    1. ThisActextendstothewholeoftheUnionofMyanmarandappliesalsotoallcitizensoftheUnionwherevertheymaybe.

    Definitions. 2. InthisAct,unlessthereisanythingrepugnantinthesubjectorcontext,2(a).theexpression"Director"meanstheDirectorofPost(b).theexpression"Inland"usedinrelationtoapostalarticle,means

    (i) Posted in the Union of Myanmar and addressed to any place in theUnion ofMyanmar or toany place for President of theUnionbeyondthelimitsoftheUnionofMyanmaror

    (ii) Posted at any post office established by the President of the UnionbeyondthelimitsoftheUnionofMyanmarandaddressedtoanyplacefor which any such post office is established or to any place in theUnionofMyanmar:

    Provided that the expression "Inland" shall not apply to any class of postalarticles which may be specified in this behalf by the President of the Union bynotificationintheGazette,whenpostedinoratoraddressedtoanyplacesorpostofficeswhichmaybedescribedinsuchnotification

    (c) Theexpression"mailbag"includesabag,box,parceloranyotherenvelopeorcovering in which postal articles in course or transmission by post are conveyed,whetheritdoesordoesnotcontainanysucharticle

    (d) Theexpression"mailship"meansashipemployedforcarryingmails,pursuanttocontractorcontinuingarrangement,bytheGovernmentoftheUnionofMyanmarorHisBritannicMajesty'sGovernmentortheGovernmentofanyBritishpossessionorforeigncountry

    (dd) The expression "mail aircraft"means an aircraft, as defined in theMyanmarAircraft Act, employed for carrying mails pursuant to a contract or continuingarrangement,by theGovernmentoftheUnionofMyanmar.HisBritannicMajesty'sGovernmentortheGovernmentofanyBritishpossessionorforeigncountry

    (e) Theexpression"officerofthepostoffice"includesanypersonemployedinanybusinessofthepostofficeoronbehalfofthepostoffice

    (2)

    (f) Theexpression "postage"means theduty chargeable for thetransmissionbypostofpostalarticles,

    (g) Theexpression"postagestamp"meansanystampprovidedbythepresidentoftheUnionfordenotingpostageorotherfeesorsumspayableinrespectofpostalarticlesunder thisAct,and includesadhesivepostagestampsandstampsprinted,embossed,impressedorotherwiseindicatedonanyenvelope,wrapper,postcardorotherarticle

    (h) Theexpression"postoffice" includeseveryhouse,building ,room,carriageorplaceusedfor thepurposesof thepostoffice,andevery letterboxprovidedbythepostofficeforthereceptionofpostalarticles

    (i) The expression "postal article " includes a letter,postcard, newpaper, book,paternorsamplepacket,parcel ,parcelandeveryarticleor thingtransmissiblebypost

    (k) The expression "the post office " means the department established for thepurposeofcarrying theprovisions of thisAct intoeffectandpresidedoverby the(Director).

    3. ForthepurposesofthisAct,..

    (a) A postal article shall be deemed to be in course oftransmission by post from the time of its being delivered to apostofficetothetimeofitsbeingdeliveredtotheaddresseeorof its being returned to the sender or otherwise disposed ofunderChapterVII

    Meanings of"in course oftransmissionby post" and "delivery".

    (b) The delivery of a postal article of any description to apostmanorotherpersonauthorizedtoreceivepostalarticlesofthatdescriptionforthepostshallbedeemedtobeadeliverytoapostofficeand

  • (c) Thedeliveryofapostalarticleat thehouseorofficeofthe addressee or to the addressee or his servant or agent ,orother person considered to be authorized to receive the articleaccordingtotheusualmannerofdeliveringpostalarticlestotheaddressee,shallbedeemedtobedeliverytotheaddressee.

    CHAPTERII.PrivilegeandprotectionoftheGovernment.

    4. (1) Wherever within the Union of Myanmar posts or postalcommunication are established by the President of the Union, thePresidentoftheUnionshallhavetheexclusiveprivilegeofconveyingbypost,fromoneplacetoanother,allletters,exceptinthefollowingcases,andshallalsohavetheexclusiveprivilegeofperformingalltheincidentalservices of receiving, collecting, sending,despatching anddelivering allletters,exceptinthefollowingcases,thatistosay

    Exclusive privilegeof conveying lettersreserved to theGovernment.

    1.InthisAct theword"Director"wassubstitutedfor theword"DirectorGeneral"byActXXXV,1950.

    (a)Letterssentbyaprivatefriendinhisway, journeyor travel,to bedeliveredby him to theperson towhom they are directed,withouthire,rewardorotherprofitoradvantageforreceiving,carryingordeliveringthem

    (b)Letterssolelyconcerningtheaffairsofthesenderorreceiverthere,sentbyamessengeronpurpose

    (c)Letterssolelyconcerninggoodsorproperty,senteitherbyseaorbyland(orbyair)1,tobedeliveredwiththegoodsorpropertywhichtheletters concern, without hire, reward or other profit or advantage forreceiving,carryingordeliveringthem

    Provided thatnothing in this section shall authorizeanypersonto make a collection of letters excepted as aforesaid for the purpose ofsendingthemotherwisethanbypost.

    (2)Forthepurposesofthissectionandsection5,theexpression"letters"includespostcards.

    Certain 5.WhereverwithintheUnionofMyanmarpostsorpostalcommunicationsare

  • personsexpresslyforbiddento conveyletters.

    established by the President of the Union, the following persons areexpressly forbidden tocollect, carry, tenderordeliver letters,or to receivelettersfor thepurposeofcarryingordeliveringthem,althoughtheyobtainnohire,rewardorotherprofitoradvantageforsodoing,thatistosay:

    (a) commoncarriersofpassengersorgoods,andtheirservantsoragents,exceptasregardsletterssolelyconcerninggoodsintheircartsorcarrigesand

    (b) (Ownersandmastersofvesselsandpilotsorotherpersonsinchargeofaircraft)2sailingorpassingonanyriverorcanelintheUnionofMyanmar, or between any parts or places in the Union of Myanmar, andtheirservantsoragents,exceptasregardsletterssolelyconcerninggoodson board, and except as regards postal articles received for conveyanceunderChapterVIII.

    Exemptionfrom liabilityfor loss misdelivery,delay or damage.

    6.The Government shall not incur any liability by reason of the loss,misdelivery or delay of , or damage to ,any postal article in course oftransmissionbypost,exceptinsofarassuchliabilitymayinexpresstermsbeundertakenbytheGovernmentashereinafterprovidedandnoofficerof the post office shall incur any liability by reason of any such loss ,misdelivery,delayordamage,unlesshehascausedthesamefraudulentlyorbyhiswillfulactordefault.

    CHAPTERIII.Postage.

    Power to fixrates of inlandpostage.

    7.(1)ThePresidentof theUnionmay,bynotification intheGazette, fix theratesofpostageandothersumstobechargedinrespectofpostalarticlessentbytheinlandpostunderthisAct.andmaymakerulesastothescaleofweights,termsandconditionssubjecttowhichtheratessofixedshallbecharged:

    (4)

    Providedthatthehighestrateofpostage,whenprepaid,shallnotexceedtheratesetforthforeachclassofpostalarticlesintheFirstSchedule.

