    REGULATION ON PRODUCT CERTIFICATION

    1. Phm vi p dng: 1. Scope:

    This document defines a number of basis

    principles in accordance with the reguirements of

    ISO/IEC Guide 65:1996 which VinaCert

    Certification Body applied in the evaluation

    process, product certification compliance

    standard and technical regulation belong to the

    fields: food, electric, mechanical, chemical,

    building materials, consumer goods, household

    goods, petroleum products

    This document is provided for customers of VCB.

    2. Thut ng, nh ngha: 2. Terms, difinition

    2.1 Khch hng: T chc/c nhn ngh VCB

    chng nhn sn phm ph hp tiu chun;

    2.2 Chng nhn:S nh gi xc nhn ca VCB

    2.3 Tiu chun vsn phm: Cc sn phm datrn cc tiu chun quc t, cc tiu chun quc

    2.1 Customers: Organizations/ individuals

    applying VCB product certification compliance

    with standard;

    2.2 Certification: Confirmation audit of VCB for

    customers products in accordance with relevant

    standards;2.3 Standard of products: The product based on

    international, natinonal standards or standard of

    association is recognized;

    2.4 Audit team: One or more auditors conducting

    audits is supported, if necessary,technical experts

    (including the sample);

    2.5 Auditors: The person has the capacity to

    conduct an assessment;

    2.6 Techinical expert: The provision of specific

    knowledge or expertise to audit team.

    3.1 VCB conduct product certification and

    evaluation compliance with standards based on

    national standards (TCVN), international standard

    (ISO/IEC) or foreingn standards depending oncustomer requirements of the certificated

    certified standards, VCB inform customers about

    the new certification standards;

    To ensure consistency, objectivity, fairness,

    impartiality, openness in the product certification

    assessment activities, confidentiality of

    customers information and responsibility before

    law for their activities.

    VCB ensures to create favorable condition for all

    applicants whose activities belong to published

    field of certification of VCB to access all services

    of VCB and not to give financial conditions or

    other conditions irrationally. The access to the

    services will not depend on size of applicant or

    membership regulation of any association.

    5.1. Facilitating auditors of VCB to access to all

    points evaluated in normal working conditions

    and providing necessary information for the VCB

    to complete the evaluation process.

    for communicate with VinaCert. Appoint a pilot

    understanding regulations on labor safety of

    customer for audit team;

    5.3. Use certification logo of VCB in accordance

    with the provisions stated in section 9 of this

    Regulation and commit to not cause any

    5.4. Do not use certificate for other purposes out

    of the certification scope and do not use

    certificate in activities negatively affecting VCBs

    reputation;

    5.5. To fully comply with provisions specified by

    VCB, especially on the maintenance of the

    system, acceptance the condition of certificate

    suspension or withdrawal of VinaCert.

    5.6. To fully implement all responsibilities in

    contract signed with VCB;

    5.7. Keep records of complaints by users of

    customers product related to compliance with the

    requirements of standards for products that VCB

    has certificated at the same time save the

    evidence of appropriate action related to

    complaint resolution activities.

    Take appropriate action with respect to such

    complaints and any deficiencies found in products

    or services that affect compliance with the

    requirements for certification;

    The customer shall document the actions taken.

    6.1. To perform the evaluation and certification as

    required by GUIDE 65:1996;

    6.2. Building and announcing on the websitehttp://www.vinacert.vn (regularly updated) the list

    of the organization certified by VinaCert.

    6.3. Confidentiality of information relating to

    customers out of the published information in

    section 6.2 and 11.4;

    6.4. Inform clients of feedback received by VCB

    regarding to quality of services and products,

    procedure or QMS of the clients.

    6.5. Compliance with the rules and regulations

    of the customers in the evaluation;

    6.6. To fully comply with regulations and rules of

    the clients on site audited.

    6.7. Ensure the independence, objectivity,

    impartiality, openness;

    Thought the policies of using auditors ofVCB. Members in audit team shall:

    - have no financial relationship with

    customers;

    - have no family relationship with key

    leaders of clients

    - not provide QMS consultant service for

    customers;

    VinaCert ensure the independence,objectivity, impartiality, openness in decision

    on certification through activities of

    Certification Council. Members of

    Certification Council shall ensure:

    - Represent benefits for all parties;

    - not take the pressure of finance, work,

    emotion in their decisions;

    -

    Understand the law.

    VinaCert ensures to provide clients with

    information on certification criteria,

    procedures of issuance, maintenance,

    expansion, suspension or withdrawal of

    certificate and regulations on using logo,

    certification mark, fee of certification.

    Provide for customer information about

    certification standard, product certification

    and evaluation regulation; certification

    maintain, suspend or withdraw procedure

    compliance with standard and regulations

    about use logo, evaluation and certification

    fee;

    VinaCert make a list of organizations,

    individuals relating to certification activity of

    VinaCert who have potential hazards leading

    to unfairness and preventive measures to

    ensure fairness in the assessment of VCB;

    VinaCert creates favorable conditions for the

    clients to be able to participate in making

    decision on selecting members of audit team

    if the clients realize that there are potential

    risk leading to unfairness caused by the audit

    team.

