Chapter 1 -Introduction  

1.1 Project Background and Objective

A.Introduction

A reconnaissance mission was conducted by ADB to Cambodia in December 2011, which was initiated after severe typhoons, devastated 18 of the country’s 24 Provinces in September and October 2011. MOU was issued by ADB in February 2012, which initiated the “Flood Damage Emergency Reconstruction Project” (FDERP) which is an emergency infrastructure restoration project in Cambodia. The objective of the FDERP program is to implement a number of reconstruction projects of provincial roads, rural roads and irrigation/flood control initiatives in the following 5 Provinces; Prey Veng, Kampong Cham, Siem Reap, Banteay Meanchey and Battambang. This report is the 15th monthly progress report for the MPWT Component’s main activities and progress during/and up through the month of April 2014. The 3.5 year emergency reconstruction project is co-funded between ADB and Australia Aid through and Emergency Assistance Loan (EAL) from early 2012. The initial budget of the project of $ 67.18 Mill was split three ways: i) ADB $55.0mill, ii) The Government of Australia: $5.25 and iii) The Government of Cambodia: $ 6.93 mill. The loan closing date is September 30, 2015. As a result of the storms in September & October 2013 a new set of Reconnaissance and Fact Finding Missions were conducted to the affected Northern Provinces. These Missions were the basis for further scope and the extension of the FDERP through the additional Financing Program; (FDERP-AF) with a Loan of 48.5 Million SDR signed on April 23. B.Background,ProjectDescription,ADBMissionsandAmendments

The overall FDERP project is managed by three Implementation Agencies (IA), which report to the Ministry of Finance and Economy, as the Program’s official Executive Agency (EA). The roles of these IAs are to monitor and manage each sector project on a regular basis in close cooperation with the relevant national and international resources. All Consultancy input at this time is in a construction supervision phase. “FDERP” was approved 2012, followed by an Agreement between RGC and ADB on April 4th 2012. The program became effective on May 14th 2012 to be implemented over 3.5 years. From the initial project scope per ADB’s February 2012 MOU, the program has been revised through various sub projects amendments.

Firstly, by ADB’s MOU after their mission in July 2012. Secondly in February 2013 through ADB’s MOU in February 2013 after a review mission

in January/February. Based on the MOU issued at the November-December Mission the last subproject CW7

was implemented. The scope, estimated procurement budgets and revisions of the program are shown in

Sections 1.1.1 through 1.1.3 below.

1.1.1 RecentMissions

A Joint Mid-term Review Mission4  for the FDERP was undertaken from 25 November to 13 December 2013 (findings per MTR 2 MOU). The Mission's main objectives were mainly to review the overall implementation progress, status of contract awards, disbursements, budget allocation and provisions for counterpart funds, utilization of imprest accounts, and utilization of loan proceeds under each loan category, procurement plan update; social/environment safeguards impacts; and status of compliance with loan covenants.

As a result of severe storms and floods during the months of September and October 2013, a Reconnaissance Mission was held from 16 December 2013 to 9 January 2014 to the Northern Provinces, in response to the Royal Government of Cambodia (RGC) request from the Minister of Economy and Finance dated 21 October 2013.

A further series of regional visits were conducted to prepare a more accurate and relevant technical and budgetary proposal for added support related to an extension of the FDERP. Hence, a “Fact Finding Mission” to the Northern Provinces was conducted between January 20th and 31st.

From this Mission detailed assessments were prepared which would include the scope of works, cost estimates and implementation plans, of the restoration required to be implemented through the new proposed subprojects. The assessments concentrated on reviewing flood damaged infrastructure in the most seriously affected 6 Provinces: Battambang, Banteay Meanchey, Oddar Meanchey, Siem Reap, Kampong Thom, and Kampong Cham). A proposed list of added projects under the MPWT Scope is enclosed in Table 8. The MoU from the Fact Finding Mission between RGC and ADB was signed on 21 February 2014, based on which the planning, design an procurement of the Additional Financing program continued. A special operation Loan Agreement # 3125-CAM (SF) to the amount of SDR 48.545 Million was signed on April 23.

1.1.2 Budgetsandsavings MPWT’s initial total budget for the original restoration of National and Provincail Roads and bridges amounts to $21.898 Million1. The loan contribution to the National & Provincial Roads is $ 19,622.493 and the grant to the works component (Component 1) is $ 2,276,500.0 The MTR MOU of December 2013 confirms that the savings of funds from the completed CW (Civil Works) contracts may be transferred to fund the extra works of FDERP (including repairs of damages from the 2013 floods). Such transfers will allow necessary variations to technical scope of Civil Contracts to be implemented. It is likely that such transfers will be required due to technical issues on project CW6 and CW8.

C.Projectsequenceandprogress The Consultancy input of planning and design of FDERP, started as early as January 2012, with EGIS International and VIDO/JV mobilizing a core design & Procurement team. This move allowed an early implementation of the Stage 2 contracts in May 2012. At the time of this report all three construction contracts under Stage 2 have been completed and handed over. Furthermore two bridge contracts in Prey Veng under stage 3 (CW4 and CW5) were completed in September and December 2013 respectively. In early 2013 MPWT’s Stage 3 construction projects was increased by another $4.4 mill, with the award of two additional construction contracts in Kampong Cham Province; i.e.: Construction of 10 structures along PR 270 in Kampong Cham Province (CW6b and CW6c). The 8.5 Km DBST road project in Kampong Cham (Contract CW6a) awarded in December 2012 was given an extension, through the addition of environment and drainage improvements, to be funded from the project’s savings. In September and October due to the heavy storms these projects in Kampong Cham slowed down to a point of “hold “for approximately 6-8 weeks. Contract CW8 is the only ICB Project under the MPWT’s component and the largest contract being implemented in Banteay Meanchey/Battamang Provinces. This was awarded in 3rd Quarter of 2013 to a Joint Venture of two national contractors. This 20 month contract was signed on September 30th. The main critical issues on this project are the removal and replacement of unsuitable soils and upgrading of drainage, which has been found to be extensive. Additional earthwork has caused a substantial increase in the contract, which will require additional funding. CW7 road Project in Kampong Cham is the last project under present scope of FDERP. This was awarded on 20 December 2013. Due to difficulties in finding sailable material, and as a result of general slow productivity this contract is presently behind schedule. The change to the overall program under FDERP has caused direct ripple effect on the scope, budget and supervision inputs both for of the Employer (MPWT) and the Consultant. The implications of such changes are reflected in the Consultant’s initial three Variation Orders. The last Variation Order #3, (Contract Amendment #2) received a NO objection by ADB on October 10th 2013 and signed on November 8th 2013 to a total amount of $485,871.42. A further VO (VO #4) was received by MPWT &PCMU a result of added tasks pending the approval of the additional funds and scope as a result of the January Fact Finding Mission and a PRC meeting conducted on March 31, awaiting ADB’s No Objection. A draft V.O #5 was issued by the consultant on April 10. The scope and TOR were discussed with MPWT and PCMU on April 29, when it was agreed to update as VO AF-1 to include a reviewed man-power input to meet the procurement limit of $2.5 consultancy cost. Original Scope of Works: As started above, the FDERP program required an early start. This was achieved by a fast track implementation and mobilization of the consultant’s planning and design team early 2012 with a contract signed in June.

