Grace Race Expands to Include Cornhole and Pancakes

Tinkling Spring Presbyterian Church will host the Grace Race+ on Saturday, April 13, with activities starting at 8 a.m. This year, the 4th annual 5K run and walk expands to include a Pan-cake Breakfast, a Cornhole Tournament, a Silent Auction and plenty of free activities for children and their families. The Grace Race+ will benefit the Boys and Girls Club of Augusta County/Waynesboro, the Woodrow Wilson Rehabilitation Center Foundation and the TSPC Youth.

The 5K (3.11 miles) Grace Race be-gins at 9 a.m. from Tinkling Spring’s campus Fishersville. Racers can register individually or as a three person team and will experience a combination of paved and dirt trails that feature the church’s historic grounds. The 5K will be preceded by a Tot Trot Fun Run for kids at 8:30 a.m.

Throughout the morning, guests can enjoy a Pancake Breakfast prepared by volunteers from the WWWRC Founda-tion or bid on items in a Silent Auction, including themed gift baskets and a reproduction oak ice box, handcrafted by students at Woodrow Wilson Reha-bilitation Center.

At 11 a.m., the competition shifts to a Cornhole Tournament. Players can choose the Competitive Level for a 50/50 split of the registration fees or the For Fun Level to earn bragging rights and gift certificates. Volunteers from the Boys and Girls Club will be serving lunch during the tournament.

Why do we like to live on or near water? For many of us the water is a source of recreation in the

form of boating, fishing or water skiing. For others it is a calm and peaceful place to get away from an otherwise busy life. For still others living on the water is like being on a perpetual vacation.

If you are in the market for a home on the water, you will find many op-tions to choose from in our area from Blue Ridge Shores, the quiet com-munity around Lake Louisa, to the larger waterfront neighborhood of Lake Monticello, to the multitude of different subdivisions around Lake Anna. Those who want a more rustic experience may be fortunate enough to find property on one of the local rivers, although that can be a more difficult proposition. Regardless of your particular needs, if a waterfront property is in your fu-ture, it is best to work with a REALTOR® who is knowledgeable both about this type of property and about the local homeowners associations as the latter will govern the ways in which you can use and enjoy both your property and the water it is near.

The Market for Waterfront Property

Like other types of property, the waterfront market appears to be on the rebound.

“We’re still coming off the off sea-son,” said Greg Isaac, with Long and Foster Realtors, a Lake Anna specialist, “but March looks good so far.” He went on to explain that sales are up this year in general and they have more homes under contract than at the same time last year.

Libby Sandridge, with Lake Anna Island Realty, agrees. “We are seeing an uptick in the market, “ she said. The year has gotten off to a good start and she is very busy...a good sign of things to come. Sandridge works the Lake Anna market and also assists buy-ers and sellers at nearby Lake Louisa.

The market also looks good at Lake Monticello. Vicki Wilson, Principal Bro-ker/Owner of Monticello Country Real-tors, said that “inventory is low at the moment.” Current prices range from $349,000 for a waterfront condo to $689,500 for a large single family home.

Keith Smith, with Roy Wheeler Re-alty, another Lake Monticello special-ist, said that there has been a shift in the market in the last three to four months resulting in an inventory short-age. A house near where he lives in Lake Monticello was priced right for the location and sold in just twelve hours. He cautioned, however, that a similar floor plan just a block away may not sell for as much or as quickly...the market is that specialized.

The homes that are doing the best are the ones on the water or on the golf course, Smith continued. He em-phasized that the local nature of the current market makes it imperative for buyers and sellers to work with agents from the area who understand these street-to-street variations in values.

Patsy Strong, Principal Broker with Strong Team Realtors, is also upbeat about the strength of the waterfront market, citing one of her recent list-ings at Lake Monticello that went under contract in just two days. The good news for sellers, said Strong, is

that “there never seems to be a short-age of waterfront buyers. You can have someone sitting out there for years waiting on the perfect waterfront home and they may walk in the door and want to purchase a particular wa-terfront listing that day.”

The market for rural properties with river frontage or private lakes is also looking up. Rick Walden, with Virginia Estates, currently has several buyers who want to take advantage of a substantial drop in price on one of his listings, a multi-million dollar estate property on the James River near Lynchburg. Another rural listing on a 19-acre private lake received multiple bids after it had been on the market for less than two weeks.

Waterfront BuyersWilson said she often gets referrals from buyers who send their friends and rela-tives, and often they decide to buy after they come first for vacation. She bought her own home at Lake Monticello after visiting her parents who had purchased a home there in the 1980s. Eventually she relocated from Massachusetts where she was living at the time and has been here ever since.

Like a lot of people who are drawn to the water, Wilson grew up on a lake. In her case the lake was North of Chi-cago and she remembers ice-skating there when she was a child. “Many ask if Lake Monticello ever freezes,” she said. “It does not.”

“Retirees are typical waterfront buy-ers,” said Smith, especially since the dollar value of these homes puts them out of reach for most first timers. Smith, and his wife Yonna, also works with move up buyers who commute to Charlottesville or elsewhere for work, as well as others who are looking for a second home.

