SBI TI Program Overview

Authorities for the construction of tactical infrastructure

Illegal Immigration Reform and Immigrant Responsibility Act of 1996

The Secure Fence Act of 2006

CBP established the Secure Border Initiative (SBI) Tactical Infrastructure (TI) Program to develop and install fencing (pedestrian and vehicle), roads, and lighting solutions along the Southwest Border.

In order to enhance efficiencies and improve program performance, CBP functionally separated

TI from SBInet in October 2007.

Prior to that separation, SBI TI was managed as a component of SBInet.

While SBI TI is managed independently, its funding remains consolidated under the BSFIT account.

Program Management

SBI TI broke down the goal of 670 fence miles into 118 fence segments (projects) to complete by 31 Dec 2008

Grouped by Border Patrol Sector (8 are receiving fence)

SBI TI/USACE awarded a Multiple Award Task Order Contract (MATOC) to create a pool of contractors pre-qualified to bid for each segment.

CBP obtains real estate through a MOA authorizing USACE to act on behalf of DHS-CBP

Environmental processes include conducting environmental surveys, using existing EAs, or preparing Environmental Stewardship Plans (ESPs) under S1 Waiver

Long lead construction materials (steel and mesh) are Government Furnished Materials (GFM); a supply and supply chain management Task Order awarded to Boeing is used to manage and execute the process

Project Management FY09 and Beyond

SBI TI is reorganizing to become a DHS Level I Investment Program consisting of a portfolio of multiple DHS Investment Levels.

Level of project review and milestone decision authority determined by DHS policy based on the portfolio sum total and the investment level of each project within the portfolio.

Current Program Cost

For FY08, SBI TI identified 118 fence segments (projects) to meet the goal of 670 fence miles by 31 Dec 2008

Grouped into the 8 Border Patrol Sectors receiving fence

SBI TI/USACE awarded an Multiple Award Task Order Contract (MATOC) to create a pool of contractors pre qualified to bid for each segment.

An initial ROM Program-Level Cost Estimate to include all segments was produced in Mar 2007 to identify initial budget inputs

USACE develops and issues RFPs, MATOC contractors/USACE/CBP walk

each segment as part of Bidder’s Conference and contractors submit their bid with Actual Pricing.

USACE District Offices (LA, Galveston, ABQ) prepare an IGCE (With Current cost ) just prior to Source Selection Evaluation Board (SSEB) and award each segment contract to the Lowest Price Technically Acceptable bid

Cost Estimate to complete projects will be reassessed after all segment bids are received in September.

Variations to costs after bids are received are possible due to contract modifications resulting from required mitigations on found cultural sites and construction delays due to delays in real estate and extreme weather conditions.

Fence Lab evaluated 9 designs in a “laboratory” environment

Texas Dept of Transportation Facility: Texas Test Institute (TTI)

Border Patrol identified designs based upon existing fence

Boeing as Fence Lab contractor identified additional COTS designs

Performed Developmental Testing including vehicle ramming, fence

cutting, climbing, and digging

Fence Lab results passed to SBI-TI Fence Design IPT to conduct trades, iterate designs, and document final fence designs.

IPT members included Border Patrol and Value Engineers to ensure

fence designs are operationally effective and reasonably priced

Trades based upon operational and engineering experience

SBI-TI Fence Design IPT produced final designs and Fence “Toolbox”

SBI Program Risk

The SBI TI PMO has a Risk Management Program that employs processes, a risk item tracking data base (RiskNav) which is a risk tracking tool , and best practices to identify

and resolve risks

Cost and Schedule are biggest risk areas: –

Cost risk of managing MATOC contract costs–

Schedule risk of managing compressed construction time lines–

Cost and Schedule risk of navigating process to obtain real estate (e.g. Federal judge determines court dates)

Operational Requirements

Operational requirements for TI were captured as a part of the overall SBInet ORD. The relevant excerpt from that document is included below.

