PENSIONS (40 ILCS 5/) Illinois Pension Code. ARTICLE 6. FIREMEN'S ANNUITY AND BENEFIT FUND‐‐CITIES OVER 500,000 Sec. 6101. Creation of fund. In each city of more than 500,000 inhabitants, a firemen's annuity and benefit fund shall be created, set apart, and maintained, for the benefit of its firemen, their widows, children and parents, and of all contributors to, participants in, and beneficiaries of any firemen's pension fund in operation, by authority of law, in such city immediately prior to the effective date. For the purposes of this Article, the firemen's annuity and benefit fund may be referred to as the "fund". (Source: Laws 1963, p. 161.) Sec. 6102. Terms defined. The terms used in this Article shall have the meanings ascribed to them in Sections 6‐103 to 6‐117, inclusive, except when the context otherwise requires. (Source: Laws 1963, p. 161.) Sec. 6103. Firemen's Annuity and Benefit Fund Act of the Illinois Municipal Code. "Firemen's Annuity and Benefit Fund Act of the Illinois Municipal Code": Division 9 of Article 10 of the Illinois Municipal Code, being a continuation of "An Act to provide for the creation, setting apart, maintenance and administration of a firemen's annuity and benefit fund in cities having a population exceeding five hundred thousand inhabitants", approved June 12, 1931, as amended. (Source: Laws 1963, p. 161.) Sec. 6104. Effective date. "Effective date": July 1, 1931, for any city covered by the "Firemen's Annuity and Benefit Fund of the Illinois Municipal Code" on the date this Article comes in effect; and the date thereafter that any other city first comes under the provisions of this Article. (Source: Laws 1963, p. 161.) Sec. 6105. Retirement board or board. "Retirement board" or "board": The board of trustees of the Firemen's Annuity and Benefit Fund. (Source: Laws 1963, p. 161.) Sec. 6106. Fireman. "Fireman": Any person who: (a) was, is, or shall be employed by a city in its fire service as a fireman, fire paramedic, fire engineer, marine engineer, or fire pilot, and whose duty is to participate in the work of controlling and extinguishing fire at the location of any such fire, whether or not he is assigned to fire service other than the actual extinguishing of fire; or (b) is employed in the fire service of a city on the effective date, whose duty shall not be as hereinbefore stated, but who shall then be a contributor to, participant in, or beneficiary of any firemen's pension fund in operation by authority of law in such city on said date, unless he applies to the retirement board, within 90 days from the effective date, for exemption from the provisions of this Article. Any person who would have been entitled on July 1, 1931 to

membershipinthisfundbyreasonofthedefinitionoftheword"fireman"containedin"AnActto provide for a firemen's pension fund and to create a board of trustees to administer saidfund in cities having a population exceeding two hundred thousand (200,000) inhabitants",filedJuly14,1917,asamended,whohasnotfiledwiththeboardpriortoJuly1,1941,awrittenapplicationtobeamembershallnotbeafiremanwithinthemeaningofthisArticle.(Source:P.A.83‐780.)Sec.6‐106.1.Gender.The masculine gender wherever used in this Article includes the female gender and allannuitiesandbenefitsapplicabletomalefiremenandtheirsurvivorsandthecontributionstobemadeforwidows'annuitiesorotherbenefitsshallapplywithequalforcetofemalefiremenandtheirsurvivorswithoutanymodificationordistinctionwhatsoever.(Source:P.A.80‐899.)Sec.6‐107.Presentemployee."Present employee": Any person employed by a city as a fireman on the day before theeffectivedate;alsoanyfiremanreceivingapensiononaccountofdisabilityfromanyfiremen'spensionfundinoperation,byauthorityof law, insuchcity immediatelypriortotheeffectivedate,whensuchfiremanrecoversfromthedisabilityandisreinstatedintoactiveservice.(Source:Laws1963,p.161.)Sec.6‐108.Futureentrant."Futureentrant":Anypersonemployedasafiremanofacityforthefirsttimeonoraftertheeffectivedate.(Source:Laws1963,p.161.)Sec.6‐109.Activefireman."Activefireman":Anypersonemployedandreceivingsalaryasafireman.(Source:P.A.78‐1242.)Sec.6‐110.Actofduty."Act of duty":Any act imposedon an active firemanby the ordinancesof a city, orby therulesorregulationsofitsfiredepartment,oranyactperformedbyanactivefiremanwhileonduty,havingforitsdirectpurposethesavingofthelifeorpropertyofanotherperson.(Source:Laws1963,p.161.)Sec.6‐111.Salary."Salary": Subject to Section 6‐211, the annual salary of a fireman, as follows:(a)Forageandserviceannuity,minimumannuity,anddisabilitybenefits,theactualamountoftheannualsalary,exceptasotherwiseprovidedinthisArticle.(b) For prior service annuity, widow's annuity, widow's prior service annuity and child'sannuitytoandincludingAugust31,1957,theamountoftheannualsalaryuptoamaximumof$3,000.(c) Except as otherwise provided in Section 6‐141.1, for widow's annuity, beginningSeptember1,1957,theamountofannualsalaryuptoamaximumof$6,000.(d)"Salary"meanstheactualamountoftheannualsalaryattachedtothepermanentcareerservicerankheldbythefireman,exceptasprovidedinsubsection(e).

