"That on or about the 29th day of May 2003 at PasayCity, Philippines and within the jurisdiction of this HonorableCourt, the above-named accused, a public officer, being amember of the Philippine National Police, at that time, aDeputized Agent of the Land Transportation (LTO),committing the offense in relation to hisfunctions and takingadvantage of his official functions, with evident bad faith orgross inexcusable negligence, did then and there willfully,unlawfully, and criminally, without any legal basis, detachand confiscate the license/registration plate (No. PYA-809)of a 1995Toyota Crown service car owned by BEL-AIRTransitService Corporation (Philippine Licensee of the Dollar Rent-A-Car, USA),as a consequence of which said firm was notable to utilize said service vehicle, in its daily operations fornineteen (19) days, depriving it of the car's usual earnings ofP4,000a day, thereby causing undue injury to said firm in thetotal sum of SEVENTYSIXTHOUSANDPESOS(P76,000.oo).

The Public Prosecutor and counsel for the accusedstipulated on the following, to wit:

1. the jurisdiction of the Honorable Court;2. identity of accused P03 Manuel taytayon,

member of the PNPdeputized at LTO-NCR;3. that Manolo Jarabata was driving the service

vehicle of the private complainant Toyota Crownwith Plate No. PYA809,a rent a car vehicle alongNAIA Road, Pasay City on 29 May 2003 in theafternoon;

4. that the accused stopped the car, apprehendedJarabata, confiscated the latter's driver's license,detached the license Plate and brought it to LTOPasig;

5. that complainant through its staff Denis Dumlaopresented documents such as LTFRBfranchiseand the registration papers at the LTOOffice inPasig at about past 5 ih the afternoon of May 29,2003;

6. that accused did not appear in the hearing atLTO;

7. that in a Resolutiondated June 17, 2003 HearingOfficer Delia Hernandez ordered that theconfiscated license plate be released withoutfine;

8. that it took 19days from the time the confiscationof the license plate before it was released;

9. that accused issued a Temporary Operator'sPermit (TOP) after he confiscated the driver'slicense of Jarabata and detached the licenseplate;

10. that the signature above the words :Signature ofDriver" in the TOP No.. .533-1956-0belongs toManolo Jarabata.

(1) Whether or not the accused is authorized· by lawto detach and confiscate· the license plate of theservice vehicle;

(2) Whether or not the accused violated Sec. 3(e) ofR.A.3019;

In his Brief, the accused-appellant assigned the followingerrors:

I. THE COURT A QUO GRAVELY ERRED IN FINDINGTHAT THERE WAS NO INITIAL VIOLATION COMITTEDBY JARABATA THAT WOULD JUSTIFY THE ACCUSED-APPELLANT'S ORDER TO DETACH' ANDCONFISCATE THE LICENSE PLATES OF THE CAR.

II. THE COURT A QUO GRAVELY ERRED IN FINDINGTHE ACCUSED-APPELLANT GUILTY DESPITE THEPROSECUTION'S FAILURE TO PROVE BEYONDREASONABLE DOUBT THAT HE ACTED WITHEVIDENT BAD FAITH OR INEXCUSABLENEGLIGENCE IN SUBSEQUENTLY ORDERING THECONFISCATION OF THE LICENSE PLATES OF THECAR.

"Section 3. Corrupt practices of public officers. - Inaddition to acts or omissions of public officers alreadypenalized by existing law, the following shall constitutecorrupt practices of any public officer and are herebydeclared to be unlawful:

(e) Causing any undue injury to any party, including theGovernment, or giving any private party anyunwarranted benefits, advantage or preference inthe discharge of his official administrative or judicialfunctions through manifest partiality, evident badfaith or gross inexcusable negligence. "The second element enumerates the different modesby which means the offense penalized in section 3(e) may becommitted. "Partiality" is synonymous with "bias" which"excites" a disposition to see and report matters as they arewished for rather than as they are. "Bad Faith" does not simplyconnote bad judgment or negligence; it imputes a dishonestpurpose or some moral obliquity and conscious doing of awrong; a breach of sworn duty through some motive or intentor ill will; it partakes of the nature of a fraud. "Grossnegligence" has been so defined as negligencecharacterized by the want of even slight care, acting oromitting to act in a situation where there is a duty to act, notinadvertently but willfully and intentionally with a consciousindifference to consequences in so far as other persons maybe affected. It is the omission of that care which eveninattentive and thoughtless men· never fail to take on theirown property. These definitions prove all too well that thethree modes are distinct and different from each other. Proofof the existence of any of these modes in connection with theprohibited acts under Section 3(e) should suffice to warrantconviction."

A. Well Your Honor, the purpose in detaching the plate isto prevent further damage or sufferingsthat would beincurred by the driver because for example inspurious documents he would pay P2,500 but I do notknow how much he will pay for the expired epe andmore since the epe is inte·nded for bus used only andhe was using it and he was then using a car he wouldincur suspension including the vehicle Your Honor willalso be suspended for three (3) months so the driverwould suffer a lot. So it is better to detach the plateand let the owners just removed (sic) the driver.

Q. So, yOl) concluded that the documents, the.registration of the car was spurious that is the reasonwhy you confiscated the license plate?

A. Well Your Honor, the car has really no documentsbecause the document belongs to a bus.
