    EXECUTIVE SUMMARY

    This Final Report summarizes the resultsachievedandthefundsusedintheimplemen-tationoftheRealEstateCadastreandRegistra-tionProject(RECRProject)fortheperiodfromsigningoftheloanJune06,2005tillDecember31,2010.

    TheobjectiveofthisReportistopresent:

    • To the general public, the project resultsandtheintegrationoftheprojectactivitieswithintheGovernment’seffortstoestablishaqualityRegisterforRealEstateCadastre;

    • To the professional users, the project re-sults and the future perspectives for fur-ther project implementation in the newthreeyearperiodofadditionalfinancing;

    • To theAREC staff, theproject results andthe futureperspectives for successful im-plementationoftheadditionalfinancingoftheproject.

    The LoanAgreement IBRDNo.4768–MKbe-tween the Republic of Macedonia (the Bor-rower) and the International Bank for Recon-structionandDevelopment(IBRD)forfinancing

    of the Real Estate Cadastre and RegistrationProject was signed on 06 June 2005 at theWorldBankOfficeinSkopje.

    TheGovernmentofR.Macedonia,atthetimeofthesigningoftheAgreementhasappointedtheStateAuthorityforGeodeticWorks(SAGW)-nowreferredtoastheAgencyforRealEstateCadastre(AREC),astheexecutivebodyoftheProject.

    TheprimaryobjectiveoftheRECRProjectistobuildanefficientandeffectiverealestateca-dastreandregistrationsystem,thuscontribut-ing to the development of efficient land andrealestatemarketsinR.Macedonia.

    TheLoanclosingdatewasDecember31.2010,whichwasalsothedeadlineforcompletingallactivities.

    TheamountthatR.MacedoniaborrowedfromtheIBRD(theWorldBank)is10.3millionEUR.The agreed co-financing amount provided bythe Macedonian Government is 1.52 millionEUR.

    The complete implementation of the projectwasexecutedincompliancewiththesetobjec-tivesandwasratedbytheWorldBankmissionthattookplaceinJune2009ashighlysatisfac-tory.Itistheopinionoftheborrowerthatthegeneralobjectivesoftheprojectandthespeci-fied project outputs have been completelyachieved. In fact, theWorld Bank has statedthat in number of areas the results are wellabovetheoutput indicators initiallyset intheProjectAppraisalDocument(PAD).

    TheBankmissionshavevisited theprojectathalfyearlyintervalsbetween2005and2010.

    AREC has won a World Bank award

    At the end of March 2010, the World BankManagement announced the winners of thethird annual „Improving the Lives of People in Europe and Central Asia Region 2010”.TheRealEstateCadastreandRegistrationProject,implementedattheAgencyforRealEstateCa-dastre,was selectedasoneof the12award-edprojects for2010. Ina competitionof282projects and among 47well conceived nomi-nationscoveringawiderangeofareas/sectorsand countries, the Real Estate Cadastre andRegistration Project according to the WorldBank isoneof the12projectswhich showedinnovationandspecific tangible results in theimprovementofthepropertyregistrationsys-teminR.MacedoniawithanimpactonthelivesofthepeopleofRM.Thefinalceremonyeventwhereall12awardedprojectswerepresentedwiththeawardstookplaceonJune03,2010inWashington.

    World Bank Managing Director Visited R.Macedonia

    World Bank Managing Director Ms. NgoziOkonjo-IwealavisitedR.MacedoniaonJanuary11-12,2011,aspartofherfirsttriptoWesternBalkans.TheaimofthevisitwastodiscussthefuturegrowthagendaandreiteratetheWorldBank’s support to theGovernmentunder thenewCountryPartnershipStrategy.Ms. Okonjo-Iweala met with the Vice PrimeMinisterandMinisterofFinanceZoranStavre-skiandVicePrimeMinisterforEUAffairsVaskoNaumovskiandwithrepresentativesofcivilso-ciety.

    TheManaging Director started her visit withthecadastreofficeinthecapitalofSkopje.Withthe help of a Bank-financed project, R. Mac-edoniadevelopedamodelcadastresystemintheregion.“This is a great improvement,”toldheracitizenwhocameto thecadastreofficethatmorning.“It took six months to get a title before. Today, it is done in a matter of days.”

