GMADA (eke GREATER MOHALI AREA DEVELOPMENT AUTHORITY The rapid growth and development of Chandigarh and its surrounding areas exerted pressure on its land, services and utilities and gave birth to Mohali Punjab as the Punjab arm of tri-city in the late 60's. Since Chandigarh and its periphery areas are most sought after by investors, developers, companies, professions and institutions, the Punjab Government intends to meet the aspirations of all the groups by developing this region as world class destination. Ltd., Singapore) were engaged. The planning of Mohali is a repeat of Le Corbusier's grid pattern and all the towns in Greater Mohali region have been well connected and integrated with Chandigarh. The price for corner plot shall be 5% extra.

The price for plot facing park (100 %frontage) shall be 5% extra.

In case both (i and ii) above apply, price shall be 10% extra.

Incomplete application shall be rejected.

Number of plots can be increased or decreased at any time at the sole discretion of GMADA.

5% rebate on the price shall be given to the applicants under physically handicapped quota. This rebate shall be available only to those physically handicapped applicants who apply under this category and shall be restricted to 3% quota of physically handicapped persons. However, the earnest money will be the same as indicated above for applicants of Physically Handicapped Quota.

TERMS & CONDITIONS

10% price of plot is to be deposited alongwith application.

15% price of plot is payable within thirty days from the date of issue of Letter of Intent.

5% price + extra price (on account of corner or facing park or both +additional price), if any is payable at the time of delivery of possession. Additional price means increase due to actual measurement of site as well as in the event of enhancement of compensation by any competent Court under the Land Acquisition Act 1894 and increase in the cost of development including amenities or otherwise.

Balance 70% would be payable as per the following payment plans:-

PAYMENT PLAN

PLAN-A If the allottee deposits the balance 70% price in lump sum within 60 days from the date of allocation letter/Letter of Intent, 10% rebate shall be allowed. PLAN-B Allottees are entitled to pay the 70% amount without interest in seven bimonthly equated installments from the date of issue of allocation letter/Letter of Intent. PLAN-C Allottees are entitled to pay the 70% amount alongwith interest @10% p.a. payable half yearly, in 7 half yearly instalments from the date of allocation letter /Letter of Intent. NOTE

I)

If the allottee under the Plan B and C makes the entire outstanding payment in lumpsum at any time then a rebate of 5% shall be allowed on the outstanding principal amount.

ii) This benefit shall be allowed only if three or more instalments are to be paid when the lumpsum payment is made.

iii) Applicant shall have to opt for the payment plan at the time of filling of application form. However, if he/she intends to change the payment plan he/she shall have to inform in this regard before Draw. Thereafter, no change of plan will be allowed.

ELIGIBILITY CRITERIA

i) Must be a citizen of India.

ii) Must have attained the age of majority i.e. 18 years as on date of submission of application.

iii) The applicant himself/herself or any member of his/her family should not own any residential plot/house/flat allotted by any Government Agency at SAS Nagar. This means that the person who has purchased plot/flat/house by way of auction or re-sale is eligible for applying the plot in this scheme. The family means husband, wife and minor children (less than 18 years of age).

RESERVE CATEGORIES

In addition to the above eligibility criteria the reserved category applicants shall have to fulfill the following conditions :-

I) The beneficiary should not have availed the benefit for allotment under the reserved category in any scheme of any Govt. Agency in the state of Punjab.

ii) Applicant under reserved category must be a domicile/resident of Punjab. The applicant will have to submit Domicile Certificate/Residence Certificate issued by the concerned Tehsildar/ Executive Magistrate of Punjab Government or any officer authorized by the Punjab Government.

iii) If at any stage, the information submitted by the applicant is found to be false or incorrect his/her allotment shall be liable to be cancelled and earnest money shall be forfeited besides initiation of criminal action.

iv) Where sufficient applications are not received against the reserved category, the excess plots shall be considered unreserved at the time of draw/allotment.

v) The eligibility shall be determined as on the date of closing of scheme.

vi) A self attested photocopy of valid certificate issued by a Competent Authority as prescribed by the Government of Punjab in case of reserved categories should be attached with the Application Form.

vii) In case of Physically handicapped/blind, the applicant should be 40% or above disabled or 100% blind to be eligible under the scheme. A self attested photocopy of certificate issued by the concerned Civil Surgeon of the District should be attached.

viii) In case of Freedom Fighter, the applicant should be recipient of Freedom Fighter pension or Tamra Patra issued by Punjab Govt./Govt. of India. A self attested photocopy of the certificate issued by the concerned Deputy Commissioner of the District, should be attached with the application form.

