RECALLING Artic le 28(b) of the Convention on the International Marit ime Organ i za t ion concern ing the func tions of t he Commi t tee,

RECALLING ALSO resolution MSC. 4(48) by which the Commi ttee adopted the International Code for t he Construction and Equipment of Sh ips Car r ying Dangerous Chemicals in Bulk <t Be Code) ,

NOTING part B of chapter YII of t he Internat iona l Convent ion for the Safety of Life at Sea, 19 74 (SOLAS 1974), as amended, by which amendments to t he IEC Code shall be adopted, be brought into force and tske effe ct in accordance with article VI II of that Convention,

NOTING FURTHER resolut ion 10 of the International Conference on Tanker Safety snd Pollution Prevention, 1978, and resolution 4 of the I nternat i onal Conference on the Harmonized Syst em of Survey and Cert ificat ion, 1988, wh ich rec o~ended that IMO take the necessary act ion to in troduce the harmon iz ed system of su rvey and certification i nto various conventions and codes ,

RE COGNIZ I NG resolut ion MEPC. 40(2 9} by which t he Marine Environment Protec tion Committee ad op ted amendments to the IBC Code introducing the harmonized system of survey and certificat ion for the pur poses of the International Convention for t he Prevention of Pollution from Ships, 1973, as modi f ied by the Protocb l of 19 78 r e lating thereto (KARPOL 73/78),

HAYING CONSIDERED, at its fifty-eighth session, amendment s to the IBC Code proposed and c irculated in accordance with articl e YIII(b)(i) of SOLAS 1974,

1. ADOPTS, in accordance with artiele VI II(b) (iv) of SaLAS 1974, amendments t o the IBe Code , the text of which is aet out in the Annex t o the presen t resolution;

2. REQUESTS the Secretary-General , iD conformity wi th article YIII(b)(v) of SOLA S 1974, to transmit to all Contracting Governmen ts t o the Convention cert ified copies of the present resolution and the text of the amendments contained in the Annex;

3. DETERMlh'ES, in a c cordance with Artide VlI I (b)( v i)(2)(bb) of SO LAS 1974, that the amendments shall b e deemed to have been a ccep te d on the date six months af ter t he conditions for the entry into force o f both the 1988 SO LAS Protocol and the 1988 Load Line Protocol are met, provided that the date o f acceptance is not before 1 August 1991, un leas, prior t o that date, objection s are communi cated t o the O r gani~8ti o n 8S prov ided f or in a rticle VI I I(b)(vi)(2);

4. INVITES Cont r ac ting Governments to note that, i n accordance .... i th arti cle Vlll(b){vii) {2) of SOLAS 1974, the ame nd ments shall enter into force 8i~ months after their acceptanc e in accordance with the preceding paragraph;

5 . REQUESTS the Secretary-Genera l to info["lll all Cont racting Gove r nmea t s whe n the co nditions fo r the eotry ioto force of both the 1988 SOLAS Protocol and the 1988 Load Line Protocol are met aod, in conformity with article VIII(g) of SaLAS 1974 , when the a~endments to the ISC Code contained in the Annex to the present re solu t ion viII enter into for ce;

6. FURTHER REQUESTS the Secreta ry -Genera l to tran Smit to the Members of the Organization which ar e not Contracting Governments to SaLAS 1974 copies of the r es olu t ion and its Annex and to inform them when the amendments enter in t o for ce .

AMEr.'DI'fENTS TO THE INTERNATIONAL CODE FOR THE CONSTRUCIION

AND EQUIPHENT OF SHIPS CARRYING DANGEROUS CHEMI CALS IN BULK (lBe CODE)

1.3 Definitions

A new definition s hou ld he added 88 fol l ows:

"1. 3 .2.] "Annive rsar y date" means the da y and t he month of each year wh ich wil l correspond to the date of expi r y of the International Certificate of Fitness for the Carriage of Dangerous Chemicals in Bulkll.

