The new United States-Mexico-Canada Agreement (USMCA), which is destined to replace NAFTA, has generated controversy in Canada over a clause that seems intended to pressure Canada from negotiating a trade agreement with China. While these fears are at first understandable, a closer look at the facts shows the concerns are also largely overstated.

At issue is Article 32.10, “Non-Market Country FTA,” which says that any member of the agreement can pull out if another signatory enters a free trade agreement with a “non-market country” as defined by any member of the USMCA.¹ This has stoked concerns that the U.S. can use this clause to pull out of the deal if Canada enters trade talks with China. But this doesn’t mean that Canada can’t grow its trade with China. Canada will still be able to engage with China on trade in several different ways. Indeed, other options may even be better anyway.

Trade agreements are only one of the many tools available for increasing trade; others, like diplomacy and government/business engagement, have been used successfully for decades to develop the Canada- China relationship.

As a result, Canada already has a strong economic relationship with China. Even with the USMCA clause, it’s poised to grow. That’s good news for the West and all of Canada – with or without a Canada-China trade agreement. Ironically, it’s the U.S.’s own tariff actions vis à vis China that have spurred more Canada-China trade.

Numerous voices from industry, government and the legal community have raised concerns that the federal project approval process is too onerous – that it takes too long, turns away too many “good” projects and drives investment out of Canada. Many blame the current federal environmental assessment (EA) process, but also fear that Bill C-69, which proposes to overhaul the EA process for major projects, may make things worse and stall infrastructure development and our economy.

For the most part, these concerns are based on a small number of high-profile examples, such as the denial of the Northern Gateway pipeline, the cancellation of the Energy East pipeline and the various challenges associated with the Trans Mountain expansion. While these “exceptions” are important, are they representative of the fate of projects that enter the federal approvals process?

A brief analysis of projects entering the federal EA approvals process found that:

• 95% projects that completed the EA process were approved.

• Even where significant potential adverse effects were found, 73% of projects were still approved.

• However, about 25% of project applications were terminated by the proponent before a decision was reached.

• On average, it took almost 3.5 years for a project to either receive approval or be terminated, with some projects taking over 10 years.

• An increasing number of projects are being terminated rather than receiving approval. What is driving this change – market conditions, Canadian competitiveness, regulatory scope or other hurdles – remains unknown.

Across Canada, some industries – including advanced manufacturing, construction, and technology-based customer service – can’t find enough qualified people to work in specific entry- to mid-level, skilled and semi-skilled jobs. People who fill these positions don’t need to have university degrees and other post-secondary qualifications – but they do need to have some technical skills. And they need to be ready to work.

Meanwhile, almost 1.2 million Canadians are looking for jobs.1 The people who are most likely to be unemployed are new immigrants, youth, Indigenous people and persons with disabilities. These groups, and women generally, also have lower workforce participation rates.2

One reason there aren’t enough qualified candidates to match the job openings is that the usual programs that prepare people for employment don’t adequately train people specifically for the good jobs that are available. They tend to offer generic programs designed to make people more employable. Participants – most often women, youth, Indigenous people and persons with disabilities – can end up no better off than they were before.3

RecommendationThere are a number of programs that are doing a good job preparing people who need jobs for the positions that are available. These programs are industry-led, demand-driven and based on competencies – that is, the things that people actually need to do. They help people find work or teach employees new skills (upskilling) by offering “hands-on” learning and certification. We recommend replicating and expanding these training programs for groups underrepresented in the workforce and offering additional supports for people who need them most.

Yes – although it will add a bit more delay to the TMX project itself, it has added significantly to the clarity – yes, clarity – needed for investors for all currently planned and future projects; it should also silence much of the protest that has rendered building infrastructure so difficult in this country. The law of the land, thanks to this decision which builds on several prior court decisions, is finally clear on what the respective participants in any major project must do. And if they do what is prescribed properly, the rule of law will support them. Canada, and in particular our resource sector, has been yearning for this clarity for years.

BUT – the Canadian government is about to toss this hard-won opportunity out the window. The long-term effects of this mistake on both our Canadian economic and social prosperity could be massive. This is not an overreaction – Bill C-69 is absolutely the wrong thing to do right now, because it will set our entire project-approval process back to square one, and reopen every potential economic development project to a new round of protests, court battles, years of delays and investment uncertainty. In the process, we will also lose an extraordinary opportunity to significantly move forward in reconciliation with Indigenous peoples.

Why on Earth would we do this to ourselves?

This is what the good people in the Senate must question. They are being asked to pass Bill C-69, a seriously flawed piece of proposed legislation, after appallingly minimal review by the House of Commons, despite the potential harm to Canada’s economy. This is a critical moment for true sober second thought – and a critical moment for the country.

The recent Federal Court of Appeal decision on the Trans Mountain pipeline expansion (TMX) (Tsleil-Waututh Nation v. Canada (Attorney General) may be – wait for it – the best thing to happen to Canada’s investment climate in a long time.