    ( 2 )Unless and until such notification as aforesaid is issued, the rates setforthinthesaidscheduleshallbethe rateschargeableunderthisAct.

  • (3)The presidentof theUnionmay, by notification in theGazette, declarewhat packetsmay be sent by the inland post as book, pattern and sample packets within themeaningofthisAct.

    (8).ThePresidentoftheUnionmay,byrule,

    (a (a)Requiretheprepaymentofpostageoninlandpostalarticlesornyclclassofinlandpostalarticlesandprescribethemannerinwhichprepaymentshallbemade:

    Powertomakerulesastopaymentofpostageandfeesincertaincases

    (b) prescribe the postage to be charged on inland postal articleswhenthepostageisnotprepaidorisinsufficientlyprepaid:(c)Providefortheredirectionofpostalarticlesandthetransmission

    by post if articles so redirected , either free of charge or subject tosuchfurtherchargeasmaybespecifiedintherulesand(d) prescribe the fees to be charged for the "express delivery " of

    postal articles , in addition to ,or instead of , any other postagechargeablethereonunderthisAnt.Explanation."Expressdelivery"meansdeliverybyaspecialmessengerorconveyance.9.(1)ThepresidentoftheUnionmaymakerulesprovidingforthe

    registration of newspapers for transmission by inland post asregisterednewspapers.

    Powertomakerulesastoregisterednewspapers.

    (2) For the purpose of such registration . every publication,consisting wholly or in great part of political or other news .or ofarticlesrelating thereto ,or toothercurrent topics,with orwithoutadvertisements,shallbedeemedanewspaper,subjecttothefollowingconditions,namely:

    (a) That it is published in numbers at intervals of not morethanthirty onedaysand

    (b)Thatithasabonafidelistofsubscribers.(3) An extra or supplement to a newspaper,

    bearingthesamedateasthenewspaperandtransmittedtherewith ,shallbedeemedtobepartofthenewspaper

    Providedthatnosuchextraorsupplementshallbesodeemedunless it consists wholly or in great part of matter like that of thenewspaperandhasthetitleanddateofpublicationofthenewspaperprintedatthetopofeachpage

    ExplanationNothinginthissectionorintherulesthereundershall beconstruedtorenderitcompulsorytosendnewspapersbytheinlandpost.

    Powertodeclareratesofforeignpostage.

    10.(1)WherearrangementsareinforcewiththeUnitedKingdom,orwithanyBritishpossessionor foreigncountry, for thetransmissionbypost of postal articles between the Union of Myanmar and the UnitedKingdomorsuchpossessionorcountry,thePresidentoftheUnionmay,inconformity with the provisions of such arrangements, declare whatpostage ratesandothersumsshall be charged in respectof suchpostalarticles, and may make rules as to the scale of weight , terms andconditionssubjecttowhichtheratessodeclaredshallbecharged.

    (2) Unless until such declaration as aforesaid is made, theexistingratesandregulationsshallcontinueinforce.

    Liabilityforpaymentofpostage

    11.(1)Theaddresseeofapostalarticleonwhichpostageoranyothersumchargeableonhisacceptingdeliveryofthepostalarticle,unlessheforthwithreturnsitunopened.

    Provided that , if any such postal article appears to thesatisfactionoftheDirector tohavebeenmaliciouslysent for thepurposeofannoyingtheaddressee,hemayremitthepostage

    (2)IfanypostalarticleonwhichpostageoranyothersumchargeableunderthisActisdueisrefusedorreturnedasaforesaid .oriftheaddresseeordeadorcannotbefoundthen thesendershallbeboundtothepostageorsumduethereonunderthisAct.

    Recoveryofpostageandothersumsdueinrespectofpostalarticles.

    12.If any person refuses topay anypostage or other sumduefromhimunder thisAct in respectofanypostalarticle, the sumsoduemay,onapplicationmadebyanofficerofthepostofficeauthorizedinthisbehalfbythewrittenorderoftheDirector,berecoveredfortheuseofthepostofficefromthepersonsorefusingasifitwereafineimposedunderthisActbyanyMagistratehaving jurisdictionwhere thatpersonmay forthetimebeingberesidentandtheDirectormayfurtherdirectthatanyotherpostalarticle, notbeingon(Government)1 serviceaddressedtothatperson shall be withheld from him until the sum so due is paid orrecoveredasaforesaid.

    Customsdutypaid 13. When a postal article on which any duty of customer is

  • bythepostofficetoberecoverableaspostage

    payablehasbeenreceivedbypostfromanyplacebeyondthelimitsoftheUnionofMyanmar,andthedutyhasbeenpaidbythepostalauthoritiesatany customsport or elsewhere, the amount of the duty shall berecoverableasifitwerepostagedueunderthis Act._____________________________________________________________

    Postofficemarksprimafacicevidenceofcertainfactsdenoted

    14.IneveryproceedingfortherecoveryofanypostageofothersumallegedtobedueunderthisActinrespectofapostalarticle,

    (a)Theproductionofthepostalarticle,havingthereontheofficialmarkofthepostofficedenotingthatthearticlehasbeenrefused,orthattheaddresseeisdeadorcannotbefound,shallbeprimafacieevidenceofthefactsodenoted,and(b)Thepersonfromwhomthepostalarticlepurportstohavecomeshall,untilthecontraryisproved,bedeemedtobethesenderthereof.

    (6)

    15.TheofficialmarkonapostalarticledenotingthatanypostageorothersumisinrespectthereoftothepostofficeoftheUnionofMyanmar,ortothepostofficeoftheUnitedKingdomorofanyBritishpossessionorforeigncountry,shallbeprimafacieevidencethatthesumdenotedasaforesaidissodue.

    CHAPTERIV.PostageStamps.

    16.(1)ThePresidentoftheUnionshallcausepostagestampstobeprovideofsuchkindsanddenotingsuchvaluesashemaythinknecessaryforpurposesofthisAct.

    Provision of postagestampsandpowertomake rules as tothem.

    (2)ThePresidentoftheUnionmaymalerulesastothesupply,saleanduseofpostagestamps.

    (3)Inparticular,andwithoutprejudicetothegeneralityoftheforegoingpower,suchrulesmay

    (a)Fixthepriceatwhichpostagestampsshallbesold

    (b)Declaretheclassesofpostalarticlesinrespectofwhich

  • postagestampsshallbeusedforthepaymentof postageorothersumschargeableunderthisAct.

    (c)Prescribetheconditionswithregardtoperforation,defacement andallothermatterssubjecttowhichpostagestampsmaybeacceptedorrefusedinpaymentofpostageorothersums

    (d)Regulatethecustody,supplyandsaleofpostagestamps

    (e)Declarethepersonsbywhomandthetermsandconditionssubjecttowhichpostagestampsmaybesoldand

    (f)Prescribethedutiesandremunerationofpersonssellingpostagestamps.

    17.(1)Postagestampsprovidedundersection16shallbedeemedtobestampsissuedbyGovernmentforthepurposeofrevenuewithinthemeaningofthepenalCode,andsubjecttotheotherprovisionsofthisAct,shallbeusedfortheprepaymentofpostageorothersumschargeableunderthisActinrespectofpostalarticles,exceptwherethepresidentoftheUniondirectsthatprepaymentshall bemadeinsomeotherway.