    - “I was truly impressed by the progress R. Mac-edonia made in the last 5 years reaching 99% coverage of the country by the real estate ca-dastre from 43% in 2005 and, at the same time, making a huge improvement in the quality of services. I hope Macedonia can share its expe-rience with other countries through the South-South initiative,” said Ngozi Okonjo-Iweala.

    2.1. OVERALL PROJECt OBJECtIVEs

    Thelong-termgoalsoftheRECRProjectaretosupporttheGovernment’sdevelopmentagen-daofpovertyreduction,promotingeconomicgrowth and increasing private sector invest-ment.

    TheProjectimprovedthecoverage,complete-nessandfunctionalityoftherealpropertyandcadastreregistrationsystems,therebycontrib-utingtothedevelopmentoftherealpropertymarkets in R.Macedonia. Themain activitieswererelatedtothefollowingissues:

    • Acceleratingtheestablishmentoftherealestatecadastre (REC)and theregistrationof rights throughout the territory of R.Macedonia;

    • Improving processes and proceduresthroughre-engineeringofofficefunctionsand introducing automation and IT tech-nology to provide efficient registrationservicesbytheAgencyforRealEstateCa-dastre;

    • Improvingtheinstitutionalcapacityofthehuman resources and strategic develop-mentofAREC,and

    • Developing thegovernment’scapacity toformulatepoliciesinordertoachieveeffi-cientpropertymarkets.

    Theprojecthasimprovedthesecurityofprop-erty rights and the performance of propertymarkets.Thishasfacilitatedprivateinvestment

    andhascreatedpossibilitiesfornewjobs.Theproject has also reduced the time for estab-lishing the real estate cadastre by improvingthe service standards for registeringpropertytransactions from a few weeks to one day.Theseimprovements,alongwithpublicaware-nesscampaignsandcitizenhotlines,helpedtoimprove transparency and expedited servicesintheregistrationofpropertytransactions.

    Inachievingtheaboveresults,theProjectex-ecutedsignificantactivitiesrelatedtodevelop-ingefficientprocedures,methodsandtechnicalsolutions for the establishment and mainte-nance of the REC, includingmodernization oftherelatedlaws,bylawsandregulations. By the end of 2010, the following project re-sultshavebeenachieved:

    • TheRECcovers99.50%fromtheentireter-ritoryofMacedonia;

    • Streamlined procedures for convertinglandcadastretorealestatecadastre(con-versionofpossession rights toownershiprights)inruralareas;

    • Transactionsareregistered inallARECof-fices inthetimeperiodprescribedbytheLawonREC(withinaperiodfrom1to15days,dependingonthetypeofthetrans-action);

    • Allcadastralsurveyingisdonethroughpri-vatesurveyors;and

    • There is awell functioningmechanism intheGovernmenttoformulatelandpoliciesthroughparticipatoryprocess.

    2.2 . PROJECt COMPONENts

    TheProjectwasimplementedthrough4Com-ponents:

    • Component1:CompletingtheRealEstateCadastre

    • Component2 : InstitutionalDevelopmentand Improving service Delivery

    • Component3:DevelopmentofLandPolicy• Component4:ProjectManagement

    Component1:

    This component supported the completion ofrealestatecadastreandregistrationofrightsin99.50%ofthecountrybytheendof2010.Thecomponentincludedtwosub-components:

    (I) Operational support for completion of theREC,includingbasemapping,cadastralre-survey,supportforsystematicadjudicationandregistra-tionof real estate rights, and rationalizationofregistrationprocedures;and

    (II) PublicawarenesscampaignforREC(system-aticregistration).

