Statement to the RTC Regarding Stakeholder Meetings

We, The Upper South East Community Coalition, have been advised that further participation in RTC

stakeholder meetings can be construed by the Army Corps of Engineers as support for the South East

Connector. We are total opposed to the road and do not wish to see it built. We will cease to attend

RTC stakeholder meetings until such time as the RTC files for its 404 Permit from the Army Corps of

Engineers and our consulting group advises us to begin attending again. Upon the filing of the permit,

we will review the NEPA process and determine the appropriate time to re-engage in the stakeholder

meetings.

SouthEast Connector Stakeholders Team Meeting Tuesday, April 26, 2011, 6:30 p.m.

I. INTRODUCTIONS

DRAFT OF MINUTES

Garth Oksol welcomed everyone to the Stakeholders Team Meeting. Attendees introduced themselves, which included:

Mr. Oksol reported that the meeting would be recorded and summary minutes of the meeting would be provided.

Mr. Oksol invited Rick Odynski to speak. Mr. Odynski stated that the Upper Southeast Homeowners Coalition was advised that further participation in the RTC Stakeholders Team meetings could be construed by the Army Corps of Engineers (Corps) as "supporting" the South East Connector project. He stated that the Coalition is totally opposed to the road and does not wish to see it built. He stated that Coalition members would cease to attend the RTC Stakeholders meetings until such time as the RTC files for its 404 Permit and the Corps and consulting group advises the Coalition to begin attending the meetings again. He stated that upon filing of the Permit, the Coalition will review the National Environmental Policy Act (NEPA) process and determine the appropriate time to reengage in participation. He thanked Mr. Oksol for allowing him to attend.

Michael Dubois, President of the Rosewood Lakes Homeowners Association (RLHOA), stated that the RLHOA was advised by the Upper Southeast Homeowners Coalition that further participation in the RTC Stakeholders Team meetings could be construed by the Corps as "supporting" the SouthEast Connector project. He stated that he is speaking on behalf of himself, Jim Busey and Michael Parks; the RLHOA is totally opposed to the road and does not wish to see it built. He stated that as RLHOA representatives, they would cease to attend the RTC Stakeholders meetings until such time as the RTC files for its 404 Permit and the Corps

and consulting group advises the RLHOA to begin attending the meetings again. He stated tl1at upon filing of the Permit, the RLHOA will review the National Environmental Policy Act (NEPA) process and determine the appropriate time to reengage in participation. He thanked Mr. Oksol for allowing him to participate.

Terri Thomas, Eastside Subdivision Representative, stated that it appears likely to her that the RTC plans to use her participation as proof that the Eastside (Subdivision) is acquiescing to the roadway, which is most definitely not the case. She stated that Eastside has been opposed to the project from the beginning, whether it was called the Tahoe-Pyramid Link, the SouthEast Connector or Veteran's Parkway or any other name. She stated for these reasons, as the representative for the Eastside Subdivision, she will not be participating in these meetings. She reiterated that the Eastside Subdivision opposed any road to be constructed through Rosewood Lakes Golf Course, the surrounding wetlands or Steamboat Creek. She stated that if advised by her neighbors in the Eastside Subdivision to reengage in participation, she will.

Marge Frandsen, Hidden Valley Homeowners Association (HVHOA), stated that HVHOA is part of the Upper South East Community Coalition, and stated that they have opposed the alignment for more years than she can count and continue to oppose it; however, the HVHOA feels it is in its best interest to "stay at the table and to participate". She added that even though HVHOA is in empathy with the other HOAs and Coalitions, HVHOA will remain at the table.

Roger Jewett stated that he was present to represent Tom Judy, who could not be present.

Mr. Oksol thanked all of the speakers.

Ill. GREEN ROADS

Mr. Oksol reported that some information on Green Roads was presented at the last meeting and invited questions.

Lori Wray referred to the handouts and asked how interested RTC is in turning the SouthEast Connector into a Green Road. Mr. Oksol stated that RTC is very interested. He has requested that Staniec Consulting (project design consultant) and T.Y. Lin (bridge consultant) begin to get up to speed on the concept because early documentation will be required. He added that he notified RTC directors that there is a cost associated with the process based on the size of the project. He stated that RTC as a whole is examining becoming a Certified Green Roads Agency.

Ms. Wray referred to "pavement technologies" and stated she is very interested in the concept of "quiet pavement".