The initial Stage 2 bridge contracts of Projects CW2 and CW3 in Prey Veng and Kampong Cham Provinces were Awarded by Direct Contracting in May 2012 and handed over to MPWT in March 2013. The first Stage 3 project: CW4 Bridge Project in Prey Veng was handed over as completed on September 20 followed by CW5 in Prey Veng which was completed on December 15 2013.

By the end of 1st Quarter of 2014, 5 out of 10 projects were already completed and under maintenance (defect liability), and the 6th project (CW6a) reach for handing over.

At the time of this report (April 2014), the Construction Contract for CW8 was signed on September 30th with accelerated site mobilization from mid- November. Earthwork and structure started slowly, but has improved after impact by MPWT and the Consultants frequent site visits and meetings with the top management of the JV. Variations to the Contract are in progress as a result of added work. The consultant’s RE for the final project (CW7) was approved and mobilized to site in early January. It is expected that subgrade work will be completed by July. Subsequent changes are shown in Section 1.1.2, which all resulting from donors’ missions and documented in the two MOUs and March 2014 Procurement regulations which define the revised project scope which is being followed today. These amendments have in turn had an impact on the Consultants’ work, both time wise, manpower input and in cost, which are documented in the three Variation Orders. Added works due to recent storms in September and October as identified in December and January is a basis for the consultants 4th VO, allowed added works under to added Funds program to proceed which the New Loan is under ratification.

1.1.2 Revised Scope of Works Per ADB Missions and MOUs of July 2012 , Jan/Feb 2013, Dec/13 and January 2014

The changes that were made to the projects in July 2012 MOU are shown in Tables 4 and 5 below. Revision #1 included 5 individual contracts for Stage 3. This was increased to a total 9 new projects in Revision #2.

Project CW6 was split from one project, divided into three individual contracts, two of which (CW6b and CW6c) represent the added 10 structures. The design of these structures was included in the Consultant’s VO#1, (approved September 2012), which included re alignment of existing sources only for no added cost.

VO #2 included two added contracts (i.e. CW6b and CW6c) which include the 10 new

structures on PR 270, which required added procurement input by the consultant. This variation was funded through the contingencies. (Approved on April 26).

At the Jan/Feb 2013 Mission it was also agreed to combine all 3 sections of project CW8 in one project. Due to its estimated cost this project was tendered through ICB as Contract CW8; on PR159 in Banteay Meanchey Refer Scope Revision #3 in Table 6.

This change resulted in an added consultancy input and also a major revision to the contract of CW8. The bids for CW8/ICB opened on July 2, 2013; The ICB-contract was signed on September 30th to the amount of $ 8.795 Mill and a construction period of 20 Months.

The various scope revisions over the last 12 months caused the Consultant’s 3rd Variation Order (Contract Amendment #2). ADB issued a No Objection on September 19th. The VO was signed on November 8, 2013, to an amount of $ 485,871.42.

Project CW7 was bid under NCB. The bids were opened on October 16th. A BER was submitted on November 13th. The contract was awarded on 13th December 2013 to the amount of $1.431 Mill.

A major change and addition to the original FDRP program is in progress as a result of the storms and devastations in September – October 2013. These are described in Section 1.1.1 above with the work scope of Stage 2 and 3 in Table 8.

At the time of this report, the consultant has prepared Bid Documents for the three direct contracts of stage 2 of the additional financing portion of FDERP-AF, expected to be awarded by the end of May. The consultant has started the initial steps of design and personnel mobilization, in parallel with resettlement categorization and hydrology studies. This will be another “fast track” exercise which is covered in a Contract Amendment and a 4th Variation Order. Two National Contractors were recommended to bid for the 3 Direct Contracts of Stage 2. The PRC’s recommendation of April 17was given No Objection by ADB on April 2014 and the contractors could proceed to price the bids in line with ADB’s Direct Contract Procurement Regulations.

The RGC has requested ADB for a supplementary loan from the Asian Development Fund (ADF), and for it to seek co-financiers from other development partners to help finance the Project. For the ADF source, the loan will have a 40-year term, including a grace period of 10 years, an interest rate of 1.0% per annum.

The revised procurement plan of March 2014 follows the scope of Scenarios and projects as listed in Table 8.

The Loan agreement for the additional financing of 48.545 Million SDR was signed on April 23, 2014.

Ratification of this loan is expected by mid April- 2014. Scenario 2 will encompass the Variations of V.O.#4, which was created to “borrow” existing manpower allotments already approved and a available per VO #3. VO #5 will follow through which the same person monthly will be retrieved.

The Loan for the Additional financing (Loan #3125-CAM/SF) will cover projects of three areas:

i). National and Provincial Roads ii). Rural Roads iii). Irrigation and Flood Management.

In as much as the loan was signed on April 23, it is expected to be fully verified and implemented by mid May 2014. The consultant’s VO#4 is a “zero cost” variation which only reallocated manpower months by temporary transferring funding from existing man months of FDERP to work in March and April on FDERP-AF.

These “borrowed” funds will be transferred back to FDERP input in the next VO: VO-AF.1 which will cover the person-months and associated funds for the entire period through 2017 completion.

There is, however, a limit to this VO, which is the $2.5 million budget for consultancy input, which, even percentage-wise to the construction budget is less than what is the case of FDERP.

