PPACA Compliance - An Employer Guide The Background On March 23, 2010, President Obama signed into law the Patient Protection and Affordable Care Act (PPACA), creating the system commonly referred to as “Obam- acare.” This created “mandates” which have been included in health insurance coverage, most notably the coverage of adult children to age 26 and preventative health care for women. On January 1, 2014, a major change will occur including requirements that em- ployers with more than 50 employees provide health coverage or pay a penalty and that individuals without health coverage obtain it for themselves or pay a penalty. At the same date, Public Exchanges set up by the states (like California) or by the federal government (like Georgia) will come into operation to provide a resource for individuals to purchase coverage if they wish. Individuals also may be entitled to a subsidy depending on their income level unless their employer provides compliant coverage. Employers may purchase coverage through a “Pri- vate Exchange,’ a carrier or the Small Business Health Options Program (SHOP). Note: Where employee counts are referred to they are Full time Equivalents (FTEs), which take into account part-time employees following a detailed formula. Individu- al employee coverage requirements apply to persons employed for 30 or more hours a week. PPACA Compliance - An Employer Guide

The Background

On March 23, 2010, President Obama signed into law the Patient Protection and Affordable Care Act (PPACA), creating the system commonly referred to as “Obam-acare.” This created “mandates” which have been included in health insurance coverage, most notably the coverage of adult children to age 26 and preventative health care for women.

On January 1, 2014, a major change will occur including requirements that em-ployers with more than 50 employees provide health coverage or pay a penalty and that individuals without health coverage obtain it for themselves or pay a penalty. At the same date, Public Exchanges set up by the states (like California) or by the federal government (like Georgia) will come into operation to provide a resource for individuals to purchase coverage if they wish. Individuals also may be entitled to a subsidy depending on their income level unless their employer provides compliant coverage. Employers may purchase coverage through a “Pri-vate Exchange,’ a carrier or the Small Business Health Options Program (SHOP).

Note: Where employee counts are referred to they are Full time Equivalents (FTEs), which take into account part-time employees following a detailed formula. Individu-al employee coverage requirements apply to persons employed for 30 or more hours a week.

In fairness, homebuilders, furniture manufacturers and persons with fireplaces should fall under scutiny as well in order to save trees. This is particularly true since 70 percent of timber goes to these uses and not to paper. Further, houses and furniture are not recycled and the fireplace wood becomes ash, while more than 65 percent of paper is recycled to other produc-tive uses.

Forest Growth is on the Rise

Ninety-one percent of the trees consumed in the United States to make paper comes from privately owned forests, which give private landowners a financial incentive to grow trees rather than sell off their land for other uses. Private landowners in the United States plant about 4 million trees every day; as a result, forest growth exceeds harvest by 37 percent.

�������� ���������Fifty or More Employees

For employers of 50 or more employees, there is an obligation beginning January 1, 2014, to provide health insurance that is “adequate” and “affordable.” If such an employer fails to do so, they must pay an annual penalty to the federal government of $2,000 (more in later years) for all employees in excess of 30.

For a plan to be “adequate,” its benefits must be actuarially equiva-lent to at least 60 percent of the full cost of medical expenses (a “bronze” plan in PPACA terms). For a plan to be “affordable,” an em-ployee may not be asked to pay more than 9.5 percent of their W-2 income for their own coverage. However, they may be required to pay for the entire cost of dependent coverage. If an employer only offered a plan that did not meet both the adequacy and affordability standards and an employee obtained coverage from the Public Exchange instead, the employer would have to pay a PPACA penalty of $3,000 per year for that employee. As a practical matter, employers must offer a 60 percent plan and should also offer several other choices with varying levels of benefits, so that employees may choose the solution that best fits their needs. The employer must decide what the employee contribution for their health insurance coverage will be. It is likely that it would be administratively simpler and more understand-able if this was stated as a dollar amount per pay period, e.g. $30 per week. Of course, this amount must not violate the 9.5 percent of W-2 standard.

If the employee chose a plan that cost more than the 60 percent plan or wished dependent coverage, they could be required to pay the difference over 9.5 percent (or its dollar alternative) using a tax efficient process (a 125 cafeteria plan). As these are minimum requirements under PPACA, an employer might assume a greater proportion of the cost (just as now).

Where employers provide adequate and affordable coverage, employees may go to the Public Exchange instead, but they will not qualify for the subsidy. If they still find it to their advantage to obtain coverage from the Public Exchange, they may be excluded from employer health coverage.

Also, it is important to remember that while it may be tempting to pay the $2,000 penalty and drop health insurance coverage, the fact that the penalty is non-deductible and that the net after-tax cost of compliant coverage is so low makes that a bad decision on economic grounds before even considering the moral and com-petitiveness issues.

Finally, the other commonly offered coverage for life, dental, vision, etc. are not covered by PPACA and are thus completely outside of these rules.

Fighting Patent Trolls

There has been a frightening development in the recent situation developing with patent trolls. As you may have read in the May 14 issue of NEWSCAN, patent trolls are a type of company known as a nonpracticing entity, which owns patents but never uses them to create anything. These companies make money solely by pursu-ing potential patent infringers and demanding license fees.

At least 30 members of Printing Industries of America are being ac-cused that they are infringing on patents that describe a process in which digital files are submitted from customers, moved across a network, and sent to a CTP device. The patents so broadly describe typical digital workflow that PIA expects other printers will be targeted. The lawyers for the case are requesting between $75,000 and $100,000 per patent infringement.

At Currents’ press time, we had heard of one printer in Illinois receiving an infringement letter. Advocacy in Action

PIA and the American Forest and Paper Association co-hosted a meet-and-greet on May 6 for Reps. Mark Pocan (D-WI) and Dan Kildee (D-MI).

The event introduced various industry representatives to new members of 113th Con-gress, allowing the freshmen legislators to get to know the association and the industry, and where our policy issues lie. It described the indus-try’s economic footprint nationwide, plus spotlighted industry focused legisla-tive issues - such as postal reform - on which PIA hopes to work with the Representatives in the future.

The second of our three state golf outings - our most pop-ular networking events! - is coming up. The 1st Annual Chicagoland Printers Scholarship Golf Outing is set for Wednesday, July 17, 2013, at Maple Meadows Golf Club in Wood Dale, IL. GLGA is co-hosting the event with the Lithographers Club of Chicago and the Graphic Commu-nications Guild. The event is open to all GLGA members, their guests and anyone in the Illinois printing industry.

Registration begins at 7 a.m. A shotgun start is at 8 a.m., with a snack after the first nine holes. A luncheon buffet and prizes fol-lowing golf complete the day.

Evans has 25 years of experience in the industry and regularly consults on paper and ink interactions. He is frequently called upon as the contributing paper and ink specialist for industry publications and has served as an expert witness in court on issues related to paper and ink.

Q: What is in an ink vehicle?

A: It consists of a solvent and drying oil and resin—either natural or synthetic.

Q: What is pseudoplasticity?

A: It is the tendency for paste inks to lose viscosity when agitated or stirred.

Q: What makes paper opaque?

A: Paper consists of fibers with air spaces between, when light pass through paper, it hits the fibers, which scatter the light by chang-ing the light’s direction. The more the light is scattered, the more opaque the paper. This light scattering is referred to as internal reflection. Filler also increases the opacity.

Q: What is internal sizing?

A: Internal sizing occurs in the beating stage where individual fi-bers are coated to increase their resistance to liquids. Rosin, which comes from softwood trees, is the most common internal sizing.
