PEOPLE'S MOTION FOR LEAVE TO SUPPLEMENT THE RECORD ON APPEAL
The People of the State of Illinois, by their Attorney, ANITA ALVAREZ, State's Attorney of Cook
County, Illinois, through ALAN J. SPELLBERG, Assistant State's Attorney, respectfully ask this Honorable
CoLIIi for Leave to Supplement the Record with one vo lume of record. The People state the followin g in
support of their Motion.
1. On June 19, 2012, the Honorable Steven J. Goebel granted
defendant's motion to declare the Illinois Eavesdropping Statute, 720
ILCS 5/14, unconstitutiona l.
2. On June 22, 2012, defendant filed an emergency motion
requesting that the tri al court amend its June 19,20 12, order declaring
the Illinois Eavesdropping Statute unconstitutional in order to comply
with Supreme Comi Rule 18.
3. On July 26, 2012, the trial court issued an order finding that the
Illinois Eavesdropping Statute, 720 ILCS 5/14, is unconstitutional. The
court specifically stated the following "Under Illinois Supreme Comi
Rule 18, the court finds the Illinois Eavesdropping Statute is
unconstitutional on its face and as applied to defendant. The court
holds that the Illinois Eavesdropping Statute lacks a culpable mental
state, subjects wholly innocent conduct to prosecution, and violates
substantive due process under the Fourteenth Amendment to the
United States Constitution (U.S. Const. Amend. XIV) and Article I,
Section 2, of the Illinois Constitution (Ill. Const. 1970, Art. I, Sec. 2).
The court further finds that the statute cannot be construed in a manner
that would preserve its validity and judgment cannot rest upon an
alternative ground. Notice under Illinois Supreme Court Rule 19 was
given."
4. The People filed a Notice of Appeal on August 9, 20 12.
5. The record was filed April22, 2013 . However, on May 1, 2012,
defendant filed a motion seeking to supplement the record on appeal,
stating that in addition to the transcripts from more than 70 different
dates the matter was called before the Circuit Court of Cook County
that were included in the record on appeal, transcripts from four
additional dates were necessary for this Court's resolution of this
appeal. On May I 0, 2013, the People filed a response to defendant ' s
motion, agreeing to order the requested transcripts and supplement the
record with them once they had been prepared. On May 14, 2013 , the
Court granted defendant 's motion.
6. The People their opening brief on September 27, 2013 .
7. The People now wish to supplement the record with one volume
of supplemental record from petiti oner's direct appeal, which contains
the transcript of the proceedings held on the four additional dates
(April 15,20 10, April 20,2010, May 5, 20 10 and May 12, 2010)
requested by defendant.
THEREFORE, the People of the State of Illinois respectfully request leave to supplement
the record with one volume of supplemental report of proceedings.