    Postage stamps tobe deemed to bestamps for thepurposeofrevenue.

    (2)WherethePresidentoftheUnionhasdirectedthatprepaymentofpostageorothersumschargeableunderthisActinrespectofpostalarticlesmaybemadebyprepayingthevaluedenotedbytheimpressionsofstamping machinesissuedunderhisauthority,theimpressionsofanysuchmachineshalllikewisebedeemedtobeastampissuedbyGovernmentforthepurposeofrevenuewithinthemeaningofthepenalCode.

    (7)

    CHAPTERV.

    ConditionsofTransmissionofPostalArticles.

  • Redelivery tosender of postalarticleincourseoftransmission bypost.

    18.(1) The president of the Union may , by rules provide for theredeliverytothesender,withoutreferencetotheconsentof theaddresseeandsubject to suchconditions(ifany)asmaybedeemedfitofanypostalarticleincourseoftransmissionbypost.

    (2) Save as provided by any rules that may be made under subsection (1) . the sender shall not be entitled to recall a postal article incourseoftransmissionbypost.

    Transmission bypost of anythinginjuriousprohibited.

    19. (1) Except as otherwise provided by rule and subject to suchconditionsasmaybeprescribedthereby,nopersonshallsendbypostanyexplosive, dangerous , filthy,noxious or deleterious substance , any sharpinstrument not properly protected , or any living creature which is eithernoxiousorlikelytoinjurepostalarticlesincourseoftransmissionbypostoranyofficeofthepostoffice.

    (2)Nopersonshallsendbypostanyarticleorthingwhichislikelytoinjurepostalarticlesincourseoftransmissionbypostoranyofficerofthepostoffice.

    20.NopersonshallsendbypostTransmission bypost of anythingindecent, etc.prohibited.

    (a) Any indecent or obscene printing , painting, photograph,lithograph , engraving , book or card, or any other indecent or obscenearticle,or

    (b)Anypostalarticlehavingthereon,oronthecoverthereof,anywords,marks or designs of an indecent ,obscene , seditious , scurrilous ,threateningorgrosslyoffensivecharacter.

    Power to makeruleastotransmission,bypostofpostalarticles.

    21.(1) The President of the Union may make rules as to thetransmissionofarticlesbypost.

    (2) In particular, and without prejudice to the generality of theforegoingpower,suchrulesmay

    (a)specifyarticleswhichmay notbetransmittedbypost(b)prescribe conditions on whicharticles may betransmittedby post

    (c)provideforthedetentionanddisposalofarticlesincourseoftransmission by post in contravention of rules made under

    clause(a)orclause(b)

    (d)provideforthegrantingofreceiptsfor,andthegrantingand

  • obtainingofcertificatesofpostinganddeliveryofpostalarticles and the sums to be paid ,in addition to any other

    postal,forsuchreceiptsandcertificatesand

    (e) regulatecovers,formsmaximumweights,andenclosures,andtheuseofpostalarticles,otherthanletters,formakingcommunications.

    (3)Postalarticlesshallbepostedanddeliveredatsuchtimesandin suchmanner as theDirectormay , by order , from time to

    timeappoint.

    (8)

    22.(1)wherethedispatchordeliveryfromapostofficeofletterswouldbedelayedby thedispatchordelivery there fromat the sametimeofbook.patternorsamplepacketsandparcels,oranyofthem,suchpacketsorparcels,oranyofthem,may,subjecttosuchrulesasthepresidentoftheUnionmaymakeinthisbehalfbedetainedinthepostofficesolongasmaybenecessary.

    Power to postponedispatch or delivery ofcertainpostalarticles.

    (2)Whereseparateparcelpostsareestablished,parcelsmaybeforwardedandconveyedbythem,beingdetained,ifnecessary,inthepostofficeforthatpurpose.

    23.(1)Anypostalarticlesentbypostincontraventionof anyoftheprovisionsof thisActmaybedetainedandeitherreturned tothesender or forwarded to destination, in each case charged with suchadditionalpostage(ifany)asthepresidentof theUnionmay,byrule,direct.

    Power to deal withpostal articles postedincontraventionofAct.

    (2)AnyofficerinchargeofapostofficeorauthorizedbytheDirector in this behalfmay open or unfasten any newspaper or anybook , pattern or sample packet, in course of transmission by post,which he suspects to have been sent by post in contravention ofsection20,clause (a) ,orofsection21,orofanyof theprovisionsofthisActrelatingtopostage.

    (3)Notwithstandinganythinginsubsection(1)(a)anypostalarticlessentbypostincontraventionofthe

    provisions of section 19may , under the authority of the Director ,ifnecessary,beopenanddestroyedand

    (b)anypostalarticlesentbypostincontraventionoftheprovisions of section 20 may be disposed of in such manner as thepresidentoftheUnionmaybyruledirect.

  • 24.Exceptasotherwiseprovided in thisAct,whereapostalarticlesuspectedtocontainanygoodsofwhichthe importbypostorthe transmissionbypost isprohibitedbyorunderanyenactment forthe time being in force , or anything liable to duty is received fordeliveryatapostoffice , theofficer in chargeof thepostoffice shallsendanoticeinwritingtotheaddresseeinvitinghimtoattend,eitherinpersonorbyagent,withinaspecifiedtimeatthepostoffice,andshallinthepresenceoftheaddresseeorhisagentoriftheaddresseeorhisagentfailstoattendasaforesaidtheninhisabsence,openandexaminethepostalarticle

    Power to deal withpostal articles containing goods contrabandorliabletoduty

    Provided,first,thatiftheDirectorsodirectsinthecaseofanypost office or class of post offices , the officer in chargeof the postoffice shall call in two respectable persons as witnesses before heopensapostalarticleintheabsenceoftheaddressesorhisagent:

    Provided , secondly , that in all cases a postal article , afterbeing opened under this section, shall bedelivered to the addressee,unless it is required for the purpose ofany further proceeding underthisoranyotherlaworenactmentforthetimebeinginforce,andthatthe opening of the postal article and the circumstances connectedtherewithshallbeimmediatelyreportedtotheDirector.

    (9)

    Power to deliversuch articles toCustomsauthority

    24.AThepresidentoftheUnionmaybygeneralorspecialorderempoweranyofficer of the post office, specified in suchorder , to deliver any postal article,receivedfro,beyondthelimitsoftheUnionofMyanmarandsuspectedtocontainliable toduty , to suchCustomsauthorityasmaybespecifies in thesaidorder,and Customs authority shall deal with such article in accordance with theprovisionsoftheSeaCustomsActorofanyotherlawforthetimebeinginforce.

    Power tointercept notifiedgoods duringtransmiss ion bypost.

