1.0-lntroduction

1.1 Applicability This guide to Rules and Regulations ("Guide") is adopted pursuant to the Articles of Incorporation, and the Declaration of Covenants, Conditions, and Restrictions, ("Declaration"). These documents provide for the establishment of reasonable rules and regulations concerning the use of individual lots and common areas. The Architectural Review Committee ("ARC") serves as representatives of the Board of Directors ("Board") while enforcing the Guide. Compliance with this Guide is required, but is not the sole basis for review or approval, nor does it guaranty approval of any application. In reviewing each application, the ARC may consider any factors it deems relevant. Decisions may be based purely on aesthetic considerations. Each owner acknowledges that determinations as to such matters are purely subjective in nature and that opinions may vary as to the desirability and attractiveness of a proposed addition or modification.

1.2 Purpose

This document is not intended to replace the Declaration, but to clarify the process by which homeowners may customize and modify the exterior presentation of their homes and/or lots. The intent is to provide consistent guidance to owners regarding requirements for additions and modifications to property in the community, and matters of particular concern to the ARC when considering applications for approval of such conditions and modifications. Additionally, the Guide sets forth various restrictions on other matters relating to community standards and the overall appearance of property in the community.

1.3 Application and Review Process

Unless otherwise specifically exempted by the Declaration or this Guide, each and every proposed exterior modification/addition to residential units or lots require prior approval of the ARC. Submit one copy of the Request for Architectural Approval form to Matthews Ridge Homeowners Association, Inc; PO Box 26844; Charlotte NC, 28221. The application can also be sent via email to [email protected]. Each application must include a copy of the lot survey showing the size and location of the proposed modification/addition as well as a list and description of the materials to be used. Color samples may assist the ARC in rendering its decision and expedite the review process. The ARC may require submission of such additional information as may be reasonably necessary to consider any application. Review of the application, and notification to the applicants shall be conducted as described in the Declaration. Where specifically permitted to proceed without prior approval, such permission shall only be effective so long as the Owner complies with every requirement of this Guide. The ARC is not responsible for ensuring structural integrity or compliance with state and local building codes. Homeowners must obtain all necessary building permits and other government approval that may be required for the proposed modification or addition.

2.0 General Architectural Standards

2.1 Antennas, Satellite Dishes {DBS, MOS, DSS) Homeowners who wish to place a satellite dish on the exterior of the residence must submit a Request for Architectural Approval to the ARC. Freestanding antennas/dishes are not permitted. If installation is required in other than the following approved locations, include a statement from the installer with the ARC application. Standard, approved placement of a satellite dish is:

• Attached to or mounted on a deck or patio in the rear of the residence and extending no

higher than the eaves of that portion of the roof of the dwelling directly in front of such antenna; or,

• Attached to or mounted on the rear wall or rear roof of the residence so as to extend no higher than the ridgeline of the residence at a point directly above the position where attached or mounted to the wall.

Pursuant to FCC Section 207 of the Telecommunications Act of 1996, the Association will not require prior approval for antennas/dishes in the attic, crawl space, garage, or other interior space of the dwelling, or another approved structure so as not to be visible from the exterior of the residence.

2.2 Backyard Play Equipment, Basketball Goals

Swing sets, basketball goals, trampolines, and all other play structures are not permitted anywhere on the property

2.3 Birdbaths, Birdfeeders, Birdhouses

Birdbaths, birdfeeders and birdhouses are not permitted on the exterior of the property unless expressly approved in writing by the Board or ARC using required form.

2.4 Clotheslines, Fuel Tanks, Outside Storage

Clotheslines, aboveground fuel storage tanks, woodpiles, and similar items are not permitted. Storage of any materials (such as, but not limited to, lawnmowers, landscaping materials, and lumber) outside an enclosed structure is not permitted. Do not place furniture intended for indoor use on any outside area, including porches.

2.5 Decks, Patios, Screened Porches, Driveways

ARC approval is required prior to construction, modification or extension of decks, patios screened porches, and driveways. Deck footings and patios must stay within tile minimum building line (MBL) of any lot. No deck or patio shall extend into the side yard beyond the side plane of the residence. Deck waterproofing , sealing and staining is pre-approved provided that natural wood color is used. Only clear sealer is permitted on driveways.

