a quality productThe certification of plant stocks is essential for the supply of healthy plants and vitally important to fruit growers. We are fortunate in havingthe benefit of The Plant Health Propagation Scheme (PHPS) which is administered by the NSA and run by the Animal and Plant HealthAgency (APHA) who carry out extensive and independent inspections of all entered stocks.

The Principles of Certification.The site must meet rotational and isolation requirements. The parent material is derived from virus indexedpedigree stocks and meets the scheme specifications. No disease masking pesticides are allowed (especially relevant to Blackspot and Raspberry Root Rot). Every mother plant is inspected twice during the growingseason by trained inspectors. Any suspect plants are sent to the laboratory for further testing. There are published tolerances for any non-quarantine pestsand diseases which must not be exceeded

Certification GradesPHPS - Certified Stock Virus Tested Pedigree Mother Plants are produced by the NuclearStock Association (NSA) at East Malling by testing for all importantviruses, pests and diseases using a full range of PCR and graft based tests. This Virus Indexed material is then used by commercialpropagators to produce Elite and A Certificate plants for sale.

PHPS - Approved Health When a variety is first released and before pedigree material isavailable from the NSA we offer stocks that have been entered andinspected at the Approved Health Grade. This grade is part of thePHPS and uses the same criteria as the A Certificate Grade withregard to the health of the stocks but offers no safeguard with regards to trueness to type.

Plant Passport When the stringent requirements of PHPS are not met, Rubus andStrawberries are inspected once only by APHA against a muchreduced set of criteria in order to meet the EU Plant Passport standard.

strawberriesYOUR CHOICE OF PLANTSWe offer strawberry plants in a wide range of plant types, providing you with theopportunity to select the plants most suited to your needs; taking into account yourgrowing system, planting window, target pick date and plant budget.This guide provides the key points for each type, summarising the propagation methodand application recommended.

Soil Grown - Bare Root Plants (Sold as frozen/frigo plants ex cold store January - June)

A+ PlantsGraded by crown size from traditional runner beds, these carefully selected plantsrepresent 25-30% of the daughter plants. The precise crown diameter used during thegrading will vary from variety to variety and from year to year but under favourableestablishment conditions, fruit growers can expect to harvest commercial yields within50 to 60 days of planting. With fewer flowers than Waiting Bed plants, A+ are easier toestablish and suitable for planting in soil any time from February to June and also forhigh density, late planting (June/July) in substrate by specialist growers. When grown insoil, plants can then be cropped for a further 1 or 2 seasons.

A Grade PlantsThese plants are graded by crown diameter and represent the next 50% of the plants from the traditional runner bed. Ideal for planting insoil and often de-blossomed after planting, A Grade plants are a low risk, relatively low cost option for larger scale growers who areplanning for 2 and 3 year cropping cycles in lower input growing systems. N.B.: A premium of £6.50 per thousand is charged for coldstored plants.

Waiting Bed Plants The preferred option for maximising ‘50-60 day’ fruit yields in both substrate and soil based growing systems. These plants are producedin a ‘Waiting Bed’, grown at a controlled density, and are runner cut in order to maximise crown size, truss numbers and flower counts.WB plants are ideal for programmed cropping by specialist growers.Experienced growers willl know that in order to maximise the fruiting potential of these plants, they must only be planted under optimumconditions for rapid root development. For spring and summer planting, short cycle, high frequency sprinkler irrigation is required forsuccessful plant establishment. Flower mapping recommended.

We offer Waiting Bed plants in 2 forms:

Fresh Waiting Bed (FWB): grown from summer dug fresh plants and offered as ‘heavies’ for planting from January to March and‘mediums’ and ‘lights’ for planting from April to June.

Double Cold-stored Waiting Bed (DCWB): grown on for a second season from over-wintered, cold-stored small plants and offered as‘heavies’ - often multi-crowned plants - for planting from January to March and ‘mediums for planting from April to June.

Released in 2012 by EastMalling Research and theStrawberry Breeding Club,MallingTM Centenary has thepotential to be of real value tointensive growers seeking togrow a better eating varietyfor their supermarketcustomers.

Fruit quality and yield This early season selection has been released as a direct result of the variety’s significantly improvedflavour, appearance and shelf lifecompared to the current industrystandards of Elsanta and Sonata.The berries are very regularly shapedand large, with 62% of the cropgreater than 35mm in the HDCsubstrate trial (SF128). This is theresult of a relatively simple flowertruss structure that gives 5-6 flowersper truss. The berries have a highlevel of gloss which is retained during storage. The flavour has consistently been extremely good in all trials. Shelf life is excellent and thevariety was rated 1st for shelf life in the 2015 Hoogstraten glasshouse trial. In the HDC trial over four seasons MallingTM Centenary was thetop rated selection when assessed for berry appearance, flavour, colour, uniformity and shelf life. MallingTM Centenary has performed verywell as a tray plant yielding in excess of 440g/plant and was the second highest yielding selection at 717g/plant in the following year in theHDC Substrate Trial (SF128 2011/12). In the 2015 Proefcentrum Hoogstraten 2015 Glasshouse Trial MallingTM Centenary yield was6.9Kg/m2, comparable to the highest yielding varieties in the trial and cropped over the period 18/3/15 to 7/5/15. When the plants weregrown in the soil, yields were lower but comparable to Elsanta.

Vibrant EU 37422Bred and selected by East MallingResearch, Vibrant is a high yielding, highquality early variety that has rapidly becomepopular as an early selection and hasadvanced the English strawberry season by ten days.Fruit quality and yieldVibrant produces beautifully shaped, uniform, conic berries which are medium to large in size and with virtually no Class II fruit. The berries are glossy, brilliant red in colour and are carried on strongly erect, long, flowering peduncles. Vibrant was bred to give a high 60-day yield by producing a large number of flowering trusses in succession thus cropping over an extended period. Each truss carries only 4 to 5 flowers thus maintaining a larger fruit size (72% of the Vibrant crop exceeded 35mm compared to 56% for Elsanta in the Hoogstraten trial). Maincrop yields have been consistently good and have normally exceeded 1kg per plant. Picking speeds are exceptionaldue to the good presentation of the berries and the fruit is easily handled and packed being firmer than both Clery and Elsanta. Flavour is excellent and Vibrant was the top rated selection for flavour in the HDC Substrate Trial in 2011.