    25. Where a notification has been published under section 19 of the SeaCustomsAct in respect ofany goods ofany specified description, orwhere theimport or export into or from the Union of Myanmar of goods of any specifieddescriptionhasbeenprohibitedorrestrictedbyorunderanyotherenactmentforthetimebeinginforce,anyofficerofthepostofficeempoweredinthisbehalfbythepresidentoftheUnionmaysearch,orcausesearchtobemade,foranysuchgoods in course of transmission by post and shall deliver all postal articlesreasonablybelovedorfoundtocontainsuchgoodstosuchofficerasthePresident

  • oftheUnionmayappoint in thisbehalf ,andsuchgoodsmaybedisposedofinsuchmannerasthepresidentoftheUnionmaydirect.Incarryingoutanysuchsearch , such officer of the post officemay open or unfasten , or cause to beopenedorunfastened,anynewspaperoranybook,patternorsamplepacketincourseoftransmissionbypost.

    Power tointercept postalarticles for publicgood.

    26. (1)Ontheoccurrenceofanypublicemergency,or in theinterestof thepublic safety or tranquility , the president of the Union or any officer speciallyauthorizedinthisbehalfbythePresidentoftheUnionmay,byorderinwriting,directthatanypostalarticleorclassordescriptionofpostalarticlesincourseoftransmissionbypost shallbe interceptedordetained ,orshallbedisposedofinsuchmannerastheauthorityissuingtheordermaydirect.

    (2) Ifanydoubtarisesasto theexistenceofapublic emergency,orastowhetherantactdoneundersubsection(1)wasintheinterestofthePublicsafetyor tranquility , a certificate signed by a Secretary to the Government shall beconclusive proof on the point.

    Power to dealwithpostal

    27. (1)Wherea postal article is received by post fromany placebeyond thelimitsoftheUnionofMyanmar

    articles fromabroadbearing

    (a) bearing a fictitious postage stamp , that is to sayany facsimile orimitationorrepresentationofapostagestamp,or

    fictitious or previously usedstamps

    (b) purporting to be prepaid with any postage stamp which has beenpreviouslyusedtoprepayanyotherpostalarticle,

    theofficerinchargeofthepostofficeatwhichthepostalarticleisreceivedshallsend a notice to the addressee inviting him to attend , either in person or byagent,withina specifiedtimeat thepostoffice to receivedelivery of thepostalarticle.

    (2)Iftheaddresseeorhisagentattendsatthepostofficewithinthetimespecifiedinthenoticeandconsentstomakeknowntotheofficerinchargeofthepost office the name and address of the sender of the postal article and toredeliver totheandtoredeliver totheofficeraforesaidtheportionof thepostalarticlewhichbearstheaddressandthefictitiousorpreviouslyusedpostagestamp,orifthepostalarticleisinseparablefromthestamp,theentirepostalarticlethepostalarticleshallbedeliveredtotheaddressorhisagent.

    (10)

    (3) If the addressee or his agent fails to attend at the post officewithin the time

  • specified in thenotice,or ,havingattendedwithin that time, refuses tomakeknown thename and address of the sender or to redeliver the postal article or portion thereof asrequiredby sub section (2) , the postal article shall not be delivered to him , but shall bydisposedofinsuchmannerasthePresidentoftheUnionmaydirect.

    Explanation For the purposes of this section , the expression "postage stamp"includesanypostagestampfordenotinganyrateordutyofpostageofany(*** * )1 foreigncountry,and the impression ofany stampingmachineprovidedorauthorizedforthepurposebyorunderauthorityoftheGovernmentofsuch( * * *)1country.

    27A. No newspaper printed and published in the Union of Myanmar withoutconformingtotheruleslaiddowninthePress(Registration)Actshallbetransmittedbypost.

    (b)That,inadditiontoanypostageandfeesforregistrationchargeableunderthisAct,suchfurtherfeeasmaybefixedbythenotificationshallbepaidonaccountoftheinsuranceofpostalarticles.

    31.ThePresidentoftheUnionmaybenotificationintheGazettedeclareinwhatcasesinsuranceshallberequired,anddirectthatanypostalarticlecontaininganythingrequiredtobeinsured,whichhasbeenpostedwithoutbeinginsured,shallbereturnedtothesenderorshallbedeliveredtotheaddresseesubjecttothepaymentofsuchspecialfee

    33.SubjecttosuchconditionsandrestrictionsasthePresidentoftheUnionmay,by rule, prescribe, the Government, shall be liable to pay compensation, notexceeding theamount forwhich a postal article has been insured, to the senderthereofforthelossofthepostalarticleoritscontents,orforanydamagecausedtoitincourseoftransmissionbypost:

  • Transmissionbypostofvaluepayablepostalarticles.

    PowertoMakerulesastovaluepayablepostalarticles.

    Provided that the compensation so payable shall in no case exceed thevalueofthearticle,lostortheamountofthedamagecause.

    33. 34.ThePresidentoftheUnionmay,bynotificationintheGazette,directthat,subjecttotheotherprovisionsofthisActandtothepaymentoffeesatsuchratesasmaybefixedbythenotification,asumofmoneyspecifiedinwritingatthetimeof posting by the sender of a postal article shall be recoverable on the deliverythereof from theaddressee,and that thesum so recovered shallbepaid to thesender:

    ProvidedthattheGovernmentshallnotincuranyliabilityinrespectofthesumspecifiedforrecoveryunlessanduntilthatsumhasbeenreceivedfromtheaddressee.

    Explanation.Postalarticlessentinaccordancewiththeprovisionsofthissectionmaybedescribedas"valuepayable"postalarticles.

    35.(1)ThepresidentoftheUnionmaymakerulesastothetransmissionbypostofvaluepayablepostalarticles.

    (2)Inparticular,andwithoutprejudicetothegeneralityoftheforegoingpower,suchrulesmay

    (a)declarewhatclassesofpostalarticlesmaybesentasvaluepayablepostalarticles

    (b)directthatnopostalarticleshallbesosentunlessthesenderdeclaresthatitissentinexecutionofabonafideorderreceivedbyhim

    (c) limitthevaluetoberecoveredonthedeliveryofanyvaluepayablepostalarticle

    (d)Prescribetheformofdeclarationtobemadebythesendersofvaluepayablepostalarticles,andthetimeandmannerofthepaymentoffees

    (e)Providefortheretentionandrepaymenttotheaddresseeincasesoffraudofmoneyrecoveredonthedeliveryofanyvaluepayablepostalarticleand

    (f) Prescribethefeestobechargedforinquiresintocomplaintsregardingthedeliveryoforpaymentforfailurepayablepostalarticles.

    (3) Postalarticlesshallbemadeovertothepostofficeforthepurposeofbeingsentas"valuepayable",andshallbedelivered,whensosent,atsuchtimesandinsuchmannerastheDirectormay,byorder,fromtimetotimeappoint.

    (4)No suit or other legal proceeding shall be instituted against theGovernmentoranyofficerofthepostofficeinrespectofanythingdone,oringoodfaithpurporting tobedone,underany rulemadeunder clause(e)of subsection(2).

    36.(1)Wherearrangementareinforcewith(any)1foreigncountry.Forthetransmissionbypostofregistered,insuredorvaluepayablepostalarticlesbetweentheUnionofMyanmarand(suchcountry)1 ,thePresidentoftheUnionmaymakerulestogiveeffecttosucharrangements.

