Sept. 15, 22 & 29, 2016 No. 7874 COUNCIL PROCEEDINGS The Thermopolis Town Council met in regu- lar session September 6, 2016 at 7 pm at Town Hall. Present were Mayor Mike Mortimore, Council members Tony Larson, John Dorman Sr., Mark Nelson and Dusty Lewis. Also pres- ent were Mayor/Codes Administrative Assistant Fred Crosby, Clerk/Treasurer Tracey Van Heu- le, Public Works Director Ernie Slagle, Police Chief Steven Shay, Town Engineer Anthony Barnett and Town Attorney Mike Messenger. AGENDA: Following the pledge of allegiance, Nelson made a motion, seconded by Larson and carried to approve the agenda as amended. Dale Andreen and John Dorman Jr. were added un- der Citizen Participation. MINUTES: Dorman made a motion, seconded by Mortimore and carried to approve the Council meeting minutes from August 2 and 16, 2016. BILLS: Nelson made a motion, seconded by Larson and carried to approve the General, Enterprise and Special Fund bills for August 2016. Dorman, Mortimore and Lewis abstained on the approval of the bills to their businesses. ALEX MCLEAN- HOMECOMING STREET CLOSURE: Nelson made a motion, seconded by Larson and carried, authorizing the Mayor to sign the WYDOT permit asking for 6th and Broadway to be closed for the Homecoming pa- rade on September 30, 2016. LODGING BOARD REPORT: Greg Wilson from the Lodging Tax Political Action Com- mittee reviewed the expenditures of lodging tax funds. Nelson made a motion, seconded by Lewis and carried to approve and support the ballot initiative for the lodging tax renewal. OTHER: EDC Director, Amanda Moeller, re- minded the Mayor and Council of the Brown- field Conference to be held September 13 & 14 at the county museum. Dorman will represent the Town at the meetings. TOWN ENGINEER: ANTHONY BARNETT: Barnett noted that Wild West Construction will pick up excess chips later this month and the project will be complete. Work is progressing on grant applications. DEPARTMENT REPORTS: Police Chief Shay and Public Works Director Slagle pre- sented August reports for their respective de- partments. CODES ADMINISTRATION: FRED CROS- BY: RIGHT OF WAY AGREEMENT: Nelson made a motion, seconded by Larson and carried to approve a fence right-of-way agreement with Bill and Julia Mathews at 118 S. 8th Street. If the Town ever needs access to the right of way, the fence must be removed by the prop- erty owner. TOWN ATTORNEY: MIKE MESSENGER: FIRST READING OF AN ORDINANCE TO SET FEES FOR CONSTRUCTION TRASH AND TIRES: Messenger read the ordinance. Nelson made a motion and Larson seconded to approve the first reading of the ordinance. Discussion ensued on tire disposal, fees, recycling, alter- nate uses and varying costs by disposal method. Nelson made a motion and Larson seconded to amend the motion to charge $3.00 per tire and $5.00 for tires over one ton. Discussion ensued on the tire categories and charges. Voting no were Mortimore, Lewis and Larson. Nelson and Dorman abstained. The amendment failed. Mortimore made a motion, Nelson seconded and carried to amend the motion with the following fees: $5.00/car tire, $8.00 per truck tire, $15.00 per semi-truck tire and $20.00 per tractor tire. A vote on the first reading was called and all voted aye. Motion carried. ADMINISTRATION: FRED CROSBY: SLAK- ER CONTROL PANEL BID: Crosby noted one bid was received. Chemco bid $42,957.00. Nel- son made a motion, seconded by Mortimore and carried to approve the Chemco bid for the slaker control panel. Sept. 22, 2016 No. 7880 PUBLIC NOTICE Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Ser- vice Commission’s (Commission) Rules, notice is hereby given that a public hearing has been scheduled regarding the application of Rocky Mountain Power (RMP or the Company) re- questing authority decrease rates on deferred net power costs (NPC) pursuant to Tariff Sched- ule 95; and to increase rates pursuant to Tariff Schedule 93, renewable energy credits (RECs) and Sulfur Dioxide (SO2) emission allowances. The public hearing is set to commence on Tuesday, October 11, 2016, at 9:00 a.m., in the Commission’s hearing room located at 2515 Warren Avenue, Suite 300, in Chey- enne, Wyoming. RMP is a public utility, as defined in W.S. §37-1-101(a)(vi)(C), providing retail electric public utility service under certificates of public convenience and necessity issued by the Com- mission. RMP is subject to the Commission’s jurisdiction pursuant to W.S. §37-2-112. Pursuant to Tariff Schedule 95, RMP pro- poses to recover an approximately $12.2 mil- lion comprised of total deferred NPC including embedded cost differential adjustments during the deferral period, deferral period interest, and residual balances from prior ECAMs. The Com- pany proposes to revise Tariff Schedule 95 by adding the $12.2 million to the currently effec- tive deferred NPC rate that is designed to col- lect $13.9 million from retail customers. Not- withstanding the $12.2 million increase for the deferral period, the $13.9 million will decrease when the Company stops collecting amounts from prior ECAM deferrals May 14, 2016. Pursuant to Tariff Schedule 93, the Com- pany is proposing to refund to customers ap- proximately $644 thousand to account for cal- endar year 2015 balancing account adjustments and 2016 forecast sales revenues for REC and SO2 products in the market. From the cur- rently approved $690 thousand surcredit, this results in an overall increase of $50 thousand from current rates. RMP is also requesting a change to the fil- ing date and rate effective date for future fil- ings beginning in 2017. The current filing date is March 15 and the request is to change it to April 15. The current rate effective date is May 15 and the request is to change it to June 15. All interested persons are encouraged to at- tend the public hearing which will be conduct- ed in accordance with the Wyoming Adminis- trative Procedure Act and the Wyoming Public Service Commission Rules and Special Regula- tions. COUNCIL PROCEEDINGS

