COMMUNICATION FROM THE CHAIR
The Speaker (Hon. Teya): Hon. Members, in the recent past, the country has
experienced floods that have swept both property and human lives in their paths. Several families
have been rendered homeless and crops submerged in flood waters, bridges have been washed
away and roads made impassable with many of them turning to highways of death.
Most painfully, Nyamira County has not been spared. Just last week a bus belonging to
Daima Connections SACCO plunged into a flooded river along the Narok-Mai-Mahiu Road with
a number of causalities reported. Sadly, a good number of victims were from Nyamira County.
Hon. Members, such accidents expose our underbelly as a County and put to test our
preparedness for such eventualities.
The County Government responded fairly well by opening a help desk in Narok and
transferring some of the victims to Nyamira. In this regard and by this communication, all Hon.
Members have been invited to join other leaders from Gusii among them H.E, Hon. John
Nyagarama, the Governor of Nyamira County and his counterpart H.E, Hon. James Ongwae the
Governor of Kisii County to a funeral mass service to be held tomorrow April 19, 2018 at 10:00
a.m. The service will take place at Nyamira Primary School grounds.
Hon. Members, I now wish to inform you that the County Pension Fund (CPF) has
invited County Assemblies Liaison Committees for a three-day Induction Workshop to be held
from May 4-6, 2018 at Flamingo Hotel, Mombasa. The workshop will be centred on the core

limited to; coordination of Committee operations, budget making, circumstances where Liaison
Committee can sanction the County Executive Committee (CEC) Members, working relationship
between Committee Chairpersons and Secretariats.
Finally, Hon. Members, on March, 29 2018, you passed a resolution in this House that a
new car be acquired for the Speaker in 21 days. The resolutions of this House are binding and
have to be implemented. The County Assembly Service Board (CASB) took up the matter in an
effort to implement this within the stipulated period. However, after consideration of all factors
that had to be met for this to be realised, the CASB observed that, the resolution was passed after
the supplementary budget had been passed by this House without factoring in funds for the
purchase of the car. Again, the procurement process could take more than 21 days. Reallocating
funds from other votes to meet this cost could negatively affect other programmes that are
already in progress.
Fully aware that the Office of the Speaker is pivotal in the running of the Assembly, the
Board endeavours to explore a short term course of action that could make it possible to have the
current car attached to the Office of the Speaker be reconditioned to enhance efficiency and
safety. Hon. Members, the CASB requested that the purchase of a new car for the Office of the
Speaker be put on hold until the end of 2017/2018 Financial Year (FY) so that this is factored in
during the 2018 /2019 FY budget.

STATEMENTS SOUGHT
STATUS OF NYAMIRA STATE UNIVERSITY
Member for Magombo Ward (Hon. Onyinkwa): Hon. Speaker Sir, I am seeking a
statement from the Department of Education and Youth Empowerment regarding our State
University as provided for under the Constitution. I am seeking that the Chairman in his
statement responds to:
1. The status of Nyamira State University.
2. The total amount allocated in the previous budgets for the construction of the
university and whether the money has generated any value to date.
3. The policy governing the construction of the university.
4. Whether there are plans to develop Nyamira State University.
I happen to have been in the first Committee that established the Nyamira State
University which was registered and it was meant to have commenced so that at our County
benefits from higher education.

NUMBER OF SPRINGS CONSTRUCTED IN MAGWAGWA WARD

Member for Magwagwa Ward (Hon. Omayio): Pursuant to Standing Order (SO) 40, I
seek a statement from the Chairperson, Committee on Environment, Energy, Water, Mining and
Natural Resources regarding the number of springs constructed in Magwagwa Ward and in the
statement the Chairperson is required to respond on:
1. The status and total number of springs constructed in Magwagwa Ward in the year
2017/2018.
2. The cost for each spring constructed.
3. The location and details.
4. The total budgetary allocation for all springs in Magwagwa Ward for that financial
year.
For this and the other statements I raised yesterday, I equally urge the Chairman as they
are going for fact finding including the Hon. Nominated Member from Magwagwa, who seems
to have the full information, we need to get clear information on the matter and the money
spent there. To just say that I am also waiting for a signal from those Hon. Members who play
politics with their elected Members from their wards, I also need that signal so that I can be
comfortable.