Husbandry and SeasonA genuinely early variety with a 50% pick date at leastseven days ahead of Elsanta. The plants are moderatelyvigorous with good resistance to Powdery Mildew andCrown Rot but are susceptible to Verticillium Wilt. A second crop can occur if the crop has been forced and up to 400gms of good quality fruit can be produced from July onwards.

Royal SovereignBred by Joseph Paxton in the 1890’s this is one of the oldest fruit varieties stillcultivated. An early season variety with large and tasty fruits and a longestablished reputation. This was the variety served to Queen Elizabeth II at hercoronation banquet. Certified Stock : £168 per thousand

Sweetheart EU 34842Bred at East Malling Research, this elegant selection is another outstanding varietythat can be successfully grown without high input costs. Cropping at a similar timeto Elsanta, Sweetheart has attractive berries which are uniformly conic, larger andslightly darker than Elsanta, with good skin strength. Sweetheart is far lesssusceptible to bruising than Sonata and is easy to handle in the packhouse. Brixlevels are higher than Elsanta and the flavour is very pleasant with a good balanceof sweetness and acidity. Yields well in excess of 6 tonnes per acre and Class Ipercentages in excess of 90% have been achieved from commercially grown, openground production, over a long picking season. 60-day yields are modest. Thevariety has a compact but vigorous habit, with a denser canopy than Elsanta butwith well displayed fruit. The variety has reasonable resistance to Powdery Mildew.Sweetheart is susceptible to Crown Rot but appears to be tolerant to VerticilliumWilt under field conditions.Certified Stock : £184 per thousand

ChristineChristine is an early season variety cropping some5 days ahead of Elsanta and responds particularlywell when covered with fleece. The berries arelarge, bright, orange-red and easily picked. Class Ipercentages are good with few small ormisshapen berries. Fruit quality is excellent and inan HDC trial Christine was recorded as ‘thefirmest variety with high skin strength and littlebruising’. Flavour is excellent with good levels ofsugar. This variety will give three full crops whengrown on a traditional matted row and is the onlyearly variety that is resistant to Verticillium Wilt; italso has good resistance to Mildew and isuntouched by Two Spotted Spider Mite. HoneoyeCropping 4-6 days ahead of Elsanta andproducing attractive, conical, orange-red fruit.Fruit firmness is slightly below the standard set byElsanta and the berries have a tendency todarken. Honeoye is susceptible to Verticillium Wiltand needs frequent picking to produce the bestresults. Certified Stock : £156 per thousand

KoronaStrongly recommended for the PYO grower as aresult of its combination of flavour, season anddisease resistance. The variety produces a highyield of large, bright, attractive fruit commencing5 days ahead of Elsanta. MarshmelloAn East Malling Research variety producing strong, vigorous,large crowned plants with excellent disease resistance.Marshmello was selected on the basis of its superb flavour andlarge fruit. Although too soft for some uses, this variety has beensuccessfully and exclusively marketed to the amateur sector byMarshalls but is available for PYO industry where it hasperformed well. Not available for retail plant sales. Certified Stock : £184 per thousand

ElsantaElsanta is still one of the UK’s most important varieties thirty-threeyears after its initial release by the Dutch breeders. Superb fruitquality and excellent shelf life make this the supermarkets’favourite. Susceptibility to fruit splitting and malformation, acompact picking season and poor disease resistance, particularlyto Verticillium Wilt and other soil-borne diseases, limit theprofitability of this variety in many situations. The medium tolarge, firm, orange-red fruit are the variety’s greatest asset.Susceptibility to Two Spotted Mite and Powdery mildew also testthe grower’s competence.Fresh dug plants are available from mid-September through tomid-April. Bench graded cold-stored plants are offered fromJanuary until end June.

A+15mm+The traditional A+ grade that offers good 60-day potential at arealistic price. Carefully selected to ensure that all plants reach aminimum of 15mm crown diameter.No large plants are removed from this grade.

Eros EU 1672Regular, attractive conical berries, good flavour and a bright,glossy finish are typical of this variety. Eros is resistant to RedCore and has some tolerance to Verticillium Wilt. A usefulmain season PYO variety.Certified Stock : £184 per thousand

Sonata EU 14768Released by Fresh Forward in Holland. Sonata is an Elsanta -Polka cross that has rapidly become the most widely plantedJune bearer in the UK.Sonata produces a very high Class I grade out of attractive,uniform, conical berries that are bright and glossy withsuperior flavour and texture compared to Elsanta. The varietyis not susceptible to splitting but is not quite as firm as Elsantaand is more sensitive to bruising and ripens quickly in hotweather. Overall yield is less than Elsanta but Sonata’s Class Iyield is superior. The variety crops five days later than Elsantaunder tunnels and two days later in the open. Sonata hasgood resistance to Powdery Mildew but is susceptible toVerticillium Wilt, Rhizoctonia and Crown Rot, the latterneeding careful management.

A+14mmOur own grown bench graded plants. Carefully selected toensure that all plants reach a minimum of 14mm crowndiameter. No large plants are removed from this grade.