2.6 Dog Pens, Runs, Dog Houses Dog pens, houses, and runs are not permitted anywhere on the property. Pets must be on a leash and restrained at all times.

2.7 Exterior Changes, Shutters, Doors All exterior changes must be approved in writing prior to the changes being made. Homeowners can request to change the color of a door, shutters, and/or trim. Each of these three elements can be a different color. When submitting a request for a color change, color chips or siding samples would be attached to the standard ARC request form.

ARC will approve a color choice when it deems the selection meets the following criteria:

• The color maintains/enhances the appearance of the Craftsman style homes in the Matthews Ridge neighborhood. Craftsman colors are typically in muted tones, and examples of Craftsman colors are readily found on the internet.

• The color complements the siding, brick and stone colors of the house. • The color sufficiently blends with colors that already exist on neighboring houses.

2.8 Exterior Lighting, Seasonal Decorations Any exterior lighting or ground landscaping lights must be approved prior to being installed.

Outdoor light replacement fixtures should closely reflect the dimensions of the original fixtures and display the craftsman style of the homes in Matthews Ridge. Options can include dusk to dawn operation and/ or motion sensors. All requests for outdoor light replacement must be submitted on the ARC request form and follow the proper submission process.

All holiday decorations are pre-approved from Thanksgiving through 15th of January. Seasonal decorations are approved two weeks prior to the event until two weeks after the event.

2.9 Fences

An application for review is required to eliminate any misunderstanding. An application for Architectural Review form must be submitted to and approved by the ARC before construction can begin. The application must include a copy of the property survey showing the location of the fence and an explanantion of why the change is desired. Please see attachments 3.2, 3.3, and 3.4 to view the fence options. Approved fences must meet these additional restrictions:

• Chain-link or similar fences are not permitted. • A single fence is permitted between adjacent lots sharing a common property line. • Fences are not permitted in the front yard and must tie into the structure at the back corners

of the dwelling. Under no circumstances may a homeowner erect a fence outside of the property line. In the event of an obstacle, the homeowner must shift the fence inside the boundary line of the lot.

• Fences on corner lots must be installed so the fence does not extend past the outside corner of the building making it visible from the street in front of the home.

• Fence finishes may be one of the following: 1)unstained. 2) stained with a transparent, clear (uncolored) stain. or 3) stained with Porter/ Pg Sun Proof Stain- "New Bark" (or approved equal). If a stain other than Porter stain is submitted as an approved equal, it must be substantially similar in all aspects to the Porter stain. including color and degree of transparency.

• Residents must accept responsibility in writing for maintenance of all landscape and property inside fenced area.

• Invisible fencing is not permitted in the front yard of a Lot, only in the backyard. Owners must get architectural approval prior to installation of invisible fencing, just as they would with any other exterior modification or addition.

• FENCING OF ANY SORT INSTALLED OR ALTERED WITHOUT ARC APPROVAL IS

NOT PERMITTED. RESIDENTS WILL BE REQUIRED TO IMMEDIATELY REMOVE ANY FENCE INSTALLED OR ALTERED WITHOUT THE WRITTEN APPROVAL OF THE ASSOCIATION.

2.10 Flagpoles, Flags

Flags and poles may not be attached or installed without the written approval of the Association using the required form attached to these guidelines.

• Freestanding flagpoles are not permitted anywhere on the property. • Any attached flagpole requires ARC approval prior to any flag being flown. • ARC approval is required for all flags (decorative, sports teams, etc.) except the US and

US Service flags. No ARC approval is needed for the following flags: American flag, Army, Navy, Air Force, Marine or Coast Guard.

• One decorative garden/ mini flag (approx. 12.5" x 18") may be placed within the front landscaping that directly borders the house; No ARC approval required.

