BACKGROUND The RMR ceilings are the maximum amount child care providers can be reimbursed from the state for subsidized child care. It applies to the CalWORKs Stage One child care program administered by the California Department of Social Services (CDSS) and the CalWORKs Stages Two and Three and other child care programs administered by the California Department of Education (CDE). The CDE is responsible for the contract awarded on a competitive basis to conduct the biennial RMR survey for child care providers. The survey is based on a methodology of zip codes groupings that have similar socio-economic characteristics (e.g., similar housing costs, population density, and employment rates). The survey results are utilized to create the RMR ceilings based on an aggregate of the survey data for each county. This letter provides information on the implementation of the 2009 RMR ceilings for California’s subsidized child care providers.

BACKGROUND

The RMR ceilings are the maximum amount child care providers can be reimbursed from the state for subsidized child care. percentile of the 2005 RMR survey and the license-exempt child care provider ceilings at 60 percent of the Family Child Care Home ceilings through December 31, 2014.

The AB 1476 and the SB 876 require California to implement ceilings at the 85th percentile of the 2009 RMR survey reduced by 10.11 percent. If the new calculated ceiling is less than the 2005 RMR ceiling, then the county will continue to utilize the 2005 RMR ceiling. The license-exempt child care provider ceilings will continue to be 60 percent of the Family Child Care Home ceilings. The new RMR ceilings are effective January 1, 2015.

Although no client will receive a reduction in their reimbursement, some clients may see an increase. Counties must review each child care case to determine if these changes result in an increase to a client’s reimbursement and notify those clients in accordance with the Manual of Policy and Procedure (MPP) Section 47-420.3 cited below. To assist Counties in preparing for this change, attached are the new RMR ceilings.

NOTICE OF ACTION (NOA)

The CDSS MPP Section 47-420.3, specifies that County Welfare Departments (CWDs) shall notify clients whenever there is an approval, denial, change, or discontinuance in the amount of a child care subsidy. With the implementation of the changes described in this letter, it is likely that many clients’ child care payments will be affected.

To provide timely notice to these individuals, the CWDs shall issue a NOA, NA833, to all impacted clients at least ten days before the change in child care benefit occurs. The reason for the change will be listed as, “Your child care subsidy amount has increased due to a change in state law, effective January 1, 2015.” A copy of the NA Back 9, Your Hearing Rights, must accompany each of these notices. The CWDs are reminded that clients have the right to a hearing for the purpose of determining an incorrect subsidy or grant computation in accordance with MPP Section 22-003.