    Component2:

    The objective of this componentwas to trans-formAREC into amodern and efficient agencyforrealestatecadastre,andimproveservicede-liveryinalllocalofficeswithagoaltocompletethe registrationof transactionswithin thetimeperiodprescribedbytheLawonRECbytheendoftheproject.Thiscomponentincludedthefol-lowingsub-components:

    (I) InstitutionaldevelopmentofARECasanef-ficientandpublicserviceorientedagency;

    (II) Promoting transparency and accountabilitythroughtheissuanceof“customerbillofrights”,establishment of a hotline for customer com-plaints,andstrengthening internal investigationofcorruptionandmisconduct;

    (III) Improvingregistrationservicesforthepub-lic,focusingonAREClocalofficesandcustomerservicesforsecondarytransactions;

    (IV)Development of an automated registrationandcadastresystem;and

    (V) EducationandtrainingforARECstaffaswellastheprivatesectorsurveyors.

    Component3:

    Thiscomponentsupportedformulationandde-velopmentofpoliciesneededtoensurethecom-pletion of the real estate cadastre and the fullfunctioning of the real estatemarkets throughdevelopmentofgovernmentcapacitytocoordi-natetheformulationoflandandrealestatepoli-ciesthroughconsultativeprocesses.

    Component4:

    This component included support to AREC tomanagetheprojectthroughfinancingthePMUexpensesincludingcontractstaff,aswellasmon-itoringandevaluation.

    2.3. PROJECt MANAgEMENt

    TheProjectmanagementisbasedontheLoanAgreement and the Project Appraisal Docu-ment(PAD).

    Theentitiesparticipatingintheprojectimple-mentationweretheProjectCoordinationCom-mittee(hereafterreferredtoas“PCC”)andtheProjectManagement Unit (hereafter referredtoas“PMU”).

    The Project Coordination Committee was chairedbytheDirectorofARECandwasmadeup of state advisors and other heads of sec-tors.TheCommitteeensuredthecoordinationamongthevarioussectorsinimplementingtheproject.

    the Project Management Unitwas themaincoordinatingandexecutivebodyoftheProject,staffedwithcontractedconsultantsofrequireddisciplinesandARECstaffwiththetasktosuc-cessfullyimplementtheProjectandassuretheharmonizationofactivitiesrelatedtothemod-ernizationofthelandregistrationandcadastralsystem.ThePMUhadthefollowingfunctions:

    (1)ProjectCoordination(2)Planningandbudgeting;(3)Procurement;(4)Financialmanagement;and(5)Monitoringandevaluation.

    TheProjectManagementUnitreportedtotheDirectoroftheARECandcooperatedwiththeProject Coordination Committee, the ARECSectors and Departments, the AREC local of-ficesandtheCenterforREC-Skopje.

    The implementation of the different ProjectcomponentswasaresponsibilityoftheexistingAREC sectors anddepartments and theAREClocal offices. The coordination of the threemain components (establishment of REC, in-stitutional development and improvement inservicedeliveryandlandpolicydevelopment)wasperformedbyARECstaff(componentco-ordinators)assignedbytheARECDirector.TheindividualsassignedwerenotpartofthePMU,but were Project Coordination Committeemembers.

    Monitoringandevaluationwasakeyfactorinrecognizing theproject success. TheMonitor-ingfocusedonthreeprojectareas:

    1. Regularmonitoringofprojectperformancesupported by computerized system formoni-toringandevaluation,establishedintheinitialperiodofProjectimplementation.Thesystemmonitoredthenumberofpropertiessubjecttore-survey,adjudicationandtheregistrationofreal estate rights. The systemalsomonitoredthecommissions’output,thedisputesandthe

    complaintsbythecitizens,andthespeedandthequalityofregisteringon-goingtransactions.

    2. Regular Customer surveys (which wereinitiated in the project preparation phase) tomonitor and evaluate customer satisfactionandcompliancewithservicestandards.

    3. Socio-economicandenvironmentalimpactassessmentoftheproject.

    Theperformancemonitoringindicatorsusedtomonitor and evaluate the Project implementa-tionperformanceandimpactweremonitoredbytheWBSupervisionTeam,onaquarterlybasis.

