1. PROJECT BACKGROUND

1.1 INTRODUCTION

Lahore city is the provincial headquarter of Punjab province. It is also second largest cityof Pakistan having population of more than seven million. Like all metropolitan cities it isalso facing problem in terms of drainage system especially in old areas of Lahore. In oldLahore, drainage system has completed its life in most of the areas and not fulfilling thecurrent requirements. There are currently several depression zones in old Lahore likeLaxmi chowk. Existing drainage system is so poor that water remain stagnant for severalhours even after a small rainfall. In order to address this issue, Government of Punjab hasdecided to provide new drainage system. In this regard, storm water drainage system forSham Nagar to River Ravi will be constructed.

1.2 PURPOSE OF THIS DOCUMENT

The purpose of this document is to shortlist/pre-qualify experienced Firms/Contractors/Joint Ventures (JVs) for the Project “Storm Water Drainage System from Sham Nagar toRiver Ravi, Lahore” which comprises construction of storm water drain, box culvert andlaying of sewer/relocation of WASA utilities and related additional works, if any.

1.3 PROJECT AREA

Project area consist of abadies around Chuburji and Shami Nagar, Lahore.

1.4 BRIEF SCOPE OF WORK

The Brief Scope of Work is given in this section.Following is the scope of work to be executed with reference to TOR

i. Construction of precast box culvert drainii. Shifting services of Sui Gas, LESCO, PTCL, etc.iii. Restoration of road cut

2. FEE OF THE PRE-QUALIFICATION DOCUMENTS

Prequalification Document, in the English language, may be purchased by the interestedapplicants on the submission of a written application to the address below and uponpayment of a nonrefundable fee of Pak Rs.500/- from the office of the Director(Procurement & Stores), Water & Sanitation Agency, 59-F, Gulshan-e-Ravi, Lahore.

3. INSTRUCTIONS TO APPLICANTS

3.1 Submission of Application

Applications for Pre-qualification (one original and three copies) must be submittedseparately in sealed envelopes to be delivered by hand or through registered mail to: -

not later than 1500 hrs on 05 September 2016 and be clearly marked “Storm WaterDrainage System from Sham Nagar to River Ravi, Lahore.”

The applications are to be prepared in English language. Response to all questions shouldbe provided complete along with supporting documents and certified copies ofRegistration with Pakistan Engineering Council. No column is to be left blank. Applicantsmay request the office of Director (P & S), at above mentioned address, for theclarification about the Project or the Pre-qualification during office hours before thedeadline for submission but no document will be received/considered after the due date.All documents submitted by the firms/contractors/JVs should preferably be delivered. Any mis-statement(s)/false information by any applicant will result into hisdisqualification at any stage.

3.1.1 Basic Eligibility

The firms fulfilling the following basic requirements shall only be considered for further evaluation (relevant documents to be attached):

i. Registration with Income Tax Authoritiesii. Taxpayer Status for the last two (2) Yearsiii. Registration with Registrar of Firms (Certified copy of Partnership Deed) OR copy

of SECP registration certificateiv. Registration with PEC in C-1 categoryv. Registration with HUD & PHED for financial year 2016-17vi. Affidavit on Legal Paper that firm has no litigation and not blacklisted by any Govt.

Agency/Firm

In case of foreign firms, they have to form a JV with local firms as per provisions of“Construction and Operation of Engineering Works By-Laws, 1987 of PEC, duly amended”.However, they will have to produce license in Category C-1 or above from PEC along withthe bid in a separate envelope.

3.2 Qualification Criteria

3.2.1 General

Pre-qualification will be based on the criteria given in succeeding paras regardingthe Applicant’s Experience Record, Personnel Capabilities, Equipment Capabilitiesand Financial Soundness, etc. as demonstrated by the Applicant’s responses in theforms given in this document. The Client “Water and Sanitation Agency (WASA),LDA Lahore” reserves the right to waive minor deviations, if these don’t materiallyaffect the capability of an applicant to perform the contract. Sub-Contractor’sexperience and resources shall not be taken into account in determining theApplicant’s compliance with the qualifying criteria. However, Joint Ventureexperience & resources shall be considered. The following criteria is evolvedkeeping in view the complexity of the project.

Pre-qualification status will be decided on the basis of Pass/Fail criteria. Theapplicant must secure at least 50% marks in each category and 65% overall marks.

3.2.2 Experience Record

3.2.3 Personnel Capabilities

3.2.5 Financial Position

3.2.6 Litigation History

The applicant and partners of a Joint Venture should provide accurate informationon any litigation or arbitration resulting from contracts completed or underexecution over the last five (05) years. A consistent history of litigations against theapplicant or any partner of a joint venture may result in rejection of the application.