    (2)Inparticular,andwithoutprejudicetothegeneralityoftheforegoingpower,suchrulesmayprescribe

    (a) the form of declaration to be made by thesenders of suchpostal articles as aforesaidand(b)thefeestobechargedinrespectthereof.

    Powertogiveeffecttoarrangementwithothercountries.

    CHAPTERVII.UndeliveredPostalArticles.

    37.(1)ThePresidentoftheUnionmaymakeruleastothedisposalofpostalarticleswhichforanyreasoncannotbedelivered(hereinafterreferredtoas"undeliveredpostalarticles").

    (2)Inparticular,andwithoutprejudicetothegeneralityoftheforegoingpower,suchrulesmay

    (a)prescribetheperiodduringwhichundelivered postal articlesatapostofficeshallremaininthatofficeand

    (b) provideforthepublicationoflistofundeliveredpostalarticles,orofanyclassofundeliveredpostalarticles.

    (3)Everyundeliveredpostalarticlesafterbeingdetainedatapostofficefortheperiodprescribebyruleundertheforegoingprovisionofthissection,shallbeeitherforwarded,freeoffurthercharge,tothepostofficeatwhichitwasposted,forreturntothesender,orsenttotheofficeoftheDirector.

    (39).UndeliveredpostalarticleswhichcannotbedisposedofundertheforegoingprovisionsshallbedetainedintheofficeoftheDirectorforsuchfurtherperiod(ifany),andshallbedealtwithinsuchmanner,asthePresidentoftheUnionmay,byrule,direct:

    Providedthat(a)Lettersandpostcardsshallbedestroyed(b)Moneyorsaleableproperty,notbeingofaperishablenature,found

    inanyundeliveredpostalarticle,shallbedetainedforaperiodofoneyearintheofficeoftheDirector,and,ifontheexpirationofthatperiodnopersonhasestablishedhisrightthereto,shall,ifmoney,becreditedtothepostoffice,and,ifsaleableproperty,besold,thesaleproceedsbeingcreditedtothepostoffice.

    CHAPTERVIII.ShipandAircraftLetters.

  • DutyofMasterofShipandPilotofAircraft,DepartingfromanyportorplaceintheUnionofMyanmar,andnotbeingamailshipormailaircraft,toconveymailbags

    (40) Themaster of a ship,not being amail ship (and the pilot or otherpersoninchargeofanaircraft,notbeingamail aircraft,)1 about todepart fromanyportorplace in theUnionofMyanmar toanyport orplacewithin,oranyportorplace beyond, the Union of Myanmar, shall receive on board any mail bagtendered to him by any officer of the post office for conveyance, granting areceipt there fore in such from as the President of the Unionmay, by rule,prescribe, and shall, without delay, deliver the same at the port or place ofdestination.______________________________________________________________

    41.(1)Themasterofaship(orthepilotorotherpersoninchargeofanaircraft )1arrivingatanyportorplace in theUnionofMyanmar shall ,withoutdelay,causeeverypostalarticleofmailbagsonboardwhichisdirectedtothatportorplaceandiswithintheexclusiveprivilegeconferredonthePresidentoftheUnionbysection4,tobedeliveredeitheratthepostofficeatthatportorplace or to some officer of the post office authorized in this behalf by theDirector.

    (2) If there is on board any postal article or mail bag which isdirected to any other place within the Union of Myanmar, and is within theExclusiveprivilegeaforesaid(themasterorpilotorotherpersonasaforesaid)2shall,withoutdelay,reportthefacttotheofficerinchargeofthepostofficeattheportorplaceofarrivalandactaccordingtothedirectionshemayreceivefromsuchofficer ,andthereceiptofsuchofficershalldischargehimfromallfurtherresponsibilityinrespectofthepostalarticleormailbag.

The Presidentof theUnionmay ,by notification in theGazette,declare what gratuities shall be allowed to masters of ships not bringmailships , notbeingmail ships (orpilots or other persons in chargeof aircraft,not being familiar craft)1 in respect of postal articles received by them forconveyanceonbehalfofthepostoffice:andthemasterofaship,notbeingamailship(orpilotorotherpersoninchargeofanaircraftnotbeingamailaircraft )1 about to leave any port or place in the Union of Myanmar asaforesaid shall , if he receives on board a mail bag for conveyance , beentitledtodemandandobtainimmediatelytheamountofthegratuitypayableunderthissectioninrespectofthemailbaganditscontents.

    Allowanceofgratuitiesforconveyanceofpostalarticlesbyshipsoraircraftotherthanmailshipsormailaircraft.

    CHAPIERIX.MoneyOrders.

    43.(1) The president of theUnionmay provide for the remitting ofsmallsumsofmoneythroughthepostofficebymeansofmoneyorders,andmaymakerulesastosuchmoneyorders.

    Powertomaintainmoneyordersystemandtomakerulesastoremittancesthereby.

    (2) In particular, andwithout prejudice to the generality of theforegoingpower,suchrulesmayprescribe

    (a) the limit of amount for which moneyorders may beissued:

    (b) the period during which moneyorders shall remaincurrent:

    and(c) the rates of commission or the fees to be charged on

    moneyordersorinrespectthereof.

    44.(1)SubjecttosuchconditionsasthePresidentoftheUnionmay,by

    46.(1)WherearrangementsareinforcewiththeUnitedKingdom,orwithanyBritishpossession, State in IndiaorPakistanor theUnion ofMyanmar or foreigncountry, for the issue and payment through the post office of moneyordersbetweentheUnionofMyanmarandtheUnitedKingdomorsuchpossession,Stateor country, the President of the Union may make rules to give effect to sucharrangements.

    (2)Inparticular,andwithoutprejudicetothegeneralityoftheforegoingpower,suchrulesmayprescribe

    (a) the manner in which, and the conditions subject to which, suchorders maybeissuedandpaidintheUnionofBurmaand

    (b)theratesofcommissiontobechargedthereon.Recovery ofmoneyorderpaid to thewrongperson.

    47. If any person, without reasonable excuse, the burden of proving whichshalllieonhim,neglectsorrefusestorefund

    (a)anyamountpaidtohiminrespectofamoneyorderbyanofficerofthepostofficeinexcessofwhatoughttohavebeenpaidtohiminrespectthereof,or

    (b)theamountofamoneyorderpaidbyanofficerofthepostofficetohiminsteadoftosomeotherpersontowhomitoughttohavebeenpaid,

    suchamountshallberecoverablebyanofficeofthepostofficeauthorizedbythe

  • Director in this behalf from the person so neglecting or refusing as if it were anarrearoflandrevenueduefromhim.

    48. No suit or other legal proceeding shall be instituted against theGovernmentoranyofficerofthepostofficeinrespectof

    (a) anythingdoneunderanyrulesmadebythePresidentof theUnionunderthisChapteror

    (b) the wrong payment of a moneyorder caused by incorrect orincomplete informationgivenbytheremitteras tothenameand address of the payee, provided that, as regardsincomplete information, therewasreasonable justificationforaccepting the information as a sufficient description for thepurposeofidentifyingthepayeeor

    (c)thepaymentofanymoneyorderbeingrefusedordelayedby,oranaccountofanyaccidentalneglect,omissionormistakeby,oronthepartof ,anofficerofthepostoffice.orforanyothercausewhatsoeverotherthanthefraudorwilfulactordefaultofsuchofficeror

    52.Whoever,beinganofficerofthepostoffice,commitstheftinrespectof,ordishonestlymisappropriates,or,foranypurposewhatsoever,secretes,destroysorthrows away, any postal article in course of transmission by post or any thingcontained therein ,shall be punishable with imprisonment for a termwhich mayextendtosevenyears,andshallalsobepunishablewithfine.