The following order of preference will be adopted:-

I) Self

ii) Widow of the Freedom Fighter who is drawing the pension.

iii) Freedom Fighter's son/daughter and grandson/grand daughter.

ix) In case of war widows, serving defence personnel and ex servicemen/ paramilitary forces a self attested photocopy of the certificate issued by the Deputy Director Distt. Sainik Board should be attached. In case of Punjab Police Personnel, a self attested photocopy of the certificate issued by the DGP, Punjab/D.C. as the case may be, should be attached.

x) In the case of Gallantry Award Winners:

a) The Gallantry award winners from the defence services, paramilitary forces who have distinguished themselves by acts of bravery and valour in the defence of our Country, both in war and peace time and Punjab Police Personnel awarded with President Police Medals for Gallantry and Police Medals for Gallantry. They should not already have received any such discretionary quota plot/house/flat from any other scheme in any part of the Country.

b) In case of posthumous award, the widow (if there is only one) shall be considered the next of kin eligible to avail this quota. In case the awardee was unmarried, the mother or father in that order.

c) The following order of preference will be adopted:-

(i) Param Vir Chakra (iv) Ashoka Chakra (vii) President Police Medals for Gallantry

(ii) Maha Vir Chakra (v) Kirti Chakra (viii) Police Medals for Gallantry

(iii) Vir Chakra (vi) Shaurya Chakra (ix) Sena Medal/Nau Sena MedalNayu Sena Medal

xi) In case of the Sports Persons, the applicant should be Medal winner (for Gallantry Award winners) of Olympics, Common Wealth or Asian Games, Mountaineers who have scaled Mount Everest and possess the requisite certificate awarded by the Indian Mountaineers Foundations duly countersigned by the Ministry of Youth Affairs and Sports, Govt. of India.

Please note that if at any stage the information submitted by the applicant is found to be false or incorrect his/her allotment shall be liable to be cancelled and earnest money shall be forfeited besides criminal action.

HOW TO APPLY

The application form attached with the Brochure alongwith self attested passport size photograph should be submitted to any of the Banks mentioned in this brochure, either in person or by post on or before the closing date. Application should be accompanied by earnest money in the shape of banker's cheque/pay order/Draft in favour of Estate Officer, GMADA, Mohali payable at the station where the application is sought to be submitted. Application found incomplete or defective in any respect or not duly signed by the applicant is liable to be rejected.

NOTE: Since all the applications are being received in the designated Bank branches, no application should be sent by post or otherwise to GMADA's office. Such applications will not be included in the draw.

TERMS OF APPLICATION

I. Submission of application is no guarantee of allotment.

ii. Conditional applications will not be considered.

iii. Submission of false/fabricated documents shall attract criminal proceedings.

iv. GMADA reserves the right to increase or decrease the number of plots prior to holding draw of lots depending upon the feasibility at site.

v. GMADA further reserve the right to change the facilities, specifications, locations etc. and also the right to withdraw the scheme.

vi. While corresponding with GMADA, applicant is required to quote his application form number, scheme, amount deposit, receipt number etc. as may be relevant.

vii. Details of drawings and specifications or any other information concerning the scheme can be obtained from the Estate Officer, GMADA, SAS Nagar.

viii. The allottee shall abide by the terms and conditions of allotment as contained in the brochure, allotment letter and any other terms and conditions revised/amended by the GMADA from time to time.

MODE OF ALLOTMENT

I. In case number of applications received is less than the number of plots available in a category, all the applicants will be issued Letter of Intent subject to their being eligible otherwise. However, plot number shall be allotted through draw. In case number of applications received is more than the number of plots available under a particular category then draw of lots will be held.

ii. For the purpose of draw all applications will be included in the draw of lots category-wise, without scrutiny of the applications. Thereafter, only the cases of successful applicants will be scrutinized. On scrutiny, if the applicant is found eligible, a letter of intent will be issued.

iii. Where the applications are more than the number of plots then a waiting list in order of seniority will be drawn to the extent of 10 % of the number of plots available under each category. The plots will be offered to the applicants in the waiting list in order of their seniority. However the applicants kept on waiting list will be given allotment in the event of surrender of plot under scheme only.

iv. The waiting list will be valid for one year from the date of draw.

v. If the requisite number of applications is not received in a reserved category the plots shall be offered to those belonging to the unreserved category.

