1. !t Is stipulated In Sec. 181 of DepED Order No. 88, s. 2010 dated June 24, 2010 entitled "2010 Revised Manual of Regulations for Private Schools in Basic Education "any private school which desires to revise its rates of tuition and other school fees or charges or to impose other fees or charges shall file

application therefor with the Regional Director". The application shall include the follov,,ing documents:

a. Statement of the itemized current rates of tuition and other charges and the corresponding

itemized proposed changes thereon, as well as the new fees or charges proposed to be imposed, and of the proposed allocation of the incremental proceeds. Such statements

shall, when accomplished be under oath by the proper official (s) of the school concerned.

b. Financial statement sho,.'lfing the financial status of the school duly certified by a Certified

Public Accountant.

c. A copy of the last tax return, filed with the Bureau of Internal Revenue.

d. Pmof of the consultation conducted (Minutes of the Meeting with the Names and signature of the attendees)

e. Certification undei oath that 70% of the tuition or other school fees Oi chaiges shall be

allocated for payment of salaries, wages, allowances and other benefits of the members of

the faculty and all other employees of the school concerned, and the balance for

institutional development, student assistance and extension services, and return of

investment.

REMINDERS ON THE TIMELINES FOR THE ISSUANCE OF TEMPOR.A.RY GOVERNMENT PERMIT, RENEWAL, AND GOVERNMENT RECOGNITION

1. The Schools Division Offices and all Prjvate Schools are requested to follow and act in

accordance ,,vith the provisions stipulated in DepED Order No. 88, s. 2010 dated June 241 2010 entitled "2010 Revised Manual of Regulations for Private Schools in Basic Education" and in DepED Order No. 11, s. 2011 dated February 4, 2011 entitled" Amendments to the 2010 Revised Manual of Regulations for Private Schools in Basic Education" particularly on the following Sections for the jssuance of Government Permit and Recognition.

Section 28. Authority to Operate. Educational i.11stitutions can undertake educational operations only when so. authorized by the Department Consistent with the national educational policies, plans and standards1 the Regional Director concerned shall have the authority, accountabibty and responsibility for approving the establishment of private pre-schoot elementary, and high schools and learning centers.

Section 29. Permit and Recognition. Government authority vvhich may be issued for the operation of private schools in basic education shall be of two kinds: a) pemrit and b)

recognition.

· PERMIT - A permit for each year level or course shaU be effective for a period of one year. The permit issued to a year is valid only for a specific educationa1 program and, while issued on a school year basis shall remain valid until formally revoked by t.lie DeparL'Tient.

RECOGNITION - A recognition for each year level or course shaU be for an indefinite period provided that the requirements of law, rules and standards will

be satisfied.

Section 30 of the 2010 Revised Manual on the Requirements for Issuance of Permit is amended :in DepED Order No. 11 s. 2011 dated February 4, 2011. The highlights of the amendments are on the timelines in the :issua,,ce of temporary permit.

• Not late:r than September 30 of the same year the said application was filed­Per authority of the Regional Director, the Division Office shall assess the completeness of the documentary requirements attached to the subject application. The applicant school shall be :informed in writing of deficiencies noted.

• Not later than October 30 of the same year..,. -The school shall submit compliance of the deficiencies.

• Not later than Novem,ber 30 of the same year - If all the documentary requirements are complete or the school has complied the deficiencies! the Division Office through the Division Inspection Team shall conduct ocular inspection and evaluation of the applicant school's compliance with the minimum standards set for the program applied for.

• Not later than December 15 of the same year - The applicant school shall be officially infom1.ed of the deficiencies noted, after the conduct of the inspection and evaluation until January 31 of the following year. Thereafter, the Regional Office shall re-evaluate and validate compliance with the requirements.

• Not later than February 28 of the following year the said application was filed -The issuance of the Temporary Government PerIDit, if the applicant school complies with all the requirements. Otherwise, a written disapproval shall be issued within the same period.

Renewal of Temporary Perm.it- The Temporary Permit is valid for one year only.

e On or before January 2"d preceding the opening of the school year - the newly­established school must apply for a RENEW AL PERMIT for the succeeding year .

.. Grant of Recognition - Tne grant of recof,i Lition for schools shall be based on their satisfactory operation during the school year, without any deficiencies in :instruction, administration and/ or management and on full compliance with the prescribed

• On or before February 1"1 preceding the opening of the school year in which recognition is Lntended- Schools operating courses under a temporary permit shall file an application for recognition of those courses on the first and second

level of instr.uctions.

