April21, 2016. BACKGROUND

Proposed use: Bar and Grill

Site: Vacant undeveloped land

Surrounding land uses: Abutting the property to the north are Arby's, and Encino Plaza (under construction), to the east, Walgreens, a Commercial Plaza with 4 Suites (Laredo Emergency Room, Polish Nail Salon, Way Back Burger and Ka Restaurant) and a vacant lot; to the south Nee! Title and to the west single family residences (Del MarC Subdivision). North of the site are Wendy's and StripesNalero Gas Station. East of the site are Exxon, a Commercial Plaza with 5 Suites (Flooring Concept, Golden Hands, Sweet Spot, T-Mobile and New Nails), Junction Drive, Burger King, Danny's Restaurant, and Pepper Tree Plaza with 6 Suites (Tequila's, Design Klass, Pho I, Yes Nails, Rio Amusement, and Arza Construction) Rudy's and Discount Tire. South of the site are a vacant lot, Commerce Bank and Family Medicine Center. West of the site is a residential subdivision (Del Mar C).

Comprehensive Plan: The Future Land Use Map identifies this tract as Light Commercial.

Transportation Plan: The Long Range Thoroughfare Plan identifies McPherson Road as a Major Arterial and Del Mar Boulevard as a Modified Major Arterial. The Plan does not identify Merlin Road, or Welby Court.

Letters sent to surrounding property owners: 22 In Favor: 0 Opposed: 5 One(!) petition in favor, out of the 200'

STAFF COMMENTS .

The Laredo Land Development Code (Section 24.63: Permitted Uses) permits Bars in zones AE, B-4, M-1, M-2 andMXD. This property is currently zoned B-3(Community Business District) zoning district. The applicant is applying for a Conditional Use Permit. Section 24.94.5(A)(3): Conditional Use Permit Application Submittal Criteria state that, "Applications for properties currently zoned B-1, B-IR, CBD, B-3, or B-4, may only seek conditional status for those uses permitted by zones B-IR, CBD, B-3, B-4 or M-1 of higher intensity."

Staff does not support the issuance of the proposed CUP at this location for the following reasons:

I. The proposed CUP is not appropriate at this location because it is not compatible with the Comprehensive Plan's designation for the area as Light Commercial.

Staff Comments (cont.) 2. The proposed CUP location of Building B, Suite 510 does not comply with the distance requirement as per

Section 24.65 Supplementary Zoning District Regulation; 24.65.14 Highway Commercial District; (8) Night Clubs, Bars, Saloons, Cantinas, Billiard Parlors, or Carnivals when located 300 feet or more from an R District are permitted. Laredo Land Development Code Book. The proposed bar location is approximate 50'away from a very well established residential neighborhood (Del Mar C/RS zoning district). The proximity of the proposed parking for the entire project abuts Del Mar C, a single family residential neighborhood, which is only 5' between the proposed location and the RS (Residential Suburban District) zoning district.

3. The proposed CUP is not in conformance with the surrounded uses in the area, however the property abuts businesses that face the commercial corridor along McPherson Road.

Should the Commission recommend approval of the proposed CUP, staff suggests the following conditions:

1. The Conditional Use Permit is issued to Junction Partners, LTD and Encino Plaza LTD, and is non-transferable.

2. The Conditional Use Permit is restricted to 3,700 S.F. of area on Building B, Suite 510, as per the site plan, Exhibit "A", which is made part hereof for all purposes.

3. The Conditional Use Permit is restricted to a bar with hours of operation from Monday through Sunday from 11:00 a.m. through 12:00 midnight.

4. The establishment must make provisions to keep litter to a minimum, and to keep it from blowing onto adjacent streets and properties.

5. Signage shall be consistent with the City's Sign Ordinance and TABC rules or regulations. 6. Off-street parking shall be provided in accordance with the City of Laredo Land Development Code. 7. Outdoor music and speakers shall be prohibited and there shall be no ground vibrations created or

sustained on the site which are perceptible without instruments at any point on any property adjoining the subject property.

8. Off-site parking is prohibited. 9. Strobe lights, flashing lights, and any other outdoor lighting designed to attract attention are

prohibited. 10. The establishment shall not exceed the "Occupant Load" as set forth in the Certificate of Occupancy

with Occupant Load issued to SUP business holder. 11. The establishment shall, during all hours of operation, maintain, free from obstruction or

impediment to full instant use in the case of fire or other emergency, all exit accesses, exits or exit discharges.

12. The establishment shall undergo an annual Fire Inspection. 13. Owner shall comply with all permits, licenses, certifications and inspections required by the codes

and ordinances of the City of Laredo, and shall be kept up to date and current including but not limited to Food Manager License (annual), Food Handler's Permit (annual), and Certificate of Occupancy with Occupant Load, Occupant Load being the approved capacity of a building or portion thereof.

14. Landscaping of property shall be provided in accordance with the City of Laredo Land Development Code.

15. Lighting of property shall be screened to avoid adverse impact on adjacent residential neighborhoods.

16. Owner shall provide a 7' high opaque fence along property lines which abut or adjoin any residential zones/uses.

17. Owner shall comply with, Building, Health, Life and Safety, and all applicable codes and regulations as required.

Proposed Activities; A new bar that will also be serving food.

Hours of Operation: Restaurant will open from 11:00 AM to 12:00 AM Sunday through Thursday and from 11:00 AM until2:00 AM Friday and Saturdays (as permitted by the requested Conditional Use Permit zoning change).

Number of Employee: Full time 14 and part time 8 to 12 depending on holidays and times of the year.

Number ofVehides: There are a total of 202 parking spaces throughout the planned site for a proposed 30,000 s.f. of commercial space. As required by ordinance, there are enough required parking spaces throughout the planned retail and commercial development. (5x30=150)

Relevant Information: The Conditional Use Permit will be held by the owners of the building and developers of the 3 % acre site -Junction Partners, Inc. The permit will be only for use in that designated building. Plaza Encino has the best business demographics in Laredo for an area within a 1 ~ - 2 mile radius of the Del Mar & McPherson intersection.

Comprehensive Plan: The Future Land Use Map recognizes this area as Low Density Residential.

Transportation Plan: The Long Range Thoroughfare Plan does not identifY Green Street.

R-2 (Multi-Family Residential District): The purpose of the R-2 is to provide an area for higher density residential uses and those public and semi-public uses normally considered an integral part of the neighborhood they serve.

Is this change contrary to the established land use pattern? Yes, the established land use pattern is primarily low-density residential in nature.

Would this change create an isolated zoning district unrelated to surrounding districts? No, there are R-3 district adjacent to the East and across the street to the South.

Will change adversely influence living conditions in the neighborhood? Yes, the proposed district may introduce more intense uses into the area.

Are there substantial reasons why the property can not be used in accordance with existing zoning? Yes. The current R-1 district does not allow multi-family residential uses.

2. Trees shall be installed at the time of issuance of building permits in accordance with the Laredo land Development Code.

3. All curb cuts shall comply with the Transportation Element of the City of Laredo Comprehensive Plan.

4, · "The setback lines indicated on the plat shall be for refrence only. The official setback line shall be determined based on the current zoning district in accordance to Section 24.77.1 of the Laredo Land Development Code.·