    VinaCert builds monitoring mechanism in

    audit process to ensure fairness; VCB

    determines not to use auditors that does not

    explicitly declare their relationship with

    customers.

    nghim trn dy chuyn sn xut, ti kho hoctrn th trng khng nh cht lng sn

    phm lun c duy tr, ph hp vi tiu chun

    tng ng. Ty thuc vo bn cht ca sn

    phm v h thng qun l cht lng m khch

    hng thit lp, VCB tha thun chu k nh

    gi gim st cht llng sn phm. Chu k nh

    gi gim st khng ngn hn 6 thng.

    7.1. VCB conducting certification appropriate

    standards for customerss product when meet

    fully requirements of standards that customer

    registration certificate.

    7.2. The validity of all certification is 3 years from

    date of issue. During the validity of certificate,

    VCB conducting product monitoring assessment

    have been certified by: take samples for testing

    on production lines, in warehouses or on the

    market to confirm the product quality are

    maintanined in accordance with relevant

    standards. Depending on products and quality

    management system that the customer has

    established, VCB will agreement product quality

    surveillance cycle. Surveillance cycle is not

    shorter than 6 months.

    1. Tip xc ban u trao i thng tin: Nhn vin phngsale tip xc vi khch hng nhm thu thp cc thng tin cnthit. ngh khch hng hon thin BM-QT-13-01.

    2. Khch hng np bn ng k chng nhn sn phm choVCB km cc ti liu lin quan theo BM-QT-13-01. Nu cnVCB c th t chc kho st ti c s c nhng hiu bitc bn v hot ng iu hnh sn xut, trang thit b v snphm ca khch hng.

    3. Phng CD lin h vi KH hon thin cc th tc chngnhn sn phm

    4. VCB s tin hnh nh gi iu kin m bo chtlng. VCB tin hnh ly mu th nghim theo cc phngthc thch hp th nghim mu in hnh/ mu i dinca sn phm. VCB ch chp nhn chng nhn sn phmph hp tiu chun khi:

    - iu kin m bo cht lng t yu cu;

    - Kt qu th nghim ti ch t yu cu; - Kt qu th nghim mu in hnh/ i din t yu cu(chp nhn 1 ch tiu c kt qu th nghim khng t, visai lnh khng qu 20% so vi mc ch tiu cng b. Chtiu khng t khng phi l ch tiu c quy inh trong

    quy chun k thut)

    5. Bo co kt qu, bao gm bo co kt qu nh gi thnghim v kt qu nh gi iu kin m bo cht lng

    6. Nu kt qu th nghim mu in hnh v h thng qunl cht lng hoc iu kin m bo cht lng ca khchhng ph hp vi yu cu chng nhn, khch hng s cVCB cp chng nhn ph hp tiu chun/ quy chun k thutv cp du cht lng/ hp quyca VCB

    7. Duy tr chng nhn: VCB s tin hnh nh gi gim stnh k. nh gi gim st cng tin hnh ly mu i dinnh nh gi cp chng nhn.

    8. Cp li giy chng nhn: VCB s tin hnh nh gi lisau 03 nm.

    PRODUCT CERTIFICATION PROCESS

    2. Certification application

    1. Initial contact

    3. Assessment planing

    4. Type of testing

    5. Test and assessment reports

    6. Certificate award

    8. Reassessment after 03 years

    4. Quality assurancesystem assessment

    7. Suveillance

    1. Initial contact to exchange information: Staff ofSale Room contact with the customer to collectthe necessary information. To request the clientto complete BM-QT-13-01.

    2. The customer submit a product certificationapplication for the VCB and attached relevantdocuments under BM-QT-13-01. If need, VCBcan conduct surveys at the facility to have basicunderstanding of the production operating,equipment and product activities of customers.

    3. Certification Derpatment contact with customer tocomplete product certification procedures.

    4. VCB will conduct to assess quality assuranceconditions. VCB conduct test sampling by theappropriate methods for testing of product typical/representative samples. VCB only accept productcertification appropriate standard when:

    Conditions to ensure qualified quality; On-site test results meet the requirements;

    Test results of typical/ reprensentative samplesmeet the requirements (acceptance 01 testingcriteria that result does not achieve, withdeviation not exceeding 20% compared to thepublished criteria. Not reached criteria is notcriteria specified in the technical regulations)

    5. Result reports including report result of testassessment and result of assessment qualityassurance conditions.

    6. If the test results of typical samples and qualitymanagement system or quality assurance

    conditions in accordance with certificationrequirement, VCB will grand certificate suitablestandards/ technical regulations and quality/regulation sign for customer.

    7. Maintaining certification: VCB will conductperiodical surveillance. Surveillance also takerepresentative sample as certificationassessment.