3.3 Joint Venture (JV)

3.3.1 Joint Venture must comply with the following requirements: -

a) Following are minimum qualification requirements: -

i) In accordance with PEC Bye Laws, Foreign Firms are required to form JVswith local Firms.

ii) The lead partner shall meet not less than 50% percent of all qualifyingcriteria given in paras heretofore.

iii) Each of the partners shall meet not less than 25% percent of all thequalifying criteria given in paras heretofore.

iv) The joint venture must collectively satisfy the criteria of paras 3.2, 3.3 and3.4 heretofore, for which purpose the relevant figures for each of thepartners shall be added together to arrive at the JV’s total capacity.Individual members must satisfy each of the requirements of paras 3.5 and3.6 heretofore.

b) Any change in a prequalified JV after prequalification, shall be subject tothe written approval of the Client prior to the deadline for submission ofbids. Such approval may be denied if: -

i) Partner(s) withdraw from a JV and remaining partners do not meetthe qualifying requirements;

ii) The new partners to a JV are not qualified individually or as another JV; or

iii) In the opinion of the Client, a substantial reduction in competitionwould result.

c) Bid shall be signed by all members in the JV so as to legally bind allpartners, jointly and severally, and any bid shall be submitted with a copyof the JV agreement providing the joint and several liabilities with respectto the contract.

3.3.2 The prequalification of a JV does not necessarily prequalify any of its partnersindividually or as a partner in any other JV or association. In case of dissolution ofa JV, each one of the constituent firms may prequalify if they meet all theprequalification requirements and any partner of JV has requested/shall request forthe same and then his prequalification shall be subject to the written approval ofthe Client.

3.4 Conflict of Interest

The Applicant (including all members of a JV) must not be associated, nor havebeen associated in the past, with the consultants or any other entity that hasprepared the design, specifications and other prequalification and biddingdocuments for the project, or was proposed as Engineer for the contract, over thelast five (05) years. Any such association may result in disqualification of theApplicant.

3.5 Updating Prequalification Information

3.5.1 Bidders shall be required to update the financial, personnel and equipmentinformation used for prequalification at the time of submitting their bids, toconfirm their continued compliance with the qualification criteria and verificationof the information provided at the time of prequalification. A bid shall be rejectedif the Applicant’s qualification thresholds are no longer met at the time of bidding.

3.6 Other Factors

3.6.1 Only firms/contractors/JVs that have been prequalified under this procedure shallbe invited to bid. A qualified firm/contractor/JV may participate only in one bidonly for the contract. If a firm submits more than one bid, singly or as a JV, all bidsincluding that bidder will be rejected. This rule will not apply in respect of bidswhich include specialist sub-contractors who are used by more than one bidder.

3.6.2 a) The scope of work mentioned under Para 1.4 is provisional and the Client reserves the right to amend it in the Bidding Documents.

b) Reject or accept any application; and

c) Cancel the prequalification process and reject all applications.

3.6.3 a) All the Applicants will be informed, in due course, of the result ofevaluation of Pre-qualification process.

b) The Client shall neither be liable for any such actions nor be under anyobligation to inform the Applicants of the grounds for rejection, however,may be debriefed.

4. EVALUATION CRITERIA

Applicants meeting Eligibility Criteria specified in Para 3.1.1 & the minimumrequirements mentioned in Para 3.2 besides other factors shall be considered for pre-qualification. No compromise shall be made on minimum requirements of 50% score ineach category and 65% overall score in qualification criteria specified in Para 3.2. Theevaluation of the Firms/Contractors/ Joint Ventures (JVs) will be carried out as per criteriaattached as Annexure-I.

5. ADDITIONAL CLAUSES

5.1 Answers must be given to all questions in the attached Forms. If necessary,additional sheets may be attached. Failure to provide complete information mayresult in disqualification.

5.2 Each sheet shall be duly signed by the applicant or by the duly authorizedrepresentative of the Applicant. Such authorization shall be indicated by a writtenpower of attorney which shall be attached with the application.

5.3 All the documents submitted by the Applicants shall be treated as confidential andshall not be returned.

5.4 If necessary, additional sheets may be added to the Forms. Each page of each Formshall be clearly marked in the right top corner as follows: Form I, Page 1 of 2,Form I, Page 2 of 2, etc.

5.5 Only those Pakistani Firms/Contractors/JVs can apply or participate in JointVentures for the purpose of pre-qualification who have valid registration in “C-1 orabove CATEGORY" with the Pakistan Engineering Council.

5.6 The Firms/Contractors/JVs must provide clear evidence through documentationsthat their manufacturer has the requisite capacity, expertise and specializedtechnology regarding the relevant machinery/equipment to be installed under theproject.

5.7 All the forms given in the documents shall be completely filled in.