    53.Whoever,beinganofficerofthepostoffice.contrarytothisdutyopens,orcausesorsufferstobeopened,anypostalarticleincourseoftransmissionbypost,orwillfullydetainsordelays,orcausesorsufferstobedetainedordelayed,anysuchpostalarticle,shallbepunishablewithimprisonmentforatermwhichmayextendtotwotears,orwithfine,orwithboth

    62.Whoeverplaces inoragainstanyletterboxprovidedbythepost office for the reception of postal articles any fire ,matchor light ,anyexplosive,dangerous,filthy,noxiousordeleterioussubstance,oranyfluidorcommitsanuisanceinoragainanysuchletterbox,ordoesanythinglikelyto injure any such letterbox or its appurtenances or contents , shall bepunishablewith imprisonment fora termwhichmayextend tooneyear,orwithfine,orwithboth.

    Penalty for affixingwithout authority athingtoorpainting,tarringordisfiguringpost office latterbox

    63. Whoever, without due authority , affixes any placard ,advertisement , notice , list, document, board or other thing in or on , orpaints , tars or in any way disfigures any post office ,or any letterboxprovided by the post office for the reception of postal articles , shall bepunishablewithfinewithmayextendtofiftyrupees.

    Penalty for makingfalsedeclaration.

    64.Whoever,beingrequiredbythisActtomakeadeclarationinrespect of any postal article to be sent by post or the contents or valuethereof,makesinhisdeclarationanystatementwithheknows,orhasreasontobelievetobefalse,ordoesnotbelievetobetrue,shallbepunishablewithfinewhichmayextendtotwohundredrupees,and,ifthefalsedeclarationismade for the purpose of defrauding theGovernment ,with finewhichmayextendtofivehundredrupees.

    Penalty for masterof ship or pilot ofaircraft falling tocomply with theprovisionsofsection40or41.

    65. whoever ,(being the master of ship or the pilot or otherpersoninchargeofanaircraft,)1

(1)Whoever, being either the master of ship (or pilot orotherperson in chargeofanaircraft)2 arrivingatanyportorplace in theUnionofMyanmaroranyoneonboardknowinglyhasinhisbaggageorinhispossessionorcustody,afterthepostalarticlesonboardoranyofthemhavebeen sent to the post office at the (port or place of arrival ,)1 any postalarticlewithintheexclusiveprivilegeconferredonthePresidentof theUnionbysection4,shallbepunishablewithfinewhichmyextendtofiftyrupeesforeverysuchpostalarticleasaforesaid.

    (2)Whoever,(beingsuchmaster,pilotinotherpersonasaforesaidoranyoneonboard,)1 detainsanysuchpostalarticleasaforesaidafterdemandmadeforitbyanofficerofthepostofficeshallbepunishablewith fine which may extend to one hundred rupees for every such postalarticle.

    I.INLANDPOSTALARTICLES.

    Letters.

    8. Letters may be transmitted by post with or without prepayment ofpostage.Unpaidletters,withorwithoutcover,shallbesecurelyclosedbythesenders,andanysuchletterpostedwithouthavingbeensecurelyclosed,shallbeforwardedfordisposaltotheofficeoftheDirectorGeneraltobedestroyedforthwithinaccordancewithrule207.

  • 9. Whennoninflammableor"Safety"cinematographfilmsaresentbytheletterpost , they shall be contained ina substantialmetal caseandthemetal case shallpacked inastrongwoodenorcardboardcontaineranda labelbearingthewords"Thiscontainsnoninflammablefilmsonly"printedinredtypeorwritteninboldhandinredinkshallbeaffixedtotheoutsideofeachpacket.

    10. The DirectorGeneral, may , in special circumstances, prescribe a limit ofweightforlettersforandfromanyparticularpostofficeoroffices.

    Postcards.

    11. Singleandreplycardsofprivatemanufacturemaybetransmittedbypostaspostcards:

    Providedthat(a) thepostageisprepaidinfull,(b) theirdimensionsarenotgreaterthan57/8by41/8 inchesorlessthan4

    by27/8 inches, and(c) asregardssubstance, theyareneither thinnernormoreflexiblethantheinland

    postcardsissuedbythePostOffice.12. Allreplypostcardsofprivatemanufactureshall,displaythetitle"Postcard"on

    the addressside,but this title is not obligatory for single cards of privatemanufacture.Replyhalvesofreplypaidcardsshallbearthewords"Postcards"and"Reply".WhateverisprintedontheaddresssideoftheinlandorinternationalofficialpostcardsissuedbythePostOfficeisalsopermissibleontheaddresssideofcardsofprivatemanufacture.

    13.(1) A postcard shall not be folded, cut, or otherwise altered, except that theimpressedpostagestamp(ifany)maybeperforatedwithinitialsnormayapostcardbeenclosedincoverofanykind.

    (2) Therighthandhalfoftheaddresssideofapostcardisinallcasesreservedfortheaddressoftherecipient,forthepostagestamporimpressionofstampingmachinenecessaryforprepaymentwhichshould,sofaraspossible,beaffixedintheupperrighthandcorner,andforthepostaldirections"Registered"and"Acknowledgmentdue"butthelefthandhalfoftheaddressside,aswellastheback,maybeusedbythesenderforthepurpose of a written communication, or may be otherwise disposed of, subject to therestrictionsmentionedinclause(3)ofthisrule.

    Note1. AlthoughtheverticallinedrawnontheaddresssideoftheinlandpostcardsissuedbythePostOffice,bearingtheportraitofHisMajestyKingGeorgeVI,ontheimpressedstamp,doesnotdividethatside into twoequalparts thedivisions somadeshall betaken to represent the "righthandhalfoftheaddressside"andthe"lefthandhalfoftheaddressside"forthepurposeofthisrule.

    Note2. Asmallspacemarkedoffbyfinelinesorminutedotstoindicatetheplacewherethepostagestampshouldbeaffixedisallowedontheupperrighthandcorneroftheaddresssideofpostcards.

    (3) Nothingshallbeattachedtoapostcardexcept(a) stampinpaymentofpostageorotherpostalfeesorstampduty(b) a gummed label completely adherent to the card , and bearing the

    nameandaddressofthepersontowhomthecardissent(c) asimilar labelnotexceeding2 inches in lengthand3/4 inch inwidth

    bearingthenameandaddressofthesenderofthecardand(d) engravings,illustrations,drawingsandphotographsonverythinpaper

    andcompletelyadherenttothecard.Stamps inpayment of stampdutymaybeaffixed to theback of thepostcard.Thearticles

    specified in clauses (c) and (d), may be affixed either to the back or the lefthand half of theaddressside.

    (4) Thereplyhalvesofreplypaidcardscannotberegisteredbytheoriginalsendersofsuchcards.