Member for Bonyamatuta Ward (Hon. Mocheche): In the statement that has been
sought by Hon. Omayio, he has categorically mentioned a nominated Member from Magwagwa
Ward. I am asking Hon. Fred Omayio to be specific, because we do not have Nominated Hon.
Members from particular wards. Let him come out clearly and say who he is referring to.
Member for Magwagwa Ward (Hon. Omayio): I thought I was very clear that it is Hon.
Abel Mokaya from Magwagwa Ward? I think he knows and he will assist these two Committees
to get vital information to this House Mr. Speaker.
MARKET COMMITTEES IN NYAMIRA COUNTY
Member for Ekerenyo Ward (Hon. Nyabaro): I wish to seek a statement from the
Chairman, Committee on Trade, Tourism and Cooperative Development on the market
committees that are within this County. For example, Ikonge Market, Ekerenyo Market and other
market committees that have expired and have not been renewed.
STATUS OF LIQUOR LICENSING BOARD AND OTHER BOARDS
From the Committee on Gender, Sports, Culture and Social Services, I wish to know the
status of the Liquor Licensing Board and other boards that fall under that department.

STATUS OF HEALTH FACILITY MANAGEMENT BOARDS
On health services, I wish to know the status of all the facilities management boards and
their expiry dates and if they are due for reappointment.
OPERATION OF BOARDS OF MANAGEMENT IN YOUTH POLYTECHNICS
On Education and Youth Empowerment, I wish to know the status of operation of Boards
of Management in Youth Polytechnics. There is a rumour that youth polytechnics are appointing
board members that we do not know the regulation they are using and we need to know the status
of boards in all these institutions.
COUNTY POLICING OVERSIGHT BOARDS
We also wish to know the status of County Policing Oversight Boards and all boards that
fall under the County Government. On those boards whose mandate has expired, how are the
departments working without the existence of the boards because we do understand that some
departments are working without management boards? I wish also to know what plans the
departments have to ensure that board elections are conducted as per the regulations.

STATUS OF THE SEWERAGE SYSTEM IN NYAMIRA COUNTY
Member for Magombo Ward (Hon. Onyinkwa): My statement relates to the
Department of Environment, Water, Mining and Natural Resources regarding the status of the
sewage system not only in our capital here, but also in the sub-county levels. I am asking the
chairman to respond on the following elements:
(a) The total budget allocation on waste management for 2016/2017 and 2017/2018
financial years.
(b) The status of the sewerage system in all the major towns in our County.
(c) The level of operation of the sewerage system per major town.
(d) The plan the department has in place to ensure proper waste management.

Member for Magombo Ward (Hon. Onyinkwa): My final statement, Hon. Speaker is
directed to the Department of Education and Youth Empowerment. It is in regard to the
polytechnic instructors and casual workers. Kindly Members, in the sheet there is a correction
there of casual workers. In this statement, I want the chairman to give us a detailed response on
the following:
(a) Details of all instructors and casual workers in all youth polytechnics in the County.
(b) Details of instructors and casual workers who have been paid if any and the details of
those who have not been paid and their relevant dues in total.
(c) The reasons as to why instructors and casual workers of polytechnics have not been
paid and for how long?
(d) What plans they have put in place to make sure that their dues and the dates they are
going to be paid.
(e) The annual budget set for the payment of polytechnic instructors and workers.

Special Elect Member (Hon. Mokua.): Thank you, Mr. Speaker. Standing on behalf of
the Leader of Majority who represents Township Ward, based on Standing Order (SO) 140. He
wishes to seek a statement from the Chairperson, Lands, Physical Planning and Urban
Development regarding Nyamira Town Car Park along the main road. In the statement, the
Chairperson is required to respond on:
(a) The actual status of the Nyamira Town car park.
(b) The general outlook of the parking from the main road as provided by the drawing.
(c) Were the kiosks supposed to be along the road as per the drawing?
(d) How many kilometres is the parking as per the drawing?
(e) The starting point and the ending point of the car park
Member for Magwagwa Ward (Hon. Omayio): Maybe, this would be a correction
because the Hon. Member is saying that under SO 140. Maybe it is a slip of the tongue it is
supposed to be SO 40.
Special Elect Member (Hon. Mokua): I wish to correct my colleague that I mentioned
SO 40. Finally, the chairperson should also give the total budget allocated for the car park.

today as you can see from the Order Paper. I direct that the responses of all the statements sought