(e) In the case of a fireman who holds an exempt position above career service rank:(1) For the purpose of computing employee and city contributions, "salary"means theactualsalaryattachedtotheexemptrankpositionheldbythefireman.(2)Forthepurposeofcomputingbenefits:"salary"meanstheactualsalaryattachedtotheexempt rank position held by the fireman, if (i) the contributions specified in Section 6‐211havebeenmade,(ii)thefiremanhasheldoneormoreexemptpositions for at least5 consecutive years andhasheld the rankof battalion chief orfieldofficerforatleast5yearsduringtheexemptperiod,and(iii)thefiremanwasbornbefore1955;otherwise,"salary"meansthesalaryattachedtothepermanentcareerservicerankheldbythefireman,asprovidedinsubsection(d).(f)BeginningontheeffectivedateofthisamendatoryActofthe93rdGeneralAssembly,andfor any prior periods for which contributions have been paid under subsection (g) of thisSection,allsalarypaymentsmadetoanyactiveorformerfiremanwhoholdsorpreviouslyheldthe permanent assigned position or classified career service rank, grade, or position ofambulancecommandershallbeincludedassalaryforallpurposesunderthisArticle.(g) Any active or former firemanwho held the permanent assigned position or classifiedcareer service rank, grade, or position of ambulance commandermay elect to have the fullamountofthesalaryattachedtothatpermanentassignedpositionorclassifiedcareerservicerank,grade,orposition included in thecalculationofhisorhersalary foranyperiodduringwhich the fireman held the permanent assigned position or classified career service rank,grade,orpositionofambulancecommanderbyapplying inwritingandmakingallemployeeand employer contributions, without interest, related to the actual salary paymentscorrespondingtothepermanentassignedpositionorclassifiedcareerservicerank,grade,orposition of ambulance commander for all periods beginning on or after January 1, 1995. Allapplicable contributionsmust be paid in full to the Fund before January 1, 2006 before thepaymentofanybenefitunderthissubsection(g)willbemade.Anyformerfiremanorwidowofafiremanwho(i)heldthepermanentassignedpositionorclassifiedcareerservicerank,grade,orpositionofambulancecommander,(ii)isinreceiptofannuity on the effective date of this amendatoryAct of the93rdGeneralAssembly, and (iii)paystotheFundcontributionsunderthissubsection(g)forsalarypaymentsatthepermanentassignedpositionorclassifiedcareerservicerank,grade,orpositionofambulancecommandershallhavehisorherannuityrecalculatedtoreflecttheambulancecommandersalaryandtheresulting increaseshallbecomepayableonthenextannuitypaymentdatefollowingthedatethecontributionisreceivedbytheFund.Inthecaseofanactiveorformerfiremanwho(i)diesbeforeJanuary1,2006withoutmakinganelectionunderthissubsectionand(ii)waseligibletomakeanelectionunderthissubsectionatthetimeofdeath(orwouldhavebeeneligiblehadthedeathoccurredaftertheeffectivedateofthisamendatoryAct),anysurvivingspouse,child,orparentofthefiremanwhoiseligibletoreceiveabenefitunderthisArticlebasedonthefireman'ssalarymaymakethatelectionandpaytherequiredcontributionsonbehalfofthedeceasedfireman.Ifthedeathoccurswithinthe30days immediatelypreceding January1,2006, thedeadline forapplicationandpayment isextendedtoJanuary31,2006.Anyportionofthecompensationreceivedforserviceasanambulancecommanderforwhichthecorrespondingcontributionshavenotbeenpaidshallnotbeincludedinthecalculationofsalary.(h)BeginningJanuary1,1999,withrespecttoafiremanwhois licensedbytheStateasanEmergencyMedicalTechnician,references inthisArticleto thefireman'ssalaryorthesalaryattached to or appropriated for the permanent assigned position or classified career servicerank,grade,orpositionofthefiremanshallbedeemedtoincludeanyadditionalcompensationpayable to the fireman by virtue of being licensed as an EmergencyMedical Technician, asprovidedunderacollectivebargainingagreementwiththecity.(i)BeginningontheeffectivedateofthisamendatoryActofthe93rdGeneralAssembly(andforanyperiodpriortothatdateforwhichcontributionshavebeenpaidundersubsection(j)ofthis Section), the salary of a fireman, as calculated for any purpose under this Article, shallincludeanydutyavailabilitypayreceivedbythefireman(i)pursuanttoacollectivebargaining

agreement or (ii) pursuant to an appropriation ordinance in an amount equivalent to theamountofdutyavailabilitypayreceivedbyotherfiremenpursuanttoacollectivebargainingagreement, and references in this Article to the salary attached to or appropriated for thepermanentassignedpositionorclassifiedcareerservicerank,grade,orpositionofthefiremanshallbedeemedtoincludethatdutyavailabilitypay.