    SincethestartofaWorldBank-fundedRealEs-tateCadastreandRegistrationProject (RECRP)inMacedoniain2005:

    • Registered property transactions in thecountry have increased by 151 %, reach-ing105,567registeredtransactionsin2010comparedwith42,116in2005;

    • Annual mortgages registered in the landadministrationsystemincreasedfrom2920in 2005 to 9145 in 2010, demonstrating asubstantialincreaseintheuseofownershiprightsascollateral.Over40,000mortgageshavebeenregisteredsincethecommence-mentoftheRECRPinMacedonia;

    • TheoverallCustomersatisfactionincreasedfrom2.7in2005to3.67in2009(scale1-5);

    • In 2005, the established RECwas 46.1 %.Attheendof2010theestablishedRECwas99.50%;

    • In90%ofregistrationofficesinthecountry,theProjecthelpedreducedthetimetoreg-isterasaletransactiontofivedaysor less–downfrom60daysin2004;

    • Theworksare100%performedbythepri-vatesector.Attheendof2010,therewere252licensedprivatesurveyorsand110reg-isteredsurveyingcompaniesprovidingserv-icesdirectly tocitizens inMacedonia–upfrom14privatesurveyorsandnoregisteredsurveying companies at the commence-mentoftheProject.

    Outoftheplannedfundsforexecutionoftheactivitiesfromthiscomponentby31ofDecem-ber2010,contractsweresignedintheamountof5.875.493EUR,and5.807.244EURhasbeenpaid.

    Themostsignificantoutcomefromthiscompo-nentistheestablishmentofRECon99.50%ofthe entire territory of Republic ofMacedoniaby 31 of December, 2010. The implementa-tionoftheactivitiesfromthefirstcomponentwasprecededbynumberofactivities,suchas:aero-photogrammetricsurveyof190CMssup-portedbyaPublicAwarenessCampaignunderthemotto“Markwhat isyours”,digitalizationofthecurrentcadastralplansfor260CMsandtheirupdating–reambulationintheurbancon-struction area, production of inventory lists,recruiting additional number of commissions(lawyers, surveyors and administrative assist-ants)andtrainingthesecommissionsaswellaslogistical support to theARECcommissions inthe rights registration procedure. In addition,the AREC has procured vehicles, officemate-rialsandequipment foranuninterruptedandon-timeestablishmentoftherealestatecadas-tre,whichactuallywastheessentialobjectiveofthiscomponentandtheProject.

    The establishment of REC was divided intothreesectorsA,BandCenterforREC-Skopje.

    By31stofDecember2010,intheCenterforREC-Skopje8cadastremunicipalities(CM)remaintobeadjudicated,while intheSectorforRECB,onlyonecadastremunicipalityremainstobeadjudicated–CMBanicaundertheauthorityoftheLocalOfficeforREC–Gostivar.Theplanistoestablisharealestatecadastreinthestatedca-dastremunicipalitiesbytheendofthesecondquarterof2011.ThegeneralconclusionisthattheestablishmentoftheRECintheurbanareas

    from2007to2010hadasignificantprogress.Atthebeginningoftheproject,theRECestab-lishment tempo was not in compliance withtheplanned tempomostlydue to the lackoflogisticalsupport,lackofmaterialsandequip-ment, technical issues, etc. In addition, thecommissionswhichwere recruited lacked theexperience inperformingworksof suchchar-acter and therefore necessary trainings wereconveyed. The LawonREC fromMarch 2008hassignificantlysimplifiedtheregistrationpro-ceduresanddecreasedtheregistrationtimein

    ordertospeeduptheRECestablishmentproc-ess.TheprocedureofRECestablishmentwhichwasperformedlateronbythetrainedcommis-sions, supported by newly recruited commis-sions,aswellastheuseofreambulationdatahave increased the percentage of establishedRECintheurbanareas.Theabove-mentionedwasahighpriority toAREC from2007 to theendof2010,sincetherealestatepropertiesintheurbanareashavethehighestvaluewhichmeansthattherealestatemarketisgreatlyde-velopedandhaslargenumberoftransactions.

    3.1.2. PrivateGeodeticSector

    ThechangesandtheamendmentstotheLawon Survey, Cadastre and Registration of RealEstate Rights (Official Gazette of R. Macedo-nia#.84/2005,#109/2005and#70/2006)haveenabled:

    • Establishmentofprivategeodeticpracticefor performance of operative-field worksrelatedwiththeRealEstateCadastre;

    • Streamliningofproceduresforregistrationoftherealestaterights;

    • Introduction of newmanner for registra-tionof realestate rights– sporadic regis-trationofrealestaterights,and

    • ConversionoftheLandCadastreintoaRealEstateCadastreincertainpartsofcadastremunicipalities.