Chapter2 –Executive Summary  

2.1. Progress Summary as of April 2014

Background and Objective; The “Flood Damage Emergency Reconstruction Project” (FDERP) is an emergency infrastructure restoration project which was initiated after an ADB mission to Cambodia in December 2011 as a result of storms and floods that struck the country in September/October the same year.

The Project was formalized through an MOU by ADB in February 2012 and financed through a co-funded Emergency Assistance Loan (EAL) between ADB and Australia Aid, to a total initial budget of $ 21.89 million. (Refer Project Background and Objective; Section 1.1)

The initial scope of FDERP’s MPWPT included 12 emergency contracts which were divided between Stage 2 and 3 in 3 Provinces.

The Emergency Program of FDERP’s projects under the IA of MPWT was implemented in an accelerated mode by firstly engaging the consultant in January 2012 through a retroactive financing model, with an official contract delayed until June 21, 2012.

This “fast track” approach all three projects under stage 2 to be awarded and mobilized under a Direct Contract procurement by Mid May 2012.

All projects were completed under budget and handed over in the period of March-September 2013.

The two first projects which were awarded under stage 3 were the Baray Kaot Bridge in Prey Veng, (CW4) in December 2012 ($ 806,898.27); completed on September 20th 2013, and two bridges in Prey Veng; Sam Put Thour and Ampil Krao (CW5) awarded in January 2013; completed on December 15th.

The tender and award of the remaining 5 projects of FDERP’s Stage 3 in Kampong Cham and Banteay Meanchey (CW 6a, 6b, 6c, CW 8 and CW7) followed in succession in 2013, with all projects in progress, as shown in the following section: “progress and status of FDERP”.

In September/October 2013 damages were caused to infrastructures in the Northern areas of the country resulting from severe storms and floods. Assessments of the damages were made jointly by ADB, MPWT and the consultants. Facts from the damages and project proposals were submitted to MEF and AFB for repairs as an extension to the existing program, which were initially addressed at the December Mid Term Review and reconnaissance visits to the affected areas.

Based on the Fact Finding Mission in January 2014 the scope of the additional civil works were agreed and formulated in the February 21 MOU, which was followed by the revised Procurement Plan of March 2014.

The additional Funding of project FDERP-AF is being allocated to an overall potential budget of $ 75.0 million (Refer Table 10 above) for all three IAs. A proposal of 9 new Construction Contracts for MPWT to be implemented through 2 stages in a similar model as FDERP-2012 (Refer Table 8).

As explained in section 1.1.2 above, the procurement of the 3 civil works contracts under stage 2 of the Additional Financing program received a NOL on April 24th for contracts CW9b, 10a and CW11/12 expected to be awarded by the end of May 2014.

From February to March the consultant’s team started design, planning and procurement for the stage 2 contracts. The manpower for this was permitted through VO#4 which provided an internal distribution of personnel. The engagement of the same consultant was justified in the February MOU and MPWT’s recommendation of March 26.

Planning, initial design work and procurement procedures are already in progress with the objective to have stage 2 contractor mobilized by direct Contracting before the June 2014 rains.

An initial draft TOR for the consultancy input has been discussed with PCMU and MPWT. Final scope of work and financing will be implemented through the 4th Consultancy Variation Order, which will allow a zero cost increase through internal manpower re allocation. This was followed by another Contract Amendment (VO#5). The PRC minutes were completed on March 31.

By the time of this report a NOL to VO#4 is still perching. Meetings were held regarding VO#5, and based on a revised TOR which still needs a NOL before another variation order can be prepared which will cover the works required from April 2014 to March 2017. The consultants are concerned, however, that the $2.5 million budget will not be enough to cover the works in the March 2014 procurement plan. Secondly, without an agreement to the TOR, Scope and budget, the consultants are unable to mobilize project staff. This will cause a delay-even of stage 2 work.

Progress and Status of FDERP.

The progress of 10 Civil Works (CW) projects as of April 2014 is shown below. For more details of the scope and status of each contract; refer to Chapters 4 and 5:

Contract: FDEP-MPWT-CW6b; Emergency reconstruction of three bridges on PR 270; Kampong Cham Province.

Period: April-2013- July 2014 Status: Actual; 51.5%; Schedule: 61.7%. Clearing of storm damages is

in progress and precast elements are progressing well. Riverbed erosion and land slide protection of CWb-1 are the most critical issues to complete in time before rains. Added scope and cost estimates have been prepared and discussed with Owner.

Contractor is slipping behind schedule due to extension water diversion works and slide slope protection.

CW6c: Contractor: Ung Sim Sia Construction Co.Ltd Contract Amount: $ 1,522,735.70

Period: April 2013- February 2014 Status: 91% completed vs Scheduled: 96%. Main delays were caused

by floods. Added repair work in progress. Contract is behind and has applied for extension.

CW7: Contractor: Tang Kim Eng Co., Ltd. Contract Amount: $1,431,562.20

Contract: FDERP-MPWT-CW 7; Reconstruction of 8.1 Km DBST along PR 270 in Kampong Cham Province.

Period: December 2013 to October 2014 Status: Actual; 34%; Schedule: 60%. Contractor was late in mobilizing

initial; one issue was to find sources of approved road material. This is being resolved in conjunction with the consultant’s materials team. However, contractor has difficulties mobilizing equipment on time.

CW8: Contractor: Joint Venture: USS & Seaboard Contract Amount: $ 8,795,645.58

Contract: (ICB) FDERP-MPWT-CW8; Reconstruction of 34.6Km road/PR 159: Banteay Meanchey, plus one 3 span RC bridge.

Period: 20 calendar months; contract was awarded September 30,-13 Status: Cost Variations one being reviewed necessary to complete

unforeseen work. Progress: 18% completed vs. planned 30.4%. i.e. marginal

behind schedule. The contractor is facing serious challenges in removal and

replacing unsuitable material. Regular coordination meetings are conducted with all parties to resolve this. The contractor has changed site staff and increased equipment to improve progress and to protect completed earthwork from next rains.

Due to delays caused by early rains, the contractor is adjusting his work program.

This report is prepared by the consultant’s resident team and covers activities and progress as of April 2014.

Original and Revised Scope of FDERP

After completion of 2012 immediate repair works, FDERP projects were divided in two Stages (Stage 2 and Stage 3) as shown in Tables 1 and 2 and records above. The scope of this original program was updated through three ADB MOUs, which were based on site investigations in mid-2012, early 2013 and late 2013. The following is a breakdown of these revisions: Revision # 1 cover corrections as shown in Tables 3 and 4; updated through a MOU in February 2012.