2. Failure to. submit the application w1th t.l-te required documents on the. above-stated tirnelines shall be subjected to the following provisions as stipulated in Batas Pambansa Big. 232

dated September 11, 1982:

Par. 2, Sec 28 which states that:

Section 68 on Penalty Clause:

3. All schools shall post copies of new permits and recognition of their programs on bulletin boards located inside their campuses.

GUIDELINES FOR THE ISSUANCE OF GOVElL~lvIENT PERMIT TO OPEN/OPERATE A NE\V SCHOOL/COURSE

A! SUBMISSSION of LETTER-REQUEST with Notadzed FeasibiJity Study

I. A letter-request for the opening of a new school, or for the operation of a new course/grade or year level in existing elementary and secondary schools, shall be addressed to the DepED Regional Director and coursed through the Office of the Schools Division Superintendent of the city or lo~ality where proposed school is located.

Date of Submission: On or before September 30 preceding the start of the school year when the school/new course is supposed to operate.

2. A notarized Feasibility Study must accompany the letter-request.

Feasibility study must cover comprehensively the following factors, supp01ted with sufficient evidence:

a. Purpose and objectives of proposed school or course; b. Availability and adequacy of school site and building, including documents of ownership

thereof, location plan, development plan, pictures, or architect's plan of building, if the same is still to be constructed;

c. Itemized cost of the project covering ihe en!ire course in terms of site development, school building and quarters. ciassrooms, equipment and facilities, library, salaries of faculty and staff, and maintenance;

d. Financial capacity of applicant, including his resources to support its operation from year to year without depending solely on student's fees;

e. Proposed faculty line-up and administrative and supervisory staff together with their individual Transcript of Records, eligibility, and (widence of willingness to join the school; and

f Need or demand for establishment of the school/ or operation of course in the locality. If the course is already being offered in the same town or city, there must be an evidence of the following factors:

• Distance of the applicant-school to the·existing schooC • Emolment in the existing school; • Number of students in the same locality enrolled in schools other than in the existing

school; • Number and names of prospective pupils/students of applicant-school; and • Facilities, standards, and supportive provisions for effective instruction and quality

education.

(Note: Failure to submit the desired FeasibHity Study tn support the request for operation shall be grounds for the outright dismissal of the same.)

3. The Regional Office or the Division Office (as authorized by the Regional Director) evaluates the request for the opening and operation of the new school/course/gradelyear level.

B. ACCOMPLISHMENT of APl'LICATION FORM

4. If the request is deemed in order and the proposed operation of the new school/course/grade/year level is feasible and viable. the DepED Regional Office issues '~Application Form for Government Permit".

5. Applicant-school accomplishes the Application Form and complies with all the requirements, supported by duly certified/authent:c documents (2copies in 2 folders).

C. REGISTRATION with Securities and Exchange Commh,sion (SEC)

6. Applicant goes to SEC Office to get forms or documents for SEC registration.

7. Applicant gets an endorsement from the DepED Regional Director addressed to the SEC Director, relative to the school's application for SEC registration.

8. Applicant submits accomplished SEC documents, togt,'ther with the Regional Office endorsement, to SEC Office. ·

9. Applicant gets the approved SEC Registration from the SEC office and includes it in the Schools' Folder of Required Documents.

D. COMPLIANCE with requirements listed in Application Forut supported by documents

Comply with required papers and documents. (See the list of requirements in the Application Form.)

E. SUBMISSION of COMPLETE DOCUMENTS

10. Applicant submits Completed Documents in 2 folders to the Division Office through the Records Section.· (Folder will be marked "Received" with the corresponding date.)

11. Division Supervisor for Private Schools evaluates all the documents submitted by applicant-school, then endorses/forwards them to the Regional Office.

F. OCULAR INSPECTION after Payment of Inspection Fee and School Bond

12. Applicant pays the inspection fee ofTwo Thousand Pesos (P2,000.00) at the Division Office and a school bond in the amount of Two Thousand Pesos (P2,000.00) per course at the Regional Office .

13. The Regional Field Technical Assistance Team and the Divis1on Supervisor for Private Schools conduct an ocular inspection and check the veracity of submitted documents against the actual facilities and conditions of applicanl-schoo!.

14. Division Supervisor for Private Schoo.ls prepnres Inspection Report with recommendations.

15. If there are deficiencies, Supervisor prepares an endorsement signed by the Schools Division Superfotendent returning all documents and advising applicant to correct the identified deficiencies and to comply with all the requirements.