    8. Re-issuance of the certificate: VCB will conductre-evaluation after 03 years.

    8.1.1.Customer is required to comple application

    form for product certification (BM-QT-13-01 for

    general product certification or BM-QT-23-01

    for Global GAP certification) and attach to: Organizational chart of the company/

    enterprise;

    The technical documentation of product,

    production plan;

    Quality control plan or certification of standard

    conformity, certification of quality management

    system;

    The measurement and testing control plan;

    8.1.2. VCB conducting preliminary survey when

    necessary;

    8.1.3. VCB agreement with customers on

    contracts of evaluation and certification.

    regulations.

    For products is food and agricultural products,

    the sample sizes to test microbiological,

    chemical and other criteria required follows:

    Each samples unit for microbiological analysis

    volume not less than 300g or 0.3 liters.

    Sample unit for micbiological roanalysis is not

    mixed samples. Where prepackaged

    products, each samples unit for

    microbiological analysis is a product unit but

    not less than specified above.

    other criteria not less than 1000 grams or 1

    analysis and other criteria are typical sample

    from five different locations in one shipment.

    The sampling sites are sometimes specified

    cc tiu chun sn phm hoc cc ti liu quy

    8.4.1 VCB review audit results and certification

    standard compliance in accordance with the

    contends: the scope of the certificate, validity

    period and number of the certificate. Certification

    is only granted before all criteria are met.

    8.4.2 VCB sent certificate to customers.

    10.4 Depending on the level of change, VCB willagree to the customers on additional surveillance.

    If such is the case, the auditee shall not release

    certified products resulting from such changes

    before the VCB has notified the auditee

    accordingly. Customers will paid all costs incurred

    related to addition surveillance.

    10.5 Re-issuance of certificate: After 3 years of

    certificate valid conformity of the current standard,

    VCB will conduct re-audit as the first and

    certification appropriate standard and have

    validity in next 3 years.

    nhn c cc hnh ng khc phc ph hp.

    Nu trong thi gian 3 thng, khch hng khng

    c cc hnh ng khc phc ph hp th chng

    nhn ph hp tiu chun s b nh ch thm 3

    thng. Nu sau 3 thng, KH vn khng c hnh

    ng khc phc ph hp th chng nhn ph hp

    tiu chun s b thu hi vnh vin.

    11.4 Vic nh ch v thu hi chng nhn phhp tiu chun s c VCB thng bo ln

    Withdraw of appropriate standard certificate is

    VCB take withdraw decision of customers

    certificate and invalidation of the certificate;

    11.2 Depending on the level, VCB consider

    suspending or withdrawing certificate granted if

    the customers does not comply with one of the

    following:

    Use appropriate standard certificate or VCB

    logo contraty to regulations;

    Failing to arrangement periodically

    surveillance as agreed;

    Failing to maintain of product quality, violation

    certificated regulation of VCB;

    There is serious complaints from individuals

    or organizations using the customers

    products;

    Do not pay the full certification fee

    agreement.

    11.3 During the validity period of the certificate, if

    the customers violate the provisions of Section

    11.2, certificate may be suspended for 03 months

    until the VCB receive appropriate corrective

    action. If the period of 03 months, customers do

    not have the appropriate corrective action, the

    certificate will be suspended further 03 months. If

    after 03 months, the customer do not appropriate

    corrective action, the appropriate standard

    certificate will be revoked permanently.

    11.4 The suspension and withdrawal ofcertification that VCB will be announced on the

    website: http://www.vinacert.vn and notify the

    reletant organizations/ individuals in writing.

    12. Bi thng trch nhim v khiu ni 12. Reponsibility compensation and

    complaints

    12.1 If during the time of initial audit, certified

    customer gives evidence that VCB causes

    damage to the customer and make a request forcompensation, VCB will consider compensation

    12.2 Customers can make an appeal activities

    reting to audit process of VinaCert. VinaCert will

    consider and resolve appeal of the customer. If

    the customer does not agree to decision on

    appeal resolution of VinaCert, the customer is

    entitled to request for resolution as regulated by

    the laws.

    12.3 Neither party shall be responsible for making

    compensation in case that there are objective

    factors arising out of control of both parties but

    shall notify each other of these events by fax or

    mail within 5 days since the date of occurring.

    13.1 The expenses for product evaluation and

    certification activities are specified in the contract.

    Customers do not pay any other expenses for

    VCB except the cost for addition assessment

    specified in this Section 13.2;

    13.2 When requiring to verify corrective actions of

    customers at the point audited, the customers

    shall pay all costs of travel and stay for auditor(s)

    of VCB;

    13.3 VCB issues invoice for full cost of audit of

    VCB. The late payment after 30 days from the

    date of invoice issuance, the customer shall bear

    the interest rate of 1.5%/ months for the value to

    be paid;

    13.4 VCB will decide certification suspension for

    customers who do not pay for certification cost

    after 60 days from the date of invoice issuance.

    The recovery of certification will be made after

    customers pay certification assessment costs for

    VCB.

    13.5 VCB will decide certification suspension that

    customers do not pay for certification assessment
