SITE DETAILS

Locality Plan

The site has frontage to D'Aguilar Highway and subject to access approval from TMR. Thesite proposes to include sealed car parking, gravel hardstand manoeuvring area, spillcontainmentstructure, and a diversion drain for stormwater from the highway. Landscapedareas are included as per the overriding development application.

COMMENTSThe application is code assessable and the plans have been checked and are in compliancewith the codes and standard drawings of Council's development manual, except wherereferenced In the outlined conditions.

DELEGATIONOF AUTHORITYThe Chief Executive Officer has the power to act as the "AssessmentMana-ger" in respectof decisions required to be made by Council for all Development Applications received byCouncil under Chapter 6 of the SustainablePlanningAct 2009.

Council granted this delegation to the Chief Executive Officer at the Ordinary Meeting heldon 23 December 2009.

RECOMMENDED DECISIONThat Council approve the DevelopmentApplication for Operational Works associated withearthworks, carpark, and stormwaterdrainage for transportdepot on land described as Lot 5on RP15002 and situated at 8513 D'Aguilar Highway, Moore subject to the conditionscontained in the Schedules and Attachments.

CONDITIONSOF APPROVALSCHEDULE1

GENERAL CONDITIONS

1. Carry out the development in accordance with the material contained in thedevelopmentapplication, supporting documentation, Somerset Regional CouncilDesign Standards, and the approved plan(s), except where amended by theseconditionsof approval.

2. This approval extends to engineering works including earthworks, sediment anderosion control, roadworks, retaining walls, stormwater drainage and other worksas detailed on approved drawings and is conditional upon:

2.1 Provide written approval from the Department of Transport and MainRoads to carry out works on a state controlled road.

2.2 The Applicant is responsible for obtaining all necessary approvals andpermits required from any external agencies in satisfying the conditionsofapproval. The cost of obtaining these approvals and permits are at theApplicant's expense.

3. Certification must be given to Council by a Registered Professional Engineer inQueensland (RPEQ) that the works have been undertaken in accordance withthe approved plans and specificationsand to Council'srequirements.

4. A legible copy of the Approved Drawings and Conditions of approval is to beavailable on site at all times during construction.

5. Prior to works commencing, it is required that a pre-start meeting be attended byCouncil's officers, the supervisingengineerand the Contractor. At that meeting,it will be necessary for the supervising engineer to provide Council with thefollowing:

5.1 A works program5.2 Inspection and test plan5.3 Public liability certificate of currency (project specific)5.4 WorkplaceHealth and Safety plan5.5 Job Specification5.6 Environmental Management Plan5.7 Traffic ManagementPlan

6. Compulsory inspections and meetings shall be undertaken by Council, with aminimum of two clear working days notice required to be given to Council for aninspection of sections of the work at the followingstages:

6.1 At the point of completion of all works.6.2 Other inspections as deemed necessary by Council.

7. Notification to Council, with a minimum of two clear working days notice, is

required to be given for work at the followingstages:

7.1 Prior to commencementof works.

Council reserves the right to conduct inspections of these works.

8. Where the progression of work leads to substantiatedcomplaints, the Applicantshall immediately rectify works and undertake any directions from CouncilOfficers to rectify any works.

9. From time to time, Council and/or their representativesmay enter the work site to

which this approval relates and undertake any testing or analysis of any part ofthe construction, and Council is not liable for the rectification or anycompensation for any damage caused in the testing or analysis process. Should

work be found to be not constructed to specification or of poor quality, anyreasonable instruction given by Council Officers shall be considered to be acondition of approval and undertaken by the principal contractor.

10. Where complete or incomplete works under this approval adversely affectadjoining properties, Council land, roads or other infrastructure, the Council mayrequire by notice, works to be completed. Where Council deems it necessary to

undertake works for the safety or health of the community or protection ofinfrastructure, costs associated with such works shall be recoverable from theapplicant.

11. Any damage which is incurred to services, signs, footpaths, roadways, kerb andchannel, or other work abutting the subject land as a result of the proposeddevelopmentshall be repaired immediately should hazards exist for pedestrian orvehicular safety. Otherwise, all damage shall be repaired immediately uponcompletion of works associated with the developmentat the Applicantsexpense.

12. Unless otherwise approved in writing by the ManagerPlanning and Development,hours of construction shall be:

Mondayto Saturday - 6.30 a.m. to 6.30 p.m. - Noise permittedSundayand Public Holidays - No audible noise permitted

Work or business which causes audible noise shall not be conducted from or onthe site outside the above hours.

13. It is the applicant's responsibility to appoint the principal contractors, completeforms, notify Workplace, Health and Safety, pay fees and carry out any otherWorkplace, Health and Safety legislative requirements, and submit evidence ofcomplianceto Council.

14. All wastes to be managed in accordance with the relevant legislation andregulations with regulated waste to be disposed of at a licensed facility by alicensed regulated waste disposal contractor and general solid waste to bedisposed of at Council approved landfill sites with the contractor covering allcosts reasonably incurred for the receipt and managementof the waste.

EARTHWORKS

15. Earthworks and fill on the subject land shall not lead to ponding of water oractionable nuisance and shall ensure all lots, both internal and adjoining, drainfreely to a lawful point of discharge.

