1. Timeliness of the Research
Given the current situation of the penitentiary system in Romania, in which the European
Court of Human Rights (ECHR) in Rezmiveş case and others against Romania, adopted on
April 25, 2017, a pilot judgment on detention conditions in our country, this paper aims,
among other things, to identify alternative solutions to remove the causes of prisons
overcrowding, the selected topic arousing a great interest.
The ECHR pilot decision in Rezmiveș cause and others against Romania comes after
Romania was convicted for improper conditions in penitentiaries since 2007, in Bragadireanu
case, later, in 2012 ECHR adopting a semi-pilot decision in Iacov Stanciu case against
Romania, for the same reasons.
Through the pilot decision of April 25, 2017, the ECHR established that, within six months
from the final stay (established at 3 months after the ruling), the Romanian state should
submit a firm timetable, containing adequate measures to solve the problem of overpopulation
and of the conditions offered in the detention facilities in order to comply with the provisions
of the international conventions in the field.
One of the causes of prison overcrowding is obviously related to the lack of places of
detention, but it should not be neglected that the recidivism rate in Romania, although
decreasing in recent years, is still very high. Thus, according to official data, for 2018,
published by the National Administration of Penitentiaries (ANP) in 2019, the recidivism rate
in Romania was 38.4%
According to the European recommendations (the Committee of Ministers and the Committee
for the Prevention of Torture), increasing the number of accommodation places is not the only
and most suitable solution for correcting problems in the penitentiary systems. In this context,
an analysis on how to intervene in the preparation of social reintegration of prisoners and
prevent relapse, may create the premises of reducing the number of people imprisoned, in
accordance with the recommendations made by the European forums.
The achievement of the proposed targets is directly correlated with the manager’s ability to
identify alternatives or complementary solutions to the existing problems in the Romanian
penitentiary system.

According to specialized theories, antisocial behavior and especially criminal behavior is
determined by several structural causes, including poverty, poor education and mental
disorders. In this context, any solution proposed, within the public policies in this field, which
does not take into account the causes that can generate antisocial behaviours and which
exclusively target their effects, offers, at most, temporary solutions to the problem of prison
overcrowding.
One of the fundamental objectives of social services is to achieve the social inclusion of the
vulnerable population. Social services for persons deprived of liberty are structures with
attributions in the psychosocial field within each penitentiary, which aim prisoners’ family
and social reintegration and the prevention of recidivism. Applications for social reintegration
of persons deprived of liberty are subscribed, according to the legislation in force, to all the
activities carried out to meet the individual and group social needs, in order to overcome the
difficult situation, to prevent the risk of social exclusion, to promote social inclusion and to
increase the quality of life. Economic and social costs generated by the relatively high number
of inmates in Romania, about 22,000 require an analysis on how the state manages social
reintegration of this category of persons and to prevent relapse in order to adapt policies and
strategies organizations providing services in this area.
This scientific approach aims to identify the specific aspects of the management of the
psychosocial services granted in the Romanian penitentiaries but also the impact that this
intervention has on the person deprived of liberty after being released. Through the present
research, starting from the needs and characteristics of the beneficiaries (clients) of
specialized services, the aim is to carry out an analysis of how the organizations with
attributions in this field respond to these needs and how the strategies in the field should be
adapted to respond adequately to the real needs and to ensure the objective of such services,
namely, to ensure the social inclusion of former prisoners.
Thus, based on the results of this scientific approach, proposals will be formulated regarding
the organization of structures with attributions in planning and providing services, in order to
prevent the recurrence in the case of former detainees and, consequently, to reduce the
number of persons who are serving sentences deprived of liberty and the costs generated by
them.
Therefore, we consider that it is not enough for the problem of persons deprived of liberty to
be regarded only as a criminal execution problem but it must be approached from the

perspective of the social policies as a whole and of the way in which they are implemented at
the level of each specialized service.
2. Main objective of the research
This scientific approach aims to identify the specific aspects of the management of the
psychosocial services granted in the Romanian penitentiaries and to analyze the causal
relations existing between the way in which the management of these services is achieved and
the achievement of the objective of the organizations within which they are organized, that of
social reintegration of the prisoners and the prevention of the phenomenon of recidivism, in
order to streamline the processes within these organizations.
3. Structure of Phd Thesis
The thesis is structured in six chapters to which are added, the introduction, the conclusions,
the proposals and the annexes, being drafted from the general aspects regarding the public
management to the particularities of the social reintegration services from the penitentiaries
analyzing the international context and the national public policies in the field, from the
perspective of the external environment as well as the concrete way in which it influences the
provision of specialized services. At the same time, within the work are analyzed existing
management mechanisms and institutions and the actual way in which they are organized in
the detention premises.
Chapter I - Public Management - contains the theoretical landmarks and defines the concepts
used in the paper, while at the same time being carried out an analysis on the particularities
encountered within the Romanian penitentiary system.
Thus, after defining the concepts of manager and management, the defining elements of
public management and also the main theoretical ways of approaching the management are
presented.
Next, the principles of public management and its functions are presented and analyzed from
the perspective of applicability within the prison system, so that later an incursion into the
theories on the organizational culture will be carried out, especially that, in the present thesis,
we propose to carry out an analysis from the perspective of the organization and functioning
of services in which the organizational culture is very strongly influenced by their past, which
have been militarized until recently.