Initially, stage 2 included seven sub projects of 1 detour road/dyke plus 6 bridges . This was changed to only three individual contracts.

Stage 3 was increased from the original scope of four sub projects to five individual projects.

Revision #2 was introduced through ADB’s MOU in July 2012. (Refer Table 5). The scope of Stage 3 projects was increased from five projects to 9 sub projects. Revision #3: The above scope was revised again (refer Table 6) at the ADB Mission in January/February 2013. These last revisions affected the last 4 projects of Stage 3. These revisions have all had an impact on the periods and cost of the Supervision Consultant’s input; refer the three Variation orders: VO1, 2 and 3 (Contract Amendment #2). Refer Implementation Schedule in Annex 3 and Description of VOs in Annex 7. Revision #4: This scope revision is in fact an extension to the existing program. This project: FDERP-AF is a result of September and October floods 2013, documented in the MTR MOU and the Fact Finding MOU signed on 21 February 2014 between RGC and ADB. Refer Sections 1 and 2 above, Table 8 and budgets per Tables 9 and 10.

Budget and Funding/FDERP

The original total original budget allocated for MPWT’s component of the program was $ 21.898 Million. This budget was through a two-source funding; 1) a loan by ADB (2852 CAM) to an amount of $ 19,622,493, 2) a grant from the Government of Australia of $ 2,276,500. (Grant 0285-CAM) All projects under FDERP stage 3 are submitting IPCs on a regular basis.

Supervision and consultant’s services

The design and supervision Consultant [Egis International in JV/Vido] started actual work as early as January/February 2012 but with an actual signed contract on June 21st, 2012. By that time core design and procurement staffs was already in Cambodia for more than 4 months.3 The original Consultancy Design and Supervision Contract amounts to $ 2,316,481.75 with a revision which resulted in an increased contract amount of 2,802,353.17 per VO#3/Contract Amendment #2. As shown in Section 3, the Consultant’s site supervision set up is conducted by a Resident Engineer to whom one or two Site Inspectors are reporting on a daily basis. This set-up is cost effective as one Resident Engineer can manage more than 1 project at the time, and consequently supervise 2-3 inspectors. Refer Organization Chart in Section 3.1. Deputy Team Leader and head office admin staff. In the field are 4 Resident Engineers and 7 Site Inspectors on 5 active projects.

Problems encountered and actions taken and general progress.

During the month of Marcharch, 5 projects were under construction as outlined in the section above and in Chapter 4 and 5. The following projects were handed over and competed by end of December.

On an overall basis the construction projects under MPWT are progressing well with the exception of road project inCW7, which might face extension. a) Project CW6a: This project has clearly been the biggest issue of all MPWT/FDERP Projects schedule - wise; at a point of extremely slow progress. After completion of CW5 in December there have been visible efforts by the contractor to change the approach. Extra works on drainage and environment protection were added to the original scope. Road striping will wait until drains are done. b) Project CW6b: The project got off to a good start with temporary bypasses on all three sites. During the rains of September and October, the contractor concentrated primarily on producing pre-cast concrete units to be moved to site when conditions improve. In CW6b-1 Bridge which is a most complicate site, detour is completed. Survey of channel was conducted I order to study slope protection. Major design issues were implemented to rectify this. Added structural and hydrological tasks are implemented in an accelerated mode to be completed before 2014 storms. Contractor is now working 10hrs every day in a battle to finish all substructures, abutments and 20m riverbed mattresses by mid-June. CW6b-3 bridge, beams were installed. Contractor demolished existing bridge CW6b-2, and piling work and beam launching are completed. c) Project CW6c: Most construction works on box culverts and bridges are completed. The completion date of this contract was completion is expected in May 2014, extended, primarily due to set back as a result of flood destructions in September and October. . e) Project CW8: A large section of the 34 Km project faces sub-quality soil. The contractor and the Consultant are working very closely to find material sources and also define various methods how to combat the clay sub base and the low capacity embankment. The Client and the Consultant are urging the contractor to accelerate site progress and improve management in order to protect completed works and stay on target. Some revisions to drainage structures are required. f) Project CW7: This contractor has already reached a delay of 2 months. It is imperative that subgrade is completed before rains.

Procurement

The procurement procedures follow the regulations outlined in “Kingdom of Cambodia’s Procurement Manual for All Externally Financed Projects/Programs in Cambodia”. Procurement of the 3 Direct Contracts of FDERP-AF section 2 are in progress. PRC meeting is expected to allow contract award by end of May.

Variations

The consultant’s VO #1 covers the cost of added design tasks as a result of the 10 additional structures along PR 270 in Kampong Cham, which was covered financially within the consultant’s budget and approved in September 2012. VO#2 included the required added procurement tasks for the consultant to implement all levels of procurement, tender and assessments through the final steps of BER and PRC. ADB gave No Objection on April 26th 2013. VO #3 (CA #2) was originally submitted for MPWT’s review on May 10th 2013. After various meetings with PCMU, ADB and MEF the final and 5th draft was issued in August to the amount of $ 485,871.42 with a PRC meeting held on August 30th. The Variation Order was signed on November 8th. The VO #3 was approved in full on

November 8, 2013 As a result of the September and October 2013 floods an added project in the Northern Provinces was discussed at the Mid Term Review in November/December 2013. This was followed by a reconnaissance Mission in December 2013(Refer Annex 4). The result from the Fact Finding Mission in January 2014 was summarized in ADB’s MOU signed on 21 February 2014. The Consultants VO #4 provided an internal re-distribution of person-month, which allowed design &procurement input for Stage 2 of input to FDERP-AF. NOL for VO#4 is still perching. All work under VO#4 was charged towards existing allocations of FDERP, for consultancy input in March and April 2014. These (temporary) transferred allocations will be re-instated to FDERP work in the next VO-AF1.

General Progress (Original FDERP) Stage 2: Projects CW1, CW2 and CW3 are either under defect liability or fully completed since the hand overs.

Stage 3: By the end of April the project is implementing 5 active projects to a total amount of $ 17.272 Mill including the most recent award of CW7. The 5 completed projects (CW1 through 5) amount to a total of $ 9.162 Mill with a total saving of $ 1,125,035.82, which is proposed to be transfer to cover extras of C.W. project under FDERPs remaining 5 Contract.

