commits a breach of any of the provisions of these Rules which inthe opinion of any court before which the proceedings are taken wasreasonably calculated to endanger the safety of life and property orto cause a dangerous accident, and an accident was caused as a resultof such default or negligence, such person shall be guilty of anoffence and shall be liable on conviction to a fine not exceeding tenthousand ringgit or to imprisonment for a term not exceeding twelvemonths or to both.
33. Any prosecution under these Rules may be conducted by theQuarry Inspector or any other officer approved by the State Directorof Lands and Mines.
34. (1) With the exception of rule 32, the Quarry Inspector or theState Director of Lands and Mines may, in lieu of taking proceedingsagainst any person in respect of any offence against the provisions
of these Rules, compound the matter by accepting from such persona sum of money not exceeding five hundred ringgit.
(2) The method and procedure for compounding such offence isas prescribed in Schedule 2.
(3) The composition of an offence under these Rules shall havethe effect of an acquittal of such accused person.
PART VI
GENERAL
35. Nothing in these Rules shall operate to exempt any person
from any civil or criminal liability.
36. Wherever it is proved to the satisfaction of any court having jurisdiction that a breach of any of the provisions of these Rules hasbeen committed by any person employed on the land in respect of which such breach has been committed, the employer shall be heldto be liable for such breach, and to the penalty provided therefore,unless he shall prove to the satisfaction of such court that the samewas committed without his knowledge or consent and that he hadtaken all reasonable means to prevent the same and to enforce theobservance of such provisions:
Provided that nothing contained in these Rules shall be deemedto exempt such first mentioned person from liability in respect of any penalty in respect of any penalty provided by these Rules forany breach proved to have been committed by him.
37. No liability shall lie against any authorised officer in respectof any expense, damage or injury arising in a or from the lawfulexercise of the powers conferred on him by these Rules and suchofficer shall not be subject to any action, claim or demand whatsoeverarising in or from the lawful exercise of such powers.
38. (1) Any valuable mineral deposit exposed by quarrying operationsshall forthwith be reported by the licensee, permitee or manager tothe Senior Quarry Inspector who shall accord priority to its workingor mining.
(2) In the event mining is accorded priority the licensee or permiteeshall be given first option to mine provided he applies for and isgiven a mining title over his temporary occupation licence or permitarea. His temporary occupation licence or permit need not besurrendered if quarrying and mining operations are to be carried outsimultaneously.
(3) If a licensee or permitee who is given the option under subrule(2) fails or does not wish to mine the mineral deposit he shallsurrender his temporary occupation licence or permit over the areaconcerned and cease all quarrying operations thereon:
b. Permanent privation of the sight of either eye.
c. Permanent privation of the hearing of either ear.
d. Privation of any member or joint.
e. Destruction or permanent impairing of the powers of anymember or joint.
f. Permanent disfiguration of the head or face.
g. Fracture or dislocation of a bone.
h. Any hurt which endangers life, or which causes the suffererto be, during the space of twenty days, in severe bodilypain, or unable to follow his ordinary pursuits.

METHOD AND PROCEDURE FOR COMPOUNDING SUCH OFFENCE
1. Sum to be collected and method of payment.
(1) The sum of money to be collected for compounding an offenceshall not exceed five hundred ringgit.
(2) Payment of the sum shall be made in cash or by money order,postal order, cashier’s order, banker’s order or banker’s draftmade payable to the Director of Lands and Mines and crossed
“Account Payee Only”.
(3) Payment may be delivered personally or by post to the personmaking the offer.
(4) Every payment received shall be accounted for as moneybelonging to the State Government of Selangor and an officialreceipt shall be issued for it to the person to whom the offer
to compound was made.
2. Form for offer to compound.
3. The form as follows shall be used for making an offer to compoundbut may be modified as necessary.
3. This offer will lapse on ............................... If full payment of the sum statedabove is received by the close of business of the date, no further proceedings willbe taken against you in respect of the offence. Otherwise, prosecution will be institutedwithout further notice.