Member for Bosamaro Ward (Hon. Keganda): Thank you, Hon. Speaker. I beg to
move a Motion THAT, All Health Centres in Nyamira County to operate on a 24-hour basis.
Article 43 (1) (a) and (b) of the Constitution of Kenya, 2010 states that every person has
the right to the highest attainable standard of health which include; the right of health care
sources including reproductive health. Further, aware that the 1948 World Health Organization
(WHO) declaration that health is a fundamental human right and commitment to ensuring the
highest attainable level of health for all. Recognizing that, all UN member states have agreed to
strive to achieve universal health care by 2030 as part of the sustainable development goals.
Further, recognizing that improved health services coverage largely depends on the
availability, accessibility and capacity of health workers to deliver quality integrated care that is
modelled on a people-centred approach.
Cognizant that, there are a lot of health centres in Nyamira County that are managed and
regulated by the County Government as affirmed in the Constitution of Kenya, 2010, Fourth
Schedule 2 (a) and (b).
Appreciating that the County Assembly Sectoral Committee on Health Services
conducted a field study on some of the health facilities and tabled a report in this House on
March 6, 2018 and the said motion was adopted on March 21, 2018.
Acknowledging that there exists in the health centres a crisis in terms of unprecedented
time and staff management coupled with poor and inadequate service delivery, this Hon. House
resolves that this is a prudent and just to direct the Executive Arm of the County Government of
Nyamira as hereunder:
1. That, all Health Centres in Nyamira County should have a Clinical Officer attached to
them forthwith.
2. That, all health centres in Nyamira County should be operational on a 24-hour basis
for maximum, efficient and effective service delivery to the citizens of the County.
3. That necessary budgetary allocation and adjustments be done to enable the above to
be achievable as soon as practically possible, but within the next budget cycle.
I call upon Hon. Fred Nyachae Omayio to second.
Member for Magwagwa Ward (Hon. Omayio): Thank you, Hon. Speaker. I stand to
second and at the same time thank Hon. Keganda for the concern he has shown on health matters
in our County. This is the only way we can help the people of Nyamira County who we
represent. Every person has a right to a high standard of health. We have so many health centres,
but they do not have enough facilities, doctors, nurses and equipment.
If I may narrate an incident; some time back, one of my voters had an accident and was
brought to our referral hospital, an X-Ray was taken and was referred to Tenwek Hospital. I
travelled and arrived at Tenwek Hospital at around midnight to find that a new X-Ray was done.
From Nyamira Referral Hospital, the patient was told that he had a fracture and would be fixed

with some metals, but at Tenwek, we were told that the patient only suffered soft tissue injuries.
We had to travel back with the patient after receiving simple pain killers. We want the County to
equip the Hospital with modern machines to work effectively.
I support that the health facilities work 24 hours to serve our people effectively. Like the
National Hospital Insurance Fund (NHIF) card is only allowed at specific hospitals. In as much
as we would like these facilities to work 24 hours, let them serve equally. How do people of
Magwagwa who are supposed to be admitted at Magwagwa Health Centre, if it is put in place as
the Hon. Member has proposed in the motion going to benefit if the NHIF card is not allowed.
Let the card serve in all facilities so that those with it can manage to use it. I second.

Member for Bomwagamo Ward (Hon. Barongo): Thank you, Mr. Speaker. The motion
from the Hon. Keganda came at the right time. I thank Hon. Keganda who is a church elder. The
highest ignorance comes out of poor training of our health personnel while health is paramount
and our facilities are run by people who are not qualified as Clinical Officers. We must have
Clinical Officers all over the County. I happen to be a Member of the Committee on Health
Services. We need the Department of Health Services to have enough budgetary allocation so
that we can get more officers employed to give services to our people.
People are dying because of negligence and we need this to be implemented immediately
as the House that is mandated by God and the people of Nyamira to make the Executive wake up
to know our work. We are not singing, it is not business as usual. We are serious from our hearts
and we want to save the people of Nyamira. Hon. Keganda has done something since we came to
this House, this is the only item he has come with that is very important.