    Inrelationtotheestablishmentandthefunc-tioning of the private geodetic practice andwith the purpose of following the dynamicsof itsdevelopment,thenexttableshowstwobasic indicators, i.e. the number of persons(geodetic engineers) which have successfullypassedtheexamandhaveacquiredthelicenseforauthorizedsurveyor,aswellasthenumberof registered private surveying companies inthe country working in compliance with theLawonREC,forperformanceoffieldandgeo-deticworks.

    3.1.3. Newlegislation

    Law on Real Estate Cadastre

    The Agency for Real Estate Cadastre in 2007started drafting the new legal framework, asplannedintheprojectdocuments.TheLawonRealEstateCadastrewasadoptedbytheParlia-mentinearly2008andwaspublishedintheOf-ficialGazetteofRMno.40/2008.ThenewLawonRealEstateCadastrestipulatestransforma-tionofSAGWintoanAgencyforRealEstateCa-dastre,providingtheAgencygreaterindepend-ence in themanagement that contributed toimprovedefficiencyintheperformanceaswellasimprovementoftheclientservices.TheLawintroducedtheestablishmentofanindepend-ent Chamber of Authorized Surveyors withpublicauthorizations.TheLawalso stipulatedchangesinthemethodofperformingtheream-bulation,aprocedureinwhichtherealestatedataforthelegalbasiswillbeacquiredduringthesurveyandanapplicationformalongwithaStatementforIdentificationforeachcadastreparcelseparatelywillbeproduced.TheLawonREC stipulated special procedure for registra-tionoftherealestaterightswhichenabledreg-istrationinatimeperiodofnolongerthan15days.Therealestatedataaredisplayedpublic-lyonspeciallyassignedlocationsforreceptionofdocuments-cadastreoffices.Thenewpro-ceduredoesnotincludeinterviewingofclientsandapublichearingaswiththepreviousLaw.Thisassumessimplificationoftheworkingpro-ceduresandreducedtimeperiodforissuanceofdataandregistrationofrightsintheREC.AnewfeatureintheLawonRECisthelistforconditional registrationof objects under con-

    struction.TheconversionasamethodofRECestablishment, already used in the rural ar-eas, was also applied in the populated areasif thefield situationdidnotdiffermuch fromthecondition inthecadastrerecords.Forthefirsttime, theLaw forRECregulated thepro-cedures relatedwith the production of topo-graphicmaps,thespatialunits’registryandtheNational Spatial Data Infrastructure. The newLawfrom2008acceleratedtheestablishmentoftheRECandsimplifiedtheRECmaintenanceprocedures.

    InDecember2010,theLawhasbeenmodifiedandsupplementedduetotheneedofsynchro-nizationoftheLawwiththeLawonCivilServ-antsaswellasduetotheneedofincorporatingtheEUdirectiveswhichrefertogeodeticworksperformedbyforeignersregisteredinR.Mac-edonia.

    New Tariff Lists

    AfteracquiringconsentfromtheGovernmentof R. Macedonia, on 23.12.2009, AREC an-nouncedintheOfficialGazetteofR.Macedo-niathenewTariffLists,reducingthefeesfrom10%to72%forthemostrequestedservicesforregistration intherealestatecadastreand is-suanceofdatatothelegalentitiesandnaturalpersons.

    3.1.4. Public Awareness Campaign

    As part of Component 1, a public awarenesscampaignwasconveyedwiththeobjectiveofinforming the general public of the system,modesofoperationwithinthesystemaswellastherightsandobligationsofpropertyown-ers, project activities and changes that tookplaceandtheneedofadjustingtonewcondi-

    tions. The focus of this PACwas aimed at allclients,startingfromcivilservantswhomain-tainandmanagecadastreandlandregistersinAREC, through lawyers, notaries and certifiedsurveyorstocitizensatlarge.InOctober2006,ARECinitiatedthePublicAwarenessCampaign,andinaoneandahalf-yearperiod,thisissuewassystematicallyaddressed.