16. If all requirements a1·e met and the recommendation is favorable, Supervisor prepares TEMPORARY.PERMIT for Superintendent's signature.

17. Schools .Division Superintendent signs recommendatfou for approval .of TEMPORARY PEAAHT and endorses it to the Regional Director, DepED Region VII Office ..

G. ISSUANCE of TEMPORARY PEAAfIT

18. Regional Ofl:ice through the members of the Regional F~eld Technical Assistance Team . reviews all documents, as well as the recommendation in the Inspection Report.

19. If all requirements are met, Regional Diredor signs ~rEMPORARY PERMIT.

20. TEMPORARY PERMIT is endorsed to appjicant-school through Division Office. In turn, Division Office endorses approved Tx3MPORARY PERl\'llT to applicant-school.

With the approved TEMPORARY PERi\llT, the applicant-school can start actual operation of its new school/course/grade/year level.

(NOTE: The TEMPORARY PERlffiT is valid for one school year only.

The newly-established school must apply for a RENEW AL PERMIT for the succeeding year.·

The school can later apply for.GOVERNMENT RECOGNITION upon compliance ·with the corresponding requirements.) ·

,Renewal of TEMPORARY GOVERNMENT PERMIT

I. Follow the same requirements in the Applicatioh Fonn.

2. Submit: updated/cunent data or changes in the do\';umei1ts of the school, including curriculum.

----- New pictures of improvements made in the school facilities. ----- List of additional textbooks, instmctional materials, supplies and equipment. ----- Copy of Tuition Fee schedule (if there is an increase in amount, there must be an

approval from the Regional Director.) ---- Copy of Teachers' and employees' SSS/Retirement Plan. ----- Copy of latest Financial Statement of the school certified by an independent CPA.

3. Payment of Inspection Fee in the amount of P2,000.00.

4. The Regional Field Technical Assistance Te.am, together with th~Division Supervisor for Private Schools, conducts an ocular inspection of the applicant-school to check the veracity of documents and verify the actual conditions of school site, buildings, classrooms and other facilities.

5. Supervisor prepares Inspection Report and makes recommendation based on findings.

6. If there are deficiencies, Supervisor prepg_res endorsement returning .a.II documents and advising applicant-school to correct the deficiencies and to comply with aU the. requirements.

7. If all the requirements are met, Schools Division Superintendent signs reconunendation for approval of the renewal of TEMPORARY PERMIT ·

8. The Regional Field Technical Assistance Team reviews the completeness of the documents, then countersigns t}1e Government Permit.

9. Regional Director approves and signs the Renewal of Temporary Government Permit.

10. The approved Government Permit 1s indorsed to the Di.vision Office, then to the applicant-school.

Grant of GOVERNI\'IENT RECOGNITION

1. Follow the same requirement in the Application Fo1m and the guidelines in the renewal of Government Permit. Date of Submission: On or b~fore February l l'l preceding the opening of the school year.

2. 7. If all requirements are met, Schools Division Superintendent signs recommendation for approval of the grant of Goventment Recognition. ·

8. The Regional Field· Technical Assistance Team reviews the .completeness of the documents, then countersigns the Certificate of Government Recognition.

9. Regional Director approves and signs the Certificate of Government Recognition.

10. The approved Certificate of Government Recognition is endorsed to the Division Office, then to the applicant-school.

2. The above-mentioned documents shall be submitted to the Schools Division Office together

with the following additional documents for processing by the Division-in-charge and to be endorsed to

the Regional Office for validation:

a. letter-Request of the School

b. Photocopy of the School Permit/Government Recognition

c. Photocopy of the Letter of Confirmation of Tuition Fees and Other School Fees of

the Previous School Year

3. For private schools' applications of confirmation of non-increase in tuition fees and other school

fees, the required documents to be submitted by private schools are those that are enumerated in

paragraph no. 2 of this Memorandum.

4. All Schools Division Offices are requested to endorse the applications for confirmation of tuition

and other school fees or charges immediately after processing and validating the documents. The deadline for submission of said application to the Regional Office is April 30 of ever/ year. Applications received

after the deadline shall be denied by this Office.

5. For newly opened schools or new courses/levels offered by the schools, applicant-school shail be

required to submit proposal on the schedule of tuition fees and other school fees.

6. The letter of confirmation received by the private schools shall be posted on a conspicuous place

in the school for the information and guidance of the learners, teachers, parents, alumni, and other interested parties.