16. This approval does not extend to any material proposed to be imported to orexportedfrom the site:

16.1 Other than from or to site(s) that have a current development approvalenabling them to export/importany material; or

16.2 The material is being exported to and accepted at a licensed Councilrefuse facility.

17. Contaminated material must not be used as fill on the site. Any filling must beundertaken using inert materials only.

18. Waste material as a result of demolition works and excavation works must not beused as fill where the material includes the following as defined within theEnvironmentalProtection Regulation:

18.1 commercial waste;18.2 constructionor demolition waste;18.3 domestic clean-up waste;18.4 domesticwaste;18.5 garden waste;18.6 industrial waste;18.7 Interceptorwaste;18.8 Recyclable biodegradablewaste;

18.9 Recyclable waste;18.10 Regulated waste.

All waste material above as defined within the Environmental ProtectionRegulationmust only be disposed at a waste facillty approved for the receipt ofwaste.

19. Where vegetation is removed, the vegetationwaste shall be disposed of by:

19.1 Milling.19.2 Chipping and/ormulching19.3 Disposal at an approved waste disposal facility.19.4 Burning provided fire permits are in place.

Waste other than vegetation waste, generated as a result of the operationalworks shall be disposed of to an approved disposal facility via an approved wastereceptacle and/orcollection service.

ACCESS

20. Landowners are responsible for the construction and maintenance of anyvehicular access for the property.

GENERAL SERVICES

21. All works required for this development must take due regard of any and allexisting services and, if considered necessary by the relevant authorlty, suchworks must be alteredat the cost of the Applicant.

TRAFFIC CONTROL

22. Temporary signage and traffic control for construction on or near road reservesshall be provided in accordance with Part 3 (works on roads) of Manual ofUniform Traffic Control Devices (MUTCD) - Department of Main Roads.

23. Any Road or lane closure must be applied for to Transport and Main Roads, andall conditionsof that approval complied with during construction of the works.

EROSION CONTROL

24. Erosion and sedimentation controls shall be implemented, as necessary, andshall be maintainedto Council's satisfaction at all times during the course of theproject and the ensuing defects liability period. Should proposedcontrolsprove tobe ineffective, Council will require the developerto install additionalmeasures.

25. No construction works may commence on subject sites until appropriateSedimentand Erosion Controlshave been implemented.

26. All unpaved areas where earthworks have been undertaken are to be grassseeded to achieve good grass cover.

27. Measures shall be applled to Council's satisfaction to prevent site vehiclestracking sedimentand other pollutants onto adjoiningstreets during the course ofthe project, and to prevent dust nuisance during construction and the ensuringdefects liabilityperiod.

28. Stockpiles of topsoil, sand, aggregate, spoil or other material capable of beingmoved by the action of running water shall be stored clear of drainage paths andprevented from entering the road and/or drainagesystem.

29. Should it be necessary for the road and/or drainage system to be reinstated orcleaned up due to erosion, debris and/orsediment from the site, then such worksshall be at the developer'sexpense. Such works shall be undertaken immediatelywhere there is a potential hazard to pedestrians and/or passing traffic.

30. The site shall be maintainedin a clean orderlystate at all times.

31. It should be noted that, in approvingplans for this project, Council has carried outan audit check of information submitted. Accordingly, Council has placedreliance on the certificate of design that the approved plans are correct and in

accordance with required engineeringstandards.

ADVICES

1. Biosecurity Queensland should be notified on 13 25 23 of proposeddevelopment(s) occurring in the Fire Ant Restricted Area before earthworkscommence. It should be noted that works involving movements of soil associatedwith earthworks may be subject to movement controls and failure to obtainnecessaryapprovals from Biosecurity Queensland is an offence.

It is a legal obligation to report any sighting or suspicion of fire ants within 24hours to Biosecurity Queenslandon 13 25 23.

2. The Aboriginal Cultural Heritage Act 2003 commenced in Queensland on April16, 2004. The Act is administered by the Department of Environment &Resource Management(DERM).

The Aboriginal Cultural Heritage Act 2003 establishes a Duty of Care forIndigenous Cultural Heritage. This applies on all land and water, includingfreehold land. The Cultural Heritage Duty of Care lies with the person or entityconducting an activity.

Penalty proposing an activity that involves additional surface disturbancebeyondthat which has already occurred at the proposed site need to be mindful of theCultural Heritage Duty of Care requirement.

Details on how to fulfil the Cultural Heritage Duty of Care are outlined in the Dutyof Care Guidelines gazetted with the Act.

Council strongly advises that you contact DERM's Cultural Heritage CoordinationUnit to obtain a copy of the Duty of care Guidelinesand further information on theresponsibilitiesof proponentsunder the terms of the AboriginalCultural HeritageAct 2003

3. The Australian Government recently declared koala populations in Queenslandas a vulnerable species under the Environment Protection and BiodiversityConservationAct 1999 (Cth). Accordingly,where development may facilitate an

action that is likely to have a significant impact on the koala the applicant isrequired to refer that developmentproposal to the Federal Environment Minister.A significant impact includes the removal of two or more koala food trees or anyother activity that may impact on local koalas.