    The main objectives of the public awarenesscampaignunderthemotto“Knowing what be-longs to whom”wereto:

    (1)PromoteARECasa transparent institutionopenforcommunicationwithcitizens;(2) Educate the citizens about the AREC re-sponsibilitiesand themethods throughwhichthecitizenscanacquirerealestaterightsinaneasierandfasterway;and(3)Promotetheon-goingreformswithinARECandrequestdirectassistanceandsupportfromcitizensforamoresuccessfulimplementation,especially with regard to reducing corruptionandincreasingefficiency.

    Thecampaignhasusedbrochures,TVandra-diospots,andothermediatoreachtheseob-jectives.Therewerebrochuresandpamphletsproducedanddisseminatedtoinformthepub-licoftheongoingactivities(andfees)ofAREC.ThesebrochureswerewellvisibleinallofthevisitedlocalofficesforREC.

    The PAC was also focused on branding andadvertising. Advertisement boards and Bill ofRightshavebeenplacedintheCenterforRECSkopjeandall 29 localoffices forREC,wheretheclientscanget informationregardingnec-essaryinformationfortheservicesandproce-dures.

    Thepublicawarenesscampaignhas improvedthe AREC’s reputation both internally and ex-ternally and staff moral and ownership hasclearlyrisen.

    Under the media campaign for cadastre re-forms,inNovember2007,ARECcompletedthesecondphaseof“TheCadastre-serviceforthecitizens”byorganizingweeklyforumswiththecitizens in the cities of R.M. The objective ofthese forumswas toprovide thecitizenswith

    adviceforovercomingtheirproblemsinrefer-ence to their real estateproperty in the localofficesforREC. Withtheobjectivetoreachouttotheclients,ARECorganizedforums“DaysoftheCadastre”throughout the entire country. These forumswere open for all citizens who would like tomeettheARECstaffanddiscusstheproblemsrelatedwiththecadastre.

    In 2005, the general satisfaction of the cli-ents–usersofcadastreserviceswas2.7(ona scale from1-5). During the project, 3 cli-entsurveyswereconveyed.Duringthecon-veyanceofthesurveyswereusedquantita-tive (field surveys and questionnaires) andqualitative(focusgroups)researchmethods

    inobtainingtherequesteddata.Duringthefirst survey in 2006, the methodology andthequestionnairesforconveyingthesurveyswerecreated.Duringthenexttwoclientsur-veys,theselectedconsultantcompanyuseda methodology and questionnaires whichenabledcomparabilitywiththepreviouscli-entsurveys.

    Theachievementsintheprevioustablesshowincreasedpercentageofregisteredrightsinthesystematicregistrationfrom2006till2010,asaresultofincreasednumberofthecommissionsforpublicdisplay,trainingsofthestaffandim-provingofworkingconditions.

    TheSectorforInternalControlwassupportingthe quality control of the reambulation thatwascontractedtotheprivatesectorundertheRECRP. The QC process is a three part proc-ess involving the Sector for Internal Control,theSectorforCISandtheSectorforGeodeticWorks.Eachhadaparticulartaskandpartof

    theQCtoperform. Inthepastthishasbeendoneonanad-hocbasis,alongwithotherim-portantwork.

    Inadditiontheactualcadastrecontrolhasnotbeen performed consistently (the other con-trolsarefortheterrainmodelandthegeodeticnetwork). Standard workflows and a proce-duremanualforthewholequalitycontrolproc-esshavebeenestablishedandwereapprovedbyAREC’smanagementandwereusedforthecontrol of thematerials submitted under thesigned contracts.     3.2.7. Development of a strategic Business Plan for AREC

    Acting in line with one of the recommenda-tions that refer to the implementationof theWorldBankfinancedRealEstateCadastreandRegistrationProject,AREChasapproachedthedevelopment of a strategic plan and a timebasedimplementationplan.

