3. Approve 3/15/18, 5/10/18, and 5/17/18 minutes.The Committee unanimously approved the minutes.
4. Groundwater Sustainability Plan (GSP); General Manager’s ReportMr. Petersen presented a status report. He will attend the Water Resources Agency’s meetings on the river surface water management plan to synchronize with the GSP as appropriate. Three to four meetings on the GSP are planned in July, and meetings on the GSP and fee study will be combined in August. It is anticipated that the Advisory Committee will consider a draft fee study in August.

Mr. Petersen stated that they propose a management plan to coordinate the individual GSPs. The management plan would benefit the GSA and is not required by the DWR. The Board approved this alternative prior to the Advisory Committee’s consideration due to schedule timing.
Abby Taylor Silva stated that the consensus of the Grower Shipper Committee is in support of the proposal, although some preferred individual plans.
Tom Virsik stated that he has written a couple letters on these proposals. Roughly speaking, the Board chose rationally.
Mr. Petersen invited Committee members to suggest model websites for the update planned for the SVBGSA webpage. SVBGSA has implemented the Granicus legislative recordkeeping program and will be publishing a monthly newsletter. A survey on potential projects will be initiated next week.There’s been discussion regarding establishing an ad hoc Technical Advisory Committee.
5. Status of Basin Boundary ModificationThe submittal deadline has been extended to July 31, 2018. It is unclear whether the upper valley GSP submittal would then be required by 2020, in which case they would probably choose a different direction.
Ben Gooding, Department of Water Resources, stated that the SVBGSA could withdraw its basin boundary modification application at any time prior to approval.
6. Memorandum of Agreement with the Water Resources Agency Mr. Petersen reported that the SVBGSA Board approved this item without inclusion of the $85,000 expenditure for completing the GEM data. The item will be considered by the Monterey County Board next week.
7. Committee Member ReportsDave Chardavoyne stated that the Water Resources Agency would be making presentations on the interlake tunnel project.

SUBJECT: Assignment of HydroMetrics Contract to Errol L. Montgomery and Associates, Inc.
RECOMMENDATION:SVBGSA Executive Committee and staff recommends that the SVBGSA Board adopt a resolution authorizing an amendment to the agreement with Hydrometric Water Resources Inc. consenting to the assignment of the contract between Hydrometrics and the SVBGSA to Errol L. Montgomery and Associates Inc.
BACKGROUND:The Salinas Valley Basin GSA (SVBGSA) is responsible for developing Groundwater Sustainability Plans (GSPs) in parts or all of six sub-basins in the Salinas Valley. In order to accomplish this GSA staff applied for and received a $1.5 million grant to develop the GSP’s. Staff also completed a selection process that resulted in an agreement between Hydrometrics Water Resources Inc. and the agency to complete the planning process.
DISCUSSION:Mr. Williams, President of Hydrometrics, recently informed staff that Errol L. Montgomery Associates Inc. was acquiring his business. Mr. Williams also inquired as to the process that would need to occur to assign the contract that exists between the GSA and Hydrometrics to the new business owner.
Section 15.06 of the contract with Hydrometrics reads in part:
Assignment and Subcontracting. The CONTRACTOR shall not assign, sell, or otherwise transfer its interest or obligations in this Agreement without the prior written consent of the GSA. None of the services covered by this Agreement shall be subcontracted without the prior written approval of the GSA. Notwithstanding any such subcontract, CONTRACTOR shall continue to be liable for the performance of all requirements of this Agreement.
Prior to requesting board approval for the assignment of the agreement staff required written statements from Mr. Williams and from Errol L. Montgomery and Associates Inc. stating that they would fulfill the terms of the agreement with the existing team of

consultants remaining intact. Letters to that effect have been received and are attached to this report.
The request for assignment has been reviewed and approved by legal counsel who has prepared an amendment to the agreement that would allow for the assignment to take place. The amendment is also attached.
The SVBGSA Executive Committee reviewed this item at their June 28, 2018 meeting and unanimously recommended approval to the full SVBGSA Board.
FISCAL IMPACT:There is no expect fiscal impact from this action