Valerie Anderson asked at what point the Green Roads application would begin. Mr. Oksol stated he is unsure but his gut instinct is that it would occur after the NEPA process. He stated that he is also unsure whether the process is a continual process or if the application is to be submitted at one rime. He offered to explore the issue. Ms. Anderson encouraged Mr. Oksol to do so and added that she especially liked all the environmental management aspects.

Mr. Jewett referred to the reference to "reduced costs" related to Green Roads and asked if that has been proven. Mr. Oksol stated yes and no and added that there is an application fee (that he believed was approximately $25,000). He added that use of recycled materials and the opposition to hauling materials long distances (exporting or importing) result in reduced upfront

costs. He stated another cost reduction would be realized based on the long-term maintenance of the road (rather than allowing it to deteriorate to the point of replacement).

Mr. Jewett asked if the total cost of a Green Roads project would be less. Mr. Oksol stated potentially yes.

IV. OLD BUSINESS a. 30 million cubic feet of embankment b. Photo simulation to show more vehicles

i. Next iteration of photo simulations

Mr. Oksol next referred to the "Photo Simulations" and offered to include more vehicles (including trucks) in the next computer-generated photo simulations (as requested by Mr. Crivelli previously). He stated that RTC might try to limit trucks to provide a more scenic road.

Mr. Jewett stated that when the roundabout was added from Geiger Grade, it was presented to the Southeast Truckee Meadows Citizens Advisory Board (CAB), which was told that trucks would not be allowed. He asked if that would be the case for the north end. Mr. Oksol stated he had not heard that trucks were not allowed. He offered to ask Blaine, RTC Project Manager, who provided the presentation to the CAB.

Mr. Oksol referred to the "30 million cubic feet", which was discussed a couple months ago. He reported that in looking at the area between Alexander Lake Road and Mira Loma (roughly one mile), the fill volume is very small because it is on the hillside. He stated that the other numbers earth-wise are very low, only about 9 to 10 feet high, which will reduce the fill volume. He stated that Stantec is currently working on the earthwork balance for the flood model.

Mr. Oksol stated that he has the numbers for direct and indirect impacts to the Waters of the U.S. He added that in the next couple of weeks, the determination of earthwork volume will be finalized.

Mr. Crivelli stated he still wants to see the calculations of how the mitigation numbers were determined. Mr. Oksol agreed to ask Trina Magoon, Staniec, for the information. He stated that his current information is based on the flood model. Mr. Crivelli stated that he has spoken with Paul Urban but he did not have all the information. Mr. Oksol agreed and stated that Stantec is working on the final touches for the flood model.

Mr. Jewett stated that previously a request was made for updated traffic volumes but he has not seen them. He added that every day last week, he visited the areas of McCarran, Pembroke and Mira Loma at 8:30 a.m. and 9:30 a.m. and did not see high traffic numbers. He suggested that traffic volumes have decreased from the projections. Mr. Oksol stated that Jessica Sferrazza requested the numbers as well. He added that the information would be posted on the website soon.

Ms. Anderson stated that David Von Seggern developed a map that he would provide at Earth Day. She stated she is still unsure of the planned roadway alignment. Mr. Oksol stated that on the south end the road would be tied in at the intersection of South Meadows and Veterans Parkway. Mr. Jewett stated there is a signal at the intersection currently and added that the road would go over the white top marsh.

Ms. Frandsen asked what impact the road would have on flooding on the backside of Hidden Valley. Mr. Oksol referred to maps showing the alignment.

Ms. Wray referred to the letter from Mr. Oksol regarding the Truckee River Flood Management Authority (TRFMA) Project, which showed a map including a park and asked about the status. Mr. Jewett stated that when he was recently in the area, the area was covered with water. Mr. Oksol referred to the conceptual map of the area. He clarified that other than Steamboat Creek, the project does not touch any other open Waters of the U.S. He stated that the TRFMA included a park in their Locally Preferred Plan (LPP) to provide storage area for a dam (that might not be included at this point).

Mr. Crivelli clarified that the park was planned as a detention area from South Meadows, which was abandoned. He stated that the cost is prohibitive based on the cost to benefit ratio.

Mr. Oksol referred to images of the realigned Steamboat Creek. Ms. Anderson stated she would like to see Alexander Lake retained. Members discussed land ownership, alignments and parks as shown on maps. Members agreed that Damonte Ranch is a good example of successfully restored wetlands.

Mr. Jewett stated that water velocities would be increased coming into Hidden Valley. Mr. Oksol referred to the area where Truckee River backwater stopped and flooding in Steamboat Creek began during the 1997 flood event. He summarized that most of the flooding was a result of the Truckee River. Mr. Jewett disagreed and stated he was watching Rosewood Lakes where water was flushing in from both bridges and had nowhere to go.

