    SUMMARY OF EXPECTED TESTIMONY OFROBYN S. SHAPIRO,

    Robyn Shapiro is an attorney at law specializing in bioethics issues. She is a partner inthe law firm of Drinker Biddle Gardner Carton and has held academic positions regarding thestudy of bioethics, membership on government committees regarding health law issues,membership on American Bar Association committees regarding bioethics, and has authoredpublished articles regarding bioethical issues. She has been a board member of the AmericanSociety for Bioethics and Hum anities. Ms. Shapiro's educational background, work ex periences,memberships, publications, and other experiences and credentials are described in herCurriculum Vitae, a copy of which is attached. The testimony and opinions of Ms. Shapiro willbe based upon her educational background, w ork experiences, knowledge of the relevant medicalliterature, knowledge of bioethics issues, and review of the relevant records, documents, anddepositions in this case. Her opinions w ill be expressed to a reasonable degree of certainty.

    Ms. Shapiro will testify about the professional field known as "bioethics." She willexplain that bioethics specialists come from a variety of backgrounds, including philosophy,medicine, law, sociology, religion, and others. She will explain that no accreditation is requiredof those who hold themselves out as bioethics specialists.Ms. Shap iro will testify about the claim s that have been asserted against the University ofMinnesota IRB in this lawsuit. She will testify in opposition to any testimony or evidencesuggesting that the University of Minnesota IRB was negligent with regard to the CAFE Study.Ms. Shapiro w ill testify that the Un iversity of M innesota IRB acted reasonably and in conformitywith the requirements of federal law when it reviewed, approved, monitored, and took actionsregarding the CAFE Study at the University of Minnesota. Also, Ms. Shapiro will disagree withany testimony from plaintiff s experts, including but not limited to Paul R. Wolpe, Ph.D.,suggesting that the University of Minnesota and/or the Un iversity of M innesota IRB violated anybioethical standard of care or principles of bioethics.Ms. Shapiro w ill testify that the University of M innesota IRB w as properly constituted inaccordance with the requirements of federal law, and the IRB used proper procedures forreviewing the application and supporting documents for requesting approval to use humansubjects in the CAFE Study at the University of Minnesota. She will also testify that with regardto the CAFE Study the consent document approved by the University of Minnesota IRBcomplied with the m andates and requirements of federal law.Ms. Shapiro will testify that it is not usual or customary practice for an IRB to mandatethat consent from a potential human research subject be obtained by someone other than thatperson's treating physician. She will testify that although there have been some writingssuggesting this procedure as an available approach that can be used, federal law does notmandate such an approach when a principal investigator is a treating physician of a potentialhuman research subject, and it is not customary practice for an IRB to mandate that someoneother than the PI obtain informed consent in these circumstances.

    Ms. Shapiro w ill testify that the processes used at thc University of Minnesota and. by theUniversity of Minnesota IRB regarding potential conflicts of interest were reasonable, compliantwith federal regulations, and compliant with the usual and customary standards of similarorganizations. She will point out that all faculty members are required to make self-disclosures,and she will state that this is a reasonable and appropriate procedure. She will testify that the useof a "conflict management review committee" was a procedure that was over and above thecustomary and standard practices among IR& at that time. She will testify that the post-approval monitoring program utilized by the University of Minnesota IRB was as rigorous aprocess as used by other IRBs.

    Ms. Shapiro will testify that according to federal guidelines people arc presumed to becapable of providing informed consent. She will point out that in the CAF Study at theUniversity of Minnesota a competency evaluation procedure was used with regard to potentialhUm,an research subjects, She will testify that this was a very reasonable and . appropriateprocedure. Ms. Shapiro will point out that the CAFE Study did not involve the use of anyplacebos, but instead involved, the use . of three Medications which were available for use in theprivate sector in the care and treatment of patients with psychosis. Ms. Shapiro win testify thatthe University of Minnesota. IRB had a reasonable and app ropriate system in p lace for healthcareprofessionals involved in clinical research to report significant adverse events,

    Ms. Shapiro will testify about the Declaration of Helsinki. She wil,1 point out that theUnited States Government has never adopted the Declaration of Helsinki or incorporated theDeclaration of Helsin,ki into the federal regulations applicable to research involving humansubjects. She will testify that, as noted above, it is not customary for an IRB to mandate thatconsent from a potential. human research subject be obtained from some healthcare professionalother than that person's treating physician.Ms. Shapiro will testify about the concept of therapeutie misconception. She will testifythat the consent form used in the CAFE Study in November 2003 reasonably and adequatelyaddressed issues relating to possible therapeutic misconception. She will also explain that issuesrelating to possible therapeutic misconception are less concerning in a situation like the CAFEStudy since no placebo was used and the patient's dose of the study m edication coul,d be adjustedin response to the patient's symptom s and needs_Ms, Shapiro reserves the right to amend and/or supplement her opinions as moreinformation becomes available.