HapilHapil is a large, vigorous plant producing a heavy crop ofvery large, bright, glossy mid-season fruit. The easilypicked fruit, its size, flavour and appearance all give greatappeal to the PYO customer. Susceptible to VerticilliumWilt.Certified Stock : £168 per thousand

Alice EU 10574Bred at East Malling, Alice is a main season selectionproducing bright, firm and attractive berries with a sweetflavour and juicy texture. The variety does not perform wellas a 60-day plant but subsequent yields surpass those ofElsanta. Alice has good resistance to Verticillium Wilt andto Crown Rot.Certified Stock : £184 per thousand

Cambridge FavouriteBred in 1938 and nursed through the war as a numberedseedling, Cambridge Favourite became the most widelygrown variety in the 1960’s. Excellent disease resistanceand a vigorous free runnering habit makes this an easilygrown variety that crops heavily and reliably under a widerange of conditions. The medium sized fruit hangs well onthe plant but is too soft to stand much travelling. Stillunsurpassed as a processing variety and valued by thePYO customer. Certified Stock : £156 per thousand

MallingTM PegasusBred by East Malling Research. Fruit appearance, shapeand skin finish are good but the flesh is softer thanElsanta and the variety crops some 5-10 days later.Pegasus has good all round disease resistance and istolerant of Verticillium Wilt. Recommended as a reliable,general purpose variety for the PYO industry.Certified Stock : £166 per thousand

Lucy EU 32752This East Malling Research release has been outstanding whentrialled under low cost, unprotected growing systems, producingexceptionally high yields with a 50% pick date 5 to 7 days later thanElsanta. Lucy delivers very large, attractive, firm, mid-red glossyberries, 80% of which exceeds 35mm. The berries hold exceptionallywell on the plant and are unaffected by heavy rain. Lucy has a usefullevel of resistance to Crown Rot but is moderately susceptible toVerticillium Wilt and Mildew. This is a high yielding, grower friendlyvariety well suited to traditional field production. Certified Stock : £179 per thousand

Elegance EU 32070Bred and selected at East Malling Research by Dr. DavidSimpson, Elegance is one of the most exciting mainseason varieties to be released by that programme.Outstanding 60-day performance, fruit quality, shelf lifeand yield make this an exceptional selection.Fruit quality and yieldElegance was named after its elegant, bright and glossy berrieswhich are orange-red in colour and uniformly conic. The berries arefirm and hold on the plant for several days with no darkening incolour. The fruit is easy to pick and pack with no susceptibility tofinger bruising and has exceptional shelf life. Elegance has a sweetstrawberry flavour with a pleasant juicy texture. The berries are welldisplayed with virtually no Class II fruit resulting in impressivepicking speeds. Elegance was specifically bred for good 60-dayyields and its performance in trials has been superb. Elegance wasthe highest yielding variety of the 19 trialled by the HDC (projectSF92a) on Mr George Busby’s farm in 2010-11. At Tongeren inBelgium, Elegance topped the 2011, 2012, 2013 and 2014Maincrop Trials where the variety’s yield and exceptional shelf lifecreated real interest. Elegance has been the highest yielding varietyon our farm when grown without protection for the last four years.Season and husbandryElegance is a mid-late season variety. Picking commencesapproximately five days later than Sonata and extends over a long period, typically 4 to 5 weeks. Elegance is susceptible toMildew on the foliage and has some tolerance to Verticillium Wilt and Crown Rot.

Commercial growers have reported a susceptibility to Red Core.Flavour is enhanced by reduced levels of Nitrogen and water.

Fenella EU 32669Bred and selected by Dr. David Simpsonat East Malling Research from a Lucycross, Fenella is a late season selectionwith excellent disease and weatherresistance allied to a high yield ofquality fruit.Fruit quality and yieldFenella produces large berries with an averageweight of 15gms which are attractively glossywith a waxy skin and large flat calices. Theberries are orange-red, with a similar firmnessto Elsanta and with good shelf life. They havean excellent and distinctive sweet flavour andare mildly aromatic with a pleasant juicytexture. Yields of Fenella have been equal to,or better than, Elsanta in the two maincroptrials to date with much higher Class Ipercentages. ‘60-day yields are the same asElsanta when the same crowns are compared.’(Adam Whitehouse, EMR 2009)

Season and husbandryProduction peaks midway between Elsanta andFlorence with a season similar to Symphony.The variety produces a lush, vigorous plant witha compact, upright habit and long trusses, displaying the fruit well. Fenella has very goodresistance to Verticillium Wilt and to Crown Rotand the fruit stood up to the torrential rain ofthe 2007 and 2012 seasons.This unique combination of disease resistance,vigour and rain tolerance allows for the reliableproduction of good quality, low cost,unprotected fruit for a full range of marketingoutlets.

Cupid EU 37423Cupid is one of the most interesting varieties to emerge fromEast Malling Research in that it is the only selection to carrycommercially useful levels of resistance to four major diseases,namely Verticillium Wilt, Crown Rot, Black Spot and PowderyMildew. This variety crops at the same time as Florence andproduces a high yield of attractive, uniform, conic berries withgood skin strength and shelf life. The fruit remains firm with nofinger bruising even under the hottest conditions. Cupid is avigorous variety and produces a good leaf canopy that iseffective in protecting the fruit from adverse weather. This varietyshould be tried where disease problems normally limit yield. Approved Health : £184 per thousand

Symphony EU 1713Bred at The James Hutton Institute, Symphony is a wellestablished late season variety with a 50% pick date 8 to 10 dayslater than Elsanta. The berries are bright, regular and glossy withgood flesh and skin firmness and a pleasant, slightly acidicflavour. Maincrop yields are excellent; the variety has good fieldresistance to Red Core and some tolerance to Vine Weevil and isparticularly suited to low cost, outdoor production. Their fruitsize is larger than Tulameen averaging 6.6gms per berry in trials.The flavour is pleasant and the colour good, if a little dull. Detailedtests at EMR East Malling have highlighted the variety’s excellentshelf life; yield is excellent with 3.3kg per stool recorded by JHI.Octavia is a moderately vigorous, thorny selection producingupright, leafy laterals with well presented fruit. Bud break is goodand the variety crops to the base of the fruiting canes. They aresusceptible to Root Rot but resistant to biotypes 1-4 of the largeRaspberry Aphid, Cane Botrytis and Cane Spot. The 50% pick dateof Octavia has consistently been 11 to 12 days later than that ofGlen Ample. Octavia has exceptional winter hardiness and survived -30OC in Poland in the 2006/7 winter.

Imara ”Advaberimar” EU 40335The earliest of the ABB varieties Imara commenced its primocane cropat the end of July when trialled at PCF Tongeren in 2012 and produced50% of its 1.8kg/plant crop by early September. The berries are large,cohesive, firm and have an outstanding shelf life. The fruit is uniform,attractively coloured and easily picked. Imara is less prone to darkeningthan Polka but does need picking on a regular basis. The variety isvigorous and strong growing, producing branched canes with small,unobstructive spines. No significant problems have been identified todate with pests or diseases.