Mr. Oksol continued to refer to maps and figures. Mr. Crivelli mentioned access points. Mr. Oksol stated that access points are limited; however, when City of Reno takes over the project, that could change.

Mr. Jewett referred to a map showing homes in the Rosewood Lakes area and stated that a walking trail behind the homes was turned over to City of Reno for maintenance years ago; however, nobody is taking care of it. He added that without maintenance, the same problem would occur with the SEC project. Mr. Oksol mentioned the suggestion of adoption of segments of trails or creeks for maintenance. Discussion ensued over the abandoned Rosewood trail and lack of maintenance. Mr. Jewett asked if the new trail system would connect to the Rosewood trail. Mr. Oksol stated this is the first he'd heard of the path so a new one would be constructed.

Ms. Anderson suggested the path might be better located away from the road. Mr. Oksol stated that the location would be determined in final design. He showed rights of way that could be maintained as open space. He reported on white top mitigation areas. Ms. Frandsen suggested that Mr. Oksol contact Dr. Sue Donaldson at the Cooperative Extension. Mr. Oksol stated that he is working with Mae Gustin, Tom Leonard, GBI and Tom Skordal on the issues. He added that the SEC Resource Team is following the issue closely and offered to add Ms. Frandsen to the correspondence list. He stated that an RTC SEC open house would be scheduled probably in June. He offered to make contact with Or. Donaldson.

Mr. Jewett asked about "sacred sites". Mr. Oksol stated that a cultural resource investigation was conducted.

Members discussed impacts to Waters of the U.S. and wetlands. Mr. Jewett asked about the Hidden Meadows Pond. Mr. Oksol explained that although the alignment was revised to avoid the pond, he had offered to work with homeowners if requested since RTC would have equipment in the area (which could save money).

Ms. Anderson asked about open space next to the road or creek. Mr. Oksol mentioned that the challenge would be long-term maintenance. He stated that RTC is doing more than required related to wetland mitigation and recreation; however, long-term maintenance would have to be provided by someone. He added that the local governmental entities are experiencing decreased budgets resulting in no appetite to take on the responsibility. He stated that a good suggestion was made the previous day to schedule a meeting of the representatives of the parks and recreation departments to discuss maintenance down the road.

Mr. Oksol suggested that members of the Stakeholders Team could express interest or support of the linear greenway over simply a grass ditch. Ms. Frandsen stated it makes a lot of sense; however, if government assumes responsibility, revenue will be needed for maintenance which the public would probably see as additional citizen costs. Mr. Oksol agreed and stated that homeowners would oppose a special assessment district because it would be a regional benefit when the project is completed. Ms. Frandsen stated that based on the current economic situation, the road might not even be needed 14 or 15 years from now.

Mr. Oksol stated that in speaking with Ralph Walker, representative of Hidden Valley HOA, he stated that 90% of the residents no longer want to see the pond mitigated into wetlands or a park. He added that they would like the smell to be mitigated. Mr. Jewett stated if that is the direction from the HOA, the issue should be dropped from further consideration, with which Mr. Oksol agreed.

Ms. Anderson asked when this becomes a "scenic by-way" if there would be other money available for maintenance. Mr. Oksol stated that he believes that in building the walkways and trails, funding for construction will most likely not be an issue; however, he reiterated that long­term maintenance would be. He added that it might be a good opportunity for UNR to utilize and maintain the area for research projects.

Ms. Frandsen asked how many acres are anticipated for purchase of UNR property. Mr. Oksol stated he would have to get back to her with an answer because no final determination has been made. Ms. Anderson stated that she believes UNR Farms should remain open space. Mr. Oksol stated that under the Corps permit, the mitigation area must remain open.

Members discussed the floodway and where flooding occurred during the 1997 flood.

Mr. Oksol reported that T.Y. Lin was selected as the bridge design contractor and negotiations are underway. Ms. Frandsen mentioned the fault line, which Mr. Oksol stated was recently discovered and is being tested (electrical resistivity). Mr. Jewett asked if the bridge would be built per seismic standards. Mr. Oksol stated it would be and added that the total project cost

estimate is approximately $167 million. Mr. Jewett asked if nationwide average costs would be considered in RTC's estimate.

Ms. Frandsen reiterated that she would like to see updated traffic counts from RTC.

Road elevations were discussed. Mr. Oksol explained that elevations were designed to meet codes and standards to prevent flooding.