DELAYED PAYMENT

I) In case of non-payment of instalments by due date, GMADA will resume the plot. However, if applicant moves application for condonation of delay within specified period, he/she shall be liable to pay interest and penalty on the amount due at the following rates for the delayed period on due amount:-

1 Upto one year Normal (10%) applicable rate of interest + 3% P.A. for delayed period 2 If the delay is upto 2 years Normal (10%) applicable rate of interest + 4% P.A. for delayed period 3 If the delay is upto 3 years or more Normal (10%) applicable rate of interest + 5% P.A. for delayed period

ii) In case of enhancement of price due to increase in area, enhancement of land compensations or for any other reason, the increased price shall be added to the balance payment scheduled subject to the conditions stipulated in sub-para (vi) below.

iii) In case of fully paid plot, the enhancement of price due to any or all the above reasons, shall be paid within 60 days without payment of any interest of such demand or in 3 equal six monthly instalments along with an interest @10% per annum.

iv) In case of reduction in area, the excess amount shall be refunded/adjusted, as the case may be, on pro-rata basis within a period of 60 days.

v) The method of payment shall be intimated in the Letter of Intent to be issued after draw.

vi) No separate notice for payment of installment shall be sent.

REFUND OF EARNEST MONEY

i) In case applicant asks for refund of earnest money before draw, refund shall be allowed after deducting the processing fee of 2% of the amount deposited with application.

ii) Unsuccessful applicants shall be refunded their earnest money within 90 days from date of draw. However, interest @ 5.5% per annum shall be allowed for the period beyond 181st day in case refund is made after 180 days from the date of closing of the scheme.

iii) In case an applicant wants to surrender the plot within 30 days from the date of issuance of Letter of Intent, 10% of the earnest money shall be deducted.

iv) If refusal is received after 30 days from the date of issuance of Letter of Intent, the entire earnest money shall be forfeited.

OTHER CONDITIONS

i. List of successful applicants considered in the draw shall be displayed at Greater Mohali Area Development Authority's notice board and shall also be displayed on the website i.e. www.gmada.org .

ii. The plot shall be used only for residential purposes.

iii. Allotment shall be governed by the Punjab Regional and Town Planning And Development Act, 1995, and the rules framed there under and other allied instructions/policy decision issued by the GMADA later on.

iv. Plot is being offered on "as is where is basis".

POSSESSION AND OWNERSHIP

i. Possession of plot shall be handed over to the allottee after completion of development works at site in a period of 2.5 years from the date of issuance of Letter of Intent. In case for any reason GMADA is unable to deliver the possession of plots in stipulated period, allottee shall have a right to withdraw from the scheme by moving an application to the Estate Officer, in that case, the Authority shall refund the entire amount deposited by the applicant along with 10% simple interest. Apart from this, there shall be no other liability of the Authority.

ii. In case the Authority is unable to give the possession of the plot due to any other reason, the allocation of the plot shall be cancelled and the Authority shall refund the entire amount deposited by the applicant alongwith 10% simple interest. Apart from this, there shall be no other liability of the Authority.

iii. The ownership of the land shall continue to vest with Greater Mohali Area Development Authority until full payment is made of outstanding dues in respect of said plot.

iv. The allottee shall be required to execute a Deed of Conveyance in prescribed format and prescribed manner within 90 days of payment of entire money. The expenses of registration and execution of Conveyance Deed shall be borne by the allottee.

v. The Letter of Intent shall be transferable after receipt of 25% of the total price of the plot, by way of sale, gift or otherwise with the prior permission of Estate Officer, GMADA, SAS Nagar subject to the payment of 1% of the total price of the plot as transfer fee and Rs. 1000/- as processing fee.

CONSTRUCTION OF BUILDING

i. Construction on plot shall be completed within a period of 3 years from the date of issue of allotment letter.

ii. Construction shall be carried out as per sanctioned Building Plans and as per the provisions of PUDA (Building) Rules, 1996 as amended from time to time.

iii. Any construction carried out in violation of sanctioned building plan/building rules shall be dealt with as per policy laid down in this regard from time to time.

iv. Before occupying the building, allottee would be required to obtain completion certificate/ occupation certificate from the Estate Officer, GMADA. SAS Nagar.

EXTENSION FEE

If the construction on the plot is not completed within the stipulated in para above, extension in construction period would be granted subject to payment of extension fee, as may be determined from time to time. However, extension fee in period of completion of building shall be subject to the satisfaction of the Estate Officer that the failure to complete the building within the stipulated period was due to a cause beyond the control of allottee.