Member for Gesima Ward (Hon. Maroko): Thank you, Mr. Speaker. I also stand to
support the motion moved by Hon. Keganda. At the same time, I remind Hon. Barongo that Hon.
Keganda has rose on very many occasions articulating issues. When you speak like that and
Bosamaro people hear that it is only today, that is putting Hon. Keganda into a corner that he
cannot come out of.
Even though, I am also touched that most of our health facilities according to their status,
are supposed to operate on a 24-hour basis, not forgetting that as they are categorised at times we
may talk that health facilities are supposed to operate 24-hours. We are talking about health
centres and the sub-county hospitals, but we are not mentioning dispensaries. Dispensaries are

the ones that our people are normally used to and nearer to our people. As much as we talk of
health centres, we should also see what we can do with the dispensaries.
That is not pre-empting what I wanted to say. I happen to come from near Gesima Health
Centre. At times, if you go there at night, you may not find it operating on 24 hours. On inquiry,
you find out that there is insufficient housing for staff to live nearer to the facility. I also support
that our people are supposed to access health services. When they do not get health services
which are their right, their right is denied.
The project of upgrading Esani Sub-County Hospital in Gesima Ward has stalled; the
building is leaking and there is an X-Ray machine that is in that facility that has not been in use
for the last one year. I wonder when the people of Gesima will benefit from that X-Ray machine.
Those are some of the things that are making some of us get concerned. When we are
talking about clinical officers, you find a big health centre with only one clinical officer.
According to its status, it is supposed to have more than one. It is a high time that the
Department of Health Services came up with a budget projection for sufficient staff in those
health centres in order to give our people services.
I am not generally emphasising on the health centres, I am equally disturbed because one
of my family members right now, has been in hospital since morning and has not been served
because our medical insurance provider, CIC is saying that I have depleted my limit. If as a Hon.
Member I cannot get treatment, what about an ordinary mwananchi? I am really disturbed and I
am not even able to continue making my contribution here because of that simple issue. If my
intervention cannot be seen, I may not be the only victim. There could be other Hon. Members
with similar problems. We are not getting the services we expected from CIC.

Member for Magombo Ward (Hon. Onyinkwa): Thank you, Hon. Speaker. I stand here
to fully support the motion that has been moved by my friend. I think it should go on record that
Hon. Keganda has stood in this House several times through the CASB where several beautiful
decisions have been made, tabled and passed in this House. Beside motions, we have seen the
value of him being in that Board where proper decisions and realignment of our Assembly have
happened.
In the Constitution, Article 1 vests sovereign power in the people which they can exercise
either directly or through elected representatives like us. This sovereignty cannot only be
exercised on behalf of the people by the legislature, but by the Executive also. The Executive has
no alternative, but to provide services to the expectation of our people. One of the key areas of
these services is health protection. It is a constitutional right for our people to be served 24 hours.
Health care is a fundamental right and it should not be tampered with at any one moment.
Kenyans in Nyamira County are demanding that we now need to get health care service for 24

hours. We are not asking all health facilities to operate on a 24-hour basis. We are just seeking
only those health facilities that are capable of offering these services to do so.
I was among the Members in a tour to one of the health centres accompanying the mover
of the motion to a health facility that has all the facilities and that is Ting'a Health Centre.
Besides us seeking them to operate in 24 hours, the staff cannot operate even for eight hours. It is
so sad that it is on the experience that I saw there that I am seeking that alongside passing this
motion, we also request that the Department of Health Services does the following.
Transfer some of the workers who have stayed in these places for many years. They think
they own these health facilities. We do not need them there. The administrator could not even
come out and welcome us. We sat as patients and we called upon the administrator who refused
to get out of the office to see us. In fact, we came back without seeing the administrator to learn
about the facility. This is how bad some of these people have stayed in places and when we go
through the records, they have stayed there for over 20 years. Some are so old that you do not
even want to talk to them because you think it is your grandmother whom you should be nursing
at home.
We also need qualified clinical officers. Some health centres simply do not have qualified
people. The other day, I took a lady who was suffering from high blood pressure and was given
an injection which needed reversal because that was wrong medication. She reacted to the
injection so fast that I had to rush her to Kisii for further treatment. We are seeking that when we
start operating 24 hours, then we need to be assured that the people employed in the facilities are
qualified.
The other one, much as it will be long term, we need housing at the facilities, especially
clinical officers. Let there be a provision for a clinical officer's house and this time round, we do
not have to have our own clansmen working in our health facilities. We can have Luos or other
tribes coming to work at our health facilities; reason being, they may respect and provide good
services to our people.
Finally, some facilities simply do not have even basic drugs. A simple parameter to find
out if you are suffering from malaria lacks in most of our facilities and somebody is treated
awkwardly and left to go. Let us all support this motion. It is a high time we went 24 hours. The
world is moving fast. Our County cannot remain behind and we expect to provide quality
services to our people.