(j)AnactiveorformerfiremanwhoreceiveddutyavailabilitypayatanytimeafterDecember31,1994andbeforetheeffectivedateofthisamendatoryActofthe93rdGeneralAssemblyandwhoeither (1) retiredduring thatperiodor (2)hadattainedage46andat least16yearsofservicebytheeffectivedateofthisamendatoryActmayelecttohavethatdutyavailabilitypayincludedinthecalculationofhisorhersalaryforanyportionofthatperiodforwhichthepaywas received, by applying in writing and paying to the Fund, before January 1, 2006, thecorrespondingemployeecontribution,withoutinterest.In the case of an applicant who is receiving an annuity at the time the application andcontribution are received by the Fund, the annuity shall be recalculated and the resultingincrease shall become payable on the next annuity payment date following the date thecontributionisreceivedbytheFund.Inthecaseofanactiveorformerfiremanwho(i)diesbeforeJanuary1,2006withoutmakinganelectionunderthissubsectionand(ii)waseligibletomakeanelectionunderthissubsectionatthetimeofdeath(orwouldhavebeeneligiblehadthedeathoccurredaftertheeffectivedateofthisamendatoryAct),anysurvivingspouse,child,orparentofthefiremanwhoiseligibletoreceiveabenefitunderthisArticlebasedonthefireman'ssalarymaymakethatelectionandpaytherequiredcontributiononbehalfofthedeceasedfireman.Ifthedeathoccurswithinthe30days immediatelypreceding January1,2006, thedeadline forapplicationandpayment isextendedtoJanuary31,2006.Anydutyavailabilitypay forwhich thecorrespondingemployeecontributionhasnotbeenpaidshallnotbeincludedinthecalculationofsalary.(k)ThechangestothisSectionmadebythisamendatoryActofthe93rdGeneralAssemblyarenotlimitedtofiremeninserviceonoraftertheeffectivedateofthisamendatoryAct.(Source:P.A.93‐654,eff.1‐16‐04.)Sec.6‐112.Disability"Disability": A condition of physical ormental incapacity to perform any assigned duty ordutiesinthefireservice."Injury":Damagesufferedbyorhurtdonetoafireman."OccupationalDisease":Asickness,diseaseorillnessoftheheart,lungs,orrespiratorytractofa fireman,arisingsolelyoutofhisemploymentasa fireman,duetoexposurestoheatandextremecold,inhalationofheavysmoke,fumesorpoisonous,toxicorchemicalgaseswhileinthe performance of active duty in the fire department. "Occupational Disease" also includescancer.(Source:P.A.83‐661.)Sec.6‐113.Compulsoryretirement."Compulsoryretirement":Separationofafiremanfromtheserviceduetohisreachinganagesetbylaworordinancebeyondwhichthefiremanisprohibitedfromworkingasafireman.(Source:Laws1963,p.161.)Sec.6‐114.Withdrawal,withdrawalfromservice,orwithdrawnfromservice."Withdrawal", "withdrawal from service", or "withdrawn from service": The discharge,resignationorcompleteseparationfromserviceofafireman,otherthandeath.(Source:Laws1963,p.161.)

Sec.6‐115.Assets."Assets": The total value of cash, securities and other property. Bonds shall be valued atamortizedbookvalue.(Source:Laws1963,p.161.)Sec.6‐116.Annuity."Annuity":Annualpaymentsforlife,unlessotherwiseterminatedunderthisArticle,payablein12equalmonthlyinstallmentsbeginningonthefirstdayofthesecondmonthnextfollowingthedateoftheeventuponwhichpaymentofannuityshalldepend,shalloccurandsubsequentpayments tobedueandpayableon the firstdayofeachandeverymonth thereafter, exceptthatasmallerprorataamountshallbepaidforpartofamonthwhentheannuitybeginsafterthefirstdayofthemonthorendsbeforethelastdayofthemonth.(Source:Laws1963,p.161.)Sec.6‐117.Presentvalue."Present value": The amount of money needed to provide an annuity or benefit at somefuturedatecomputedaccordingtotheapplicablemortalityandinteresttables.(Source:Laws1963,p.161.)Sec.6‐118.Priorserviceannuity."PriorServiceAnnuity"shallbecreditedforpresentemployeesforservicerenderedpriortotheeffectivedateinaccordancewiththeprovisionsofthe"Firemen'sAnnuityandBenefitFundAct of the Illinois Municipal Code" and this Article. Each such credit shall be improved byinterestuntiltheamountofannuitytowhichanemployeehasarightisfixed.Indeterminingsuchannuity,theannualsalaryfortheentireperiodoftheemployee'sservicepriortotheeffectivedateshallbethesalaryineffectontheeffectivedate,butnotinexcessof$3,000peryear.(Source:Laws1963,p.161.)Sec.6‐119.Ageandserviceannuity."Age and Service Annuity" shall be provided firemen for service rendered on or after theeffectivedate.(Source:Laws1963,p.161.)Sec.6‐120.Presentemployees limitation toandamountofpriorserviceannuities incertaincases.Apresentemployee,whohasacrediton theeffectivedate, forpriorserviceannuity,ofanamountsufficienttoprovideannuityasofhisageonsuchdateequaltothattowhichhewouldhavehadaright ifemployeecontributionsandcitycontributionshadbeenmadeforageandserviceannuityduringhis entire serviceuntil his attainmentof age57, is entitled to apriorserviceannuity from thedatehewithdraws fromservice, fixedasofhisageon theeffectivedate,ofsuchamountascanbeprovidedbyhiscreditforthispurposeontheeffectivedate.Anysuchpresentemployeehasnorighttoreceiveageandserviceannuity.(Source:P.A.81‐1536.)Sec.6‐121.Presentemployees‐Age57inservice‐Amountofannuity. contributionsandcitycontributionshadbeenmadeinaccordancewiththisArticleduringhisentireperiodofserviceuntilheattainedage57,isentitledtoanageandserviceannuityandpriorserviceannuityfromthedatehewithdrawsfromservice,fixedasofhisageonthedatewhenhehas tohiscredit suchsums;suchannuitiesshallbe theamountsprovided fromtheentire sum accumulated to his credit for age and service annuity and prior service annuitypurposesonsuchdateoffixing.(b)Apresentemployeewhoattainsage57ormorewhileinserviceandwhohasnottohiscreditforageandserviceannuityandpriorserviceannuitytheamountdescribedinparagraph(a) above, is entitled on the date of hiswithdrawal to an age and service annuity and priorserviceannuityfixedasofhisageonthedateofwithdrawaloftheamountprovidedfromtheentiresumaccumulatedtohiscreditforageandserviceannuityandpriorserviceannuityonsuchdateofwithdrawal.(Source:P.A.81‐1536.)

