Newsletter 2018-35 August 31, 2018 ROGER HANSHAW ELECTED HOUSE SPEAKER Del. Roger Hanshaw (R), 62nd District was elected Speaker of the West Virginia House of Delegates by a vote of 62 to 34. Hanshaw was nominated by the majority party after a meeting of the party’s caucus. Minority Leader Tim Miley from the 48 th District, won the nomination of the minority caucus and received 34 votes. Hanshaw, 38, was first elected to the House in 2014. He’s a lawyer with the Bowles, Rice firm, focusing on environmental and technical issues in business transactions, as well as regulatory compliance matters. He also has a Ph.D. in chemistry and is a certified professional parliamentarian. Hanshaw has been involved in several high-profile legislative activities even as the body has been outside its regular session. He is a member of the PEIA Task Force, which is still in the process of determining the shape of insurance plans for public employees, as well as how to pay for the plans. Hanshaw is co-chairman of the Legislature’s Committee on Flooding, which has been swept into a controversy over why state government has lagged on spending an available $150 million in federal grant. HUB/PAC, the CAWV’s political action committee, has supported Speaker Hanshaw in both of his elections to the House of Delegates and is endorsing him in this year’s race. JENKINS, ARMSTEAD APPOINTED TO SUPREME COURT VACANCIES Gov. Jim Justice this week appointed West Virginia House Speaker Tim Armstead and Congressman Evan Jenkins to the West Virginia Supreme Court of Appeals. The appointments will last until a November special election is held to fill the remainder of the terms and follow controversy that has surrounded the state’s high court, leading to impeachments, resignations and federal charges. Armstead and Jenkins were among the names listed by the Judicial Vacancy Advisory Commission as potential appointees to hold the court over until the special elections. Aside from Armstead and Jenkins, 18 others have filed to run for the two unexpired terms. DUES REVIEW TASK FORCE FORMED CAWV President Roger Thomas has appointed a task force to review the CAWV’s membership dues. CAWV Treasurer Nate Orders will chair the group which has already met to begin its review of the association’s current dues structure. “It has been nearly 15 years since the last dues increase,” said Treasurer Orders. “The CAWV has been effective in increasing member services and benefits without raising dues but a lot has changed in the organization and industry since 2003. The CAWV Strategic Plan calls for the association to become more involved with workforce development and, even though the CAWV was successful in getting a record-setting highway funding program through the West Virginia Legislature, we will continue to advocate for increased investment in schools, water and sewer facilities, airports, dams and other

infrastructure projects. Both goals will require a significant amount of resources from the association,” he said. Task force members are looking at dues schedules for contractor associations in surrounding states. They are also looking at various scenarios relating to the current volume dues formula and limits. The task force will make its recommendations to the full CAWV Board of Directors at its next meeting. CONSTRUCTION MAY RESUME ON MOUNTAIN VALLEY PIPELINE Work on Mountain Valley Pipeline has been authorized to resume, less than a month after a federal order halted the project. Pipeline developers stated that they expect construction to start up again soon and that MVP would bring back workers whose duties had been suspended. The Federal Energy Regulatory Commission issued a letter on Wednesday, giving the go-ahead to resume pipeline construction. On August 4, the same agency ordered a stop to construction in response to an order by the Fourth U.S. Circuit Court of Appeals. Environmental groups have challenged approvals by the U.S. Forest Service and the Bureau of Land Management over a 3.6-mile segment of the pipeline’s route through the national forest. The environmental groups questioned whether the plans for pipeline construction adequately control erosion and sediment. In the decision announced Wednesday, FERC cited a recent analysis by the Bureau of Land Management concluding that the route through the Jefferson National Forest is the best of several alternatives. The $3.5 billion Mountain Valley Pipeline would extend 42-inch diameter natural gas pipeline over 303 miles to transport West Virginia natural gas into southern Virginia. and would go through Wetzel, Harrison, Doddridge, Lewis, Braxton, Webster, Nicholas, Greenbrier, Fayette, Summers, and Monroe counties. AGC SURVEY RESULTS ON CONSTRUCTION WORKFORCE Eighty percent of construction firms report they are having a hard time filling hourly craft positions that represent the bulk of the construction workforce, according to the results of an industry-wide survey released today by Autodesk and the Associated General Contractors (AGC) of America. Association officials said shortages pose a significant risk to future economic growth and they released a new workforce development plan to solve the growing problem. “Labor shortages in the construction industry remain significant and widespread,” said Ken Simonson, AGC’s chief economist. “The best way to encourage continued economic growth, make it easier to rebuild aging infrastructure and place more young adults into high-paying careers is to address construction workforce shortages.” Of the more than 2,500 survey respondents, 80 percent said they are having difficulty filling hourly craft positions, Simonson noted. Craft worker shortages are severe in all four regions of the country, with 81 percent of contractors in the West and South reporting a hard time filling hourly craft positions, almost identical to the 80 percent rate in the Midwest and 77 percent rate in the Northeast. The labor shortages come as demand for construction continues to grow. Simonson noted that construction employment expanded between July 2017 and July 2018 in 281 out of 358 metro areas that the association tracks—more than three out of four—according to a new analysis of federal construction employment data the association also released. Growing demand for construction workers helps explain why 81 percent of firms report it will continue to be hard, or get harder, to find hourly craft workers this year.

