TO: ALL PROSPECTIVE BIDDERS DATE: January 7, 2022 Bid Manager: Heather Shortino, Recreation Coordinator Bid Due Date: January 14, 2022 PROJECT NAME: INTERACTIVE ACTIVITIES RENTAL SERVICES-FITFEST (RC-22-055) PROJECT DESCRIPTION The Cosumnes Community Services District (CSD), a special district local government agency serving south Sacramento County, is seeking competitive bids for Interactive Activities Rental Services for the Elk Grove FitFest on April 23, 2022. PROJECT LOCATION: Elk Grove Park (9950 Elk Grove-Florin Rd., Elk Grove, CA 95624) BID FORM All Proposals shall be made upon the Bid Form, attached hereto as Exhibit “A”. Please direct questions prior to the Proposal submission time specified below in writing to Heather Shortino, Recreation Coordinator. Proposals received after the time specified above will be returned. Proposals shall be valid for 90 calendar days after the time specified above.

AWARD OF CONTRACT

The District shall award the Contract for the Project to the Bid that is deemed most advantageous to the District. The Board of Directors of the Cosumnes Community Services District reserves the right to reject any or any proposal and to waive any informality in any Proposal.

INSURANCE

Contracted Bidder is required to provide a certificate of insurance comprehensive general or comprehensive personal liability coverage for a minimum of $1,000,000 Per Occurrence, $2,000,000 Aggregate naming the Cosumnes Community Services District additional insured. The certificate must name: Cosumnes Community Services District, City of Elk Grove and the County of Sacramento, 8820 Elk Grove Blvd. Elk Grove, CA 95624. The following statement must appear on the certificate: “Additional Insured Endorsement names the Cosumnes Community Services District, the City of Elk Grove and the County of Sacramento, its directors, agents, or employees are included as additional insured.”

PAYMENT

The prices paid for the various items in the bid proposal shall include full compensation for furnishing all labor, materials, tools, equipment, and incidentals necessary to complete the finished service as provided in these specifications. The Cosumnes Community Services District (CSD) is an independent local government entity and a political subdivision of the State of California, established under Government Code Sections 56261.1 and 56439(c). The District provides emergency medical and fire protection services to the cities of Elk Grove and Galt and to unincorporated areas in south Sacramento County, and provides parks and recreation services to the Elk Grove Community. The District encompasses roughly 157 square miles and serves an estimated population of 174,400. The CSD is dedicated to the principles of competition and fairness. The District is committed to ensuring that local taxpayers receive the maximum value for every District expenditure. Toward that goal, we encourage qualified vendors to participate in doing business with the CSD.

1. The undersigned Bidder proposes and agrees if this Proposal is accepted, to enter into an agreement with the Cosumnes Community Services District to perform and furnish all services provided in these specifications.

Please submit a bid that includes all associated costs that meets and/or exceeds the following bid specifications. All units may be substituted for something comparable with CSD approval. Please note we are not looking for inflatables or games; a separate RFP is listed on our website if interested. The Services to be provided are more particularly described in the attached hereto as EXHIBIT “A” and incorporated herein by reference.

Contractor shall perform all Services under this Letter of Agreement in a skillful and competent manner, consistent with the standards generally recognized as being employed by professionals in the same discipline in the State of California, and consistent with all applicable laws. Contractor represents that it, its employees and sub-contractors have all licenses, permits, qualifications and approvals of whatever nature that are legally required to perform the Services, and that such licenses, permits, qualification and approvals shall be maintained throughout the term of this Agreement. Compensation for the above services shall be billed at the rate(s) described in EXHIBIT “A” - BID FORM. However, unless expressly agreed in writing in advance by the District, the cost to the District for the Services shall not exceed $ [Insert Amount].

If Contractor is an employer or otherwise hires one or more employees during the term of this Letter of Agreement, Consultant shall also provide proof of workers compensation coverage for such employees which meet all requirements of state law.

Invoices shall be submitted to the District after Services are rendered at the completion of each event to the address listed above. The District shall review and pay the approved charges on such invoices in a timely manner. Services shall begin on April 23, 2022 and be completed by April 23, 2022 unless extended by the District in writing. The District may terminate this Letter of Agreement at any time with or without cause. If the District finds it necessary to terminate this Letter of Agreement without cause before completion of the Services, Contractor shall be entitled to be paid in full for those Services adequately completed prior to the notification of termination. Contractor may terminate this Letter of Agreement for cause only.

Contractor shall defend, indemnify and hold the District, its officials, officers, employees, agents and volunteers free and harmless from any and all claims, demands, causes of action, expenses, liabilities, losses, damages and injuries to property or persons, including wrongful death, in any manner arising out of or incident to any alleged acts, omissions or willful misconduct of Contractor, its officials, officers, employees, agents, contractors and sub-contractors arising out of or in

connection with the performance of the Services or this Agreement, including, without limitation, the payment of all consequential damages, attorneys’ fees, experts’ fees and costs, and other related costs and expenses.