Sec.6‐122.Presentemployees‐Age50butlessthan57inservice‐Age50outofservice‐Amountofannuity.Apresentemployeewho(1)attainsage50ormorebutlessthan57whileinservice,having10ormoreyearsofserviceatthedateofwithdrawalor(2)withdrawswith10ormoreyearsofservicebeforeage50andthereafterattainsage50whileoutofservice,isentitledtoanageandserviceannuityandpriorserviceannuityfromthedateofwithdrawalorafterattainmentof age 50, as the case may be, fixed as of his age at the date of withdrawal, or at age 50,respectively,insuchamountascanbeprovidedfromthetotalofthefollowing:(1)Ifserviceis20ormoreyears,theentiresumaccumulatedtohiscreditforageandserviceannuityandpriorserviceannuity;or(2) If service is 10 or more but less than 20 years, (a) the sum provided from the sumaccumulatedtohiscredit forageandserviceannuityfromsalarydeductions,(b)1/10ofthesumaccumulated tohis credit for suchpurposes from the contributionsby the city for eachcompletedyearofserviceafterthefirst10years,(c)thesumcreditedforpriorserviceannuityfrom employee contributions and applied to any firemen's pension fund in operation, byauthorityof law in the cityon theeffectivedate, and (d)1/10of the credit forprior serviceannuity,inaccordancewith"Firemen'sAnnuityandBenefitFundActoftheIllinoisMunicipalCode",foreachcompletedyearofserviceafterthefirst10years.TheannuityprovidedinthisSectionforanemployeewhoattainsage50outofserviceshallbecomputedasthoughtheemployeewereexactlyage50atthetimeitisgranted,regardlessofhisactualageatthetimeofhisapplicationtherefor,andnosuchemployeehasanyrighttoanyannuityonaccountofanytimebetweenthedateheattainsage50andthedateofapplicationfor annuity, nor shall any annuity be payable if the employee has received a refund ofcontributions.Annuity in excess of that fixed by this Section shall not be granted unless the employeereenters the service before age 57. If such re‐entry occurs, his annuity shall be provided inaccordancewiththissectionorSection6‐121,whicheverisapplicable.(Source:P.A.81‐1536.)Sec.6‐123.Minimumamountofannuityofpresentemployee.Anypresentemployeewhowithdrawsonoraftertheeffectivedate,havingatleast20yearsofservice,andforwhomtheannuityotherwiseprovidedinthisArticleislessthantheamountstatedinthissection,hasarighttoannuityasfollows:Ifheisat leastage50onwithdrawal,hisannuity, fromandaftersuchwithdrawal,shallbe50%ofhissalaryonthedayoneyearpriortosuchdate.Ifheislessthanage50onwithdrawal,hisannuity,afterthedatehebecomesage50,shallbe50%ofhissalaryonthedayoneyearpriortothedateofhiswithdrawal.AnysuchemployeewhoremainsinserviceafterqualifyingforannuityunderthissectionorSection10‐9‐53oftheFiremen'sAnnuityandBenefitFundoftheIllinoisMunicipalCode,shall

Theannuityshallbecomputedasthoughtheemployeewereexactlyage50whentheannuityisgrantedregardlessofhisageat thetimeofapplication.Nosuchemployeehasanyrighttoannuityforanytimebetweenthedateheattainsage50andthedatehemakesapplication,norshallanyannuitybepayableifhehasreceivedarefundofcontributions.(Source:P.A.81‐1536.)Sec.6‐127.Futureentrants‐Re‐entryandnewfixation.Exceptasmaybeotherwiseprovided in thisArticle,noamountofannuityother than thatfixed in accordance with Sections 6‐125 and 6‐126 shall be granted to any future entranttherein described unless he re‐enters the service before age 63. Sec.6‐128.3.Minimumwidow'sannuities.(a) Notwithstanding any other provision of this Article, beginning January 1, 1988, theminimumwidow'sannuitypayabletoanypersonwhoisentitledtoreceiveawidow'sannuityunderthisArticleshallbe$325permonth.(b) This Section shall apply to all persons receiving awidow's annuity under this Article,without regard to whether the death or retirement of the fireman occurred prior to theeffectivedateofthisamendatoryAct(P.A.86‐272).(Source:P.A.86‐272;86‐1028.)Sec.6‐128.4.Minimumwidow'sannuities.(a) Notwithstanding any other provision of this Article, beginning January 1, 1996, theminimum amount of widow's annuity payable to any person who is entitled to receive awidow'sannuityunderthisArticleis$700permonth,withoutregardtowhetherthedeceasedfiremanisinserviceonoraftertheeffectivedateofthisamendatoryActof1995.(b) Notwithstanding Section 6‐128.3, beginning January 1, 1994, the minimum widow'sannuity under this Article shall be $700 per month for (1) all persons receiving widow'sannuitiesonthatdatewhoaresurvivorsofemployeeswhoretiredatage50oroverwithatleast20yearsofservice,and(2)personswhobecomeeligible forwidow'sannuitiesandaresurvivorsofemployeeswhoretiredatage50oroverwithatleast20yearsofservice.(c) Notwithstanding Section 6‐128.3, beginning January 1, 1999, the minimum widow'sannuity under this Article shall be $800 per month for (1) all persons receiving widow'sannuitiesonthatdatewhoaresurvivorsofemployeeswhoretiredatage50oroverwithatleast20yearsofservice,and(2)personswhobecomeeligible forwidow'sannuitiesandaresurvivorsofemployeeswhoretiredatage50oroverwithatleast20yearsofservice.(d) Notwithstanding Section 6‐128.3, beginning January 1, 2004, the minimum widow'sannuityunderthisArticleshallbe$900permonthforallpersonsreceivingwidow'sannuitiesonorafterthatdate,withoutregardtowhetherthedeceasedfiremanisinserviceonoraftertheeffectivedateofthisamendatoryActofthe93rdGeneralAssembly.(e) Notwithstanding Section 6‐128.3, beginning January 1, 2005, the minimum widow'sannuity under this Article shall be $1,000 per month for all persons receiving widow'sannuitiesonorafterthatdate,withoutregardtowhetherthedeceasedfiremanisinserviceonoraftertheeffectivedateofthisamendatoryActofthe93rdGeneralAssembly.(Source:P.A.93‐654,eff.1‐16‐04.)Sec.6‐129.Widow'spriorserviceannuity."Widow'sPriorServiceAnnuity"shallbecreditedforthewidowofamalepresentemployeeforserviceprior to theeffectivedate, inaccordancewith the"Firemen'sAnnuityandBenefitFundActoftheIllinoisMunicipalCode"andthisArticle.Forapresentemployee in serviceonAugust31,1957,andunderage57on thatdate, theannuity so provided shall be improved by interest at 4% per year during his subsequentservice.ForapresentemployeeintheserviceonAugust31,1957,andoverage57onthatdate,the annuity so provided shall be improved by interest at such rate in themanner stated inSection6‐132ofthisArticle.(Source:Laws1963,p.161.)Sec.6‐130.Widow'sannuity."Widow'sAnnuity"shallbeprovidedforthewidowsoffiremenforserviceaftertheeffectivedate.(Source:Laws1963,p.161.)

