The Housing (Jersey) Law 1949 (the "Housing Law") was brought in to protect the limited
pool of accommodation available in Jersey. Along with the Regulation of Undertakings and Development (Jersey) Law 1973 (the "Regulation of Undertakings Law"), the Housing Law placed controls upon the population influx into the Island.
Regulation 1(1)(j) of the Housing Regulations states that housing consent can be granted if the Housing Minister "is satisfied that the intending purchaser, transferee or lessee either is, or will be, essentially employed in Jersey and that consent can, in the best interests of the community, be justified". it is these regulations which have enabled businesses in Jersey to bring individuals to the island who are essentially required to grow and develop their business as it provides those individuals with Housing qualifications to buy or lease property.
An individual granted a 'J' Category Housing consent (a "J Category Employee") is now entitled through a company owned by the individual (in the case of a purchase) or through a company owned by his employer (in the case of a lease) to buy or rent any property allocated for 'J' Category occupation by the Housing Minister. Prior to 2005 any purchase of property for occupation by a 'J' Category Employee had to be in the name of a company owned by his employer.
A 'J' Category Employee who chooses to buy a property must buy through a company which they incorporate and own. if they choose to rent, they must rent through a company owned by their employer if they work in the private sector. There then needs to be a licence between the employer and the employee in which the employee agrees to comply with the terms of the lease, not least to pay the rent.
Public sector employees are permitted to rent in their own name thus avoiding the complications in the private sector described above. it is hoped this anomaly in law will be rectified by the new Migration Law.
Time limited ConsentsThe Housing Minister has the power to impose conditions upon all Housing consents. One such condition which has been imposed from time to time upon 'J' Category Housing consents is a time limitation to that consent of, typically, 3 or 5 years. The purpose behind this time limitation was to ensure that businesses still take seriously their obligation to train local employees into the roles being granted 'J' Category housing consents and, in time, to reduce the number of such consents required by business. This has caused businesses difficulty over years as it is a 'hard sell' to an individual that they should up-root their family, sell their house in the UK to buy or rent a property in Jersey, only to be told in 3 or 5 years' time once the family has settled, that they must leave. 'J' Category consents unlimited in time are now granted by the Housing Minister and indeed a policy was published in 2006 stating that "time restricting 'J' category consents is no longer consistent with approved policy and law".
'J' Category Employee's Undertakingsif a 'J' Category Employee chooses to buy, they must provide an undertaking to the Housing Minister that they will sell the property if they cease to be employed in the role to which the 'J' Category consent relates.
in today's markets where houses may not sell so easily, it may be that a 'J' Category Employee losing their job (perhaps through redundancy) would have difficulty complying with this undertaking. it is hoped the Housing Minister would treat such individuals sympathetically.
Changes in lawThe Housing Law and the Housing Regulations are about to undergo a major overhaul with the new proposed Migration Law. Broadly speaking the system in place for granting essentially employed individuals housing rights will remain in the new Law. The Housing Minister will retain the right to grant time-limited consents and consents for individuals to rent and not buy property (although it is thought that this right is unlikely to be exercised other than in exceptional circumstances).
One important principle contained in the migration consultation document is a desire to enable businesses to operate, as a general principle, on a level playing field with competitors as regards the number of 'J' Category consents each business is permitted. A large business may be allocated a specified number of 'J' Category consents for a particular role and the business will then be free to allocate those consents to individuals who perform that role without the need to revert to the Housing Minister for consent on an individual basis each time.