Special Elect Member (Hon. Boera): Thank you, Mr. Speaker. I support the motion
from Hon. Keganda who happens to be again my uncle. I am a Member of the Committee on
Health Services and I have visited Ting'a Health Centre. It is on record that I always play
football at Sironga Playground and one day, one of the players had an injury. We went to Ting'a

Health Centre being closer than Nyamira Referral Hospital, but to my surprise, at around 5:00
p.m. we found nobody, not even the security person.
Again, on another day, there was an accident and somebody was wounded and as a Good
Samaritan, I rush the wounded person to Mongorisi Health Centre. I was surprised to find it
already closed. It was around 5:30 p.m. I only found the security person.
Let me go to Bosiango Health Centre. Among the very many health centres that we have,
the one I have seen is that it is equipped properly. It has even wards except some hiccups we
have in terms linen and beddings. That health centre should be even admitting patients unlike
other health centres. This is a time that we want to give services to our people at their nearest
points, especially on emergency cases. We can also recommend that we have basic equipment
like X-Ray machines in these health centres. For example, somebody from Sirate, which is at the
far end of Bosamaro Ward, at the border of Bosamaro and Magombo Wards, then somebody gets
an accident on a motor cycle. That person will pass around three health centres to come to
Nyamira Referral Hospital for an X-Ray.
Recently, on Kisii-Chemosit Road, we have had very many accidents occurring and the
nearest health centres have not helped victims, especially late in the evening. This is a time that
we would like to offer services to our people. In our supplementary budget here, we have records
that we passed around Kshs. 1.3 billion that is going to the Department of Health Services. If we
cannot have qualified clinical officers and medical personnel in our health centres, then the Kshs.
1.3 billion will not help our people. I support this motion and it should be implemented with
immediate effect as your wisdom may direct.

the motion that comes from a member of my party to this House. Being a mother, I am also
crying for health services to be closer to our people of Nyamira. I come from Gesima Ward
where we have a nice Gesima Health Centre which is well equipped. To my surprise, there are
no specialists to operate those most needed equipment. So, you get that a mother going to deliver
at around 3:00 p.m., but cannot be attended to at the health centre. We have an X-Ray machine,
special beds, but no specialists to attend to patients. Imagine at 3:00 p.m. the nurses are already
at home.
I visited Machururiati Dispensary which has been equipped with good beds, but there is
no space. The roof of the room in which the equipment are kept is leaking. They cannot serve the
purpose. If we are crying to get such expensive equipment which are required, but we do not
have specialists to operate them to benefit mwananchi, there is no reason to buy these expensive
equipment.
On the same, we have casuals working there and have not been paid for quite a while.
This kills morale of work and will not serve as they are supposed to. I cry that we need clinical

officers in every health centre such that the common mwananchi gets services for 24 hours as
proposed in the motion by Hon. Keganda. I support.

Watu wetu wanateseka. Akina mama wajawazito, wagonjwa ambao wanaugua ugonjwa
wa ukimwi wanateseka kwa sababu hawana bima ya afya. Twaomba hii Kaunti yetu ya Nyamira
ichukue hatua kwa haraka. Sisi twalia kwa niaba ya watu wetu waliotuchagua. Ukitembelea hizi
zahanati, karibu zote hazina mahabara. Kwa sababu gani? Ukitembelea hopsitiali zetu wapata
wauguzi kama wako unaambiwa wameenda mlo wa adhuhuri na ameenda kwa masaa matatu.
Mbona wanawaacha watu wetu wasumbuke hivyo? Huu ni wito walioitiwa na wakaitikia
na wanafaa wahudumie watu wetu. Ninaomba Bunge hili letu lipitishe mswada huu kwa sababu
tusipowasaidia na kulia kwa niaba ya watu wetu, Mwenyezi Mungu atawafungulia viwavi jeshi
na wataanza kuwala Waheshimiwa masikio peke yake na watabaki bila masikiso kwa sababu
hatukuwasaidia waliohitajika kusaidiwa.
Naomba kuunga mkono mswada huu na ikipitihswa twataka mambo haya yafanywe kwa
upesi.