PADA menjalankan kuasa yang diberikan oleh subseksyen 17(1) AktaKerajaan Tempatan 1976, Majlis Daerah Kuala Langat, dengankelulusan Pihak Berkuasa Negeri, membuat kaedah-kaedah berikut:
1. Kaedah-kaedah ini bolehlah dinamakan Kaedah-Kaedah Pekerja(Kelakuan Dan Tatatertib) (Majlis Daerah Kuala Langat)(Pindaan) 2003 dan hendaklah disifatkan telah mula berkuat kuasapada 1 Julai 2001.
2. Kaedah-Kaedah Pekerja (Kelakuan Dan Tatatertib) (Majlis DaerahKuala Langat) 1995 adalah dengan ini dipinda dengan memasukkanselepas Kaedah 52, Kaedah 52A seperti yang berikut—
“52A. (1) Walau apa pun apa-apa peruntukan dalamKaedah-Kaedah ini jika Majlis mendapati atau jikarepresentasi dibuat kepada Majlis bahawa adalah wajarperkhidmatan seseorang pegawai ditamatkan demikepentingan awam, Majlis bolehlah meminta laporan yangpenuh daripada Ketua Jabatan di mana pegawai itu sedangberkhidmat atau telah berkhidmat. Laporan tersebuthendaklah mengandungi butir-butir berhubungan dengankerja dan kelakuan pegawai itu dan ulasan-ulasan KetuaJabatan, jika ada.
(2) Jika setelah menimbang laporan yang diterima dibawah subkaedah 1, Lembaga Tatatertib berpuas hatibahawa memandangkan syarat-syarat perkhidmatan,kegunaan pegawai itu kepada perkhidmatan, kerja dankelakuan pegawai itu dan segala hal keadaan lain kes itu,adalah wajar demi kepentingan awam untuk berbuatdemikian, Lembaga Tatatertib boleh menamatkan
perkhidmatan pegawai itu mulai dari tarikh yang hendaklahditentukan oleh Lembaga Tatatertib.
(3) Adalah sah di sisi undang-undang bagi LembagaTatatertib untuk mengesyorkan kepada Majlis bahawaperkhidmatan seseorang pegawai itu ditamatkan demikepentingan awam walau pun prosiding tatatertib belumdijalankan di bawah mana-mana peruntukan Kaedah-Kaedah ini; dan Majlis boleh dengan demikian menamatkanperkhidmatan pegawai tersebut. Subkaedah 4 hendaklahterpakai berkenaan penamatan perkhidmatan pegawai awam
itu di bawah subkaedah ini.
(4) Walau apa pun jua dalam Kaedah-Kaedah ini danmana-mana undang-undang lain yang berlawanan, apabilamenamatkan perkhidmatan mana-mana pegawai demi
kepentingan awam di bawah kaedah ini, pegawai itu bolehtidak diberikan apa-apa peluang untuk didengar danseseorang pegawai yang perkhidmatannya telah ditamatkan
demi kepentingan awam di bawah Kaedah ini tidak boleh,bagi maksud Perkara 135(2) Perlembagaan Persekutuan,dianggapkan telah dibuang kerja, tidak kira sama adamenamatkan perkhidmatan pegawai itu melibatkan suatuelemen hukuman atau yang berkaitan dengan kelakuanberhubungan dengan jawatannya yang Majlis menganggaptak memuaskan atau patut disalahkan.”.

EMPLOYEES (CONDUCT AND DISCIPLINE) (AMENDMENT)RULES 2003
IN exercise of the powers conferred by subsection 17(1) of the LocalGovernment Act 1976, the Kuala Langat District Council, with theapproval of the State Authority, makes the following rules:
1. These rules may be cited as the Kuala Langat District CouncilEmployees (Conduct And Discipline) (Amendment) Rules 2003and shall be deemed to have come into operation on 1 July 2001.
2. Kuala Langat District Council Employees (Conduct AndDiscipline) Rules 1995 are amended by inserting after Rule 52, Rule52A as follow—
“52A. (1) Notwithstanding any provision in theseRegulations, where the Council finds or where the Councildeems that it is desirable that the service of an officerbe terminated in the public interest, the Council may callfor a full report from the Head of Department in whichthe officer is or has been serving. The said report shallcontain particulars relating to the work and conduct of the officer and the comments, if any of the Head of Department.
(2) If, after considering the report received undersubrule 1, the Council is satisfied that having regard tothe conditions of the officer thereto, the work and conductof the officer and all the other circumstances of the case,it is desirable in the public interest to do so, the Councilmay terminate the service of the officer with effect fromsuch date as the Council shall specify.
(3) It shall be lawful for the appropriate Disciplinary
Board to recommend to the Council that the service of an officer be terminated in the public interestnotwithstanding that disciplinary proceedings have notbeen carried out under any of the provisions of theseRules; and the Council may so terminate the service of the said officer. Subrule 4 shall apply in respect of termination of service of such public officer under thissubrule.
(4) Notwithstanding anything in these Rules and anyother law to the contrary, in terminating the service of
any officer in the public interest under this rule, suchofficer may not be given any opportunity of being heardand an officer whose service has been terminated in the
public interest under this rule shall not, for the purposeof Article 135(2) of the Federal Constitution, be regarded
as having been dismissed, regardless of whether suchtermination of the service of the officer involved an elementof punishment or was connected with conduct in relation
to his officer which the Council regards as unsatisfactoryor blameworthy.”.