Kweli ”Advabereen” EU 40334Three weeks later than Imara with a 50% pick date around the end ofSeptember in the 2012 PCF Tongeren trials, Kweli produced a similaryield of Class I fruit to that of Imara. The berries are an attractiveorange-red and do not darken after harvest. Kweli has an exceptionalshelf life being the firmest of the ABB varieties. The berries are large(averaging 5gms), well flavoured and easily picked. The variety isvigorous and produces well branched canes with no evident pest ordisease problems to date. Kweli performed particularly well in the UKtrials in 2012 when grown under polythene and glass and hasconsistently produced a high quality product that has been well receivedby the customer. Kweli is suitable for double cropping and is capable ofproducing a significant and very early floricane crop. The berries are very large, averaging inexcess of 6gms in trial, well presented and easily picked andhave a very bright, attractive appearance. The fruit is orange-red and does not darken after harvest; the flavour is excellentand the berries are consistently sweet throughout the harvestperiod. The berries are firm and have excellent shelf life.Kwanza is a little earlier than Kweli and about 10 days laterthan Polka. The variety has a compact, upright growth habitwith large leaves and few basal shoots or spines. No significantproblem has been detected with pests or diseases. Difficultiesin propagating the variety has delayed the availability.

Kwanza was the top rated primocane in the 2013 PcFruit trials scoring a remarkable 92.4%

ObsidianObsidian is a very early ripening, high yielding, vigorouscultivar with large fruit that have excellent fresh fruit quality.The berries are large, even in shape, firm and with anexcellent colour that is retained under refridgeration andfreezing. Fruit flavour is very good as is shelf life. Obsidianhas performed well in the UK but the season is verycondensed.

Karaka Black EU 10720Karaka Black is an early season blackberry bred by theHortResearch breeding programme in New Zealand. Theattractive, shiny fruit have similar shape to that of Kotata, arewell displayed and easy to pick. These dark black fruits arefirm and have an outstanding shelf life. Karaka Black has agood blackberry flavour but may be slightly acidic whenpicked under ripe or grown in cool climates. Yields in trials inNew Zealand have been outstanding and the variety hasperformed well under commercial growing conditions in theUK. Karaka Black is one of the earliest high qualitiesavailable. Picking commences in early July and extends untilmid-August. The variety produces canes of moderate vigourand although spiny are reasonably easy to manage. Spacingof 1m is recommended.

Black ButteBlack Butte is an early season variety, ripening in mid-July andproducing attractive, well presented, uniform berries of goodflavour and exceptional size (over 11gms/berry). The variety isthorny and the trailing canes are vigorous and winter hardy.Black Butte has particular appeal for PYO growers and thosesupplying specialist local outlets.

Loch Tay EU 16917Bred by JHI, Loch Tay is the second major selection toemerge from the breeding programme that producedLoch Ness and is now widely planted in both the UK andEurope. Three weeks earlier than Loch Ness and withsignificantly better flavour, Loch Tay is rapidly becoming apreferred variety by the multiples. Fruit firmness iscomparable to Loch Ness but the berries are slightlysmaller at 4.5-5gms average. The variety has a semi-erectthornless habit similar to Loch Ness, but with significantlyimproved vigour and better resistance to Downy Mildew.

Natchez EU 35827A semi-erect, high yielding early season selection from theArkansas breeding programme. The berries areconsistently large with an average weight of 8gms. Thefruit is long, conic in shape, exceptionally glossy and firmand is not susceptible to bleed after picking. Colourretention after harvest is good and the berries have verygood shelf life characteristicsFlavour is good with a pleasant acid-sugar balance andBrix values of 8-9% are normal.

Asterina® EU Application No. 997076 var. Fruloche

Bred in Switzerland and the result of a cross between LochNess and Chester, Asterina has exceptional flavour. Thisvariety is thornless with a good level of vigour. The fruit is very large, bright and shiny with an excellentblackberry aroma; the first berries ripen in mid-July andpicking continues over a prolonged period.

Loch Ness This thornless blackberry, bred at JHI, produces a very highyield of top quality fruit. The fruit is large, typically 5gms ormore, very firm and glossy black with an excellent flavourwhen fully ripe. Yield is good with picking commencing inearly August and continuing until first frosts. Loch Ness hasgood resistance to Purple Blotch and Botrytis but warm, wetweather in June can highlight the variety's susceptibility toDowny Mildew (Peronospora rubi). The inherent quality ofthis variety and, in particular, its winter hardiness, make itone of the best adapted for the northern European climate.Loch Ness produces strong semi-erect and erect canes. On well established plants, tip pruning of newly emergedprimocanes is recommended. Planting distances vary from1.25m to 2.0m depending on soil fertility and irrigation.

Ouachita EU 32662This mid-season selection from the Arkansas programmeproduces strong, erect, spine-free cane that carry compactlaterals. Late Season: Listed in order of cropping

ChesterBred in Maryland, USA, Chester’s combination ofhigh quality fruit, excellent flavour and a late seasonhas resulted in its becoming one of the most popularvarieties in the UK.Well presented, shiny black fruit of 5-6gms with anattractive fruity flavour and superb shelf life aretypical of this variety. The berries do not soften orlose their attractive shine under hot conditions. Thepicking season begins in mid-August in the UK andnormally continues until the first frosts, althoughquality declines in early October. The yield potentialof this variety is unequalled.The variety is extremely vigorous producing semi-erectthornless canes. In our experience, Chester thrives onheavy, non-irrigated soils. Disease resistance isexcellent with no evidence of Downy Mildew or PurpleBlotch. Plant spacings of 2.0m to 2.5m arerecommended. Tip pruning of newly emergedprimocanes is essential.

