The Social Assessment conducted for PlDP in November 2006 found about 20 households on canal embankment and on the protection structures of the Tagugpo Intake of Lupon IS. During field validation, however, it was found that there are 67 households informal settlers on those locations and that some of these are IP - households especially on the protection structl-lres of the Tagugpo Intake.

Series of dialogues were conducted with .the informal settlers together with the IP scattered - households who are economic migrants in the site. Consulta,tion meetings were held with the LGUs (Barangays and Municipalities) and NCIP and requested for their assistance to resolve the problem. With their assistance, the informal settlers, including the IP - hol~seholds agreed on the cash value of unsalvageable construction materials as NIA assistance and that NIA will provide transport to haul the dismantled dwellings to their individually identified settlement area. The agreement was formalized thr1-l a Memorandum of Agreement which was executed between NIA and the informal settlers. The agreed cost is estimated at P405,770.00.

Although not required because the system does not overlap with an Ancestral Domain, thru the assistance also of the NCIP, a Certification of Precondition (a certificate of compliance to the FPlC Process and certification that the community has given its consent) to the proposed rehabilitation of Lupon IS was issued.

Lnst December, 2006 NIA-Lupon Irrigation System coordinated with the National Commission on rzdigmus Pooplo Provincial OfFice at Mati City, D m Oriental for the conduct of conaultativo assembly meetings with Indigenous People at the mbnicipalitiea of Lupon and Bannybanay.

On Janwy, 2006 bath NIA and NCIP ofllcials conducted coneultatian meetingn with the locd government offiobh of both Lupon and Bannybanay . Then, consultation meetinge with ths leaders of the Indigenous Peaple of Upon and Banaybanay wae conducted to yet far the poseible date1 and venues for tho coneultativo aewmbly meeting with all the indigenous people within tho rndcipaliti6s of Lupon and Bansybanay.

Theu, the NCIP oflicials conducted interviewe with the Irrigsbra AssocUona' leaders, several Xndigemus People in the watrtrahed aroa d suverd individual farmers witlrin the system h m the fourth week of January up to tho manth of February, 2007 to d ~ l 6 i n e thc cffectd of the proposed project of NIA under th4 Participatory Irrigation Development Project.

On Maroh,2007 two separate muitativo assembly meetings were conducted between NLA of8cials, NCll? &ciala, LOU officials, aad the Indigenous People of the municipalities ofLupon and Banaybaoay.

Fortunately, the Indigenou~ People had no demands excopt that the affected squatrars dong the upstream podan of the dam site of Lupan Irrigation System which are ako members of the h d i p o u a People shall be givan ausisitance tither in the form of cash or conehicticm matd& and ahall be provided with a dump truck for thc hauling of their demolished materials to their new settlement area.

After MA committed to provide the necessary assistance, NCIP afi ials oornrnilted to provide relevant data regarding tho consulfativrt aesembly meeting wc had conducred and the pmposod project of NIA under PlDP to the pmuincial govcament oftices concerned at Mati City, Davao Oriontal for their hfonnation rmd poeeible actions. In the advent of PIDP, all 9ffe~ted scctars within and orrtside of the project coverage area me required to ba known and could avail of fair treatateat m case of fiegal aquattms which b v a been there for quite 8 long time. Hence, a 8ettlemaU plan is hereby proposed far the attainment af aettling the irreue of squattm.

A. First Stage of Implementah

Last December, 2006 identification of squattere colony in the itma wtrt conducted to dewmine the number of houees, type and the degree of construction, lootaion, cost of atruciuree comtruoted, occupation of the occupants, and other relevant information.

Then we conducted s8vtral i n f d meetings andlor dJaIoguea with the squatters &om both the Municipalitiee of Banayhanay and Lupan to determine the length of lime they stay in the area and their individual &man&.

Nmt, wc conducted cmultatiw meeting8 with the barmgay officale md LGU aEiciple ooncarned d t h regards to their municipal settlement p h for these aquattcrs.After pseeentation of our program undur PDP aad aur settlement plan far the affected squatters we learned bat both the muni~ipalitiee ofLupon ad Banaybanay had no resettlement plan for the squatters and they did not havz any ~ommftmcnt for assistance for the &acted squatters.

B. Second Staga of Implementation

For the months of February to May, 2007 NIA info~mtd the affeoted squatters that their municipal and barangay offi~ials had no srcttlement plan for them. NIA informed them that NIA can pmvide them with assistance h the fonn of ash d o r in kind (Like ccment, reiru5orced steel bars, other cofl~truotion material8 and vehicles for the hauling of the demolished materials to their new resettlement ma

The legal &mands of the individual identified squatters were consolldatcd for the preparation of the program of works to be endorsed to the 1mdi.g institution for canfirmation.