The Thermopolis Town Council met in regu-lar session September 6, 2016 at 7 pm at Town Hall. Present were Mayor Mike Mortimore, Council members Tony Larson, John Dorman Sr., Mark Nelson and Dusty Lewis. Also pres-ent were Mayor/Codes Administrative Assistant Fred Crosby, Clerk/Treasurer Tracey Van Heu-le, Public Works Director Ernie Slagle, Police Chief Steven Shay, Town Engineer Anthony Barnett and Town Attorney Mike Messenger.

AGENDA: Following the pledge of allegiance, Nelson made a motion, seconded by Larson and carried to approve the agenda as amended. Dale Andreen and John Dorman Jr. were added un-der Citizen Participation.

MINUTES: Dorman made a motion, seconded by Mortimore and carried to approve the Council meeting minutes from August 2 and 16, 2016.

BILLS: Nelson made a motion, seconded by Larson and carried to approve the General, Enterprise and Special Fund bills for August 2016. Dorman, Mortimore and Lewis abstained on the approval of the bills to their businesses.

CITIZEN PARTICIPATION: DALE AN-DREEN & JOHN DORMAN JR: Crosby noted the Town needs 20 metal signs for the decora-tive street lights. Andreen & Dorman present-ed metal signs they manufactured. Additional discussion ensued on the weight of the signs, fragility of the poles and sign designs. Larson made a motion and seconded by Lewis to pur-chase and evaluate a total of seven signs. Vot-ing aye were Larson, Mortimore, Nelson and Lewis. Dorman Sr., abstained. Motion carried.

ALEX MCLEAN- HOMECOMING STREET CLOSURE: Nelson made a motion, seconded by Larson and carried, authorizing the Mayor to sign the WYDOT permit asking for 6th and Broadway to be closed for the Homecoming pa-rade on September 30, 2016.

LODGING BOARD REPORT: Greg Wilson from the Lodging Tax Political Action Com-mittee reviewed the expenditures of lodging tax funds. Nelson made a motion, seconded by Lewis and carried to approve and support the ballot initiative for the lodging tax renewal.

OTHER: EDC Director, Amanda Moeller, re-minded the Mayor and Council of the Brown-field Conference to be held September 13 & 14 at the county museum. Dorman will represent the Town at the meetings.

TOWN ENGINEER: ANTHONY BARNETT: Barnett noted that Wild West Construction will pick up excess chips later this month and the project will be complete. Work is progressing on grant applications.