1.5 Survey and Certification

the existing text of sec tioD 1.5 should be replaced by the following:

"1.5 . 1 Survey procedure

1.5.1.1 The survey of ships, 80 far 8S regards the enforcement of the provisions of the regulations and gran ting of exemptions there f rom, should be carried out by officera of the I.dministration. The Administrat ion may . however , entru!t the surveys either to surveyor~ Dominated for the purpose or to organi~ations recognized by it.

1.5. 1.2 The Admini s tration nominating surveyors or recogni~ing organizations to conduct surveys should, as a minimum, empower any nominated aurveyor or recognized organizat ion to!

.1 require repairs t o a ship; and

.2 carry out surveys if req uested by the appropriate authorities of a port State.

The Administrati on should notify the Organization of the specific respon!ibilities of the nominated surveyors or recognized organizations and of the conditions of the authority delegated to them for circulation to the Contracting Governments.

1.5 . 1.3 When a nominated surveyor or recognized organization determines tha t the condition of the ship or its equipment does not correspond substantially with the particulars of the International Certificate of Fitness for the Carriage of Dangerous Chemicsls in Bulk, or is such that the sh ip is not fit to proceed to s ea without danger to the ship, or persons on board, or without presenting unreasonable threat of harM to the marine environment, auch surveyor or organizatioo should immediately ensure that corrective action is taken and should in due course notify the Administration. If such corrective action is not taken, the Certificate should be withdravn and the Administration should be notified immediately; and, if the ship is in a port of another Contracting Government, the appropriate author i ties of the port State should also be notified immediately. When an officer of the Administration, a nominated surveyor or a recognized organization has notified the appropriate authorities of the port State. the Government of the port State concerned should give such officer. s urveyor or organization any nece!sary assis tance to carry out their

1.S.1.t.. I n e\'ery case, the Administration should guarantee the completeness and efficiency of the survey, and should undertake to ensure the neceslary arrangements to satisfy this ohligation.

1. 5 .2 Survey requiremen ts

1.5.2.1 The structure, equipment. fittings, arrangements and material (other than items in re spect of which a Cargo Ship Safety Construction Certificate , Cargo Ship Safety Equipment Certificste and Cargo Sh ip Ssfety Radio Certificate or Cargo Ship Safety Certificate sre issued) of s chemical tanker should be subjected to the following aurveys:

.1 ao ioitial survey before the ship is put in service or before the International Certificate of Fitness for the Carriage of Dangerous Chemicsla in Bulk is isaued for the first time, which should include a complete examination of its structure, equipment, fittiogs, arrangements snd material in so faT as the ship i, covered by the Code. This aurvey shuuld be such as tQ ensure that the atructure, equipment, fittings, arrangements snd material fully comply with the applicable provisions of the Code •

• 2 a renewal survey at intervals specified by the Administration, but not exceeding 5 years, except where 1.5.6.2.2, 1.5.6 . 5, 1.5.6.6 or 1.5.6.7 is applicable. The renewal survey should be such as t o ensure that the structure, equipment, fittings, arrangements and 1I1S.terial fully comply .... ith the applicable provisions of the Code •

• 3 an intermediate survey within 3 months before or after the second a nniversary date or within 3 months before or after the third anniversary date of the Certificate, which should take the place of one of the annua l surveys apecified in 1 . 5 . 2.1.4. The intermediate survey should be such ss to ensure that the safety equipment, and other equipment, and associated pump and piping systems fully comply with the applicable provis i ons of the Code and are in good working order. Such intermediate surveys should be endorsed on the Certificate iasued under 1.5.~ or 1.5.5 •

• 4 an annual survey within 3 months before or after each anniversary da te of the Certificate, including 8 general inspection of the structure, equipment, fittings, arrangements and material referred to in 1.5.2.1.1 to ensure that they have been maintained in accordance with 1.5.3 snd that they r emain satisfactory f or the service for which the ship is intended. Such annual surveys should be endorsed on the Certificate iasued under 1.5.4 or 1.5.5.

