SBI TI Program Overview

Authorities for the construction of tactical infrastructure

Illegal Immigration Reform and Immigrant Responsibility Act of 1996

The Secure Fence Act of 2006

CBP established the Secure Border Initiative (SBI) Tactical Infrastructure (TI) Program to develop and install fencing (pedestrian and vehicle), roads, and lighting solutions along the Southwest Border.

In order to enhance efficiencies and improve program performance, CBP functionally separated

TI from SBInet in October 2007.

Prior to that separation, SBI TI was managed as a component of SBInet.

While SBI TI is managed independently, its funding remains consolidated under the BSFIT account.

SBI TI broke down the goal of 670 fence miles into 118 fence segments (projects) to complete by 31 Dec 2008

SBI TI/USACE awarded a Multiple Award Task Order Contract (MATOC) to create a pool of contractors pre-qualified to bid for each segment.

CBP obtains real estate through a MOA authorizing USACE to act on behalf of DHS-CBP

SBI TI is reorganizing to become a DHS Level I Investment Program consisting of a portfolio of multiple DHS Investment Levels.

Operational Requirements

Operational requirements for TI were captured as a part of the overall SBInet ORD. The relevant excerpt from that document is included below.

“Tactical Infrastructure such as fences, vehicle barriers, lighting, bridges, checkpoints, forward operating bases and road improvements greatly enhance the effectiveness and response time of agents by physically preventing or slowing crossing activity, channeling illegal flows to enforcement zones, illuminating crossing points and improving agent freedom of movement…These assets are strategically deployed through the various southwest border sectors. The constructions makeup of these assets also varies from one location to the next as most are adapted to meet the area’s specific needs.”

Tactical Infrastructure

What is it?Tactical Infrastructure (TI) is a term used by CBP to describe physical components that help secure our borders, such as lighting, roads, pedestrian and

vehicle fencing.

Why do we use fence? Installation of fence has proven to be a persistent impedance to

illegal cross-border activity, slowing, redirecting, and deterring illegal entries in

areas where personnel and technology alone cannot sufficiently secure our border.

Where does it go? Proposed fence locations are determined through operational assessments made by the local Border Patrol Agents and Chiefs, based on illegal cross-border activity and the Border Patrol’s extensive field experience in these areas. The primary objective in targeting certain areas is to provide an additional security measure in areas experiencing significant illegal cross-border activities and traffic.

Other considerations?Three main factors contribute to fence location decisions in addition to the initial Border Patrol operational assessments: (1) engineering assessments, which included construction costs; (2) environmental analyses; and (3) input from stakeholders. Each of these steps is a standard element of the planning process that enables DHS to make informed decisions in deploying a fence as operationally required.

Analysis of Alternatives

The Border Patrol has conducted comprehensive analyses of alternatives (AOAs) to determine which areas along the border would most benefit from fencing and which type of fencing would be most appropriate for each identified segment. The primary objective in targeting certain areas is to provide an additional security measure in areas experiencing significant illegal cross border activities and traffic.

Other SBI TI projects will conduct A0As consistent and scaled with their individual DHS Level of Investment.

Waiver Litigation

Waiver Litigation – County of El Paso, et al. v. Chertoff, No. EP- 08-CA-0196-FM (W.D. Tex. June 2, 2008)

On June 2, 2008. The City and County of El Paso, Texas, joined by several other local government entities, local environmental groups, and the Native American tribe Ysleta del Sure Pueblo, filed suit against DHS in the U.S. District Court Western District of Texas.

The complaint alleges an unconstitutional delegation of legislative power, and a separation of powers claim based upon the Executive’s repeal of laws.

The complaint also alleges a Tenth Amendment challenge based upon the waiver’s inclusion of State and local laws.

On Thursday, June 5, 2008, plaintiffs filed an application for a

preliminary injunction seeking to halt construction in all the Texas project areas identified in the Secretary’s April 3, 2008 waivers.

DHS filed its opposition to the application and a motion to dismiss to dismiss the case with prejudice on June 19, 2008.

On June 20, 2008, the Court issued an order striking plaintiffs’

application for preliminary injunction because plaintiffs exceeded the ten page limitation without seeking the Court’s permission to do so.

On July 7, 2008, plaintiffs filed their brief in support of the application for preliminary injunction and reply to the government’s motion to dismiss.

The government’s response is due on July 21, 2008.

On July 21, 2008, DHS filed their response and are currently waiting upon the Court’s ruling.

No hearing has been scheduled as of August 8, 2008.