Triple CrownThis Maryland bred variety is a semi-erect, spine free,late season, quality blackberry and was selected as asuccessor to Chester. The berries are significantlylarger than those of Chester at 6.5gms and have abright shiny appearance and excellent shelf life.Flavour is superior to Chester and is considered to bethe best flavoured of all the erect, thornless types,although the fruit is a little softer. Croppingcommences towards the end of August andcontinues until the first frosts. The canes are frosthardy and vigorous.

rhubarbEarly Season Invicta This vigorous, easily grown, high yielding variety is justifiably the most widely planted gooseberry variety. The berries are large, oval, smoothskinned and ripen to a pale yellow colour. Flavour when both green and fully ripe is excellent. The growth is very vigorous, spreading andthorny; the variety rapidly reaches its full potential as a bush and can be successfully grown on wires. Invicta has a yield potential double thatof Careless and has some resistance to American gooseberry mildew but is vulnerable to Phytophthora infection.

Mid Season Pax EU 4561A virtually spine-free red dessert gooseberry. Bred at East Malling Research, Pax produces dark red fruit of medium size (7.4gms) and gooddessert flavour, with a similar cropping season to Careless. Yields in trials have averaged 1.7kg/bush. The plants produce occasional spineson young wood. The variety is very vigorous and spreading. Pax is moderately resistant to American gooseberry mildew and Leaf Spot. Available as a 3 litre Potted Plant only.

Hinnonmaki RedA mid-season, very hardy variety. Produces a heavy crop of medium-sized dark red fruit on a semi-upright bush. Flavour of the fruit isexcellent - the skin of the fruit is tangy, the inside is sweet. Resistant to American gooseberry mildew.

Late SeasonCaptivatorA virtually thornless, red-fruited gooseberry with excellent resistance to American gooseberry mildew. The bushes have a vigorous spreadinghabit and carry sweet, burgundy red, pear-shaped berries in late July. Captivator is Mildew resistant and very cold hardy, having been bred inCanada. This is one of the best dessert varieties available. Highly recommended by PYO growers.

Hinnonmaki YellowA late-season, very hardy variety bred in Finland. The bush has a spreading habit and benefits from some support. Medium to large yellow fruit, famous for its aromatic flavour with a hint of apricot. Resistant to American gooseberry mildew.

We formally ask that you study these Terms and Conditions before signing our Order Confirmation which confirms that you have read, understood and agree to them, and we particularly draw your attention to sections 5, 6 and 7, which detail the limitations to our liabilities.1. These conditions and statements

1.1 The conditions set out here are the only terms and conditions on which we sell goods or supply services and, unless you and we both otherwise expressly agree in writing, they will apply absolutely. These terms and conditions override and supersede any other terms and conditions that may have been sent to you previously; and override any purchasing terms set out in any customer’s purchasing note.1.2 In these conditions:-

1.2.1 “Goods” means all goods and/or services to be supplied by us to you;1.2.2 “we”, "us" and “the Company” means RW Walpole Ltd; 1.2.3 “you” means the company person or legal entity buying the goods;1.2.4 "Contract" means the contract between you and us for the sale and purchase of Goods in accordance with these

conditions;1.2.5 "Confirmation of Order" means the document sent to you by us confirming our receipt of your order and specifying the

Goods;1.2.6 "Delivery" means delivery of the Goods in accordance with clause 4 of these terms and conditions.

1.3 The Contract represents the entire agreement between the parties. You acknowledge that you have not relied upon any statement promise or representation made or given by or on behalf of the Company which is not set out in the Contract. Any drawings, descriptive matter or advertising and any descriptions advice or illustrations contained in the Company's catalogues, brochures or website are produced for the sole purpose of giving an idea of the goods described in them. They shall not form part of the Contract or any other contract between you and us.

1.4 Any typographical, clerical or other error or omission in any quotation or Confirmation of Order or other document issued by R W Walpole Ltd, shall be subject to correction without liability on the part of R W Walpole Ltd.

1.5 A quotation for the Goods shall not constitute an offer from us. A binding contract shall only come into existence upon our receipt of a signed Confirmation of Order from you.

2. Orders2.1 All goods are offered and sold subject to the plants being unsold at the time of receipt of a signed Confirmation of Order by

R W Walpole Ltd. 2.2 It is the responsibility of the buyer to check that the Confirmation of Order accurately reflects all aspects of their order including

but not limited to quantities, varieties, grades, certificates (where applicable) and delivery dates and prices agreed.

3. Prices3.1 Except as otherwise stated under the terms of any quotation and specifically agreed in writing between you and us, all prices

are on an ex-farm basis and are as detailed on the Confirmation of Order. Where we agree to deliver the plants otherwise than at R W Walpole Ltd’s premises, you shall be liable to pay R W Walpole Ltd’s charges for packing, insurance and transport and for any phytosanitary inspection or documentation charges that may be necessary.

3.2 The Company reserves the right to charge separately for the cost of PHPS Certification or any other relevant certification or inspections.3.3 Unless stated in writing to the contrary, any quotation or unsigned Confirmation of Order is valid for a maximum of 30 days from the

date of issue, provided that the Company has not previously given you notice of its withdrawal.3.4 If the Goods sold as agreed in writing are of foreign origin, the Company reserves the right to adjust the price payable by you so as

to reflect any alteration in the value of the £ sterling in terms of currency in the country of origin of the Goods between the date of written confirmation of sale and the date of invoice.

4. Delivery4.1 We reserve the right to deliver an order by separate instalments. In such cases each instalment shall be invoiced and paid in

accordance with the Contract.4.2 Delivery of Goods shall be made by you collecting Goods from our premises within three business days after we have notified you

that the Goods are ready for collection or, if we have previously agreed in writing some other place of delivery, by us delivering the Goods to that place. You will make all arrangements necessary to receive delivery of the Goods in the manner agreed whenever they are tendered for delivery.

4.3 Any Goods not collected by you within the above timescale (time being of the essence) or not accepted where Delivery takes place somewhere other than our premises may be resold or returned to our supplier at our discretion. You shall remain liable to us for the Contract price, less any sum we have been able to recover by sale or return of the Goods.

4.4 Any Delivery times quoted by us on the Confirmation of Order or other literature are estimates only, however, if we fail to deliver within a reasonable time after the quoted delivery time, provided the Goods have not been dispatched to us by the supplier you may, by informing us in writing, cancel the Contract. In those circumstances:4.4.1 We will refund the purchase price of the Goods to you less any expenses reasonably incurred by us in relation to the

Contract; and4.4.2 Save as provided for in clause 4.1 above, you can have no further claim whatsoever against us under that Contract.

