Description of Work Subject to the Jurisdiction of the U.S. Army Corps of Engineers: The applicant proposes to retain an existing haul road that required the fi ll of 1.65 acres of jurisdictional wetlands associated with continued maintenance and operation of the existing (and currently permitted) temporary haul road providing access to the on-site borrow pit at Superior Landfill. T~1e temporary haul road is utilized to access a soil borrow area located in the northern portion of the Superior property. Soil excavated from the active borrow area is uti liized for daily/intermediate operational cover ("daily cover") of landfill cells pursuant to Georgia's Solid Waste Management Rules for Municipal Solid Waste Landfills (MSWL) and Superior's permit. waters of the United States are expected other than the current proposal to retain the existing haul road.

As compensatory mitigation for the project related jurisdictional waters impacts, the applicant is proposing to purchase 0.825 additional wetland mitigation credits. The applicant proposes to purchase these credits from a U.S. Army Corps of Engineers approved mitigation bank that services the Ogeechee Watershed. See the background section below regarding previous compensatory mitigation.

BACKGROUND

Superior was originally permitted and constructed in the early 1980’s by Superior Sanitation Services Landfill, Inc. As the 26 acre original landfill site began nearing capacity in the early 1990’s, a lateral expansion was designed and permitted. On March 17, 1993, impacts to 34.8 acres of wetlands associated with the footprint of the expansion, access roads, and borrow pit were permitted under permit number SAS-1992-05440. Mitigation for these impacts was achieved through a combination of on-site wetland restoration and creation. After the 1993 expansion, no additional wetland impacts were required as a part of the build out of Superior until the wetland crossing for the temporary haul road was permitted in 2008.

Construction of the temporary haul road was verified by the Corps under Nationwide Permit (NWP) 33 under permit number SAS-2007-02052, on February 13, 2008, with an expiration date of March 13, 2013. The permit authorized temporary impacts to 1.65 acres of palustrine, forested wetlands along the maintained easement of the disabled conveyor system originally used to transport daily cover material from the borrow area to the active landfill cells. Due to the continuous need for capping material and the inadequacy of the conveyor system, Superior was forced to purchase daily cover material and have it delivered by dump trucks using county roads. The temporary haul road was permitted to eliminate traffic safety concerns on Little Neck Road associated with off-site hauling. On February 11, 2009, 12.54 wetland credits were purchased from the Wilkinson-Oconee Mitigation Bank to mitigate for the temporary impacts associated with the placement of fill to create the 1.65-acre footprint of the roadbed.

Original site planning for the 2008 temporary haul road anticipated that the active borrow area would only be utilized for five years. However, improved operations resulted in less daily cover soil being utilized than originally anticipated, and the life of the borrow area for continued operation of the landfill was substantially extended. As such, the applicant applied for another NWP 33. This NWP 33 was verified by the Corps on March 14, 2013, to allow the haul road to remain for an additional 3 year period. The new NWP 33 verification stipulated the following special conditions:

• A Wetland Hydrology Study be conducted over a period of two growing seasons1

• A Standard Permit associated with the long term operation of Superior must be obtained for the continued use of the haul road beyond the March 2016 expiration of the NWP 33.

Superior is permitted as a MSWL by the Georgia Environmental Protection Division (EPD), Land Protection Branch (Permit No. 025-070D (MSWL)). The permitted lifetime waste capacity will allow the site to accept waste at the current rate for approximately 20 years from present depending on incoming waste volumes2. Superior requires approximately 350 to 500 cubic yards per day (CYD) of excavated soil material from the current borrow pit to provide the state regulatory required daily cover for the active landfill. It is estimated the current borrow pit can provide approximately 1.3 million cubic yards (MCY) of soil cover material if excavated to a depth of 30 feet below mean sea level; thus providing the landfill with an additional seven and a half to 10 years of soil capacity from currently available on-site sources.

Continued operation of the temporary haul road for the life of the borrow pit would result in the existing fill of approximately 1.65 acres of wetlands to remain in place during that seven and a half to 10 year period. Extending the lifetime of the temporary haul road would continue to minimize traffic safety hazards and accelerated county road wear associated with hauling soil from off-site sources. No new wetland impacts would be created by extending the life of the temporary haul road; only the duration of the currently permitted impact would be extended.

A Jurisdictional Determination was verified by letter dated July 15, 2015, for a 742 acre site. The proposed project area is within this larger site. This Joint Public Notice announces a request for authorizations from both the Corps and the State of Georgia. The applicant's proposed work may also require local governmental approval.

STATE OF GEORGIA

Water Quality Certification: The Georgia Department of Natural Resources, Environmental Protection Division, intends to certify this project at the end of 30 days in accordance with the provisions of Section 401 of the Clean Water Act, which is required for a Federal Permit to conduct activity in, on, or adjacent to the waters of the State of Georgia. Copies of the application and supporting documents relative to a specific application will be available for review and copying at the office of the Georgia Department of Natural Resources, Environmental Protection Division, Watershed

Protection Branch, 400 Commerce Center Drive, Brunswick, Georgia 31523-8251, during regular office hours. In order to obtain this information, please contact Mr. Bradley Smith at [email protected]. A copier machine is available for public use at a charge of 10 cents per page. Any person who desires to comment, object, or request a public hearing relative to State Water Quality Certification must do so within 30 days of the State's receipt of application in writing and state the reasons or basis of objections or request for a hearing. The application can be reviewed in the Savannah District, U.S. Army Corps of Engineers, Regulatory Division, 100 West Oglethorpe Avenue, Savannah, Georgia 31401-3640.