“Tactical Infrastructure such as fences, vehicle barriers, lighting, bridges, checkpoints, forward operating bases and road improvements greatly enhance the effectiveness and response time of agents by physically preventing or slowing crossing activity, channeling illegal flows to enforcement zones, illuminating crossing points and improving agent freedom of movement…These assets are strategically deployed through the various southwest border sectors. The constructions makeup of these assets also varies from one location to the next as most are adapted to meet the area’s specific needs.”

SBI TI recognizes the need for a separate TI ORD and is undertaking an effort to develop this document.

As the TI Program was previously a part of the SBInet program it had been covered under that Program Management Plan

SBI TI has a draft Project Management Plan for PF 225 only

Test & Evaluation Completed

CBP conducted developmental testing and evaluation at the fence lab that included studies, modeling and simulation, and prototype testing.

Prototype testing was conducted in a field environment to understand deterrence capabilities and create the fence “tool box.”

Operational testing and evaluation captured through deployment.

Risk Management Plan

The SBI TI PMO has a Risk Management Program that employs processes, tools and best practices to identify, track and resolve risks

The SBI-TI Risk Manager administers the SBI-TI Risk Management Plan and Risk Management Program

One of the significant mitigation activities of the program is the pre-qualification of contractors to ensure the selected contractor will be able to perform and build fence segments successfully

As the programs mature, lessons learned will be captured and incorporated to ensure continuous program improvement

Lifecycle Cost Estimate (LCCE)

A LCCE was previously created for the TI program and is currently being updated to reflect current program requirements

Independent government cost estimates are prepared for each segment to prepare for contract award

Reflects more accurate procurement cost

MATOC bids further refine procurement cost

Low price-technically acceptable contract approach limits government cost risk

For fence, O&M lifecycle cost will be calculated and refined as using assumptions developed with OBP

Tactical Infrastructure

What is it?Tactical Infrastructure (TI) is a term used by CBP to describe physical components that help secure our borders, such as lighting, roads, pedestrian and

vehicle fencing.

Why do we use fence? Installation of fence has proven to be a persistent impedance to

illegal cross-border activity, slowing, redirecting, and deterring illegal entries in

areas where personnel and technology alone cannot sufficiently secure our border.

Where does it go? Proposed fence locations are determined through operational assessments made by the local Border Patrol Agents and Chiefs, based on illegal cross-border activity and the Border Patrol’s extensive field experience in these areas. The primary objective in targeting certain areas is to provide an additional security measure in areas experiencing significant illegal cross-border activities and traffic.

Other considerations?Three main factors contribute to fence location decisions in addition to the initial Border Patrol operational assessments: (1) engineering assessments, which included construction costs; (2) environmental analyses; and (3) input from stakeholders. Each of these steps is a standard element of the planning process that enables DHS to make informed decisions in deploying a fence as operationally required.

Waiver Litigation

Waiver Litigation – County of El Paso, et al. v. Chertoff, No. EP- 08-CA-0196-FM (W.D. Tex. June 2, 2008)

On June 2, 2008. The City and County of El Paso, Texas, joined by several other local government entities, local environmental groups, and the Native American tribe Ysleta del Sure Pueblo, filed suit against DHS in the U.S. District Court Western District of Texas.

The complaint alleges an unconstitutional delegation of legislative power, and a separation of powers claim based upon the Executive’s repeal of laws.

The complaint also alleges a Tenth Amendment challenge based upon the waiver’s inclusion of State and local laws.

On Thursday, June 5, 2008, plaintiffs filed an application for a

preliminary injunction seeking to halt construction in all the Texas project areas identified in the Secretary’s April 3, 2008 waivers.

DHS filed its opposition to the application and a motion to dismiss to dismiss the case with prejudice on June 19, 2008.

On June 20, 2008, the Court issued an order striking plaintiffs’

application for preliminary injunction because plaintiffs exceeded the ten page limitation without seeking the Court’s permission to do so.

On July 7, 2008, plaintiffs filed their brief in support of the application for preliminary injunction and reply to the government’s motion to dismiss.

The government’s response is due on July 21, 2008.

On July 21, 2008, DHS filed their response and are currently waiting upon the Court’s ruling.

No hearing has been scheduled as of August 8, 2008.