hereinprovidedshallnotbepaid;norshallsuchannuitiesbepaidunlessthewidowwasthewifeofthefiremanatthetimeoftheactoractsofdutywhichresultedinhisdeath.(b)ThechangesmadetothisSectionbythisamendatoryActofthe92ndGeneralAssemblyapplywithoutregardtowhetherthedeceasedfiremanwasinserviceonoraftertheeffectivedateofthisamendatoryAct.InthecaseofawidowreceivinganannuityunderthisSectionthathas been reduced to 40% of current salary because the fireman, had he lived, would haveattained the age prescribed for compulsory retirement, the annuity shall be restored to theamount provided in subsection (a), with the increase beginning to accrue on the later ofJanuary1,2001orthedaytheannuityfirstbecamepayable.(Source:P.A.92‐50,eff.7‐12‐01.)Sec.6‐141.Minimumwidow'sannuitiesafterJuly1,1935‐Widowofpensionerunderprioract.WhenevertheannuityunderanyprovisionofthisArticleforawidowofafiremandescribedinthissectionislessthan$45permonth,thefollowingdescribedwidowsshallreceive$45permonthafterJuly1,1935,orafterthedeathofthefiremanifsuchdeathoccursonorafterJuly1,1935,andpriortoJuly1,1969,and$100permonthif thedeathofthefiremanoccursonorafterJuly1,1969,andfromandafterAugust19,1971aminimumwidow'sannuityof$150permonthtoJuly1,1975,$175amonthafterJuly1,1975andbeforeJanuary1,1976,and$200amonthafterJanuary1,1976andbeforeJuly1,1981,and$250amonthbeginningJuly1,1981,shallbepaidtoallwidowshereinafterdescribed,withoutregardtothefactthatthedeathofthe fireman occurred before the applicableminimum ratewas established by law, providedthat the $175 amonth or $200 amonth or $250 amonthminimum rates apply only in theeventthefiremanhadatleast10yearsofservicecreditathisdateofdeathintheservice:(a)thewidowofafiremanwhodiesinservice;(b)thewidowofafiremanwhowithdrawsafter20ormoreyearsofserviceandwhoentersuponannuityafterage50ormore,provided,thatthewidowismarriedtothefiremanbeforehewithdrawsfromservice;(c)thewidowofafiremanwhohasserved20ormoreyearsandwhowithdrawsfromservicebeforeage50andwhodiesbeforeheentersuponanannuity,provided,thatthewidowismarriedtothefiremanbeforehewithdrawsfromservice.The widow of a fireman who was receiving a pension under "An Act to provide for afiremen'spensionfundandtocreateaboardoftrusteestoadministersaidfundincitieshavinga population exceeding two hundred thousand (200,000) inhabitants", in force July 1, 1917,shallbepaidapensionof$45permonth.Suchpension,however,shallnotbeallowed if thewidowmarriedthefiremanpensionersubsequenttothedateofhisretirementwithapensionundersaidActandafterJune30,1915.ThewidowofafiremanwhoretiresfromserviceafterDecember31,1975orwhodieswhileinserviceafterDecember31,1975andonorafter thedateonwhichhebecomeseligible toretireunderSection6‐128shall, if she isotherwiseeligible forawidow'sannuityunder thisArticle and if the amount determined under this Section is more than the total combinedamounts of her widow's annuity andwidow's prior service annuity, receive, in lieu of suchotherwidow'sannuityandwidow'spriorserviceannuity,awidow'sannuityequalto40%ofthe amount of annuity which her deceased fireman husband received as of the date of hisretirement on annuity or if he dies in the service prior to retirement on annuity awidow'sannuityequalto40%oftheamountofannuityherdeceasedfiremanhusbandwouldhavebeenentitledtoreceiveifhehadretiredonthedaybeforethedateofhisdeathintheservice,exceptthatiftheageofthewifeatdateofretirementortheageofthewidowatdateofdeathintheservice ismore than5yearsyounger thanher firemanhusband, theamountof suchannuityshallbereducedby1/2of1%foreachsuchmonthandfractionthereofthatsheismorethan5yearsyoungeratdateofretirementoratdateofdeathsubjecttoamaximumreductionof50%.However,noannuityunderthisSectionshallexceed$500.00permonth.This Section does not apply to the widow of any former fireman who was receiving anannuityfromthefundonDecember31,1975andwhore‐entersserviceasafireman,unlessherendersatleast3yearsofadditionalserviceafterre‐entry.(Source:P.A.82‐342.)