Contracts CW 6b and CW6c are progressing satisfactorily project CW6a is proposed to be handed over in May. Contract CW7 &8 are facing delays due to insufficient source of quality material.

Chapter 3 -Supervision Consultant’s/Engineer’s Services  

3.1. Progress Status  

3.1.1. Mobilization of Staff International Structural Engineer was mobilized in mid-January 2014 to conduct design of slope protection of Svay Tahen Bridge in Project CW6b, review design of CW8 bridge due to bridge widening to accommodate sides work. At the same time, this expert carried out design of one bridge of CW9b and one bridge in CW10a. Local structural Engineer assisted him.

Due to urgency in implementation of Stage 2 under FDERP-AF before the rainy season, both international and national consultants are mobilized to carry out design and procurement works. International team leader was mobilized to lead the design team. The International procurement and contract specialist was mobilized in March 2014 to prepared bid documents. All 3 Stage 2 contracts under FDERP-AF are procured under Direct Contract, refer to MoU dated 21 February 2014. International Sr. hydrologist was mobilized as home office input to work with local hydrologist.

3.1.3. Supervision Consultant’s Activities during This Period

3.1.3.1. General design and procurement

Defect Liability Certificates were issued on 19 March 2014 to Seaboard for subproject CW2 and to Ung SiamSia for subproject CW3 after the 12 months of Defect Liability Periods.

Site investigations, surveys, structural design of the slope areas next to bridge CW6b-1 in Kampong Cham became a priority, as recent mudslides had caused changes to the original scope and site conditions. Several proposals were proposed by Contractor and discussed. It was agreed that the slope protection under the bridge will be first constructed, followed by at least 100m. After rounds of discussion, a slope protection of 100m was decided.

For CW8 (34.6 Km of Provincial Road segments (PR 159) and a bridge in Banteay Mean Chey Province). A joint survey on existing road levels was conducted between Contractor and Consultant. Contractor prepared shop drawing and submit for review later. All drawings were approved for construction.

Due to effect of September/October flood 2013, the consultant team was asked to assess the damage caused by the flood to the current projects and the road PR270 and some bridges along this road. Two reports were prepared and submitted to the Client in early November. One report relating current projects (i.e CW6a, 6b and 6c) gives an estimation approximate $37,000, and other one relating to remaining sections on PR270 (around 51 Km) plus a bridge on PR70. The latter’s estimation is around 10.72Km.

Mid Term Review Mission by ADB was conducted from 25 November to 5 December 2013. A round of site visits and meeting were carried out. MoU was prepared and signed on 28 January 2014. ADB was satisfied with progress of the Project.

Following a Mid Term Review Mission, a Reconnaissance Mission was conducted from 16 to 20 December 2013 and visit proposed roads/bridges in 5 Provinces, Battambang, Banteay Meanchey, Siem Reap, Kampong Thom and Kampong Cham. 3 Teams ADB, MPWT and Consultant joined the mission. MPWT team prepared a report based this mission and distributed to ADB in during wrap-up of Reconnaissance Mission. The project lists proposed in Reconnaissance Mission was to be confirmed in Fact Finding Mission with a kick-off meeting on Jan 20th and wrap-up meeting was held on Jan 2014, and Fact Finding MoU was signed on 21 February 2014.

Contractors for the three Stage 2 subprojects under FDERP-AF (CW9b, CW10 and CW11&12) have been selected and will be implemented before this coming rainy season, i.e mid May. The design of 2 bridges (40m PSC decks in CW9b and 15m RC bridge in CW10a) and design of a 11.2 km DBST are completed. The topo survey for CW11&12 was done and road design was completed. The bid documents were issued to the Contractor selected for Direct Contract in late April, after the bid document, which is the first subproject under direct contract, was obtained ADB’s “NOL”. The bid openings for these 3 packages is planned on 2 May 2014.

3.1.3.2. Quality Control, Supervision and Training

Coordination of quality & quantity control, supervision and recording of work progress on site was conducted on a daily basis by REs and Inspectors.

In addition: Routine site inspections by Project staff and experts. Observing and recording of material tests by Consultant’s site staff and/or Material

Engineers, Structural Engineers, TL and DTL on site and/or in laboratories or test yards.

Regular RFIs were compiled with by the Consultant for stage 3 projects. As a result of limited staff, the Engineers have often been available 7 days per week in order to maintain project momentum.

The Contractors communicated daily with the Engineers/Consultant (either direct or via the RE) on variations to structures, quality of material, site issues, progress etc.

A group of students from ITC were allowed to have a short internship on site in order learn the techniques of construction and practice what they have learnt in university.

3.1.3.3. Meetings, Communication and Report

The requirement of documentation on work progress is recognized by the consultant. A range of progress and/or technical reports have been issued through the IA during this period. Monthly Progress meetings are conducted at MPWT’s PM Office in Phnom Penh. Added site meetings are held frequently and coordinated with the respective Contractors and Site Construction Supervisory Teams.

3.1.3.4. Financial Progress and Variations

Completion Certificate was issued to Ly Chhuong (CW1) on 20 September 2013. A final contract price is $3,321,647.01 and a saving from this contract is $390,196.26. Note that the original contract was $3,383,059.32 and was amended to $3,711,843.27.

Completion Certificate was issued to Seaboard (CW2) on 28 March 2013 and Defect Liability Certificate was issued on 19 March 2014. A final contract price is expected to be $1,797,574.65 and saving from this contract is $194,599.62.

Completion Certificate was also issued to Ung SimSia (CW3) on 28 March 2013 and Defect Liability Certificate was issued on 19 March 2014. A final contract price is expected to be $1,145,847.28 and saving from this contract is $182,429.26.

Based on the above information, stage 2 savings is $767,225.15. Completion Certificate was issued to Ung SimSia (CW4) on 20 September 2013. A

final contract price is $697,445.59 and a saving from this contract is $109,452.69. Completion Certificate was issued to Royal Mekong (CW5) on 3 February 2014, a

saving from this contract is $248,357.98.

For an overall payment status please refer Section 1.1.2 abovementioned. To date Stage 2 Contractors have submitted a total of 24 IPCs (Interim Payment

Certificates), all of which have been approved (with or without amendments) to total net of $ 4,633 Mill. (Refer Sect 2.1 and Annex 2). This number includes the advance payment that the Contractors have repaid to the Client. All of 3 Contractors requested a full payment of retention of 10% of total gross claim while submitting a bank guarantee costing 5% of total gross claim. For CW2 and CW3, the bank guarantees for 5% retentions were returned to the Contractor as the Defect Liability Certificates were issued.