DEPARTMENT REPORTS: Police Chief Shay and Public Works Director Slagle pre-sented August reports for their respective de-partments.

CODES ADMINISTRATION: FRED CROS-BY: RIGHT OF WAY AGREEMENT: Nelson made a motion, seconded by Larson and carried to approve a fence right-of-way agreement with Bill and Julia Mathews at 118 S. 8th Street. If the Town ever needs access to the right of way, the fence must be removed by the prop-erty owner.

TOWN ATTORNEY: MIKE MESSENGER: FIRST READING OF AN ORDINANCE TO SET FEES FOR CONSTRUCTION TRASH AND TIRES: Messenger read the ordinance. Nelson

made a motion and Larson seconded to approve the first reading of the ordinance. Discussion ensued on tire disposal, fees, recycling, alter-nate uses and varying costs by disposal method. Nelson made a motion and Larson seconded to amend the motion to charge $3.00 per tire and $5.00 for tires over one ton. Discussion ensued on the tire categories and charges. Voting no were Mortimore, Lewis and Larson. Nelson and Dorman abstained. The amendment failed. Mortimore made a motion, Nelson seconded and carried to amend the motion with the following fees: $5.00/car tire, $8.00 per truck tire, $15.00 per semi-truck tire and $20.00 per tractor tire. A vote on the first reading was called and all voted aye. Motion carried.

ADMINISTRATION: FRED CROSBY: SLAK-ER CONTROL PANEL BID: Crosby noted one bid was received. Chemco bid $42,957.00. Nel-son made a motion, seconded by Mortimore and carried to approve the Chemco bid for the slaker control panel.

MAYOR AND COUNCIL: OTHER: Rocky Mountain Power grants for public events were discussed. It was noted the JLA spraying con-tract invoice was less than the approved bid amount. Messenger presented a memo on how the Town could join the fire district. The meet-ing adjourned at 8:23 pm. The next Council meeting is September 20, 2016 at 7 pm.

PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Ser-vice Commission’s (Commission) Rules, notice is hereby given that a public hearing has been scheduled regarding the application of Rocky Mountain Power (RMP or the Company) re-questing authority decrease rates on deferred net power costs (NPC) pursuant to Tariff Sched-ule 95; and to increase rates pursuant to Tariff Schedule 93, renewable energy credits (RECs) and Sulfur Dioxide (SO2) emission allowances. The public hearing is set to commence on Tuesday, October 11, 2016, at 9:00 a.m., in the Commission’s hearing room located at 2515 Warren Avenue, Suite 300, in Chey-enne, Wyoming.

RMP is a public utility, as defined in W.S. §37-1-101(a)(vi)(C), providing retail electric public utility service under certificates of public convenience and necessity issued by the Com-mission. RMP is subject to the Commission’s jurisdiction pursuant to W.S. §37-2-112.

Pursuant to Tariff Schedule 95, RMP pro-poses to recover an approximately $12.2 mil-lion comprised of total deferred NPC including embedded cost differential adjustments during the deferral period, deferral period interest, and residual balances from prior ECAMs. The Com-pany proposes to revise Tariff Schedule 95 by adding the $12.2 million to the currently effec-tive deferred NPC rate that is designed to col-lect $13.9 million from retail customers. Not-withstanding the $12.2 million increase for the deferral period, the $13.9 million will decrease when the Company stops collecting amounts from prior ECAM deferrals May 14, 2016.

Pursuant to Tariff Schedule 93, the Com-pany is proposing to refund to customers ap-proximately $644 thousand to account for cal-endar year 2015 balancing account adjustments and 2016 forecast sales revenues for REC and SO2 products in the market. From the cur-rently approved $690 thousand surcredit, this results in an overall increase of $50 thousand from current rates.

RMP is also requesting a change to the fil-ing date and rate effective date for future fil-ings beginning in 2017. The current filing date is March 15 and the request is to change it to April 15. The current rate effective date is May 15 and the request is to change it to June 15.

All interested persons are encouraged to at-tend the public hearing which will be conduct-ed in accordance with the Wyoming Adminis-trative Procedure Act and the Wyoming Public Service Commission Rules and Special Regula-tions.