2.11 Garbage Containers, Recycle Containers, Garbage

Garbage containers can be delivered to the curb 24 hours prior to collection and must be retrieved 24 hours after collection. Garbage containers must be stored in one of the following locations:

• Option 1--Place the containers inside your garage. • Option 2--Place the containers behind your home. • Option 3--Place the containers on the garage side of your home. There is an existing model

to this option located at 3229 Darlington Rd. It is an "L" shaped cement or paver pad with shrubs and/or bushes to shield the containers from view. If you choose to do the 3rd option, you must submit a form to the Architectural Committee for approval BEFORE beginning the project There is a list of suitable shrubbery that is specifically recommended for screening in our location and can be provided to you upon submittal of option 3.

2.12 Additional Landscaping

Additional landscaping must be approved using the standard Request for Architectural Approval form prior to the change unless it is within a three-foot radius of the home. Gardens are not permitted.

2.13 Home-Based Businesses Home-based businesses are permitted provided the following criteria are met:

• It is not evident that home-based business is being conducted. • No unusual traffic, other than normal residential traffic, is permitted. • Only removable signs are permitted on vehicles and said vehicles must be parked in the

garage or the signs may be required to be removed while in the community. • Commercial vehicles too large for a garage must be parked in the driveway. • No vehicle larger than a pickup truck or standard van (not to exceed 10,000 GVW) is

permitted.

2.14 Hot Tubs, Spas, Saunas Hot tubs and spas are permitted using the standard ARC request form for approval prior to

installation. These items must be located in the rear of the residence screened from view of the street and neighboring properties. Owners are required to install safety features

such as locks or covers and comply with all applicable state and local codes. Saunas are not permitted.

2.15 Mailboxes

Only the original black mailbox, with black ornamental base is permitted. If replacement or repair is required, the mailbox must be restored to the original design specification. The residence address must be clearly visible on the mailbox.

2.16 Outdoor Furniture

No furniture shall be used, stored or kept on the exterior of any residence except on porches. patios, and decks. Furniture not enclosed in a room shall be limited to such types as is designed for outdoor use. Up to two small planters are permitted on the front porch and must be tasteful and contain live plants. Board reserves the right to discretion.

2.17 Parking, Recreational Vehicles, Campers, Boats, Trailers

No vehicle, including recreational, camper, boat, trailer, car or truck, will be parked on the grass or sidewalk of any lot. Except for occasional overflow parking, curbside parking is not permitted. Recreational vehicles, campers, boats and trailers must be kept in the garage except temporarily in preparation for use or repair, if such period does not exceed 48 hours.

2.18 Pets

Each residence is permitted a total combination of three dogs or cats, provided the owner maintains control at all times. Pets must be on a leash, or restrained at all times.

Animal nuisance of any kind will not be tolerated, including noise and improper waste disposal. While outside the confines of the owner's property, animal waste will immediately be collected by the owner and disposed of in an approved waste receptacle. For disease prevention and sanitary reasons violators will be subject to aggressive penalties, including fines, by the Board.

Other than normal household pets, no other animals, livestock or poultry of any kind shall be raised, bred or kept on the properties. Dogs, cats or other normal household pets may be kept in homes provided that such pets are not kept, bred or maintained for any commercial purpose.

2.19 Roofs & Roof Accessories When replacing a roof, it is preferred that the new roof be identical to the one currently on the residence. If an upgrade is desired, the roof shall be similar in color to the original roof while keeping in character and with the demeanor of the whole neighborhood. The roof shall adhere to the City of Charlotte building codes and an ARC request form must be submitted for approval.

Modification to a rooftop requires an approved Request for Architectural Approval form prior to modification even if the roof is the same color and product that is currently on the roof. The ARC request must contain documentation on both the old and the proposed roof materials. Attached to the request must be a sample of both roofing materials or a photo of them. Approved rooftop accessories or equipment must match the existing roof colors, compliment the residence, and be as inconspicuous as possible. The following restrictions must also be met:

Exposed flashing, gutters and down spouts must match the existing color scheme of the residence.

• Skylights shall not exceed 3' x 5' in size and shall be mounted on the backside of the roof so as not to be seen from the street.

• Solar energy equipment will have the appearance of a skylight, have finished trim, and shall not be visible from the street.

2.20 Signs

No signs of any type or kind shall be erected, placed or permitted to remain on any residence, lot or common area except

• A single "For Sale" or "For Rent" sign which shall not exceed 2' x 3' in size. • Such permits as required by legal/government agencies. • Official community events as approved by the Board. • A security system warning sign. not to exceed 6"x6" in size. may be displayed at the

entrance to the residence.

