Pursuant to the provisions of the Agreement on Technical Barriers to Trade (Standards Code), submitted hereunder is the notification of the Philippine Government regarding the legislative, regulatory and administrative action taken as a result of acceptance of the Code on 15 February 1981 or which are currently in existence to ensure compliance with the provisions of the Agreement. 1. The Agreement was signed by the Philippines on 13 February 1981 and entered into force for the Philippines on 15 March 1981 in accordance with Article 15.6 of the Agreement. No specific legislation is required for the Philippines to implement the Agreement, copies of which have been circulated to the various government ministries involved in product standards, as well as the non-governmental agency, the Philippine Standards Association. 2. Existing Philippine legislation on standards is consistent with the obliga- tions assumed by the Philippine Government under this Agreement. Republic Act No. 4109 dated 20 June 1964 constitutes the basic legal source for standards in the Philippines. This has been subsequently amended by various laws, the latest being Executive Order No. 709 dated 29 July 1981 which converted the Philippines Bureau of Product Standards to the Product Standards Agency under the supervision and control of the Ministry of Trade and Industry. 3. For most products, technical regulations and certification systems are currently being administered by the Product Standards Agency and several other government agencies. A list of these agencies is attached as Annex A. 4. The Philippines Bureau of Standards has been designated as the principal enquiry point where all enquiries regarding Philippine application of the agree- ment shall be directed, pursuant to Article 10.1 thereof. However, in view of the recent government reorganization, this enquiry point would be the Product Standards Agency. The National GATT Secretariat which is under the Tariff Commission has been designated alternate enquiry point. Their office addresses are as follows:

Addendum

The following communication has been received from the delegation of the Philippines.

Pursuant to the provisions of the Agreement on Technical Barriers to Trade (Standards Code), submitted hereunder is the notification of the Philippine Government regarding the legislative, regulatory and administrative action taken as a result of acceptance of the Code on 15 February 1981 or which are currently in existence to ensure compliance with the provisions of the Agreement.

5. Measures taken to ensure implementation of the Ageeement include: the creation of an Inter-Agency Working Group on Technical Barriers to Trade composed of the different standardizing and certifying bodies in the Philippines, including the lone non-governmental standardizing body, the Philippine Standards Association; circulation of the text of the Agreement to all government ministries and related agencies; conducted meetings of the Working Group to co-ordinate all activities relating to standards and the implementation of the Agreement, particularly the dissemination of information on product notifications to private sector parties concerned.