Stage 3 Contractors have submitted a total of 19 IPCs, all of which have been approved (with or without amendments) to a total net cost of $ 3,501,365.67: CW4, 3 IPCs to total net value of $ 511,541.28; CW5, 4 IPC to a total net value of $ 770,725.24; CW6a, 3 IPC to a total net value of $ 443,814.94, CW6b; 5 IPC to a total

net value of $ 796,146.34; CW6c, 3 IPC to a total net value of $ 691,397.07; CW8 1 IPC to a total net value of $ 287,740.80.

The consultant’s VO #1 was signed by IA on September 14. Due to scope change, added procurement and supervision works are necessary. The

IA and the Consultant reviewed a draft of the second VO with PCMU. After the Jan/Feb ADB Mission, it has been decided that the Contingency of $69,900.00 in the present Consultancy Agreement would be fully utilized leaving a zero balance in VO#2. This VO #2 was submitted to IA on March 15.

IA Consultant have discussed VO with Clients on several occasions and first draft of VO#3 was submitted on 13 June and was revised and re-submitted on 27 June and 24 July 2013 for review and approval. Further to this, meeting was held 31 July, revised VO#3 was submitted to review on 21 August 2013, followed by PRC meeting on 30 August, a final draft was prepared for submission to MEF. ADB’s NOL was issued Oct 10th.

In Mid Term Review Mission, ADB has mentioned that they had never received the signed Contract Amendment No.2. Then, MPWT sent a copy of the signed Contract Amendment to ADB on December 24, 2013.

VO# 4 has been discussed in several occasions in order to speed up the design works for stage 2 of the added project (FDERP-AF). VO4 was prepared and submitted to IA (MPWT) on 21 March 2014, and IA forwarded it to MEF on 26 March, and PRC meeting was held on 31 March. It is expected VO4 will be approved in April 2014.

VO#5 for the FDERP-AF was prepared and presented to MPWT. Discussions on the VO#5 were held on 11 and 29 April 2014.

3.2. Problems encountered and actions taken

3.2.1 Stage 2 Projects.

During this reporting period, 2 Stage 2 Subprojects (CW2 and CW3) have been notified about the defects that need to be corrected under Defect Liability Period. Such defects have occurred at expansion joints and some dragon holes along the dyke. Contractors of CW2 and CW3 repaired the defects as stated by the Engineer. After repairs’ correction, the Defect Liability Certificates were issued.

3.2.2. Stage 3 Projects

There are seven subprojects under Stage 3: CW4, CW5, CW6a, CW6b, CW6c, CW8 and CW7. The first two were completed. CW6a was completed except the road markings, road furniture that will be done during Defect Liability Period. CW6c is expected to be completed in Mid May. The remaining three subprojects, CW6b, CW7 and CW8 are under construction.

CW6a, CW6b, CW6c and CW7 are on-going projects. CW8 was awarded as ICB contract at the end of September 2013. CW7’s BER was issued on 13 November 2013 for ADB’s NOL, and the Contract was signed on 20 December 2013.

The main issues for slow implementing CW6a are progress behind schedule that is related to mainly contractor’s performances such as lack of equipment, equipment often broken down, and difficulties in working during rainy season. Another factor is that severe flood in last Oct-Nov, this could have a severe impact on the completion of the work as schedule. It was expected that this projects needed 2 or 3 months of extension. After review, an extension until 4 March 2014 was approved. Another time extension due to additional works on drainage and improvement of environment was approved until 13 April 2014. Contractor completed major works by this intended completion date except some minor works such as

road markings, kilometer post, and added draining work at beginning work road.

CW6b which consists of 3 bridges is a challenging construction project. Due to early rise of water in Mekong River, complexity of the site for CW6b-1 (Svay Tahen Bridge), resettlement issues at detour of CWb-2 and the severe floods that started at the end of September and continued through October, it was clear that extension of time was needed to complete the Works. Contractor submitted for time extension and IA’s endorsed the time extension and IA approved the extension until the July 2013. ADB was informed about time extension already. After flood receded, the Contractor resumed the works, first of all, to repair the damaged approach roads of the detour so that the existing bridge can be removed. Another major issue is the design of slope protection for CW6b-1, which is now approved. A total of 100m slope protection will be constructed at this bridge pending funds. Extra budget is needed to finance this added work on slope protection.

CW6c which has 3 bridges and 4 box culverts is progressing on tracks. Similar to 3 above subprojects, the major issue was the flood which hit the project site September/October. It was concerned that flood would have significant impact on the implementation of the work. The Contractor submitted an application for extension citing time loss due to flood, and MPWT approved this time extension until the end of March. In addition, due to added work on roads connecting between the bridges, Contractor applied another time extension on 27 March 2014 requesting until Mid May 2015. The extension application was approved until 15 May 2014.

CW8 is the largest subproject under current FDERP. The project is still slow because demining activities were slight delayed due to high water along the road, borrow pits are still wet, existing road embankments are still wet and need some time to dry up, vast of inappropriate soils are present in the road. A few rounds of meeting were conducted between MPWT, Consultant and Contractor in order to find the way to speed up the work progress. The Client has instructed to widen the bridge by adding the sidewalks. The Consultant has revised the designs and requested Contractor to prepare the shop drawings for review. Several instructions have been issued for correction the drawings. The Contractor submitted the corrected drawing for review.

CW7 is the last package under current FDERP. As this subproject is similar to CW6a in geographic area and low rate in the bid, it is expected that some issues may arise like timely progress of UXO clearance works, or earthwork. As of this month, the works is around 25% behind schedule. The Engineer has issued 2 warning letters on such late progress, reminding Contractor to replace broken dumps trucks and complete the embankment early next month (April) and complete the subgrade by the end of the same month. But, the Contractor has completed Subgrade only 2km long as of end of April.

The contract for the Emergency Reconstruction PVR No.270 in Kampong Cham Province was awarded on 06 December 2012 for duration of 365 days. The site possession to the contractor was issued in 19th December 2012. Commence date was the thirds week of 19th December 2012.

