WHEREAS, on June 20, 2019, the Freehold Township Planning Board granted

preliminary and final site plan approval to Freehold Equity Partners, LLC (La-Z-Boy), Site Plan No. 703-2-18, Block 70, Lots 22 and 23, located on West Main Street; and

WHEREAS, in accordance with its Planning Board approval, the Developer is

required to enter into a Developer’s Agreement with the Township of Freehold; and WHEREAS, the Township Attorney has prepared a Developer’s Agreement for

this site plan.

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Freehold that the Mayor is hereby authorized to execute and the Township Clerk to attest the Developer’s Agreement between the Township of Freehold and the Developer in accordance with the approval granted by the Freehold Township Planning Board.

BE IT FURTHER RESOLVED that a copy of this Resolution certified by the Township Clerk to be a true copy be forwarded to: Township Engineer, Township Attorney, Township Planning Board, Township Construction Official and the Developer.

- - - R E S O L U T I O N - - - WHEREAS, Robert D. O’Donnell had posted the performance guarantees for

New Jersey Community Bank, Site Plan No. 765-06, located on Highway 9 and has requested release of the performance guarantees previously posted with the Township of Freehold in accordance with the previously received Planning Board approval; and

WHEREAS, the Township Engineer has, in a memorandum dated February 6, 2020, (attached hereto as Exhibit "A") recommended that the following performance guarantees be released:

Cash Performance Bond in the amount of $7,234.34; and WHEREAS, due to the length of time that has lapsed since the site improvements

have been completed, the Township Engineer recommends that the maintenance bond requirement be waived.

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the

Township of Freehold as follows:

1. It has reviewed, agrees with and hereby adopts all recommendations by the Township Engineer as set forth in Exhibit "A".

2. It hereby authorizes the release of the performance guarantees set forth in the Township Engineer's Memorandum attached hereto as Exhibit "A".

3. Pursuant to the recommendation of the Township Engineer as set forth in the memorandum referred to above, the Township hereby accepts the public improvements, if any, and any easements and/or dedications of property to be accepted by the Township of Freehold pursuant to the Planning Board approval.

- - - R E S O L U T I O N - - - WHEREAS, the Governor’s Council on Alcoholism and Drug Abuse established the Municipal Alliances for the Prevention of Alcoholism and Drug Abuse in 1989 to educate and engage residents, local government and law enforcement officials, schools, nonprofit organizations, the faith community, parents, youth and other allies in efforts to prevent alcoholism and drug abuse in communities throughout New Jersey; and, WHEREAS, the Freehold Township Committee, in the County of Monmouth and State of New Jersey, recognizes that the abuse of alcohol and drugs is a serious problem in our society amongst persons of all ages; and therefore has an established Municipal Alliance Committee; and, WHEREAS, the Township Committee further recognizes that it is incumbent upon, not only public officials, but upon the entire community to take action to prevent such abuses in our community; and, WHEREAS, the Township Committee has applied for funding to the Governor’s Council on Alcoholism and Drug Abuse through the County of Monmouth; NOW, THEREFORE, BE IT RESOLVED that the Township of Freehold, County of Monmouth, State of New Jersey hereby recognizes the following: 1. The Township Committee does hereby authorize submission of a strategic plan for the Freehold Township and Freehold Borough Municipal Alliance grant for fiscal year 2021 in the amount of: DEDR $26,972.00 Cash Match $ 4,686.00 In-Kind $28,117.50
