5) CHANGE OF AGENT5.a Consideration of Change of Agent on the
Class "A" Beer retail license for
Casey's Marketing Company d/b/a Casey's General Store #3316,
located at2350 Cranston Road from Heidi E Marcyes to Anthony Hawks
for period endingJune 30, 2021.1. The applicant is in the process
of submitting the required documents to
request such change: Schedule of Appointment of Agent form
AT-104;Auxiliary Questionnaire form AT-103; and the Supplemental
Questionnaire foragents.
2. The application was sent to the Beloit Police Department to
check municipaland state criminal records of the applicant and was
approved on September8, 2020.
3. The ABLCC should review the application to assure conformity
with existingrules, regulations and zoning ordinances of the city
and state and makerecommendation to City Council.
4. This item will appear on the October 19, 2020 City Council
agenda for action.Mr. Anthony Hawks appeared as instructed on the
virtual call.Lt. Eberhardt stated that he checked municipal and
state criminal records and tothe best of his knowledge, with the
available information, the character, record

and reputation are satisfactory and the police department has no
objectios to theapplicant.Assistant City Attorney Tjoa asked Mr.
Hawks to reaffirm question #9 on theauxiliary questionnaire stating
that he can be held personally responsible for anyviolations that
occur on the property, even when he is not present. He stated
yes,he understands.Moved by Ron Tilley – Seconded by Malissa Cronin
to recommend approval ofthe change of agent as presented. Motion

7) POLICE DEPARTMENT REPORT/COMMENTS7.a Lt. Eberhardt presented
the Alcohol Compliance Report and Calls for Service for
the Month of August and September.
8) CITY ATTORNEY COMMENTS – A reminder that a workshop is being
scheduled todiscuss a recent moratorium on the issuance of Class A
licenses in August. Thetentative date is November 16th and will be
a virtual workshop. John Wong attended theAlcohol Policy Seminar
and asked if we currently do “mapping” of licenses. The
Clerk-Treasurer will email the maps of licenses by type at the
conclusion of the meeting.

Overview/Background Information
B & I Beloit Business LLC, d/b/a Liberty House/Whiskey
Lounge is establishing a restaurant business located at 1901Liberty
Avenue, (formerly Clara Bo & Gatsby Wine Bar, Scott Murray,
Agent), and is applying for a Class “B” Beer and“Class B”
Intoxicating Liquor License for the license period ending June 30,
2021.
Key Issues
1. B & I Beloit Business LLC, d/b/a Liberty House/Whiskey
Lounge is requesting the approval of a Class “B” Beer and“Class B”
Intoxicating Liquor License for the license period ending June 30,
2021 as a part of establishing arestaurant business on premise.
2. A complete application with publication fees has been
submitted to the Clerk’s office and is being referred to theABLCC
for their January 12, 2021 agenda by the City Council on January 4,
2021 via the consent agenda.
3. The Applicant has purchased the building located at 1901
Liberty Avenue to operate the business at that location.4. The
owners were aware that the liquor license on premise expired June
30, 2020, however, they have found that
the business known as Diamond Lanes is going out of business and
is willing to relinquish their license conditionalto the approval
of this application.
5. The owners of Liberty House/Whiskey Lounge operate several
successful restaurants in the surrounding area.6. The ABLCC will
review the application at their January 12, 2021 regular meeting to
assure conformity with existing
rules, regulations and zoning ordinances of the city and state
and will make a recommendation to the Councilbased on their
review.
7. This City Council will take action on the recommendation of
the ABLCC at their January 19, 2021 regular meeting.
