Motion for Summary Judgment in the motion picture/screenplay copyright infringement suit of Briggs v Neill Blomkamp, Sony Pictures, Media Rights Capital (MRC). At the center of this suit is the 2013 film "Elysium"," (starring Matt Damon and Jodie Foster), which the plaintiff alleges was derived from and infringes on his screenplay, Butterfly Driver -which he contends the Defendant(s) accessed while it was posted on Kevin Spacey's screenwriter and short filmmaker social network website, triggerstreet.com (Trigger Street). Ninth Circuit, District Court (Oakland, Northern Division).
The plaintiff, Briggs, alleges that “Elysium” infringes on the heart of his screenplay, “Butterfly Driver”, as well as its plot, usual settings (including the featured setting of a giant miles wide super satellite city for the ultra-rich, orbiting an impoverished Earth), characters (including a poor hero who suffers rare debilitating headaches, who must get to the giant satellite city for the rich to get medical aide to save his daughter), themes, conflict, catalyst, crisis, climax-twist, the hero’s unique “character-affiliation,” the hero’s “keepsake necklace”, more.
The Plaintiff contends the infringement meets or exceed the substantial similarity required for an infringement ruling in his favor, and may even meet or exceed the uncommon striking similarity standards.