.5 ao additional s ur vey, either general or partial ac cord ing t o the cirCuMstances, should be mAd e when req uired after an investi gation prescr~bed in 1. 5.3.3, or vhenever any important repairs or renewals are made. Such a survey should ensure that the ne cessary repairs or renevals have been effect i vely made, t hat the materia l and workManship of such repairs or renewa ls a r e satis f ac t ory ; and chat the Ih i p is fit [0 proceed t o sea withou t danger t o the ship or persons on board or without presenting unreasonable threat of harm to the marine environment.

1. 5 . 3 Hainten.nce of conditions after survey

1.5. 3 .1 The condition of the ship and ita equipment should be maintained t o conform with the provisions of the Code to ensure that the ship vill remAin fit t o proceed to sea without danger to the ship or persons on board or withou t presentin g an unrea sonable threat of harm to the mar i ne environment.

1.5.3.2 After any survey of the ship un der 1.5.2 has been completed, no change should be mAde in the structure, equipment, fittings, arrangements Bnd material covered by the survey, vithout the sanction of the Administration, except by direc t replacement .

1.5.3.3 Whenever an acc ident occurs to a ship or a defect is discovered, either of Which affects the safety of the ship or the efficiency or completeness of its life-saving appliances or other equipment cove red by t he Code, the master or owner of the sh i p should report at the earliest oppo r t unity to the Administration, th e nominated surveyor or recognized organiz8tion responsible for issuing the Certificate , who should cause investigations t o be initiated to determine vhether a survey, as required by 1.5.2.1.5, is necessary. If the ship is in a port of another Contracting Government, the master or owner should also report immediately to the appropriate authorities of the port State and the nominated surveyor or recogn i zed organization ah ould ascertain that such a report ha s been made.

1.5.4 Issue or endorsement of International Certificate of Fitness

1.5.4.1 A Certificate called an International Certificate of Fitness for the Carriage of Dangerous Chemical s in Sulk, should be iSlued after an initial or renewal survey to a chemical tanker engaged in international voyages which complies with the relevant provisions of the Code.

1.5.4.2 An International Certificate of Pitness for the Carriage of Dangerous Chemicals in Bulk .hould be drawn up in the form corresponding to the model given in the appendix. If the language u.ed is neither Englis h nor French, the t ext should include the translation into one of these languages.

1 .5.4.3 The Certificate iasued under provisions of this section should be available on board for examination at all times.

1.5.4.4 Notwithatanding any other provi.ions of the amendments t o this Code adopted by the Marine Environment Protection Committee (HEPC) by resolut ion KEPC.40(29) and the Maritime Safety Committee (HSe) by resol ution HSC.16(58), any International Certificate of Fitness for the Carriage of Dangerous Chemicals in Bulk, which is current when these amendments enter into force, ahould remain valid until it expires under the terms of this Code pr ior to the amendments entering into force.

1.5.5 Issue or endorsement of International Certificate of Fitnes s by another Governmen t

1.5.5.1 A Government that is both 4 Controcting Governcent to the 1974 SOLAS Convention and a Party to KARPOL 73/78 may. at the request of anot he r such Government, cause a ship enti tled to fly the fl ag of the other State to be surveyed and, if satisfied that the provisions of the Code are compl ied with , issue or authorize the issue of the Internati onal Certi fi cate of Fi t ness f or the Carriage of Dangerous Chemicals in Bulk to the ship , and , wher e appropriate, endo rse or authorize the endorsement of the Certifica te on board the ship in accordance with the Code. Any Certifi cate 80 iS8ued should contai n a ststement t o the e ffect that it has been issued at the request of the Government of the State whose flag the ship is entitled to fly.

1.5.6 Duration and val idity of International Certificate of Fitnes s

1.5 .6.1 An International Certificate of Fitness for the Carriage of Dangerous Chemicals in Bulk should be issued for a period specified by the Administration wh ich should not exceed 5 years.

1.5. 6,2 .1 Notwithstanding the provisions of 1.5.6.1, when the ren ewal survey is completed within 3 months before the expiry date of the existing Ce rtificate . the new Certificate should be valid from the date of completion of the renewal survey to a date not exceeding 5 years from the date of expiry of the existing Certificate.