    In2007,AREChasdrafted theMainStrategicBusinessPlan for theperiod2007-2010. Inte-gralpartsof thisdocumentare the threean-nexes-strategiesfor:

    -BusinessandMarketingStrategy;-HumanResourcesStrategy;and-ITStrategy

    This strategic business plan was focused onthedemandsondifferentstakeholders,espe-cially the clients.Basedonananalysisof therequirementsof thevariousstakeholdersandthecurrentsituationwithinAREC,thePlande-finedthevision,strategiesandlongandshorttermobjectivesand theactivities required tomeet these objectives. After its approval bythe Government of RM, the AREC StrategicPlanbecameatoolforARECmanagementforgoverningthedevelopmentoftheAgencyandmonitoring the progress towards the objec-tives.

    The Strategic Plan has enabled a practicalframeworkaswellasbasisforannualplanningofAREC.Forthispurpose,AREChasproducedanannualprogramforexecutionoftheStrate-gicPlanwhichintheprocessofmonitoringandexecutionwasregularlyupdated.

    InordertodevelopaStrategyforimprovementoftheactivitiesofAREC,during2010waspro-ducedaproposedStrategicPlan forAREC fortheperiod2011-2015whichreceivedpositivecomments from the relevant ministries in R.Macedonia. In theupcomingperiod, thepro-posalwillbesubmittedtotheGovernmentofR.Macedoniaforapproval.

    3.2.8. Improvement of the working conditions

    Thissub-componentwasfocusedonthequal-ityoftheservicesintendedfortheclientsandimprovementoftheworkingconditionsfortheARECstaffintheCenterforREC–SkopjeandinthelocalofficesforREC.Thisincludedestab-lishinganadequatereceptionareaforthecli-ents.Thereceptionarea is informative,clientorientated,withpleasantapproachandavoid-ing any illicit activities.     After the installment of the POS terminals intheHeadquartersoftheAgency,inthe29localofficesforRECandtheCenterforREC–Skopjethefollowingresultswereachieved:increasedefficiencyintheworkwiththeclientsviacreditcardpaymentoftheservicesbytheusersdueto the fact that the legal entities andnatural

    persons submittingapplicationhadno longertheneedtopaythefeesonapaymentorder.Now the payment of the fees is done at thecounterwithacreditcard.

    •Notarymodule

    Inordertoeasetheprocessofregisteringrealpropertytransactions,ARECpromotedandes-tablishedthenotarymodulewhichwillenablesubmissionofchangeintherealestatecadas-treviaelectronicmeans.

    Withthismodule,thecommunicationbetweenthenotariesandAREChasbeensimplified.Thiswillimmenselyaidthecitizenswhichforacer-tainprocedurecanprocesstheentiretransac-tion in the real estate cadastre database viathenotaryoffice.Todate,9Notaryofficesareusingthismodule,while10Notaryofficesareundergoingtrainingforuseofthismodule.

    Improvingtransparencyandaccountabilityalsoincludes improvement of the client services.the Customer Bill of Rights hasbeenfinalized,printed anddistributed to all local offices forrealestatecadastre inthecountry.the Inter-nal Communication Protocol is disseminatedand training activities have been carried out.The InfoLine (anexpansionof the telephonehotline)hasbeenestablishedtoimprovetrans-parency and access of thepublic. These callsreported comments, irregularities in service,andepisodesofmisconductbyARECstaff,andcase-related questions. The methodology for

    the info line includes that all customers arecontactedtoensurethattheircomplaint/issuehasbeenresolved.Thishasprovedtobeaverypositivestepforward.Also,theARECDirectorhas shown a great interest inmonitoring theprocedure and the percentage of responsessubmittedtotheclientsappealingorrequest-inginformationonthisinfo-line.InMay2007,the government established a mechanism totestcitizensatisfaction fromthestateadmin-istration through citizen logbooks.     The study onAccess to Land for Investment waspresentedtotheLPACinSeptember2007and theMinistry of Transport has included anumber of the recommendations in the newLaw on Spatial and Urban Planning and theLawonConstructionLand.Howeverthereareanumberofother recommendations that in-

    volve otherministries, themunicipalities andothers,andthesemayrequireworkinggroupstobesetupforfurtherdiscussion.Animple-mentationplanshouldbedevelopedtoconsid-er the further recommendationsof thestudyandimplementthosethatarerelevanttothecountry.