5. Warranties and Liability This section sets out our warranties and liabilities and particularly the limits to our liabilities.NB: The reason for these limitations of liability is that whilst we, and other propagators from whom we have purchased plants, have taken all reasonable care and have managed our crops according to current accepted husbandry practices this does not guarantee trueness to type in all circumstances nor freedom from pests and diseases. The price of our goods reflects these limits to our liability. Anyone wishing to purchase plants with specific guarantees is invited to make their requirements known to the company and we will, if possible, provide a quotation that meets these requirements.5.1.1 When shown on our paperwork as PHPS certified, R W Walpole Ltd warrant that the strawberry plants and raspberry canes have

been grown and produced to FERA Plant Health standards and inspected and certified under the Plant Health Propagation Scheme (PHPS). Details of the PHPS certification scheme, including the tolerances for visible signs of pest(s) and disease(s), are published on the following website www.fera.defra.gov.uk/plants/plantHealth/phps.cfm and are available from R W Walpole Ltd on request. PHPSgrades Elite and ‘A’ Certificate for both strawberries and raspberries are inspected and certified as true to type based on visual assessment of botanical characteristics, but the inspections do not guarantee the identification of possible genetic mutations. Material certified at the PHPS grade, Approved Health(AH), is inspected and certified as to health but not in respect of trueness to type.

5.1.2 When shown on our paperwork as UK Plant Passport Grade, R W Walpole Ltd warrant that the strawberry plants, raspberry canes and other Rubus plants have been grown and produced to UK Plant Passporting regulations as inspected by FERA inspectors. Details of UK Plant Passport Regulations including pest and disease tolerances are available from: www.fera.defra.gov.uk/plants/plantHealth/plantPassporting.cfm

5.1.3 For all other plant material, the country of origin and relevant certification or passporting status, where applicable, is shown on our paperwork. Full details of these protocols are available on request from R W Walpole Ltd. Plant material not eligible for EU Plant Passporting Regulations or Certification, e.g. Rhubarb, blueberries, redcurrants etc is shown as uncertified and is not subject to any official inspections.

5.2 The above warranty is given by R W Walpole Ltd subject to the following conditions:5.2.1 The Company accepts no liability whatsoever for plant material not eligible for EU plant passporting regulations or

certification as it is not possible for the Company to guarantee the quality of such plant material.5.2.2 R W Walpole Ltd shall be under no liability for latent diseases or latent defects which may be present but not detected by any

inspectors when inspecting plants under PHPS or any other certification or passporting scheme either in the UK or the country of origin of the material, and such certificate or passport shall not be challenged in any subsequent test or inspection.

5.2.3 R W Walpole Ltd shall be under no liability in respect of any problem arising from wilful damage, negligence or failure to follow the accepted tenets of good husbandry by you or any other party including the use of inappropriate fertiliser or pesticide treatment applied to the plants, substrate, or soil in which the plants are growing.

5.2.4 R W Walpole Ltd shall be under no liability whatsoever if the total price of the Goods has not been paid by the payment due date. 5.2.5 The yield a plant will produce is dependent on many factors, many of which are outside of our control. Guidance on likely

yields and the timing of those yields in favouable conditions can be found in our brochure, and we are confident that the goods that we supply are true to type, healthy and free from pests at the time of Delivery however, R W Walpole Ltd does not guarantee the yield of the plants in any respect whatsoever. It is the Buyer’s responsibility to ensure that the Goods are suitable for his particular purpose, and we cannot be held liable for any failure of the Goods to produce the expected crop.

5.2.6 Where a Laboratory test for any pest, disease or virus has been carried out by the Company or any third party on harvested plants prior to delivery and found to be negative, this result shall be deemed to be conclusive and cannot be challenged by any subsequent customer instructed tests.

5.2.7 Our liability to you shall be limited:i) where the loss or damage, however sustained, is in respect of all the Goods delivered or collected, to the invoice price of the Goods;ii) where the loss or damage, however sustained, is in respect of part of the Goods, to the appropriate proportion of the invoice price which that part of the Goods bears to the total invoice price of all the Goods. We shall not in any case be liable for wasted expenditure, loss of profit, increased cost or any other indirect, consequential or economic loss, injury or damage without limitation.

5.2.8 Under no circumstances will R W Walpole Ltd consider valid or be liable for any complaint relating to quality, pests, diseases or other alleged disorders of plants supplied unless notified to us at Ivy Farm, Terrington St. Clement, King’s Lynn, Norfolk PE34 4PX within 72 hours after Delivery and subsequently confirmed to us in writing within the next 48 hours either by post, fax or email (upon confirmation of the “message read” acknowledgement). In the event of a written complaint, R W Walpole Ltd has the right of access to your premises to inspect the plants and to take samples and to inspect and take copies of your inspection records if relevant. Time is of the essence for the purposes of this condition.

5.2.9 Where a valid claim exists in respect of any Goods, based on any defect in the quality, condition or specification, R W Walpole Ltd shall be entitled, at our own discretion, to refund to the customer the price of the Goods or to replace the Goods. R W Walpole Ltd will have no further liability to the customer.

5.2.10 R W Walpole Ltd does not hold Product Liability Insurance. All customers should hold their own insurance for consequential loss.5.2.11 The warranties given in these terms and conditions apply to the Customer and cannot be assigned without our written agreement.

5.3 All warranties, conditions and other terms implied by statute or common law (save for the conditions implied by section 12 of the Sale of Goods Act 1979) are, to the fullest extent permitted by law, excluded from the Contract.5.3.1 Nothing in these conditions excludes or limits our liability:

a) For death or personal injury caused by our negligence; orb) Under section 2(3), of the Consumer Protection Act 1987; orc) For any matter which it would be illegal for us to exclude or attempt to exclude its liability; ord) For fraud or fraudulent misrepresentation.