1.5.6.2.2 When the renewal survey is completed after the expiry date of the existing Certificate, the new Cer tificate shou ld be valid from the date of co~pletion of the renewal survey to a date not exceeding 5 years from the dat e of expiry of the existing Certificate.

1.5.6.2.3 When the renewal survey is cocpleted mo re than 3 months be f ore the expiry date of the existing Certificate. the new Certificate should be valid from the date of coapletion of the r enewal survey to a date not exceeding 5 years from the date of completion of the renewal survey.

1.5.6 .3 If a Ce rtificate is issued for a period of less than 5 years, the Administration may extend the validity of the Certificate beyond the expiry date to the maximum period specified in 1.5.6.1, provided that the surveys referred to in 1.5.2.1.3 and 1.5.2.1.4, applicable vh en a Certificate ia issued for a period of 5 years, are carried out aa appropriate.

1.5.6.4 If a rene~al survey has been completed and a De~ Certificate cannot be issued or placed on board the ship before the expiry date of the existing Certificate. the person or organization authorized by the Administration may endorse the existing Certificate and 8uch a Certificate should be accepted as valid for a fur ther period ~hi ch should not exceed 5 months from the expiry date.

1.5.6.5 If a ship, at the time when a Certificate expires. ia not in a port in which it is to be surveyed, the Administration may extend the period of validity of the Certificate but this extension should be granted only for the purpose of allowing the ship to complete its voyage to the port in which it is to be surveyed, and then only in caaes where it appears proper and reasonable to do so. No Certificate should be extended for a period longer than) months . and a ship to which an extension ia granted should not, on its arrival in the port in Yhich it is to be surveyed, be entitled by virtue of

1 . 5.6.6 A Certificate i ssued to 4 Ihip engaged on short vo yages whi ch has not been ext ended under the foregoi ng provisions of this .eetion may be exten ded by the Administrat ion for a period of grace of up t o one mo nth from the date of expiry stated on it. When the renewal survey is completed, the new Certificate Ihould be val i d to a date not exceeding 5 years from th e date of exp i ry of the existing Certificate b e fo re the e xtension V8 8 granted.

1.5.6.7 In special circumstances, as determined by the Administration, a new Cer tificate need not be dated from the date of expiry of the existing Certificate as required by 1.5.6.2.2, 1.5.6.5 or 1.5.6 .6. In these special circumstances, the new Certificate should be valid t o a date not exceed ing 5 years from the date o f completion of t he renewal survey .

1.5.6.8 If an annual or intermediate survey is cO«lpleted before the period specified in 1.5.2, then:

.1 the anniversary date 8ho'-'1\ on the Certificate should be a«lended by endorse«lent to a date which s hould not be «lo re t han 3 mon ths later than the date on whic h the survey vas cO«lpleted;

.2 the subsequent annual or intermediate survey required by 1. 5.2 should be completed at the in tervals prescribed by that secti on using the new anniversary date;

.3 the exp i ry date may remain unchanged provided one or «lore annual or intermediate surveys, as appropriate, are carried out so that the maxi«lu«l intervals between the surveys prescribed by 1.5.2 are not exceeded.

1.5.6.9 A Certificate issued under 1.5.4 or 1.5.5 should cea8e to be valid in any of the following cases:

.1 if the relevant 8urveys are not completed vithin the periodS specified under 1. 5.2;

. 2 if the Cer tificate is not endorsed in accordance vith 1.5.2 .1.3 or 1.5.2.1.4;

.3 upon transfer of the ship to the flag of another State. A new Certificate should only be issued when the Government isauing the new Certificate is fully satisfied that the 8hip is in cO«lpliance with the require«lents of 1.5.3.1 and 1.5.3.2. In the case of a transfer between Governments that are bo th a Contracting Government to the 1974 SOLAS Convention and a Party to MARPOL 73/78, if reque8ted within 3 months a fter the transfer has taken place, the Government of the State whose flag the ship vas formerly entitled to fly should, as 800n as possible, transmit to the Administration copies of the Certificate carried by the ship before the transfer and, if available. copies of the relevant 8urvey reports."