    14. Shouldapostcardbepostedwithoutthepostagehavingbeenprepaidinfull,itshall be forwarded to the office of the DirectorGeneral to be destroyed forthwith. Should eitherportionofareplypostcardbepostedwithoutthepostagehavingbeenprepaid,thatportionshallbeforwardedto theofficeof theDirectorGeneral tobedestroyedforthwith.Shouldanyof theotherconditionsimposedbyrules11,12and13beinfringed,thepostcardshallbetreatedasaletter.

    ExpressdeliveryofUnregisteredLettersandPostcards.

  • 15.(1)Unregisteredlettersandpostcardsmaybetransmittedbypostforexpressdeliverytoanyplacenotmorethanfivemilesdistantfromatelegraphoffice.

    (2)Expressdeliverylettersandpostcardsshallbeconspicuouslymarkedontheaddressside with the words "Express Delivery" and the fee for express delivery shall be prepaid by thesenderbymeansofpostagestampsorimpressionsofstampingmachinesaffixedto,orimpressedon,theletterofpostcard.

    (3)Expressdeliveryshallnotbemadeofanypostalarticles,whetheritdoesordoesnotsatisfytheprovisionsofsubrule(2),toanyplacemorethanfivemilesdistantfromatelegraphoffice.

    (4)Notwithstandinganythingcontainedinrule8,expressdeliveryshallnotbemadeofany postal article if each the postage and the express delivery fee thereon have not been fullyprepaid.

    (32)

    BusinessReplyEnvelopesandCards.16.(1)"BusinessReplyCards"and"BusinessReplyEnvelopes"shall,subjecttotheprovisions

    ofthisrule,betransmittedbypostwithoutprepaymentofpostage,andpostagethereonshallbecollectedincashfromtheaddresseeondelivery.

    (2) Personsdesiringtheprivilegeof sendingoutBusinessReplyCardsandEnvelopes forreturntothemshallmakeapplicationtothepostmasterattheofficetowhichthecardsorenvelopes

  • aretobereturned,whoshalltransmittheapplicationtotheDirectorGeneralandawaitthereceiptofapermit.

    (3)TheannualfeeforthepermitshallbeRs.10whichshallberecoveredinadvancefromtheapplicant.Thepermitshallbecancellediftherebeadefaultinthepaymentofthepostagedueonsuchcardsandenvelopes.

    (4) Business Reply Cards shall conform in size, from and quality with the conditionsprescribedforpostcardsofprivatemanufacture.

    (5)BusinessReplyCardsandEnvelopesshallbefurnishedbytheuserandshallbearontheaddressside (a) the printedname and addressof the personor concern towhom they are tobedelivered,(b)thepermitnumber,(c)thenameofthePostOfficeissuingthepermit,(d)thewords"BusinessReplyEnvelope"or"BusinessReplycard"(e)theinscription,"NopostagestampnecessaryifpostedinBurma"and(f)thewords"Postagewillbepaidbyaddressee".Sufficientspaceshallbeleftforpostmarkingatthetopofthecardorenvelope:

    ProvidedthatinlieuoforinadditiontofurnishingBusinessReplyCardsandEnvelopesauserthereofshallbeentitledtoincorporateinanyadvertisementsissuedbyhiminnewspapersorotherpublicationsa specialdesign containing the printedentries hereinbefore specified to be used asalabelandtobeaffixedtoacardorenvelope.

    (6) BusinessReplyCardsmaybesentoutasreplyportionsofdoublepostcardsormaybeenclosedwithothermatter,butBusinessReplyEnvelopesshallbeenclosedwithothermatter.

    (7) WhenBusinessReplyCardsandEnvelopesare returnedto theofficeoforigin, theyshallbedeliveredtothepersonforwhomtheyareintendedonpaymentofthepostagechargeablethereon.

    BookPackets.17.Abookpacketmaycontain

    (1) newspapers, publicationsof all kinds, printedmusic,books, paper,parchment andcardboard,eitherblankorprinted,notbearinganywritingexceptasfollows:(a) in thecase of books and complimentary cards (such asChristmas,NewYear,

    Birthday,IdandBijoyaCards), thenameofthepersontowhomsentorpresented, thenameandaddressofthesenderorowner,date,andnotmorethanfivewordsorinitialsofacomplimentarynatureorsignifyingpresentation

    (b)inthecaseofinvoices,billsofladingandreceipts(forgoodsormoney)onprintedforms,thenecessarymanuscriptentries

    (c) in the case of printed notices, printed circulars (i.e., printed notices andprintedletters),andprintedinvitations,thedateandhouroftheoccasiontowhichtheyrelate,thenameandaddressoftheaddressee,thenameofthe sender and, in the case of notices of a meeting, the object of themeeting

    (d) in thecase of printednotices for payment of premia posted by InsuranceCompanies, dates,name andaddress of the insurant, number of policy,amountandreferencenumberandlettersand

    (e) proof corrections in proof sheets and music sheets, and corrections ofprintingerrorsinotherprintedmatter

    (2) pictures, plans,maps and drawings,whether done byhand oranymechanicalprocess, photographs and engravings, notbearing anywriting except asignature,adateanddescriptionordedicationnotexceedingfivewords

    (3)business,commercialor legaldocumentsdrawnwhollyorpartlybyhand,e.g.,deeds,accounts,powersorattorney,proposalsforinsurance,insurancepolicies

    (4) manuscripts for press and manuscript music, not bearing any writtenendorsementotherthanadirectionconsistingofnotmore than tenwordsregarding the disposal of return of the manuscript, and the name andaddressofthesender

    (5) licenses, statistical returnssentbyor to officialsby theirdesignationonly,andRevenue and Judicial processes sent by Courts to Presidents of DistrictCouncilsandviceversa

  • Note . Court summonses,notices and similar documents issuedby a criminal or Civil court,whether sent from the court of issue of returned to it, direct, or through themediumof anothercourt,governmentOffice,orrailwayadministration,aswellaspolicediariescannotbesentatbookpacketrates.

    (6) Written lettersofolddatewhichhavepreviouslypassedthroughthepostandservedtheiroriginalpurpose

    (7)documentswhollyorpartlyprintedinimitationoftypewriting,orreproducedfrom a manuscript or typewritten original by any mechanical process of polygraphy such aschromography,mimeography provided that (i) they are handed in at the Post Office counter orwindow,(ii) the specialattentionof thecounterorwindowclerk isdrawntothefactthat theyaredocumentsofthekindmentionedinthissubclause,and(iii)atleast20preciselyidenticalcopiesarepostedatthesametime.

    Explanation.By"Printing"ismeantanyspeciesoftypewritingawaytorecognize,lithography,handstamping or anymechanical presses, except the copying press and the typewriter,ordinarilyhand to produce a number of identical copies of written matter and easy to recognize. "Writing"includes typewriting and any mechanical or other process ordinarily used to produce a singledocument.

  • 18. Withanyofthearticlesmentionedinrule17maybesentanythingthatisnecessaryfortheirsafe transmissionthrough thepost,suchas rollers,etc., andany legitimatebinding,mounting,orcovering, loose or attached, and anything that ordinarily appertains to such articles, as pens andpencilsinthecaseofapocketbook,photographs,inthecaseofaphotographbook,andcardplatesinthecaseofvisitingcards.