Sec.6‐141.1.Minimumwidow'sannuitiesafterJuly1,1935‐Widowofpensionerunderprioract.(a)NotwithstandingtheotherprovisionsofthisArticle,thewidowofafiremanwhodiesonorafterJune30,1984,whilereceivingaretirementannuityorwhileanactivefiremanwithatleast 1 1/2 years of creditable service, may elect to have the amount of widow's annuitycalculatedinaccordancewiththisSection.(b)Ifthedeceasedfiremanwasanactivefiremanatthetimeofhisdeathandhadatleast11/2 years of creditable service, the widow's annuity shall be the greater of (1) 30% of thesalaryattachedtotherankoffirstclassfirefighterintheclassifiedcareerserviceatthetimeofthe fireman'sdeath, or (2)50%of the retirement annuity thedeceased firemanwouldhavebeeneligibletoreceiveifhehadretiredfromserviceonthedaybeforehisdeath.(c) If thedeceasedfiremanwasreceivingaretirementannuityatthetimeofhisdeath, thewidow'sannuityshallbeequalto50%oftheamountofsuchretirementannuityatthetimeofthefireman'sdeath.(Source:P.A.84‐11.)Sec.6‐141.2.Minimumannuityforcertainwidows.Notwithstanding the other provisions of this Article, the widow's annuity payable to thewidowofafiremanwhodiesonorafterJuly1,1997whileanactivefiremanwithatleast10years of creditable service shall be no less than 50% of the retirement annuity that thedeceasedfiremanwouldhavebeeneligibletoreceiveifhehadattainedage50and20yearsofserviceonthedaybeforehisdeathandretiredon thatday. In thecaseofawidow'sannuitythatispayableontheeffectivedateofthisamendatoryActofthe93rdGeneralAssembly,theincreaseprovidedbythisSection,ifany,shallbegintoaccrueonthefirstannuitypaymentdatefollowingthateffectivedate.(Source:P.A.93‐654,eff.1‐16‐04.)Sec.6‐142.Wivesandwidowsnotentitledtoannuities.(A) Except as provided in subsection (B), the followingwives orwidows have no right toannuityfromthefund:(a) Awife orwidowmarried subsequent to the effective date of a firemanwho dies inserviceifshewasnotmarriedtohimbeforeheattainedage63;(b)Awifeorwidowofafiremanwhowithdraws,whetherornotheentersuponannuity,anddieswhileoutofservice,ifthemarriageoccurredaftertheeffectivedateandshewasnothiswifewhilehewasinserviceandbeforeheattainedage63;(c) Awife orwidow of a firemanwho (1) has served 10 ormore years, (2) dies out ofserviceafterhehaswithdrawnfromservice,and(3)haswithdrawnorapplied forrefundofthesumstohiscreditforannuitytowhichhehadarighttorefund;(d)Awifeorwidowofafiremanwhodiesoutofserviceafterhehaswithdrawnbeforeage63,andwhohasnotservedatleast10years;(e) A wife whose marriage was dissolved or widow of a fireman whose judgment ofdissolution of marriage from her fireman husband is annulled, vacated or set aside byproceedingsincourtsubsequenttothedeathofthefireman,unless(1)suchproceedingsarefiledwithin5yearsafterthedateofthedissolutionofmarriageandwithinoneyearafterthedeathofthefiremanand(2)theboardismadeapartytotheproceedings;(f)Awifeorwidowwhomarriedthefiremanwhilehewasinreceiptofdisabilitybenefitordisabilitypensionfromthisfund,unlesshereturnedtotheservicesubsequenttothemarriageandremainedthereinforaperiodorperiodsaggregatingoneyear,ordiedwhileinservice.(B) Beginning on January 16, 2004, the limitation on marriage after withdrawal undersubdivision(A)(b)andthelimitationonmarriageduringdisabilityundersubdivision(A)(f)nolonger apply to a widow who was married to the deceased fireman for at least one yearimmediately preceding the date of death, regardless of whether the deceased fireman is inserviceonoraftertheeffectivedateofPublicAct93‐654orthisamendatoryActofthe93rd

GeneralAssembly; except that this subsection (B)doesnot apply to thewidowof a firemanwho received a refundof contributions forwidow's annuityunder Section6‐160, unless therefund isrepaid to theFund,with interestat therateof4%peryear,compoundedannually,fromthedateoftherefundtothedateofrepayment.IfthewidowofafiremanwhodiedbeforeJanuary16,2004becomeseligibleforawidow'sannuity because of Public Act 93‐654, the annuity shall begin to accrue on the date ofapplicationfortheannuity,butinnoeventsoonerthanJanuary16,2004.ThechangestothisSectionmadebythisamendatoryActofthe93rdGeneralAssemblyapplywithoutregardtowhetherthedeceasedfiremanwasinserviceonorafteritseffectivedate.IfthewidowofafiremanwhodiedbeforetheeffectivedateofthisamendatoryActofthe93rdGeneralAssemblybecomeseligibleforawidow'sannuitybecauseofthisamendatoryAct,theannuityshallbegintoaccrueonthedateofapplicationfortheannuity,butinnoeventsoonerthanJanuary16,2004.(Source:P.A.93‐654,eff.1‐16‐04;93‐917,eff.8‐12‐04.)Sec.6‐143.Widow'sremarriage.(a)Beginningon theeffectivedateof thisamendatoryActof the93rdGeneralAssembly,awidow'sannuityshallnolongerbesubjecttoterminationorsuspensionunderthisSectionduetoremarriage.Anywidow'sannuitythatwaspreviouslyterminatedorsuspendedunderthisSection by reason of remarriage shall, upon application, be resumed as of the date of theapplication, but in no event sooner than the effective date of this amendatory Act. Theresumptionshallnotberetroactive.Thissubsection (a)applies regardlessofwhetherornotthedeceasedfiremanwasinserviceonoraftertheeffectivedateofthisamendatoryAct.