5.3.2 a) Our total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of the Contract shall be limited to the Contract price; andb) We shall not be liable to the Customer for loss of profit, third party claims, loss of business, increased costs or depletion of goodwill in each case whether direct, indirect or consequential compensation howsoever caused which arises out of, or in connection with, the Contract.

5.4 Liability for any latent defects or latent diseases is specifically excluded.

6. Buyers Responsibilities Upon Delivery6.1 In order to take advantage of the remedies provided by these terms or any remedy provided by the general law the Buyer must

comply with the responsibilities set out in this clause.6.1.1 The buyer must diligently inspect and satisfy himself as to the quality and fitness for his purpose of the Goods as soon as

practicable following Delivery and keep a contemporaneous record of such inspection and disclose those records to the company upon request in the event of a complaint. Any complaint whatsoever concerning the Goods, must be notified to us at Ivy Farm, Terrington St. Clement, King’s Lynn, Norfolk PE34 4PX within 72 hours after Delivery, and subsequently be confirmed in writing within the next 48 hours by either post, fax or email (upon confirmation of the ‘message read’ acknowledgement), failing which we shall not be liable for any defect in, loss or damage to the Goods whenever and however arising. If you do not do so, you will have been deemed to have accepted the Goods. Time is of the essence for the purposes of this condition.

6.1.2 In the event of any valid complaint being notified to us within 72 hours after delivery or collection, and agreed by us in writing, you may reject such proportion of the Goods as is defective and we shall refund or credit to you in respect of the purchase price of such rejected Goods or replace the Goods at our discretion. We shall have no further liability to the customer in respect of those goods. Time is of the essence for the purposes of this condition.

6.1.3 Any Goods claimed to be defective shall be held by the customer in good, reasonable and proper conditions for a period of seven days or until collected by R W Walpole Ltd, whichever is the sooner.

6.1.4 Liability for any latent defects or latent diseases is specifically excluded under clause 5.2.2 of these terms. However we will at our absolute discretion refund the Contract price or replace Goods in the event that the Customer informs us of a genuine defect or disease which would have been present but not discoverable upon diligent inspection upon Delivery, provided such complaint is notified to us at Ivy Farm, Terrington St Clement, Kings Lynn, Norfolk PE34 4PX within 72 hours of the defect or disease becoming apparent, subsequently confirmed to us in writing within the next 48 hours either by post, fax or email (upon confirmation of the "message read" acknowledgment), and supported by a written opinion from a suitably qualified independent expert disclosed to the company not more than 10 days from the Company’s receipt of notification of complaint. Where the Goods are to be stored following Delivery prior to planting, the customer shall take a representative sample of the Goods and plant them in an appropriate growing environment. Any complaint whatsoever must be notified to the company in writing either by post, fax or email (upon confirmation of the “message read” acknowledgement to the company within 45 days of planting the sample. Time is of the essence for the purposes of this clause.

6.1.5 In the case of any complaint you shall disclose to the Company all records relating to storage of the Goods, any inspection records, records relating to the treatment of the Goods that were planted and any other relevant records whatsoever which relate to the treatment of the Goods following Delivery within 7 days of any request to do so. The Company reserves the right towithdraw any offer of refund or replacement if, in our reasonable opinion, the Goods have not been properly treated since Delivery.

7. RemediesThe Company may at its discretion replace the defective Goods or refund the Contract price for the defective Goods (or such proportion of the Goods supplied as are defective) and in any event the liability of the Company shall be limited to the Contract price for the defective Goods.

8. Quantity8.1 Under no circumstances may you reject Goods for short delivery, and your remedy against the Company shall be limited to a

rateable reduction in the Contract price or supply of the short quantity at the Company's election. 8.2 You shall not be entitled to reject the Goods where an excess has been delivered.

9. Risk9.1 Risk of damage to or loss of the Goods shall pass from us to you:

a) In the case of Goods to be delivered at our premises, at the time of collection by you or your agentb) In the case of Goods to be delivered otherwise than at our premises the time when we have tendered delivery of the Goods (whether or not the Goods or any part of them are accepted).

10. Title10.1 Notwithstanding the provisions of the Contract relating to Delivery, property in the Goods shall pass when you have paid in full the

Contract price for these Goods. 10.2 In so far as the property in the Goods has not passed to you and you are in default of your payment obligations as set out in these

Conditions, we may recover them and may enter your premises, or the premises of any third party where the Goods are situate, for that purpose, without prejudice to our other remedies.

10.3 As soon as reasonably practicable following Delivery you must label, map or otherwise record the location of all Goods supplied by us so that they are clearly identifiable as our property.

11. Cancellation11.1 A binding Contract, as defined in 1.5, above, may not be cancelled by you unless agreed by R W Walpole Ltd in writing.11.2 If all or any part of the Contract is cancelled, for any reason, then at our discretion we will be entitled to recover from you the price

under the Contract of any and all Goods (finished or unfinished) that we may then hold or to which we are committed under the Contract.11.3 We may suspend or cancel the Contract, by written notice if:

11.3.1 you fail to pay us any money when due, whether or not in relation to the Contract or any other contract you may have with us; oror you become insolvent; or

11.3.2 if you fail to honour your obligations under the Contract; or11.3.3 you do not collect or accept delivery of the Goods or any part of the Goods within a reasonable time following notification

that the Goods or part of the Goods are ready for collection or delivery.11.4 We may suspend, cancel or vary the Contract if some or all of the Goods ordered fail any relevant certification or test, or if we are

otherwise of the reasonable view that the Goods are not of the requisite quality. In those circumstances we may, at our discretion, provide you with suitable similar alternative goods if you agree. However we shall not in any circumstances have any liability to you beyond refunding any part of the contract price already paid for the Goods in question.

12. Payment Terms12.1 Payment is due at the date indicated on the invoice or as otherwise agreed by us in writing beforehand. 12.2 Where a 5% charge is added to an invoice this can be deducted for an invoice which is paid by the due date as set out on the

invoice or otherwise agreed in writing by us. We reserve the right to charge interest at 5% above base on any invoice which is more than one month overdue.

12.3 The Company reserves the right to take payment in full prior to Delivery or collection of Goods with any first time customers or with any other customer at its discretion.