Within the same chapter, a presentation of the management subsystems was made and specific
elements of the Romanian penitentiaries and the psychosocial assistance services within them,
if underlined.
The description of the characteristics of a good manager, of the roles identified for him by
different theorists and of the leadership styles was made after presenting the methods and
techniques used in the achievement of public management.
At the end of the chapter is presented the external environment of the organization, with the
emphasis on the characteristics of public institutions and their external environment.
Chapter II - Public policies in the social field and their objective-makes the transition from
the external environment specific to the public organizations in general to the specific of the
external environment to the psychosocial assistance services within the Romanian
penitentiaries.
In the first part of this chapter, the concepts of social policies and public policies are clarified
and also the evolution of social policies over time is presented. Next, we show how the
decision-makers belonging to different group of influence, can have an effect on public policy
in general and on social policy in particular.
At the end of the chapter, the objective of social policies is presented, as it is captured in the
specialized theories, considering that there is a direct connection between the objective of the
present thesis and the objectives of the social policies, which is solving social problems.
Chapter III - Analysis of the international external environment - International public
policies regarding the rights of persons deprived of their liberty and their social
reintegration - contains the regulations in the field and the international control mechanisms
that influence the organization and functioning of the psychosocial assistance services in the
Romanian penitentiaries.
This chapter presents and analyzes the main international regulations in the field and the
European Prison Rules. Also presented in this chapter are the Mechanism for the Prevention
of Torture and Inhuman or Degrading Treatment or Punishment and the subcommittee of this
mechanism, organizations that have played a decisive role in the adoption of the pilot decision
against Romania regarding the conditions of detention and which continue to have a major
influence on the organization of activities with prisoners.

Chapter IV - Analysis of the national external environment - public policies in the field of
the rights of persons deprived of their liberty and their social reintegration and the
measures adopted in order to improve the conditions of detention-contains a continuation of
the analysis of the external environment to the penitentiary system, but it concerns exclusively
the situation existing at national level.
Within this chapter, the public policies and the programmatic documents that influence the
activity carried out by the psychosocial assistance services organized within the penitentiaries
are presented as well as the steps taken by Romania to prevent the adoption of a pilot decision
and its later adoption.
Also, within this chapter, a complete analysis of the National Strategy for the Social
Reintegration of Private Persons is undertaken, starting from the way it was founded,
following its implementation and analyzing the possible risk factors regarding the
achievement of the proposed objectives.
Chapter V - Analysis of the internal environment - Organization and functioning of social
reintegration services within Romanian prisons - contains a detailed presentation and
analysis of the penitentiary system regarding the organization and functioning of social
reintegration services.
The first part presents, briefly, the entire penitentiary system in Romania so that the
organization and functioning of the central structure with responsibilities in the field of social
reintegration and those organized at the level of each penitentiary will be presented separately.
In the second part of this chapter the services that can be provided by the psychosocial
assistance services, organized at the level of the penitentiaries, and the offer of programs
available at the system level are presented
Chapter VI – The management of specialized psychosocial assistance services, organized at
the level of places of detention - contains a presentation and analysis of the way in which the
management functions are exercised by persons with attributions in the field of psychosocial
assistance performed in prisons.
This chapter presents the specific attributions of the managers by referring to the functions of
management and the principles of public management and the way in which the managers
influence, through their activity, the measures of social reintegration of the prisoners. The

chapter contains a description of the concrete activities that the managers, regardless of level,
perform in order to carry out each function within the management and an analysis of the
particular aspects of the system in which they operate.
Chapter VII - Research on the Romanian prison system - aimed at identifying the specific
elements of the management of psychosocial assistance services within the penitentiary
institutions, which can be adjusted in order to increase the performance of these services.
In carrying out the research, several hypotheses have been used regarding the organization
and functioning of the organizations that provide services for persons deprived of their liberty
as well as regarding the needs and characteristics of the beneficiaries in social context.
In this chapter are presented and analyzed the data and information that were requested from
the National Administration of Penitentiaries, the National Agency for Benefits and Social
Inspection and from penitentiaries that have the role of coordinating the other institutions in
the regions to which they belong. Initially, the method used was to study the documents that
were and are available or those provided by the aforementioned institutions, following
requests for free access to public information.
Subsequently, to verify the research hypotheses, self-administered questionnaires elaborated
in order to carry out the research were used, in order to obtain the necessary data.
After the quantitative analysis of the data and information obtained as a result of studying the
documents and applying the questionnaires, interviews were conducted with a part of the
specialists involved in the research, in order to clarify some aspects and to carry out a
qualitative analysis of the information obtained.
Within this chapter are presented, analyzed and interpreted all the data and information
obtained regarding the organization and functioning of the psychosocial assistance services in
penitentiaries, using various methods.
IV. CONCLSIONS AND PROPOSALS
Within the thesis, conclusions are drawn regarding all the hypotheses from which the research
started, identifying a number of issues that can lead to the efficiency of the psychosocial
assistance services organized in the penitentiaries.

The conclusions concern both elements of the external environment of such organizations and
elements of their internal environment. Regarding the conclusions concerning the influence
exerted by the external environment on the psychosocial assistance services within the
penitentiaries, they target both the public policies in the field and the resources in the
immediate proximity of the penitentiaries. In relation to the internal environment, the
conclusions refer both to the way of organization and functioning of the services and to the
way in which they satisfy the needs of their clients / beneficiaries.
V. CONTRIBTIONS:
- Carrying out a comparative analysis of international and Romanian public policies in
the field of psychosocial assistance of detainees;
- Carrying out an analysis of the national strategy for social reintegration of persons
deprived of their liberty, as the main document through which the forecasting and
planning of the specific activities in the field, at national level, have been realized;
- Presentation of public management in parallel with principles and theories in the field
of public administration as well as analysis of public management from the
perspective of the prison system;
- Explaining the mechanisms through which the request for social reintegration of
persons deprived of their liberty can be influenced by the way in which the
management of the psychosocial assistance services in prisons is carried out;
- Formulation of concrete proposals for the efficiency of the psychosocial assistance
services organized within the Romanian penitentiaries.