(b)Thissubsection(b)doesnotapplyonoraftertheeffectivedateofthisamendatoryActofthe93rdGeneralAssembly.Any annuity granted to a widow who remarries on or after December 31, 1989 shall besuspendedwhensheremarries,unless(i)sheremarriesafterattainingtheageof60regardlessofwhether or not the deceased firemanwas in service on or after the effective date of thisamendatoryActof1995or(ii)shehasbeengrantedaSection6‐140annuityasthewidowofafireman killed in performance of duty. An annuity suspended under this Section shall, uponapplication, be resumed if the subsequent marriage ends by dissolution of marriage,declarationofinvalidityofmarriage,orthedeathofthehusband;thisresumptionshallnotberetroactive.Ifawidowremarriesafterattainingage60oraftershehasbeengrantedanannuityunderSection6‐140andtheremarriagetakesplaceafterDecember31,1989,regardlessofwhetherornotthedeceasedfiremanwasinserviceonoraftertheeffectivedateofthisamendatoryActof1995,thewidow'sannuityshallcontinuewithoutinterruption.Any widow's annuity that was previously terminated by reason of remarriage prior toDecember 31, 1989 or suspended shall, upon application, be resumed, as of the date of theapplication, if the subsequent marriage ended by dissolution of marriage, declaration ofinvalidityofmarriage,orthedeathofthehusband,regardlessofwhetherornotthedeceasedfiremanwas inserviceon theeffectivedateof thisamendatoryActof1995; thisresumptionshallnotberetroactive.Whenawidowdies,ifshehasnotreceived,intheformofanannuity,anamountequaltotheaccumulated employee contributions for widow's annuity, the difference between suchaccumulated contributions and the sum received by her, along with any part of theaccumulatedcontributionsforageandserviceannuityremaininginthefundatherdeath,shallberefundedtothefireman'schildren,inequalpartstoeach;exceptthatifachildislessthanage 18, the part of any such amount that is required to pay an annuity to the child shall betransferred to the child's annuity reserve. If no children or descendants thereof survive thefireman, the refund shall be paid to the estate of the fireman. Sec.6‐143.1.Pensionstosurvivorsoffemalefiremen.Allprovisionsof thisArticle relating toannuitiesorbenefits toawidow,childrenorothersurvivorsofamalefiremanshallapplywithequalforcetoasurvivingspouse,childrenorothersurvivorsofafemalefireman.(Source:P.A.80‐899.)Sec.6‐143.2.Widows‐doubleannuity.Ifanywidow(1)receivesawidow'sannuityfromtheFund,and(2)afterDecember31,1989marries a firemanwho is a participant in this Fund, and (3) the fireman dies and a secondwidow'sannuitytherebybecomespayable,thenthefirstwidow'sannuityshallbecancelledatthe time the widow accepts any payment of the second widow's annuity. Any refund duebecauseofthecancelledannuityshallbepaidtothewidow.(Source:P.A.86‐1488.)Sec.6‐144.Maximumannuitiespermitted.Noannuityinexcessof75%ofthehighestsalaryreceivedbythefiremanconcernedshallbegrantedorpaidtohimexcepttotheextentthattheannuitymayexceedsuch75%undertheprovisionsofSection6‐164ofthisArticle.(Source:P.A.77‐1353.)Sec.6‐145.Mortalitytablesandinterestrates.AnyannuityfixedfororgrantedtoapresentemployeeorfutureentrantwhoenteredservicepriortoJuly1,1953,ortohiswidow,shallbecomputedaccordingtotheAmericanExperienceTableofMortality.TherateofinteresttobeusedforallpurposesofthisArticleonaccountofsuchpersonsshallbe4%perannum.Annuities for future entrants entering service after June 30, 1953, and for widows andpersonshavingarighttoannuitiesorbenefitsthroughsuchfutureentrants,shallbecomputedaccording to theCombinedAnnuityMortalityTable, ratedback4 years for female lives.Therate of interest for all purposes of this Article on account of such future entrants and theirbeneficiariesshallbe3%perannum.Allsumstothecreditofafiremanforannuitypurposesatthetimehewithdrawsbeforeage50shallbeimprovedtohiscreditthereafterbyinterestwhileheisoutofserviceandhasnotentereduponannuityuntilheattainsage57.Such interest shallbe4%perannum ifhe isapresent employee or a future entrantwho entered service prior to July 1, 1953, or 3% perannumifheisafutureentrantwhoentersserviceafterJune30,1953.Anyannuityfixedfororgranted to such employeeswho entered service prior to July 1, 1953, andwhohavenot re‐enteredtheservicepriortothetimesuchannuityisfixedorgranted,oranyannuityfixedfororgranted to a widow of any such employee shall be computed according to the AmericanExperience Table of Mortality with interest at 4% per annum, and any annuity fixed for orgranted to any such future entrantwho entered service subsequent to June 30, 1953 or hiswidow shall be computed according to the Combined AnnuityMortality Table rated back 4yearsforfemalelivesandwithinterestat3%perannum.Theamountofwidow'sannuityorwidow'spriorserviceannuitywhichshallbefixedforthewifeofa firemanwhilehe isaliveshallbeareversionaryannuitycomputedaccordingtotheapplicabletableofmortality.(Source:Laws1963,p.161.)Sec.6‐146.Termannuities‐Howcomputed.Wheneverthesumtoafireman'screditforanannuitytohimorhiswidowisinsufficienttoprovidea lifeannuityof$25permonth toeitherof them,a termannuityof suchamountofequal actuarial value shall be payable for the period of time established as the termperiod.Suchannuityshallceaseupondeathpriortotheendofthetermperiod.(Source:Laws1963,p.161.)

