    IntroductionThis booklet has been designed to assist members ofsix new emerging culturally and linguisticallydiverse (CALD) communities in the Logan/Gold Coastregions. It aims to help them understand the rights andresponsibilities of rental tenancy.

    Funded by Queenslands Residential TenanciesAuthority (RTA) through their Community EducationPublic Grants Scheme, Interlink Housing & SupportAssociation Inc. and Acces Services Inc. , the researchbase for this booklet was gaining first-hand knowledgeabout the REAL issues CALD communities face when

    renting a property. This project was managed by InterlinkHousing & Support Association Inc.

    The support and cooperation from six refugeecommunities within the Logan/Gold Coast regionsthroughout this project was very much appreciated;important information obtained through conversation,questionnaires and focus groups, all of which helped to

    create this booklet - a resource aimed at educating andempowering CALD Communities, with the view to posi-tively impacting both the immediate and widercommunity.

    Notice to Leave (Form 12)A tenant receives this form if they have breached theirTenancy Agreement and NOT fixed the problem in theseven daysafter they received a Notice to RemedyBreach (Form 11)

    Notice of Intention to Leave (Form 13)A form to say the tenant intends to leave the propertythey are renting.

    Fixed Term Agreementthe tenant must give 2weeks notice, 2 weeks prior to the expiry date of theagreementPeriodic Agreementthe tenant must give 2 weeksnotice anytime

    Exit Condition Report (Form 14a)A form which the tenant fills out at the end of the

    tenancy which shows the condition of the place whenthey leave; to record whether items in the property areclean, working, undamaged (example: stove). Thisform is compared with the Entry Condition Report.

    Good Tips for Tenants:Protect your bondif you damage the property or

    do not pay your rent, the lessor/agent will keepsomeor all of your Bond! 9

    Renting in QueenslandThe Laws for Renting . . .

    Whether you are renting from Interlink, from otherpublic housing or privately, there is a law in

    Queensland about renting.

    This law sets out what lessors and tenants can andcant do when renting.

    Below are some of the words you will hear or see whenyou are renting or when you read this book .

    The Residential Tenancies Act 1994This is the law that sets out the rules forrenting in Queensland:

    AgentSomeone who looks after a property for alessor/owner

    Real Estate AgentManages a property for the lessor/owner

    TenantA person who is paying rent to legally live in a house or unit

    TenancyWhen you have signed a tenancy agreement and arepaying rent for your home, you have a tenancy. A tenancyhas a beginning and an end .

    LessorOwner of a property that is being rented

    Renting in Queensland

    Rights and Responsibilities under the law

    TENANT is responsible for:

    Living in a property according to the conditions agreedwith the lessor in the Tenancies Agreement

    Paying rent on time (amount agreed on lease) Keeping the property clean INSIDE and OUTSIDE Not making too much noise in your neighbourhood Reporting any damage or need for maintenance to the

    lessor/agent Not using the house for anything against Australian

    law Making sure you or your visitors do not

    deliberately damage the property Paying for any damages you make

    LESSOR/AGENT is responsiblefor:

    Keeping the property safe and livable Fixing repairs when required Allowing you to live in the property as your home for

    the time stated on lease Not entering your home without giving you correct

    notice in writing Supplying keys for the property Making sure the bond is lodged with the RTA

    Good Tips for Tenants:The (RTA) uses a free interpreter service. If you need to

    call the RTA, ring the Translating and InterpreterService(131 450 ) - ask to be connected to the RTA inQueensland.

    DisputeDisagreement or difference of opinionbetween at least two people

    BreachWhen the rules of the General TenancyAgreement have not been followed by thetenant or the lessor/agent

    Dispute resolutionThis is a free and confidential serviceprovided by the RTA to tenants andlessors who want to discuss their disputeand come to an agreement. You can put ina request for dispute resolution by sendingin a Form 16 to the RTA. You can chooseto have a friend or support worker speakon your behalf to the RTA

    Property InspectionThe lessor/agent can inspect the property every 3months to record how the tenant is looking after theproperty, and to see if repairs are needed. This is agood time for the tenant to inform the lessor/agent of

    any repairs or concerns.

    Entry Notice (Form 9)Form given to the tenant so the lessor/agent can do:1) a property inspection (7 days notice) or2) maintenance repairs (24 hours notice)

    Bond LoanMoney borrowed from Department of Housing to pay forRental Bond. This money MUST be paid back

    Bond Lodgement(Form 2)Form signed by you and the lessor that is sent to theRTA by the lessor with your bond money. This form isheld by the RTA with the tenants rental bond moneyuntil the end of the tenancythe tenant or lessor canthen apply to have the bond paid back to them

    at the start of a tenancy

    General Tenancy Agreement(Form 18a)A legal agreement between the tenant and lessor/agent.When you sign the tenancy agreement, you are agreeingto live in the property according to the rules in theAgreement .

    Fixed Term AgreementA set time a tenant rents a property (example: 6 or 12months)

    Periodic AgreementA tenant rents a property for NO SET TIME. There is a

    start date but NO END DATE. A periodicagreement starts when a fixed term agreementexpires and the tenant does NOT sign a new fixedterm agreement

    Rental BondMoney paid at the beginning of tenancy, and sent to theRTA by the lessor. This is NOT rent. At the end of the

    tenancy you can apply to have the RTA return yourbond to you. The lessor/agent may also apply to keepsome or all of the rental bond for damages to theproperty, or if you are in rent arrears when you leavethe property.

    The lessor/agent is responsible for : making sure the

    premises are fit to live in when the tenant moves in making sure everything is working and livable on the

    property during the tenancy

    The tenant is responsible for : keeping the property clean and in the condition it was

    when they first moved in

    Repairs

    If there are any damages to the property the tenant should re-port them immediately to the lessor. There are some damagesthe lessor must repair and pay for. There are other damageswhich the tenant may have to pay for. Make sure you knowwho to contact in case of emergency repairs .

    It is the tenants responsibility to keep the house clean and in areasonable condition . Everybody has different ideas about whatclean means, but the next few pages will give you an idea ofsome of the things in your home and ways you can clean them.Remember that allowing stains to set into a carpet or mould toset into the bathroom may result in you losing some of yourbond.

    it can be given to the tenant when they have not

    followed the rules of the General Tenancy Agreement(example: not paid their rent on time or if they havedisturbed the peace of the Neighborhood.

    the tenant has 7 days to fix the problem

    it can also be given to the lessor/agent by the tenant ifthey have not followed the rules of the GeneralTenancy Agreement (example: you have reported yourbroken shower nozzle to the lessor many times andthe problem has not been fixed).

    the lessor/agent has 7 days to repair theproblem if you issue the lessor with aNotice to Remedy Breach (Form 11)
