The Accused

CHRISTOPHER TALAMOR y HAUTEA, 37 years old,married and a resident of Barangay Sulangan,Dumangas, Iloilo with standing Warrant of Arrest inCriminal Case No. 08-65131, for Murder, issued byJudge Danilo P. Galvez, RTC 6, Iloilo City datedFebruary 18, 2008. That upon serving the said

warrant of arrest, he was caught with illegalpossession of firearm and ammunition, hence thepresent case.

Factual Background

On October 07, 2008, at about 7:00 oclock in themorning, Chief Inspector Fusin Jr. together withthe personnel of Regional Intelligence Office 6coordinated thru PO3 Mars Cornell Heso ofLeganes Municipal Police Station to accompanythem to conduct intelligence monitoring and

surveillance on any forms of illegal activitiesaround Municipality of Leganes.

Factual Background

At about 10:00 oclock in the morning of thesame date, the team went back to the LeganesMunicipal Police Station for a briefing that wasconducted by Chief Inspector Sofronio Fusin Jr.and Chief Inspector Orlando R. Colisao for thepurpose of serving the warrant of arrest to

CHRISTOPHER TALAMOR y HAUTEA spotted atManuela Subdivision, Leganes, Iloilo.

On 11:50 in the morning, the team proceeded toManuela Subdivision to arrest the respondent,

being an accused in Criminal Case No. 08-65131,for Murder, at the sala of Judge Danilo P. Galvez,RTC 6, Iloilo City.

Upon arriving at Manuela Subdivision, the teamrushed towards Porras Residence where the

accused was spotted as given by their informant.Some of them went inside the house to verify thepresence of the accused but he was not foundthere and was able to escape.

A thorough search was done, wherein theysurrounded the possible place where ChristopherTalamor was hiding. PO3 Heso, SPO3 Jalandoniand PO1 Robles went to the grassy area near theback of Villa Feliza concrete wall and were ableto see a man hiding his body in the thick grass

and shrubs in a prone position wearing blueshort pants and without a shirt.They ordered himto get out from where he was hiding which he didso.

A 0.45 caliber pistol was seen tucked at the rightportion of Talamors waist. PO3 Heso ordered

him to lie on the ground facing down with bothhands at the back of his head, which he also did.The firearm was taken from his possession andhe was handcuffed by PO3 Heso and the othertwo policemen served as back up.

The accused was asked if he has an authority orlicense to possess said firearm and he replied

none. They placed him under arrest andinformed of his Constitutional Rights under theMiranda Doctrine. He was also informed that hehas a standing warrant of arrest in Criminal CaseNo. 08-65131, for Murder, a non-bailable offense,issued and signed by Judge Danilo P. Galvez ofRTC 6, Iloilo City dated February 18, 2008.

Christopher Talamor was brought to LeganesMunicipal Police Station and further

investigation was conducted for the legality ofrecovered firearm from his possession andcontrol, a 0.45 caliber, Colt MK IV (Series 80)with Serial Number 288187, with magazine andseven (7) live ammunitions, which was alllabeled, served as evidence and has no legalpapers/license to present for possessing it.

From the evidence presented on record itappears that in connection with this case and

aside from a standing warrant of arrest againstthe accused/respondent, the arrest was made inaccordance with Section 5, Rule 113 of the 2000Rules of Criminal Procedure, as amended and heopted to avail of his right to preliminaryinvestigation.

On account of above stated circumstances anduncontroverted pieces of evidence adduced recordsuch as the affidavit of the arresting police officers,

the subject firearm and ammunition, the copy ofthe police blotter and the letter complaint of theChief of Police of Leganes, Iloilo, the investigatingprosecutor finds and holds that there is sufficientground to engender a well-founded belief that thecrime charged has been committed and theaccused is probably guilty thereof, and should be

held for trial.