2.21 Storage Sheds, Accessory Buildings Utility buildings and/or storage sheds are not permitted on the property.

2.22 Storm Doors

Storms doors are permitted using the standard Request for Architectural Approval form. They must be full-view glass or glass/screen and must match the existing facade color scheme. Door hardware must also match the existing hardware (brass handle for brass lights, etc.) Examples of pre-approved doors are:- Larson Model - Signature, Secure Elegance or Williamsburg Series or -Anderson Model -2000, 3000 or 4000 Series

2.23 Window Air Conditioners Window air conditioning units and window fans are not permitted.

2.24 Window Boxes, Planters The Association must approve window boxes and planters and the following restrictions apply: • They are of a color and material complimentary to the residence exterior and shall be

maintained in a neat and attractive manner. • Statues and figurine planters are not permitted in the front yard. • Dead and diseased plants and all weeds shall be promptly removed.

2.25 Yard Maintenance • Residents are not permitted to install, maintain, or erect anything on the landscape of the property that will

impede or interfere with maintenance of the landscape. Residents who wish to alter the landscape of their property must obtain written approval for the changes prior to making them and will then assume responsibility in writing for the maintenance of those changes made. If the resident does not maintain the changes as agreed, the Association will then remove the changes and restore the property to its original condition.

2.26Trees and Tree Trimming

• Trees on homeowner property should be maintained in a healthy condition. Trimming of these trees should be performed in accordance with Charlotte's Land Development Services Basic Pruning Standards. Trees should be allowed to grow to their natural height & form & they should not be topped off. In addition it states that any person owning or occupying real property bordering on any street where trees have branches, limbs, trunks, or other parts projecting into the public street or property shall prune such trees and keep them trimmed in such a manner that they will not obstruct or shade the streetlights, obstruct or interfere with the passage of pedestrians on sidewalks, obstruct vision of traffic signs, or obstruct views of any street or alley.

• Trimming that does not comply with the Basic Pruning Standards or that causes injury or damage to the tree(s) may result in penalties and/ or fines imposed by the HOA. If the damage is severe, the homeowner may be required to remove & replace the tree(s) at homeowner's expense.

• Please see attachment 3.5 (two pages) to view approved trimming standards.

2.27 Replacement of Original Oak Trees • Original oak trees that were planted in the front yards in Matthews Ridge may be removed and replaced in

accordance with the following conditions: o The change is submitted for approval and approved by the HOA Board prior to the start of the project.

There is a special approval form which is on page 12. o The new tree must be in the same general location in the yard as the old tree. o If the homeowner removes the original oak or it dies, it must be replaced by one of the following trees

at the homeowner’s expense. The same type oak tree (Willow Oak – Quercus phellos) that was there originally. American Hornbeam (Carpinus caroliniana) Eastern Redbud (Cercis canadensis) Trident Maple (Acer buergeranum) Black Tupelo (Nyssa Sylvatica)

o The homeowner is responsible for the removal of the old tree including grinding the stump. Any roots that would prevent the replacement tree from thriving will need to be removed as well.

o The trunk of the new tree must be no less than 2 inches in diameter with a burlap covered root ball.

2.28 Backup Electric Generators • External backup generators that are permanently installed are not allowed in Matthews Ridge. After careful

review of placement guidelines from independent sources as well as the information provided by the manufacturers, it is clear that these devices cannot be safely installed in our neighborhood given the configuration of the houses and the size of the lots. The required placement guidelines address inherent issues such as asphyxiation from the production of carbon monoxide and fire risk of placing the device too close to flammable materials such as vinyl siding.

Picket Fence Arch up

A 4 -foot high fence with 1" x 4" pickets and either 4" or 6" posts. Pickets swoop up toward the center (center height is 4' 8") for the fence section. Each fence section is either 8-or10-feet long. Pickets are intended to be flush with spacing up to 2 Y.". A 4" ball or Virginia Gothic headpiece for each post is required. Deviations should be addressed using the standard ARC request form.