    TheStudy“security of registered rights and the Law on survey, Cadastre and property rights registration”hasbeeninitiatedbytheGovern-mentofR.Macedoniawithin theReal EstateCadastre and Registration Project. Partially,thestudywasinitiatedbyacertainnumberofcommentsregardingtheinsecurityofthereg-istered rights which represents a problem inthe investmentprocedure inMacedonia. TheincompletenessoftheRECinR.Macedonia,inasensethatonlyhalfofthecountrywascov-eredbyREC,withcertaintycausedagreatchal-lengeinthecreationofthesecurityofthereg-isteredrightsfortheMacedoniancitizen.Afterthisanalysis,severaloptionstostrengthenthesecurity of registered rights were reviewed.The Studywas produced at the beginning of2007. On the basis of the findings from thisstudy, AREC drafted an implementation planwithanenextensivenumberofprovisionsal-readyincludedintheLawonRealEstateCadas-trefrom2008.Still,thekeydecisionsreferringto theguaranteeby the state -what is tobeguaranteed,whatisnottobeguaranteedandhowtheguaranteeswillbefinanced–remaintobeagreedupon.Severalministrieshaveex-pressedinterestinthismatter.

    In2008,theMinistryofAgricultureproducedthe study for state land management in rural areas supportedbyFAO.Theobjectivewastopresentthestatusandtheconditionduringtheadministrationofaconcessionofstateagricul-tural land inone, randomlyselectedcadastremunicipality.Thepresentationof thefindingsfrom this study served as a first step and aninitiative for LPAC to reviewall issues regard-ingthelandpolicyratherthanfocusingjustonthoseissuesraisedbytheproject.

    TheStudyLand MarkethasbeenproducedinDecember 2008with the objective to collectdata and information on the situation of thelandandrealpropertymarketsinMacedonia,in the urban and rural areas, their efficiencyaswellasidentificationofthelimitations.Thestudy was produced in compliance with theproject objective: to create an efficient landadministrationandrealpropertyrightssystemleadingtowardsdevelopmentoftheefficiencyofthelandandrealpropertymarkets.

    FromMay2009tillJune2009,ARECproducedthe Report Pilot exercise for inventory of state land in the urban part of strumica.Thepilotexercise produced an inventory of the stateownedlandontheterritoryofthecityofStru-micai.e.theboundariesoftheGeneralUrbanPlanof thecityofStrumica.This is tobe thefirst phase of a larger study to be developedin reference to state land management. TheStudy provided information of great impor-tanceforsustainabilityofthelandpolicyproc-essinthecountry.Ithasdeterminedthecom-plexityofthetask,thetimeandeffortneededtocompletesuchaninventory,anddevelopa

    methodologyforundertakinganationalinven-toryprogram.Thispilotservedasexampleforundertaking Inventory of state landmanage-mentonlocallevelandthelevelofwholeterri-toryoftheRepublicofMacedonia.ThisstudywillalsoserveasinitialpointforpreparingtheStrategyofstatelandmanagementintheMu-nicipalityofStrumica.

    InSeptember2009,ARECpresentedthe study onIllegallyBuiltObjectsandInformalSettle-ments.TheStudyhasidentifiedthefollowing:the problems with the illegally built objects,the origin and the reasons for the illegal ob-jects, current practices, and mechanisms forresolutionoftheproblemsaswellasrelevantinstitutions,typeofillegallybuiltobjects(clas-sification),andproposalsforpossiblesolutions.The Study included important recommenda-tionsformeasurestobeundertakenwiththeobjectivetoeliminatetheillegallybuiltobjectsandillegalconstructionintheurbanareas.TheStudy has developed public and transparentpolicy and directions on improvement of thelegislationandtherealsituationinrelationtothe process of identification and the processof legalization/treatment of the illegally builtobjects intheRepublicofMacedonia,aswellas recommendationsonhowtodealwith in-formal developments. The recommendationsof the Study were taken into considerationwhenpreparing the Lawon illegally built ob-jects,which came into force in thebeginningof 2011.
