Is this RFP asking for Workers Compensation Legal Services? NVTA does not rely on general counsel to perform such services. 2. In Section III.A.2 (pg. 8 of the RFP), the last sentence appears to be missing a word and the intent of the sentence is ambiguous. The sentence currently reads: “This section shall include a full description of the proposer’s for carrying out the Scope of Work as described in this RFP.” Can you please clarify what NVTA is requesting in this sentence? The sentence should read: “This section shall include a full description of the proposer’s charges for carrying out the Scope of Work as described in this RFP.” 3. Would it be possible to receive a copy of the joint powers agreement forming NVTA, and all amendments? This will provide us with a better understanding of the agency. See Agreement attached. 4. We understand that NVTA representatives are on the SR 37 Policy Committee. Do you anticipate any role for legal counsel with regard to that committee? QUESTION/COMMENT RESPONSE
5. How many monthly hours will NVTA be using? Can you quantify the hours for legal services over the past year?
The administrative service hours on average are currently 20-30 hours per month. Number of hours will vary based on how many approved capital projects NVTA will be managing at that time. General counsel service hours are primarily based on contract review, attending NVTA Board meetings, review of resolution language, and less litigation related. Approved capital projects with complex agreements, i.e. construction of new support Transit Maintenance Facility, or agreements with State and Federal funding associated to the project(s) will need to be monitored closely as to use and appropriation. NVTA oversees the ½ cent Sales Tax Measure for streets and roads and may require guidance on specific measures, i.e. ballot measures. NVTA does not rely on general counsel to provide litigation and bond counsel services.
6. Will the firm selected be used for tort liability matters in accident cases?
NVTA does not rely on general counsel to perform such litigation services.
7. Does NVTA expect the need for legal work in landuse or employment law?
Landuse legal services may be possible for upcoming approved capital projects such as the Imola P+R/SR 29 project, Imola Complete Streets Plan, etc.