SEPTEMBER IS NATIONAL PREPAREDNESS MONTH

An emergency can happen anytime, anywhere. September is National Preparedness Month and we would like to share some important information about business preparation in a potential emergency situation. The Centers for Disease Control and Prevention, along with sponsorship from the Federal Emergency Management Agency, have developed an extensive library with emergency preparedness tips for the workplace, as well as at home and school. This information highlights four easy steps to being prepared in any situation. They are:

• Get a kit • Make a plan • Be informed • Get involved

An emergency kit contains basic items, and should be equipped to last for at least 24 hours at the workplace. Some basic items to include in this kit are:

• Several gallons of water • Non-perishable food items • First-aid kit • Flashlight and batteries • Medications

Step two, making a plan, is equally as important as creating a kit. Details to include can be as simple as where employees should go and how to be accounted for. A preparedness policy also should be written and distributed so information is thoroughly communicated to all employees. ($ Amounts in Millions) DOT ANNOUNCES $616.9M IN GRANTS TO AIRPORTS IN 45 STATES West Virginia will receive grants for 16 airport projects totaling over $25.9 million according to U.S. Department of Transportation Secretary Elaine L. Chao. USDOT recently announced the Federal Aviation Administration (FAA) will award $616.9 million in airport infrastructure grants, as part of the total $3.18 billion in Airport Improvement Program (AIP) funding for airports across the United States. This fourth increment of funding provides 242 grants to 226 airports and will fund 408 infrastructure projects. These include runways, taxiways, aprons, terminals, aircraft rescue and firefighting vehicles, snow removal equipment and two firefighting training facilities. WVDOH RELEASES AGENDA FOR NEXT MP COMMITTEE MEETING - SEPTEMBER 13; REMINDER - TECHNICAL PUBLICATIONS COMMITTEE SEPTEMBER 19 The WVDOH has released the agenda and handouts for their September 13, Materials Procedures (MP) Committee meeting, which will be held 1:00 P.M. at MCS&T Division in Charleston. The meeting is open to all interested persons and written comments are due by September 6th. THIRD SET OF 2018 CAWV/WVDOH TECHNICIAN AND INSPECTOR COURSES ADDED The CAWV is pleased to announce that due to demand a third set of Technician Certification Training Courses has been added to the training schedule. The courses, which are offered annually to help individuals prepare for WVDOH certification examinations required under their Quality Assurance Program, have seen greater demand this year due to the passage of the “Roads to Prosperity Bond Amendment”. Thousands of individuals have attended courses in Compaction, Aggregates, Asphalt and Portland Cement Concrete over the last several years. Test comparisons prove that those persons who attend the CAWV/WVDOH courses have a higher success rate for passing the exams. * NEW FOR 2018: All certification testing has been moved to an online format that will require the attendee to have a laptop, tablet or iPad type device to take the test. The use of smart phones during the test is prohibited. CLASS TRAINING DATES Soil and Aggregate Compaction Inspector (see note below) September 24-28, 2018 This certification will only include soil and aggregate Inspector certification. If you need to test asphalt compaction, you will need to take the Asphalt Field Technician course.