U.S. President Donald Trump’s election and actions in office have thrown Canada’s relations with its largest trading partner into upheaval. From tariffs to tweets, the uncertainty and stress have become a major headache for the federal government, and for the private sector have inflicted economic damage. This damage goes beyond the auto sector and large manufacturers to also hit the 89 per cent of Canadian small- and medium-sized businesses (SMEs) that sell primarily to the U.S. And they can least afford to take the hit. This kind of economic damage tends to fly under the radar in small cities and industrial parks, but it is important and needs attention.¹

The bad news for these SMEs and the country as a whole is that the current state of unrest with the U.S. is likely to be the new normal going forward, including beyond the current administration. Firms of all sizes are going to have to invest more time, effort and money, simply to hold on to what they currently have in the U.S., never mind to grow.

The good news is that while trade with the U.S. has gotten harder, trade elsewhere has gotten easier, in particular in Europe and parts of Asia. Far from being hamstrung by the U.S., Canadian businesses can take numerous creative and concrete steps to survive – and even potentially prosper – through the current challenges. Smaller firms will need more help to pursue opportunities abroad, maintain market share in the U.S., and improve trade between provinces at home. But more help does not mean simply throwing more money at traditional approaches. Canada faces new challenges in the U.S. and abroad. We need to take a close look at how we do trade promotion and assistance programs for small businesses in different markets, try new things – and take some risks.

ProblemCanada’s prosperity is at stake. Events in the United States, including major U.S. trade actions against Canada compounded by major tax cuts and streamlining of regulations, pose serious threats to our economy.

All of that is beyond our control – but here at home we’re just making things worse. Canada’s natural resources have been the backbone of Canada’s economic prosperity, but Canada’s investment climate for major resource-related projects has deteriorated as regulatory burdens and politically motivated decisions have rendered Canada a difficult place to get anything of significance built. Foreign investment is going elsewhere – and perhaps even more telling, so is Canadian investment. Rather than attracting critical investment, we are turning it away.

And yet, although perhaps well-intended, Bill C-69 threatens to make things much worse at a time when we can’t afford that risk. We produced a major report on Bill C-69: Unstuck: Recommendations for reforming Canada’s regulatory process for energy projects, which details our analysis and, most importantly, recommends what such legislation should include. Unfortunately, the amendments since made at the House of Commons Committee level do not address the major concerns, and in some cases, exacerbate them.

The bill is now in the Senate, but there is increasing consensus among business leaders, investors, potential investors, think tanks, academics and others that Bill C-69 is not fixable.

RecommendationMore than just amendments, Bill C-69 needs a reboot.

A reboot will enable the government to build on important policy work now underway, including its own Economic Strategy Tables, to support Canada’s economic success and environmental sustainability.

Despite some extreme reactions at both the positive and negative ends of the spectrum, the Federal Court of Appeal has NOT stopped the Trans Mountain pipeline expansion (TMX) – far from it. Further delay is certainly problematic for the federal government and for oil producers. But there is now a clear way forward – we at least now know what remains to be done. A bit more delay may very well be worth it for the greater clarity this decision has provided for this – and all future – projects.

The Tsleil-Waututh Nation v. Canada (Attorney General) decision provides a positive way forward both for the construction of the pipeline AND the interests of Indigenous communities with legitimate concerns AND those with legitimate environmental concerns. This decision, now part of the law of the land, has also made it clear that although real concerns need to be addressed, neither the environmental concerns nor Indigenous community concerns can be limitless. More importantly, the decision provides specific steps needed to address those concerns. The added certainty on these points means the decision should be welcomed by both infrastructure proponents and those with legitimate environmental and Indigenous rights concerns. For sure, there are some at the extreme who are celebrating the “quashing” of the project – but the court took exception to only two specific problems, and made it clear that the remedies are achievable. In so doing, the court has given both the National Energy Board (NEB, or the Board) and the federal government an opportunity to address them. Indeed, the court went out of its way to spell out just how limited the required steps are. There will be some further delay, but the court most certainly did not “stop” the project.

Dairy’s Alternative Facts

Facts matter

Good public policy is impossible without facts. Poor information leads to poor decisions, and people suffer. Our job at the Canada West Foundation is to determine the facts – real ones – and conduct thorough analysis. Unfortunately, supply management of our dairy, poultry and egg production in Canada is an issue where “alternative facts” dominate the debate.

Because of this, before we start our overall myth-busting, there are a couple of facts we feel obliged to note: No group, person or organization with any interest in dismantling supply management funds our work on this issue. We recommend practical public policy directions which are non-partisan, non-ideological. We don’t get paid by anyone to support dismantling supply management. We have great respect for the hard work done by ALL of Canada’s farmers and we want fair treatment for all.

However, the dairy lobby is one of Canada’s richest and most powerful. It spends more than $100 million every year on lobbying and marketing – aimed at politicians, the public, trade negotiators, and, most frustratingly, farmers. The myths they tell have their own producers scared, the public inured to exorbitant dairy prices, and politicians completely cowed. We believe that some myth busting is needed.
