The E-Gate should be able to read all industry accepted BCBP

formats (e.g. PDF417, Aztec, Data matrix) as well as NFC and RFID

boarding passes ID- documents such as passports can be also

scanned with a full page reader.

Kindly advise that the NFC enabled readers are for futuristic purpose

or it should activated in the e-Gate as standard function from day

one?

Please refer to the RFP in detail95 3.13 Price, Invoicing, Payment Terms and Taxes

Any invoice remaining unpaid after the aforesaid period of thirty

days shall be treated as a debt owed by BIAL to the Contractor and

the Contractor shall be, without prejudice to any other remedies

that it may have in this regard, entitled to recover it as such with a

monthly interest of 2% calculated from the date the payment

became due until the recovery is made in full with interest. Without

prejudice to the other rights available, the Contractor also reserves

the right to withhold the provision of services and/or deliverables

till such time all the payments due to it under this contract have

been made by BIAL and any such withholding by the Contractor shall

not be treated as breach by it of the provisions of the contract.

The Departure Entry Gates shall be wider than the other lanes to

permit entry of Passenger with a Trolley with big size bags as well.

Approximately 1200 mm to 1600 mm wide clear passage.

International standards for clear passage in any e-Gate are between

900mm to 1000mm. Any luggage larger then this size should be

moved via terminal entry gates dedicated for Groups or infants.

Kindly make the changes accordingly.

The additional width is to accommodate a Trolley with Wide

Baggage. If this modification is not possible, then Vendor Partner to

propose a solution based on functional needs of all AEEBBS

4:Guarantees and

Securities

“The Service Provider acknowledges and confirms that the

Performance Security may be invoked by BIAL in its sole discretion

for any breach or neglect or lack of satisfactory performance or non-

performance of the Services under this Agreement; without BIAL

being required to prove or to show to the Service Provider any

ground or reason for such invocation. Such invocation shall be in

addition to all other rights and remedies available to BIAL. The

Service Provider shall, at BIAL's request, vary the value and/or

validity of such securities proportionately as necessary to reflect the

changes in the Agreement.”

The clause currently suggests that the terms of contract can be

amended unilaterally by BIAL, and causes confusion. Thus in order

to bring in certainty to the said clause we would request to insert

the following clause to the existing language:

“Nothing contained in this clause shall imply that BIAL have a

unilateral right to decide on disputes and the same shall be subject

to the outcome of the dispute resolution proceedings as contained

in this agreement or as per the applicable law as the case may be. In

the event the final outcome is against BIAL, the amount of BG shall

be refunded to Service provider, forthwith.”

Prices

The Contract price shall remain firm and must not be subject to

escalation during the performance of the contract due to fluctuation

/change in the duty/tax structure/exchange rate, changes in costs

related to the materials and labour or other components or for any

other reason whatsoever.

The length of the contract is 8 years excluding the delivery period.

Forecasting Tax rates/structure over such a long period is not

feasible. Hence, any increase/decrease in price due to change in tax

structure/rate will be passed on to BIAL. Please confirm.

Prices and Payment

Terms - Customs

Duty

Customs Duty

BIAL has been granted Project Import License concession for the

imports relating to expansion project and the same is being

registered with the customs authorities. Hence, the goods would be

cleared at concessional basic duty instead of normal duties. The

Contractor has to support BIAL with respect to additional

documentation, if any, which may be necessitated in this regard.

Concession on import items customs duty will be refunded after

supply/installation or before the bid submission to consider price of

imported item. What will be the basic customs duty? This is

required for price calculations for bid. Kindly clarify.

Customs duties and Taxes may be computed seperately. BIAL

Commercial evaluation team will do the necessary normalisation

performance bank guarantee as a condition of validity of the

proposal: it is stated on one hand that proposals not accompanied

with a performance bank guarantee will be disqualified[1], however,