Retirees also like Lake Anna, Isaac said, as do “people in their 30s or early 40s with young families looking for a second home.” He stressed that a big part of Lake Anna’s popularity is its proximity to urban centers such as northern Virginia, Fredericksburg, Richmond and Charlottesville.

Recent commercial development in the Lake Anna area has brought con-veniences such as grocery stores, res-taurants and strip malls. Asian food is now available including a sushi bar and there is a crab house with delicious food and live music. These additions to the area make it much more livable and

give people something to do in the evenings, adding to its value, Isaac said.

For some buyers, the water is criti-cal but is not itself the main feature. Peter Lee, with Roy Wheeler Realty, described a 100-acre riverfront listing he once had that came with a lot of flat or bottomland. Building is pro-hibited on bottomland because of the potential for flooding and for most buyers, that part of the property has limited value. In one instance, though, the bottomland had a lot of appeal for a buyer who was part of an amateur soccer organization because its flatness made it a good playing field. The land ultimately sold to a family that had horses and viewed the flat, bottomland as a great place to ride.

Buying Waterfront PropertyIn many respects buying a waterfront property is just like buying any other home. It is important to find a home and floor plan that suits your lifestyle, and you will need to have all of the same inspections done as part of your purchase process.

There are some special consider-ations however, when it comes to buying some waterfront homes. At Lake Anna there are hundreds of communities each with its own set of

covenants and restrictions impacting how you may enjoy the water. In ad-dition, the lake touches on three counties—Spotsylvania, Louisa and Orange—all of which have their own set of regulations and their own sep-arate school systems. If Lake Anna is where you want to settle, find a local agent, Sandridge said, who is familiar with the differences between the com-munities and counties and can help you find the location that best meets your needs.

There’s another reason to work with a local agent, Sandridge continued. Since many waterfront homes are sec-ond homes, owners may be away from them for weeks at a time and may have need to call on their agent for help meanwhile. If the roof springs a leak or the hot water heater needs to be repaired or replaced, it’s good to have an agent who is willing to open the house or oversee the repair.

There are also issues to be aware of concerning the water itself such as: How deep is it? Is it navigable? How much footage is available, and is it enough to accommodate your boat if you have one? What kind of bulkhead or dock are you allowed to have? It also helps to know about any restrictions. Jet ski enthusiasts who move to Lake Louisa are likely to be disappointed.

Water skis and boards are allowed, but jet skis are strictly prohibited.

Still another question is whether the property is actually waterfront or just has a water view. As an example, some of the properties at Lake Mon-ticello are actually on coves that may be only a couple of feet deep, Smith said. You may have a view of the lake from one of these locations but you definitely can’t launch a boat.

All of these communities also have many homes with water access, but which do not actually front on the water. People who live in these homes can still enjoy the water and associated activities but can’t access it from their own yard.

There are special considerations for people who want to live on the James River. Lee cautions that if you want easy access to the water, find property on the south side since on the north side there will always be a train track separating you from the river. The track was built on the tow-path that was in use when the river

was the main source of transport for goods moving from west to east.

The Life Changing WaterfrontThe waterfront lifestyle can be life changing. According to Strong “the only thing buyers should be aware of when purchasing a waterfront home is how it might change their entire lives. I have seen it over and over again,” she said. “Buyers purchase a waterfront home for weekend use then they start extending their weekends and working there on Fridays and Mon-days, and eventually I run into them in the store in the middle of the week.” Invariably, she continued, they confide that they have made the move to the water permanent...“and they are always smiling when they say it.”

Strong believes that living on the water can change your perspective and let you recognize what is really important. “It is no longer just a house you live in. A waterfront home becomes a place for family and friends to gather, share good times and make lasting memories.”

Post General Assembly impact on HomeownersBy Gina Farthing

The 2013 Virginia General Assembly session has been very busy with leg-islation concerning the real estate industry, specifically addressing the following issues:

• HB1868First-timehomebuyerssav-ings accounts to purchase a home,

• HB1807 Issuanceof disclosurepackets to property owner associa-tions and condominiums tracking owner-occupancy,

• HB 1480Giving the real estateboard authority to hear fair-housing violations,

• HB2222Applyinglawsenactedin2012 concerning appraisal manage-ment companies’ work with com-mercial appraisals in addition to residential.

An additional item, addressed by the GA,wasGov.BobMcDonnell’splanfor transportation infrastructure fund-ing for roads, bridges and rail service.

Of the five bills to be reviewed by legislators,onlyHB1868didnotpassandwasforfollowupinthe2014GAsession.

Itisestimatedthattheremainingbills will benefit homeowners in Cen-tral Virginia.

“[They are] clarifying the roles and responsibilities of everyone involved in a real estate transaction,” said Neil Wil-liamson,oftheFreeEnterpriseForum,a privately-funded public-policy orga-nization that focuses on local govern-mentwithinLouisa,Greene,Fluvanna,Nelson and Albemarle counties plus the city of Charlottesville.