13. Non Payment13.1 We reserve the right to withhold all deliveries until all outstanding payments due to R W Walpole Ltd have been received.13.2 If you fail to pay us on the due date we may:

13.2.1 claim fixed sum compensation from you under s.5A of the Late Payment of Commercial Debts (Interest) Act 1998.13.2.2 Recover (under clause 13.4) the cost of taking legal action to make you pay.13.2.3 Without prejudice to our retention of title to the Goods, take legal proceedings to recover the price of the Goods supplied but

not paid for by the due date.13.3 You do not have the right to set off any money you may claim from us against anything you may owe us.13.4 You are to indemnify us in full and hold us harmless from all expenses and liabilities we may incur (directly or indirectly, including

financial costs, including legal costs on a full indemnity basis and the cost of instructing a debt recovery agency to recover a debt due to us if any) following any breach by you of any of your obligations under these terms.

14. Return of Goods14.1 We will accept the return of Goods from you only:

14.1.1 with our prior agreement and written confirmation;14.1.2 on payment of an agreed handling charge (unless the Goods were defective when delivered); and14.1.3 where the Goods are as fit for sale on their return as they were on delivery.

15. Use of Plants and Licences/Consents15.1 R W Walpole Ltd supplies Plants for the purpose of fruit production only. Any customer wishing to obtain parent stock for

propagation should contact the Nuclear Stock Association Ltd, c/o Dalric, Nutcroft Way, Harwell, Doncaster, S. Yorkshire DN10 5BU.15.2 Any plants which are protected by EU or UK Plant Breeders Rights are designated in our catalogue and are supplied on the

understanding that the material is for fruit production only. Propagation of protected plants for ‘own use’ or sale to third partieswithout a licence is illegal and can lead to legal action being taken against the infringer by the Head Licensees of the variety.

15.3 The purchase of Licensed Plants automatically confers the right of entry to the Head Licensee or his agent to the land or premises where the plants are situated.

16. Latest Delivery Dates16.1 Due to the possible loss of vigour during cold storage in respect to strawberry plants and the detrimental effects of leaf break on the

successful establishment of bare root raspberries, gooseberries and currants, latest delivery dates are quoted in our catalogue. Only in response to a customer’s specific instructions and at our discretion will these goods (strawberry plants, raspberry cane, gooseberries and currants) be delivered after our recommended latest delivery dates. Such deliveries will be on the basis that the customer fully appreciates the risks and takes full responsibility for any failure of such stock to establish, grow and yield.

17. Waiver and Variations17.1 No failure or delay by us in enforcing any of our rights shall constitute a waiver of any of our rights. No waiver shall be effective

unless in writing and signed by us.17.2 No variation of these terms is binding unless;

17.2.1 made in writing17.2.2 signed on behalf of each party; and17.2.3 expressly stating an intention to vary these terms.

17.3 All orders that you place with us will be on these terms (or any that we may issue to replace them). By placing an order with us, you are expressly waiving any terms you may have to the extent that they are inconsistent with our terms.

18. Force Majeure 18.1 We shall have no liability whatsoever under, or in any way related to, the sale and purchase of the Goods or otherwise, whether in

contract, tort (including negligence) or otherwise, for any failure to fulfil any obligation hereunder if and to the extent that such fulfilment is prevented by circumstances beyond our reasonable control which by its nature could not have been foreseen or was unavoidable including but not limited to failure of crops, failure of energy sources or transport network, breakdown of plant or machinery, strikes, lock-outs or other industrial dispute (whether or not involving the Company's own workforce) acts of god, war, terrorism, riots, civil commotion, interference by civil or military authorities, national or international calamity, armed conflict, malicious damage, nuclear, chemical or biological contamination, sonic boom, explosions, collapsed building structures, fires, floods, storms, earthquakes, loss at sea, epidemics or similar events, natural disasters or extreme adverse weather conditions or default of suppliers of subcontractors.

19. Law and Jurisdiction19.1 These conditions shall be governed by and construed in accordance with the laws of England and you accept the jurisdiction of the

courts of England for the purpose of trying any action arising out of the agreement.19.2 If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity

of these Conditions and the remainder of the provisions in question shall not be affected thereby.

20. General20.1 Each right or remedy we have under the Contract is without prejudice to any other right or remedy we have whether under the

Contract or not. 20.2 Failure or delay by us in enforcing or partially enforcing any provision of the Contract shall not be construed as a waiver of any of

our rights under the contract.20.3 The parties to the Contract do not intend that any term of the Contract shall be enforceable by virtue of the Contracts (Rights of

Third Parties) Act 1999 by any person that is not a party to it.20.4 All brochures, catalogues and other promotional materials are to be treated as illustrative only. Their contents form no part of any

contract between us and you should not rely on them in entering into any contract with us.20.5 If any Court or competent authority finds that any provision of the Contract (or any part of any provision) is invalid, illegal or

unenforceable that provision or part-provision shall to the extent required, be deemed to be deleted and the validity and enforceability of the other provisions of the Contract shall not be affected.20.5.1 If any invalid, unenforceable or illegal provision of the contract would be valid, enforceable and legal if some part of it were

deleted. The provisions shall apply with the minimum modification necessary to make it valid, legal and enforceable.

Ordering and Deliveries

Small Quantity PricesThe prices quoted in this catalogue apply to quantities of 500 or more for individual strawberry varieties and 250 or more for individualvarieties of raspberry and asparagus. We are pleased to supply smaller quantities but need to charge an additional £55/thousand forstrawberry and £110/thousand for raspberry and asparagus to cover the additional handling and packaging costs for orders between 50-500 plants for strawberry and 50-250 for raspberry and asparagus. Orders of 50 plants or less are covered by our “Small Order” price list which is available on request. Any payment by credit card is subject to a 2% surcharge.

Pallet RatesThe majority of our customers’ plants are despatched using theefficient next-day pallet delivery service provided by UK Pallets.As an approximate guide we can despatch 10,000 plants or3,000 canes on each pallet using pallet boxes and can deliver tothe whole of England except Cumbria and Cornwall and Devonfor approximately £60 per pallet.