The Project consists of following components with percentage of work progress:

2.2. Status:

Physical accomplishment during this Month (as of 25th -April-14) was estimated to be 84.66%. This is behind of the Contractor’s revise schedule which was 90.01% (-5.35%). the works is behind of revise schedule due to not yet start working top soil for embankment slope, Block Sodding and reflectorised thermoplastic. In addition, this contractor has progressed to low overall status; (84.66%) is also attributed to the completion of BOQ No.2 to No.9 of the PVR No.270-CW6a which is expected to complete following revise schedule.

The contract for the Emergency Reconstruction of 8.1 Km DBST Road on PR No.270 in Kampong Cham Province was awarded on 20 December 2013 for duration of 300 days. The site possession to the contractor was issued in 23 December 2013. Commence date was the fourth week of 23 December 2013.

5.6.2.1. General Scope and Progress

The Project consists of following components with percentage of work progress:

‐ Removal the UXO before starting the work: 100% completed; ‐ Clearing and grubbing : 100% completed; ‐ Embankment work: 100% completed; ‐ Structure works: Excavate bedding of crossing Pipe culvert 3 locations; ‐ Sub-Grade works: 4Km Dumping material and grading and compaction 2km; ‐ Sub-Base work: not yet start; ‐ Base- Course work: not yet start; ‐ DBST work: not yet start

5.6.2.2. Status:

Physical accomplishment during this Month (as of 25-April-14 was estimated to be 17.00% where the actual progress is 13.55%, i.e. 3.45% behind of the Contractor’s schedule. These slow progresses because the Contractor working during this month is very minor due to 4 days rained and spend almost 10 days for Khmer New Year where the official holiday is only 3 days. After return from holiday most driver and equipment operator not attend the works.

DBST Provincial RoadNo.159 (34.40km), ICB-CW8, is located from PK0+000 to PK34+400 in Banteay Meanchey and Battambang Province were awarded on 30, September, 2013 for duration of 600 days. Engineer’s (CSC’s) site house and site office and laboratory is located along the Road at PK0+700 and PK23+000

5.7.2.1. General Scope and Progress

The site possession to the contractor was issued in 30th September 2013 Commence date was the fourth week of 25rd October 2013.Progress of work during the reporting period was as follow:

‐ Clearing and grubbing work: 100%completed. ‐ Roadway excavation, common is in Progress has been completed about 46% from PK11+700

to PK20+000, PK27+000 to 32+700, (14km). ‐ Roadway excavation, unsuitable has been completed about 65%from PK7+000 to PK20+000,

PK 22+500 to 22+900 and PK23+500 to 32+700(about 22km). ‐ Top Embankment have been completed ,about 62% from PK 8+000 to PK 20+000 ,PK

24+700 to 32+700,PK22+500 to 22+900 (20km) but remains 5.90Km still not yet completed backfilling and compacting 100%.

‐ Selected sub grade Material work is in Progress has been completed about 8% from PK 30+950 to 32+200(LHS),15+600 to 16+600(LHS) and 12+000 to 15+000(LHS) (2.6Km only one side LHS).

‐ Removals of existing structure have been started five places for Box culvert at PK2+782.PK 3+120,PK4+944,PK6+944 and Pk7+915 , completed about 45%

‐ Removals of existing structure (Bridge) completed 100%. ‐ Casting concrete for slab, wall and wing wall of Box culverts and Pipe culverts at PK 2+782,

3+120.4+944 and 6+944 and 7+915, about 25% completed. ‐ Casting concrete for pipe culverts 600mm diameter has been completed, about 46%.But still

not yet installed (side drains). ‐ Installing for concrete pipe across the road have been completed at PK 0+844, PK 1+678 , PK

1+853,3+295,3+767,5+045 , 7+221,4+175 and 4+526(9 places).And has been completed installing and casting about 64%.

‐ Pile driving for Bridge has been started and completed about 51% including casting concrete for RC piles (Pile driving completed 27 holes against 72 holes).

‐ Detour road for Box culverts have been started at PK 2+782, PK3+120, PK4+944, PK 6+944 and PK 7+915, have been completed 45%.

‐ Diversion road for Bridge completed 100% ‐ . Maintained existing road and structure has been completed 78% and all vehicles can pass. ‐ Borrow pits for embankment, sub grade and sub base have been identified, materials tested

and approved by CSC. 2.2-Status:

Physical accomplishment during this Month (as of 25th-April-14) was 2.42%. This is behind of the Contractor’s schedule which was 8.67% (-6.25%).

Annex 4: ADB Mid -Term Review Mission and a Reconnaissance Mission, Fact finding Mission to Northern Provinces and Proposals for an extension to FDERP, Loan/Grant Agreement 1. Review Mission

A Joint Mid-term Review Mission4 for the Flood Damage Emergency Reconstruction Project was undertaken from 25 November to 13 December 2013. The Mission's main objectives were to review (i) overall implementation progress; (ii) status of contract awards and disbursements and projections for the remaining implementation period; (iii) budget allocation and provisions for counterpart funds (iv) utilization of imprest accounts including random review on the documentation of financial record of EA and IAs; (v) utilization of loan proceeds under each loan category; physical verification of inventory; (vi) procurement plan update; (vii) social/environment safeguards impacts; (viii) status of compliance with loan covenants;

and (ix) actual physical progress. An MOU was issued in December with the Findings and recommendations from the MTR.

2. Possible added scope due to 2013 floods.

As a result of severe storms and floods during the months of September and October MPWT submitted various proposals for rectification works of ongoing projects and also an expansion of emergency flood protection efforts to Provinces in the North which had suffered from extensive damages; areas which were not included in the 2011/2012 FDERP.

Starting in the third week of September 2013, Cambodia experienced serious flooding due to flash floods from heavy rainfall, including some areas in Thailand which drained into Cambodia, especially in the northwestern provinces of Banteay Meancheay, Battambang, Pailin and Siem Reap, where the water receded slower than expected. The heavy rains only stopped in the second week of October 2013. Overall, 20 provinces have been affected, and as of 15 November 2013, over 1.7 million people have been affected, which is about 12% of the national population. The damage from the 2013 flooding is expected to exceed that of the floods in 2011, both in terms of loss of life and impacts on infrastructure and agricultural crops, largely because the prolonged period of inundation preventing the initiation of meaningful remedial measures. An initial damage estimate, approaching $1 billion along with 188 deaths was released by the NCDM, and as of 8 November. According to NCDM, approximately 45,905 households (about 211,163 people) had to be evacuated from their homes, although many have since been able to return. More than 240,195 houses, 1,254 schools, 92 health centers and hospitals, and 533 pagodas have been affected, with sizeable infrastructure damage incurred, including 440 km of national roads and 3,569 km of rural roads. Over 118,357 ha of transplanted rice, and 57,443 ha of other crops have also been damaged, about 7% of total cultivated areas.