Ms. Frandsen asked if the project includes Heron's Landing pond. Mr. Oksol stated it is not part of the project. Mr. Jewett stated he did not understand why the effluent line that feeds the pond was not opened to feed the wetlands. Mr. Oksol explained that Nevada Division of Environmental Protection (NDEP) does not currently allow use of effluent water for wetlands. He added that he hopes to partner with City of Reno to work with NDEP to revise the ordinance. Mr. Jewett asked where water currently discharges. Mr. Oksol stated that City of Reno has a discharge permit to Steamboat Creek. Ms. Anderson stated that Heron's Landing wetland mitigation is a good example of a failure; it started off very well but eventually failed.

Ms. Anderson asked about previously mitigated areas. Mr. Oksol stated that clear maps of the mitigated areas are not available due to the age. He stated that concern over mitigating previously mitigated wetlands will not be an issue based on the best available information. He referred to tables showing the direct impact to wetlands, which has been decreased to 5.61 acres (and is expected to further decrease). He next referred to a table showing indirect wetland impacts (most of which occur from shading).

Ms. Frandsen stated that there is a lot of information available on Steamboat Creek restoration from the past. Mr. Oksol stated that he met with planners in the past, including Mahmood Azad, formerly of City of Reno. He added that Washoe-Storey Conservation District is also very interested in the creek restoration.

Mr. Crivelli referred to the table showing the direct impacts to the wetlands and stated that the numbers should reflect the wetlands that are being encroached (in addition to the directly impacted acre[s]). Mr. Oksol requested that Mr. Crivelli prepare a comment to the Corps addressing the wetland impact issue for the public process.

Mr. Jewett asked Ms. Wray how Scenic Nevada feels about the roadway going through Rosewood Golf Course. Ms. Wray stated that Scenic Nevada was opposed to the road; however, they are now trying to "make lemonade out of lemons". She stated that if the roadway is to move forward, Scenic Nevada wants to participate to identify as many community benefits and opportunities as possible.

Ms. Wray mentioned that the entire area of discussion has been impacted by development and asked if road builders should be held to a higher standard than developers. She commended Mr. Oksol and RTC for designing a lower impact project with amenities and reiterated that Scenic Nevada will continue to participate to ensure a beneficial project.

Mr. Crivelli reiterated his comment about one versus ten acres of impacted wetlands (based on only using one acre that would affect the surrounding wetlands). Mr. Oksol stated that could be a comment received from the Corps. Ms. Wray asked if any of the developments encroached on wetlands. Ms. Frandsen stated that Donner Springs and Huffaker were previously marshlands. She added that Hidden Valley is not but Rosewood Lakes was questionable. Mr. Crivelli mentioned that in South Reno wetlands were filled prior to development, for which developers received a "slap on the wrist".

Ms. Frandsen agreed with Ms. Wray and Ms. Anderson that if the project is going to move forward, she and some other homeowners want to participate and provide input. She stated that Hidden Valley would be impacted by air quality and noise.

Mr. Oksol stated that he understands where the homeowners are coming from and appreciates their participation in the process.

Mr. Oksol referred to photos of flood channels and restoration projects that have been successful in other areas of the Truckee Meadows. Ms. Anderson stated that she sees a need for preserving some areas with a fence or partition between the trails and wetlands. Mr. Jewett cautioned about the need for ongoing maintenance to prevent the spread of white top.

VI. NEXT MEETING: TBD

Mr. Oksol asked for input on the next meeting date and whether it should be scheduled after submittal of the permit application to the Corps.

Mr. Crivelli stated he would like to hear future agenda items, such as aesthetics, noise abatement, air pollution mitigation and "traffic volume revisited" (specifically on Pembroke, Mira Loma and Rio Poco). Mr. Oksol requested that Mr. Crivelli email him a list of the items for future discussion. Ms. Anderson stated that many of those issues are addressed under the topic of Green Roads.

Ms. Frandsen mentioned the issue of "dark skies". Mr. Oksol stated that RTC is now starting to use LED lights. He stated that the intersection of Mill and Terminal includes the LED lights in addition to other areas.

Mr. Jewett suggested perhaps scheduling a May meeting following the Corps submittal. Mr. Oksol offered to check on an acceptable date for the next meeting. He stated that the next meeting would focus on aesthetics. Ms. Frandsen suggested that Danielle Henderson be invited. Mr. Oksol stated she is included on the distribution list.

Mr. Oksol agreed to invite Stakeholders Team attendees to the Resource Team meetings.

Mr. Crivelli stated for the record that he was only representing himself at these meetings.