WilliamsonsaidFEFisapro-busi-ness entity seeking to provide balance between business and environmental issues concerning land usage.

The most important policy concern-inghomeowners,REALTORS®, buyers and sellers, appears to be the historic passageofMcDonnell’stransportationplan, because it is the first significant and sustainable allocation of new fund-ing for transportation infrastructure in a generation.

“Itisthefirstsignificanttransporta-tionfundingbillsince1986,”saidWil-liamson. “The gas tax, a fixed amount tax that didn’t take into account infla-tion, was set then. This new legislation,

based on current economic projec-tions for Virginia, will generate over $800millioninnewrevenueannually.”

AccordingtoPercyMontagueofMontagueMiller&Co.Realtors,Vir-ginia needed a multi-faceted approach to appropriating funds to address the state’s transportation issues.

“People are going further on less gas, and with the old method being tied strictly to the tax being a per gal-lon tax, appropriations needed fine tuning,” he said.

The Virginia Association of Real-tors sent a group of representatives toRichmondonCrossoverDay,theday when bills move from one house of the General Assembly to the other, ThisyearitwasonFeb.14.

“Everyonetalksaboutroadsandno one wants to pay for them. VAR went en masse to show a high level ofinterest,”saidBillMayofERABillMayRealty.“Wesentastrong,clearmessage.”

VAR,saidMay,considersitselfde-fenders of private property rights and homeownership, and as part of its responsibility to that ideal, consider-ation just naturally fell to following legislation on roads.

“The new bill is an economic con-duit to support community and a way tofundit,”Maysaid.

According to the Virginia’s Road totheFutureonlineatwww.varoadto-thefuture.virginia.gov, the Governor’s 2013TransportationFundingandRe-form package will:

• Changethe17.5-centsper-gallongasolinetaxtoa3.5-percenttax.

• Convertthewholesaletaxondieselfuelto6percent.

• Increasethestatesalestaxfrom5percentto6percentandraisethe motor vehicle sales tax from 3 percentto4.3percent.

• Institutea$100annuallicensetaxfor electric and alternative fuel vehicles.

• Allowa0.7percentsalestaxincreaseinHamptonRoadsandNorthernVirginia to fund transportation proj-ects there.

“Itmightnotbeperfect,butit’sastart in the right direction,” said Montague.“Fueltaxeswillbeatthewholesale level.”

“Butpeoplewillnotseeitatthepumpthough,”saidMay.“Allpeoplewill see is gas prices going up or down like they see now.”

Regarding the first time homebuy-ers savings account, Virginia resi-dents will have to wait until the next legislative session, said Williamson, duetoHB1868beingreferredtotheGAHousingCommitteefromthe 2013 session.

Lenders are concerned about ad-ministration of said accounts and are engaged with the committee to discuss the issues.

“It ispossiblethat itcouldfail,”saidWilliamson.“Becauseitneedstobe reentered next session, VAR and its lobbyists will work to move the bill forward.”

Montaguesaidthebill,HB1868,was designed like aRoth IRA forhomeowners, but lenders didn’t want alotofextrapaperwork.Inessence,

homeowners will be able to set up an account, to be used strictly for a home down payment and closing fees on thepurchasetransaction.Depositsto the account will not be pre-tax as withanIRA.

“Buttheincome[interest]willgrowtaxfree,”Montaguesaid.

The public hasn’t heard much about this house bill because it hasn’t come out as the VAR had wanted, said May.“We’reswimmingupstreamonthat one.”

TheremainingresearchedHousebills1807,1480and2222,alldirectlyor indirectly affect real estate buyers andsellers,saidMontague.

HB1807concernsinformationonowner-occupied units of a property-owners’ or condominium’s associa-tion and getting it to homebuyers in a timely fashion in order to determine possibleFHAfinancingwitha3.5per-cent down payment or outside funding with anywhere from 20- to 30-percent down.Suchapercentagecouldpre-clude many people from purchasing a home.

“FHAfinancingisthelifebloodoftherealestateindustry,”saidMay.“Buyerscan’tqualifyiftherearetoomany non-owner occupied units.”

HB1480concernsfairhousingvio-lations made by real estate licensees and which regulatory board covers complaints and says that if a licensee is involved in a violation, said inci-dent will be handled by a real estate board rather than a fair housing authority board, which would cover incidents involving unlicensed sales representation.

FinallyHB2222nowrequirescom-mercial appraisers of appraisal man-agement companies be licensed in addition to residential appraisers. This billprovidesthatunqualifiedapprais-als will no longer be done.

“They must obtain a level of edu-cation to obtain licensure,” said Wil-liamson. “Out of state lenders don’t know what they don’t know,” on the concerning factors of appraisals in the local area.

“These bills help improve trans-parency and clarify jurisdiction on handlingissues,”saidWilliamson.“Ibelieve understandable, well-defined lawshelpeveryone,theREALTORS®, buyers and sellers.” ■