Special Elect Member (Hon. Sese): Thank you, Hon. Speaker. I stand to support the
motion. Based on the fact that most illnesses attack at night, you will all agree with me that
during the day, you will be having symptoms, but they worsen at night. All the mothers here
know that labour pains attack at night. Therefore, I support this motion that health centres work
on a 24-hour basis.
There is a very bad tendency of nurses and I want to agree with Hon. Onyinkwa that
nurses who are aged train subordinate staff to inject patients on their behalf because of laziness
or maybe tiredness. This is very dangerous and risky to the lives of people they are serving.
These nurses should all be transferred or those who are of age should retire and go home.
On the issue of laboratories is crucial because some diseases have similar symptoms.
Without a good laboratory, there is likelihood that the patient will be treated for malaria while he
has typhoid. These are things we should look into knowing that health is fully devolved. There

are no better ways to help the people than to bring the services closer to them that are fully
functional.

Special Elect Member (Hon. Matini): I stand to support the motion that is on the Floor
of the House. This is a very wonderful motion because it is in the people's interest that, the
people need doctors to treat them. Of course, we cannot put two clinical officers in a health
centre, one will be enough. However, many of them ignore patients and leave them on the
queues and go for their breakfast or lunch. In case we get one in each health centre and we have
qualified nurses, they will treat patients better. I happen to come from Ting’a and I worked there
for almost 10 years. Nowadays, the buildings are very beautiful, but no treatment. Patients are
not served properly. I would recommend transfer of those nurses who have stayed at the facility
for 10 to 15 years. They are doing their businesses there. They better get transfers so that we can
see what will happen. I support this very important motion.

nimeona ni vyema niweze kusimama na kuungana na viongozi wenzangu kwa mada ya mswada
ulio mbele yetu mchana wa leo. Ni jambo la kukera moyo ukiona wananchi ambao wametutuma
hapa wanateseka sana bila wauguzi ambao wanastahili. Nimeguswa sana na hili jambo. Kusema
ukweli, ukizunguka katika zahanati zote zilizoko katika Kaunti yetu tangu ugatuzi kuanza,
hatujaendelea sana. Nimekaribisha kila mmoja kule Kituo cha Afya cha Kenyenya ambacho kiko
na majengo mazuri, lakini kulingana na zile huduma wananchi wanapokea huko, ni duni sana.
Ndio maana nimeona vyema niweze kusimama na kuunga wenzangu kwa hoja hii kwamba yale
yote ambayo yametajwa na aliyeleta mada hii, yatetekelezwe.
Wale wahusika wote wawajibike ili tusonge mbele. Mambo haya tumeyazungumzia sana,
lakini kuyatekeleza imekua vigugumu. Mhe. Spika ukiwa umekalia hicho kiti sawasawa,
ningeomba kuanzia leo, hii Idara ya Huduma za Afya iweze kubadilika. Hatuwezi ingia hapa na
kupanua vinywa vyetu na hadi leo mwenzangu tuko tu hapa kupanua vinywa vyetu, lakini ila tu
si kupanua vinywa bali tunataka matakwa ya wale ambao tunawakilisha yaweze kutekelezwa. Ni
mada ya busara na hekima ambayo inastahili kwa wananchi wapendwa wa Nyamira.
Member for Esise Ward (Hon. Nyarang’o): Thank you, Mr. Speaker Sir. The motion is
very good. Actually, in Nyamira County, there are certain sub-counties that may have only one
doctor like Borabu while here in Nyamira South Sub-County, they have several doctors. This
beats the logic of devolution. The doctors should be spread evenly across the County for equity
purposes. You can imagine a whole sub-county without a doctor. Borabu is actually
misappropriation of services and it beats the idea that the services should be rendered for 24
hours and if you look critically, most of our people who die, die outside Nyamira. This is

because they know there is no specialized doctor in our area. You hear them going to Eldoret,
Kericho, Tenwek or others.
I am told in Kericho County, they are going to employ about 200 clinical officers. Where
does Kericho get the money to employ clinical officers? That means every dispensary in Kericho
will have a clinical officer. Why not Nyamira County? In my ward, that is Esise, we do not have
a single doctor and the population could be about 20,000 people. We are still in the primitive
stage. We should have a doctor around to take care of the people in that wide area. Do we expect
them to go to Kisii, Bomet or Kericho County? This is very shameful, while we have
dispensaries dotted all over the County. Are they for prestige purposes based on clanism? Every
clan has a dispensary and there are no boundaries, but when you are sick and you need treatment.
Whenever you are planning for a dispensary, think of someone to man it. I support.