    Prohibitions

    19.(a) No communication of the nature of a letter or having the character of a personalcommunicationshallbeenclosedinorwrittenuponabookpacketexcepttotheextendspecifiedinrule17.

    (b)Nocardbearingtheheading"postcard"shallbetransmittedopenasabookpacket.(c) A book packet shall not contain "papermoney" which for the purposes of this rule

    includesunobliteratedpostageorotherstamps,currencynotes,hundies,cheques,banknotes,bankpostbills,billsofexchange,andallordersorauthoritiesforthepaymentofmoneyprovidedthatabook packetmay contain onestamped and addressedenvelope,postcard orwrapper bearing thenameandaddressofthesenderofthepacket,orsomeotherpersonnamedthereon.

    20.(1)Thedimensionofabookpacket,whichmaybeofanyshape,shallnotexceedtwofeetinlengthbyonefootinwidthandonefootindepth.When,however,thepacketisintheformofaroll,thelengthshallnotexceedthirtyinches

    Provided that, if the lengthexceedstwentyfour inches (two feet) thediameter shallnotexceedfourinches.

    (2) Printedpaperssentopenintheformofcards,whetherfoldedornot,shallbesubjecttothesameminimumlimitsofdimensionsaspostcardsofprivatemanufacture,themaximumbeingthesameasthatprescribedforbookpacketsinsubrule(1).

    21. The DirectorGeneral may, in special circumstances, prescribe a limit of weight for bookpacketsforandfromanyparticularpostofficeoroffices.

    22. Abookpacketshallbepostedwithoutacover,or inanunfastenedenvelope,or inacoverwhichcanbeeasily removed for thepurposeofexaminationwithoutbreaking anysealor tearinganypaperorseparatinganyadheringsurfaces.Apacketpostedwithoutacovermaynotbefastenedorotherwisetreatedsoastopreventeasyexamination.

    23. Ifabookpacketisfoundtocontainanythingnotpermittedbytherules,ortobeinexcessoftheprescribedsize,ortobepacketinamannernotinaccordancewiththerules,itshallbecharged

  • on deliverywith letteror parcelpostage ,whichevermay be less . Anypostagepaid on it shall ,however,betakenintoaccountinassessingthecharge.

    PatternPackets.

    24. (1) A pattern or sample packet may contain bona fide trade patterns or sample ofmerchandisenothavingany

    saleablevalue,togetherwith,or withoutanymatterwhichmaybesentasabookpacket.Thereshall be nowriting upon or in a pattern or sample packet , except thenameand address of thesender , thenameandaddressof thepersonforwhomit is intended ,atrademark ,numbers,prices,andindicationsastotheweight,six,orquantitytobedisposedof.

    (2)Objects ofnaturalhistorydriedorpreservedanimalsandplants ,geological specimensandothersimilarobjectsshallalsobeadmittedtotransmissionbypostat theratesofpostageforpattern and samplepackets,provided that they are not sent fora commercial purpose ,and thattheyarepackedinthemannerprescribedforpatternandsamplepacketsgenerally.

    25.Thedimensionsofapatternorsamplepacketshallnotexceedtwofeetinlengthbyonefootinwidthandonefootindepthandtheweightshallnotexceedtwohundredtolas

    ProvidedthattheDirectorGeneralmay, inspecialcircumstances, fixa lower limitofweightforpatternandsamplepackets,forandfromanyparticularpostofficeoroffices.

    26.(1)Apatternpacketshallbepostedwithoutacoverorwithacoveropenatbothends,orinanunfastenedenvelopeor othercoverwhichcanbeeasily removed soas toadmitofa readyexaminationofthecontents.

    (2) Samplesof seeds drugs and other articleswhich can notbe sent inunfastened orremoveableenvelopesmaybesentenclosed inboxesorbagsprovidedthattheyarefastenedinsuchawaythattheycanbeeasilyopenedtheymayalsobesentinairtightcases,whennecessary,

  • providedthatthenatureofthecontentsiscertifiedonthecoverunderthefullsignatureandaddressofthesender.

    (3)Articlesofglassorotherfragilematerialshallbesecurelypacked(inboxesofmetal,wood,orstrongcorrugatedcardboard) insuchawayastopreventallriskofinjurytothemailsortotheofficersofthePostOffice.

    (4) Liquids , oils and substances which easily liquefy shall be enclosed in receptacleshermeticallysealed.Eachreceptaclesshallbeplacesinaspecialboxofmetalorofstrongwoodorofstrongcorrugatedcardboard,containingsawdust,cotton,orspongymaterialinsufficientquantitytoabsorbtheliquidincasethereceptaclebebroken.Thelidoftheboxshallbefasteneddowninsuchamannerthatitwillnoteasilybedetached.

    (5) Fattysubstanceswhicharenoteasilyliquefied,suchasointments,softsoapsresins,etc,shallbeenclosed inaninnercover(box,bagof linenorparchment,etc .whichshall itselfbeplacedinasecondboxofwood,metalorstrongandthickleather.

    (6) Dry powders, whether dyes or not, shall be placed in cardboard boxes, whichthemselvesshallbeenclosedinabagoflinen,orparchment.

    (7) Livebeesshallbeenclosed inboxessoconstructedastopreventalldangerandtoallowthecontentstobeascertained.

    (36)

    27.(1)Ifapatternorsamplepacketisfoundtocontainanythingnotpermittedbytherules,ortobeinexcessoftheprescribedsizeorweight,ortobepackedinamannernotinaccordancewiththerules,itshallbechargedondeliverywithletterorparcelpostage,whichevermaybeless.Anypostagepaidonitshall,however,betakenintoaccountinassessingthecharge.

    (2)Ifapacketcontainingsamplesofanyofthearticlesmentionedinclauses(3)to(7)ofrule 26isnotpackedinthemannerprescribedtherein,itshallnotbeforwarded.

  • "BlindLiterature"Packets.28. Papersofanykind,periodicals,andbooksimpressedin"Braille"orotherspecialtypefor

    theuseoftheblind,shallbetransmittedbypostas"blindliterature"packets,providedthattheyarepostedinaccordancewiththefollowingconditions.

    (a) Thepacketshallconsistonlyofarticlesspeciallyimpressedasdescribedabovefortheuseoftheblindandshallnotcontainanycommunicationeitherinwritingorprintedinordinarytypeexceptthetitleandtableofcontentsofthebookorperiodical,andanykeyto,orinstructiosfortheuseofthespecialtype,oranyenclosureexceptalabelforthereturnofthepacket.

    (b) Thepacketshallbearontheoutsidetheinscription"Literaturefortheblind"andthewrittenorprintednameandaddressofthesender.

    (c) Thepacketshallbepostedeitherwithoutacover,orinacoveropenatbothendswhichcaneasilyberemoved forthepurposeofexamination.

    (d) Thedimensionsofthepacketshallnotexceedtwofeetinlengthbyonefootinwidthandonefootindepthandtheweightshallnotexceed400tolasoranylowerlimitthatmaybeprescribedbytheDirectorGeneralinrespectofbook