State-owned Property and Resources: The applicant may also require assent from the State of Georgia, which may be in the form of a license, easement, lease, permit or other appropriate instrument.

Marshland Protection: This notice also serves as notification of a request to alter coastal marshlands (under the provision of the Coastal Marshlands Protection Act, Georgia Laws, 1970, p. 939 and as amended), if required. Comments concerning this action should be submitted to the Ecological Services Section, Coastal Resources Division, Georgia Department of Natural Resources, 1 Conservation Way, Brunswick, Georgia 31523-8600 (Telephone 912-264-7218).

By letter dated January 21, 2015, addressed to the agent for the proposed project, the Georgia Department of Natural Resources – Coastal Resources Division stated: “Based on a review of the information provided by your office, it has been determined that the Superior Landfill and Recycling Center borrow pit location and the existing haul road are not considered jurisdictional under the authority of the Coastal Marshlands Protection Act of 1970. Therefore, no CMPA permit or Revocable License from this office for tidally influenced waterbottoms will be required for the proposed project at this location. The delineation of jurisdictional tidal wetlands is subject to change due to environmental conditions and legislative enactments. This delineation is valid for one year from the date of this letter, but may be voided should legal and/or environmental conditions change.”

Georgia Coastal Management Program: Prior to the Savannah District Corps of Engineers making a final permit decision on this application, the project must be certified by the Georgia Department of Natural Resources, Coastal Resources Division, to be consistent with applicable provisions of the State of Georgia Coastal Management Program (15 CFR 930). Anyone wishing to comment on Coastal Management Program certification of this project should submit comments in writing within 30 days of the date of this notice to the Federal Consistency Coordinator, Ecological Services Section, Coastal Resources Division, Georgia Department of Natural Resources, One Conservation Way, Brunswick, Georgia 31523-8600 (Telephone 912-264-7218).

U.S. ARMY CORPS OF ENGINEERS

The Savannah District must consider the purpose and the impacts of the applicant's proposed work, prior to a decision on issuance of a Department of the Army Permit.

Cultural Resources Assessment: Pursuant to Section 106 of the National Historic Preservation Act of 1966, as amended, we request the Georgia Historical Preservation Division (HPD) or any other interested party review the latest published version of the National Register of Historic Places (NRHP) to determine if the project area includes any registered properties or properties listed as eligible for inclusion located at the site or in the area affected by the proposed work. Presently unknown archaeological, scientific, prehistorical, or historical data may be located at the site and could be affected by the proposed work.

The applicant states: “A Phase I cultural resources survey dated January 9, 2015 has been completed by Southeastern Archaeological Services within the project area. Based on this survey and as discussed in the attached report of findings, no sites listed or eligible for listing on the National Register of Historic Places are present within the subject site.”

Based on a review of the Phase I survey provided, we have determined that the project would have no effect to cultural resources due to the facts that the project area is substantially disturbed (i.e., existing condition of the project area), and because the haul road already exists (no additional disturbance is proposed). In addition, the Phase I survey provided included an area that is not within the proposed project area and is therefore not applicable to this project.

Endangered Species: The applicant states: “Resource and Land Consultants conducted a threatened and endangered species pedestrian survey within the project area to determine the presence and/or absence of habitat suitable to sustain species currently listed as threatened or endangered by state and federal regulations [Endangered Species Act of 1973 (16 U.S.C. 1531-1543)]. Based on existing site conditions, habitats observed during the field survey, and as discussed within the report dated January 21, 2015, it is not anticipated that the project site supports any individual or population of threatened or endangered species listed in Chatham County, Georgia.”

After review of the application and supporting information, the Savannah District has determined that the proposed project would not affect any Federally listed threatened or endangered species that are under the purview of U.S. Department of the Interior, Fish and Wildlife Service, the U.S. Department of Commerce, the National Oceanic and Atmospheric Administration, and the National Marine Fisheries Service; or, any other interested party. Pursuant to Section 7(c) of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531 et seq.).

Public Interest Review: The decision whether to issue a permit will be based on an evaluation of the probable impact including cumulative impacts of the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefit, which reasonably may be expected to accrue from the proposal, must be balanced against its reasonably foreseeable detriments. All factors, which may be relevant to the proposal will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership and in general, the needs and welfare of the people.

Consideration of Public Comments: The U.S. Army Corps of Engineers is soliciting comments from the public; federal, state, and local agencies and officials; Native American Tribes; and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the U.S. Army Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects, and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity.

Application of Section 404(b)(1) Guidelines: The proposed activity involves the discharge of dredged or fill material into the waters of the United States. The Savannah District's evaluation of the impact of the activity on the public interest will include application of the guidelines promulgated by the Administrator, Environmental Protection Agency, under the authority of Section 404(b) of the Clean Water Act.

Public Hearing: Any person may request, in writing, within the comment period specified in this notice, that a public hearing be held to consider this application for a Department of the Army Permit. Requests for public hearings shall state, with particularity, the reasons for requesting a public hearing. The decision whether to hold a public hearing is at the discretion of the District Engineer, or his designated appointee, based on the need for additional substantial information necessary in evaluating the proposed project.

Comment Period: Anyone wishing to comment on this application for a Department of the Army Permit should submit comments in writing to the Commander, U.S. Army Corps of Engineers, Savannah District, Mr. Shaun Blocker, 100 West Oglethorpe Avenue, Savannah, Georgia 31401-3640, no later than 30 days from the date of this notice. Please refer to the applicant's name and the application number in your comments.