Member for Nyansiongo Ward (Hon. Kebaso): Thank you, Mr. Speaker. I also stand to
join my brothers in supporting the motion. Health is an important sector because it touches each
and every person. As I support that the health facilities operate for 24 hours, the burden comes
back to the Hon. Members. Two weeks ago, I was woken up at 12:00 a.m. when a woman was in
labour and because our health facilities do not operate at night, I had to foot the entire bill at
Kapkatet Hospital in Kericho County. For all these to be possible, the budgetary allocations
should also be adjusted so that we can make it possible for our people to access proper medical
care.

The Speaker (Hon. Teya): Thank you, Hon. Members. From the mood of the House, I
can see that you have exhausted discussion on this motion. Let me refer you to the Fourth
Schedule of the Constitution which is in two parts. The first part is the National Government
functions and the second one is the County Government functions. You will note that health is a
fully devolved function. Therefore, the issue you are discussing here is so vital that it calls for
sobriety and critical thinking.
Secondly, you would like to note that the national government came up with the Big Four
Agenda items and H.E., the Governor, out of the items, health is one of them that he set aside to
do and for him to demonstrate that it is a big function, then the mover of the motion and the
interests and the dreams of the Hon. Members and the people you represent need to be realised.
If you are not healthy then you are not able to function as Hon. Members and therefore, it
affects even the productivity of citizens of this County.
I therefore, agree with what you have said and since we have a committee on health, even
if the motion is passed, they will be able to take this up and see how it will be implemented.
However, Hon. Onyinkwa mentioned a very important element that not all facilities can
operate on a 24-hour basis, but we can strategically start with a number of them so that people

you are the husband, Hon. Kebaso, but we forgive you if you were not.

ADJOURNMENT
The Leader of Majority (Hon. Masira): Hon. Speaker, I beg to move a Motion THAT,
pursuant to Standing Order (SO) 25, paragraph three regarding the Calendar of the Assembly,
this House adjourns until Tuesday, May 8, 2018 at 2:30 p.m. to enable Hon. Members mourn
with the people of Nyamira County and in the coming week attend the Devolution Conference in
Kakamega County.
Aware that on April 10, 2018 a fatal accident occurred along Narok-Nairobi Road
involving a Daima Connections Bus and a number of lives were lost in the accident.
Further, aware that Nyamira County lost quite a number of people in the accident and
tomorrow, April 19, 2018 being the day scheduled for the mass to pray for the victims as from
10:00 a.m. to 4:00 p.m. at the Nyamira Primary School grounds, it is our duty as leaders of
Nyamira County to come together and mourn with our people and support the families affected
in solidarity and the love for our County.
Cognizant that the 5th Annual Devolution Conference is scheduled for April 23 to 27,
2018 in Kakamega County and all Hon. Members will be attending the Conference; further, Hon.
Speaker made a communication informing this Hon. House that the County Pension Fund (CPF)
has invited County Assemblies’ Liaison Committees for an induction workshop to be held from
May 4 to 6, 2018 at Flamingo Hotel in Mombasa, I move that this House adjourns until Tuesday,
May 8, 2018 at 2:30 p.m. I call upon Hon. Onyinkwa to second.

Secondly, Hon. Speaker there will be Devolution Conference. It is only a matter of how
well we utilize our time. That means the Members will be travelling immediately after the
funeral ceremony. I also feel in order to utilize the time we are going to spend in Kakamega will
also be very important not only for us, but also for the people that we represent.

Member for Magwagwa Ward (Hon. Omayio): Thank you, Mr. Speaker. I stand to
support, especially the issue of the accident. I am the most affected because this accident took
four from my ward. This is a very good decision. I urge the Hon. Members that we attend to
demonstrate our love for their families. I support the motion, Mr. Speaker.
The Speaker (Hon. Teya): Thank you so much, Hon. Members. I really wanted to visit
these victims in their homes, but you know the Office of the Speaker is busy trying to serve the
Hon. Members and even the members of the public, but to show that I really wanted to go to
their homes, I will be punctual tomorrow at the funeral prayer service. Therefore, since I know
the Hon. Members are people of sympathy and empathy, I know 100 percent of you will be
available at Nyamira Primary School playgrounds and that will really demonstrate that we
adjourned so that we condole with these families.
Otherwise, if you leave the Hon. Speaker to be there alone, it will be a sign that you
adjourned to go and do other businesses. So, I will be there as a person, as a citizen of this
County and as the Speaker this County assembly. I beseech that you all purpose to attend
tomorrow.