These events and disasters were highlighted and discussed at the ADB Mid Term Mission. As a result it was agreed to conduct a joint reconnaissance mission to the Northern Provinces to investigate damages and assess a potential extension to the existing emergency program by incorporating new projects, primarily funded by ADB, and within the same format as the existing program.

3. Reconnaissance Mission

The Reconnaissance Mission was mounted in response to the Royal Government of Cambodia (RGC) request from the Minister of Economy and Finance dated 21 October 2014. This mission conducted between 16 December 2013 to 9 January 2014,with a wrap-up meeting held on 9 January 2014. The discussions and understandings reached between RGC and ADB were summarized in a MOU, which was used a basic for further processing of the proposed additional financing.   

4. Fact Finding Mission

The Fact Finding Mission was conducted from 20 to 31 January 2014 for the proposed Additional Financing to existing FDERP. The objective of the Mission to carry out detailed assessments and validation including cost estimates and implementation plans, of the damage restoration required through the proposed subprojects, as well as to agree on arrangements for the Project Implementation. The discussions and understandings reached between RGC and ADB was summarized into MOU and signed on 21 February 2014. 5. Grant/ Loan Agreements

The Royal Government of Cambodia (RGC) and Asian Development Bank (ADB) signed a loan agreement and grant agreement on 23 April 2014. The total amount of Grant from the Government of Australia is $6,683,000 and the allocation of this fund is shown in Attachment to Schedule 1 table.

Annex 9: Variation Orders and Contract Amendments of EGIS International/VIDO JV with MPWT

VO#1: The Consultant submitted a Variation Order to the project under the first quarter (VO #1), The VO was signed by MPWT on September 14th.

VO#2: A draft of the second Variation Order was prepared by the consultant and discussed with MPWT and PCMU in December. It was submitted again in January, but it was revised after the Jan/Feb ADB Mission to include added procurement tasks to be within the contingency amount of the Consultant’s Contract Agreement ($ 69,900.0).

This had been completed and a final submittal with back up data was submitted in MPWT on 15 March. A PRC meeting was also conducted to review this VO. It is expected VO#2 was approved by in April 2013 after submission with a Contract Amendment.

VO#3: VO3 was already drafted in May and June and was submitted to IA on 13 June and was revised and resubmitted on 27 June for review. After rounds of discussion with the IA and PCMU, 3rd draft of added amount $591,663.33 was revised and submitted to IA on 24 July 2013. A preliminary presentation to MEF and PCMU was held on 31 July 2013.

A 5th revised version was submitted to IA on 30 August 2013 with a revised amount of $485,871.42. This VO was approved by MEF and received a NOL from ADB with conditions, after which the VO (Contract Amendment#2) was approved.

The Contract Amendment was signed on November 8th, 2013 to an amount of $2,802,353.17.

Refer to the Fact Finding MOU signed on 21 February 2014, the design of Stage 2 is crucial in order to start construction of Stage 2 subprojects in Mid- May.

MPWT (IA) informed MEF that it intends to keep existing Consultant the letter dated 26 March 2014 “Retain the present Detailed Design and Implementation Supervision (DDIS) Consultant; "Joint Venture of EGIS International and VIDO Engineering Consultant Co., Ltd." The Consultant start detailed designs of Stage 2. The cost for design work of the Stage 2 under FDERP-AF is $96320.5, and will be charged under VO#4. This amount will be paid back to FDERP in the future.

VO#4 has been discussed in various occasions. Consultant prepared this VO#4, which will result in zero cost increase and realign the staff within the current VO#3. VO#4 was submitted to MPWT on 21 March 2014, and MPWT forwarded to MEF on 26 March, and PRC meeting was held on 31 March 2014.

While VO#4 was submitted, the TOR for Consultant and Contract Amendment/Contract Variation for the new added works (FDERP-AF) were preparing.

MPWT submitted the TOR for Detailed Design and Implementation Supervision (DDIS) Consultant for FDERP-AF to MEF on 1 April 2014 for review. First draft of VO #5 which is based on this TOR was first presented to meeting between the Consultant, Advance Team, MPWT and MEF on 11 April 2014. Following a meeting on 11 April, the TOR was revised and was re-submitted to MEF on 23 April 2014.

1. Packages already awarded Civil Works:

All civil works under current project (FDERP) were awarded.

2. Packages On going

Civil Works under FDERP: 5 subprojects (CW1, CW2, CW3, CW4 and CW5) were completed and 5 subprojects (CW6a, CW6b, CW6c, CW7 and CW8) are under construction. Civil Works under FDERP-AF: CW9b, CW10a and CW11 &12 are being prepared, CW9b bid document was submitted to MPWT on 28 March and MPWT forward to MEF and ADB for prior reviews. As CW9b is the first bid document it is object to prior review (according to Procurement Plan date 12 March, 2014.)

ADB’s NOL of Bid document for CW9b was received on third week of April and a revised Bid Document for was submitted to MEF afterward. The bid documents were issued to Contractor on last week of April 2014. The bid opening for the three packages is schedule on 2nd May 2014. Contract awards are expected in mid May 2014.

CS1 (Detailed Design and Implementation Supervision): On going assignment VO#3 . Version 5 submitted for review and approval. Draft 5 had a NOL Oct 10th. VO#3 (Contract Amendment No.2) was signed on 8 November 2013.

VO#4 was submitted to MPWT on 21 March 2014, PRC meeting on 31 March 2014.

MPWT submitted the TOR of the Consultant on 1 April 2014 and the VO#5 based on this TOR submitted to MPWT on 10 April 2014. Followed by a meeting on 11 April 2014 with MPWT, MEF, Advance Team, the TOR was revised and MPWT submitted it to MEF on 23 April 2014. The variation order based the revised TOR (referred to VO#AF-1) was submitted MPWT on 25 April 2014 and the discussions between MPWT, Advance Team and EGIS was held on 29 April 2014.