GENERAL

I. The allotment will be made under the provisions of Punjab Regional & Town Planning & Development Act, 1995 and rules, regulations & policies made there under as amended from time to time and the terms and conditions of allotment letter.

ii. The price is tentative and is subject to variation with reference to the actual measurement of site as well as in the event of enhancement of compensation by the Courts under the land Acquisition Act, 1894 and increase in the cost of development including amenities or otherwise.

iii. In case of breach of any condition(s) of allotment or of regulations or non-payment of any amount due together with the penalty the plot or building as the case may be, shall be liable to be resumed and in that case an amount

not exceeding 10% of the total amount of consideration money, interest and other fees payable in respect of plot shall be forfeited as per the provision of section 45(3) of the Punjab Regional and Town Planning & Development Act, 1995.

iv. No fragmentation of the site shall be permitted.

v. The allottee shall pay all general and local taxes, rates, process imposed or assessed on the said site/building by the Municipal or any other authority competent to levy such taxes and rates.

vi. The GMADA may , by its officers and officials at all reasonable times and in reasonable manner after giving 24 hours notice in writing enter in any part of the plot./building erected thereon for the purpose of ascertaining that the allottee has duly performed and observed the conditions of allotment and provisions under the Punjab Regional and Town Planning and DevelopmentAct, 1995 and rules and regulations made there-under.

vii. The GMADA shall have full rights, powers and authority at all times to do through its officers or officials all acts and things which may be necessary and expedient for the purpose of enforcing compliance with the terms and conditions and to recover from the allottee as first charge upon the said site, the cost of doing all or any such act and things and all cost incurred in connection herewith or any way relating therewith.

viii. Any change in address must be notified by registered A.D. to Estate Officer, GMADA, SAS Nagar alongwith five self addressed envelopes of size 9"x4".

DISCLAIMER

In case for whatever reason, this scheme fails GMADA will refund the deposited money alongwith 10% simple interest to the applicant. GMADA shall not be liable for any other claim/damages in this regard.

DISPUTES

Subject to the provisions of the Act all the disputes and/or differences which may arise in any manner touching or concerning this allotment shall be referred to the Sole Arbitrator, Chief Administrator, Greater Mohali Area Development Authority (GMADA) or any person appointed/nominated by him in this behalf. The award of such Arbitrator shall be final and binding on the parties. Arbitration shall be governed by the Arbitration and Conciliation Act, 1996, as amended from time to time.

ACCEPTANCE OR REFUSAL OF ALLOTMENT

i. In case terms and conditions of allotment, as detailed above, are acceptable, allottee is required to send his/her acceptance by registered post along with a demand draft of 15% price of the plot within 30 days of issue of Letter of Intent (excluding date of issue) subject to the conditions.

ii. In case of refusal to accept the allotment offer then such refusal in writing through a registered post should be received within 30 days from the date of issue of Letter of Intent. In the event of such refusal to accept the Letter of Intent, 10% of earnest money deposited shall be forfeited. However, in case such refusal is received after a period of 30 days from the issue of Letter of Intent offer, entire earnest money deposited shall be forfeited.

Note:

i) A person or his/her spouse can submit any number of applications for allotment of same or different sizes of plots alongwith separate earnest money for each application. However only one plot shall be allotted to one person or his/her spouse.

ii) If an applicant is successful for more than one plot, he /she shall have to intimate to the GMADA with in 30 days from the date of draw regarding size of plot he/ she wants to retain. In that case, earnest money in respect of other plots shall be refunded without any deduction.

iii) In case, applicant fails to intimate the above information with in 30 days, 10% of the earnest money deposited with each application shall be deducted and GMADA will have the right to allot any of the plot to the applicant for which there will be no discretion of the applicant.

iv) If applicant deposits the 15% money for more than one plot, in that case the entire earnest money deposited for all the plots shall be forfeited and no plot of any size shall be allotted to him/her and LOIs issued shall be cancelled besides criminal proceedings against him/her.

GUIDELINES FOR FILLING THE APPLICATION FORM

Column No. 1 to 8 are self explanatory.

Column No. 9 Please fill A, B or C of your choice of payment plan as given at Sr. No. III under head payment plan of the brochure (Page 2).

Column No. 10 A& 10 B Please fill one of the code of the category for the reservation sought as given in the application form under Column No. 10 B

Column No. 12 Application should be accompanied by earnest money in the shape of banker's cheque/pay order/Draft in favour of Estate Officer, GMADA, Mohali payable at the station where the application is sought to be submitted. Name & address of the applicant should be written on the back side of the bank draft.

Column No.13 Particulars of the Bank should be filled accurately so that refund could be made to the bank who had financed the earnest money.

Column No.14 Name and relationship of the nominee should be written in capital letters.

Column No.15 & 16 Applicants and his/her spouse can apply for any number of plots. If more than one applications are being submitted, give the particulars of the other applications in all the applications submitted. If the space is less in the application form additional sheet can be attached for furnishing the detailed information.

Note:-

1 Certificate given at the end of the application form is to be furnished by all the applicants including reserved category applicants.

2. Draw slip is to be filled by the applicant and ensure signature at the given place.

3. Acknowledgement is to be tilled by the applicant.