Sec.6‐147.Child'sannuity.A"Child'sAnnuity"shallbeprovidedforunmarriednaturaloradoptedchildrenof firemenpayablemonthly from the date of death of the fireman parent of a child until the annuitantattainsage18.(Source:Laws1963,p.161.)Sec.6‐148.Child’sannuity;conditions,amount.Achild'sannuity,shallbepaidforthebenefitofanyunmarriedchild,lessthanage18,ofanyfollowingdescribedfiremen:(a) A firemanwhose death results from the performance of any act or acts of duty; (b) afiremanwhodiesinservicefromanycause;(c)afiremanwhowithdrawssubsequenttoage50andwhoentersuponor iseligible forannuity; and(d)a firemanhavingat least20yearsofservicewhowithdrawsanddiesbeforeheentersuponannuity.TheannuityshallbepaidwithoutregardtothefactthatthedeathofthedeceasedfiremanparentmayhaveoccurredpriortotheeffectivedateofthisamendatoryActandshallbepaidmonthly in an amount equal to 15% of the current annualmaximum salary attached to theclassifiedcivilservicepositionoffirefighterifnowidowsurvivesand10%ofsuchsalarywhilethe widow survives and no age limitation in this Section shall apply to a child who is sophysicallyormentallyhandicappedas tobeunabletosupporthimself;provided, ifannuitiesforthewidowandchildrenofafiremanwhodiesonoraftertheeffectivedateandwhosedeathhasbeentheresultofanactoractsofdutyperformedonoraftersaiddate,orforthechildreninanysuchcasewhereinawidowshallnotexist, computedat therateshereinbeforestated,wouldexceedthefinalannualsalaryofafirstclassfireman,(onewhoreceivesmaximumsalaryforclassifiedcivilservicerankoffirefighter),theannuityforeachchildshallbereducedproratasothatthecombinedannuitiesforthefamilyofthefiremanshallnotexceedsuchamount;andinthecaseofthefamilyofafiremanwhodiesonoraftersaiddateandwhosedeathistheresultofanycauseorcausesotherthaninjuryincurredintheperformanceofanactoractsofduty in which annuities for such family, computed at the rates hereinbefore stated wouldexceed60%ofthefinalannualsalaryofafirstclassfireman,theannuityofeachchildshallbereducedproratasothatthecombinedannuitiesforthefamilydonotexceedsuchlimitation.Child's annuity shall be paid to the parent who is providing for the child, unless anotherpersonisappointedbyacourtoflawasthechild'sguardian.(Source:P.A.95‐279,eff.1‐1‐08.)Sec.6‐149.Parent’sAnnuity."Parent'sAnnuity"shallbeprovidedforthenaturalparentorparentsofafiremanwhodiesonoraftertheeffectivedatewhileinactiveservice,orisdisabledandinreceiptoforpendingreceiptofdisabilitybenefit,oruponleaveofabsencewithwholeorpartpay,oruponleaveofabsencewithoutpayduringaperiodofnotmorethan3monthsintheaggregate,orinreceiptofannuitygrantedafter20yearsofservice,orwhileoutoftheserviceafter20yearsofserviceandpendingreceiptofannuitytowhichthefiremanhasarightuponattainmentofage50ormore;provided,thatatthetimeofthefireman'sdeath,nowidoworunmarriedchildunder18yearsofageentitledtoannuitysurviveshim;and,providedfurther,thatsatisfactoryproofshallbemadetotheboardthatthefiremanwascontributingtothesupportofhisparentorparents.Parent'sannuityshallbe18%ofthecurrentannualsalaryattachedtotheclassifiedpositionheldbythefiremanat thetimeofhisdeathorretirementandeachsurvivingparentshallbeentitledtoreceivesaid18%annuityonamonthlybasis.(Source:P.A.77‐1359.)Sec.6‐150.DeathBenefit.(a)EffectiveJanuary1,1962,anordinarydeathbenefitshallbepayableonaccountofanyfireman in service and in receipt of salary on or after such date, which benefit shall be in

additiontoallotherannuitiesandbenefitshereinprovided.Thisbenefitshallbepayableupondeathofafireman:(1)occurringinactiveservicewhileinreceiptofsalary;(2)onanauthorizedandapprovedleaveofabsence,withoutsalary,beginning on or after January 1, 1962, if the death occurswithin 60 days from the date thefiremanwasinreceiptofsalary; (3) receiving duty, occupational disease, or ordinary disability benefit;(4)occurringwithin60daysfromthedateofterminationofdutydisability,occupationaldisease disability or ordinary disability benefit payments if re‐entry into service had notoccurred; (5) occurring on retirement andwhile in receipt of an age and service, prior serviceannuity orminimum annuity; provided (a) retirement on such annuity occurred on or afterJanuary1,1962,and(b)suchseparation fromservicewaseffectiveonorafter the fireman'sattainment of age 50, and (c) application for such annuity was made within 60 days afterseparationfromservice.(b)The ordinarydeathbenefit shall be payable to suchbeneficiary or beneficiaries as thefiremanhasnominatedbywrittendirectionduly signedandacknowledgedbeforeanofficerauthorizedtotakeacknowledgments,andfiledwiththeboard.Ifnosuchwrittendirectionhasbeenfiledorifthedesignatedbeneficiariesdonotsurvivethefireman,paymentofthebenefitshallbemadetohisestate.(c) Beginning July 1, 1983, if death occurs prior to retirement on annuity and before thefireman'sattainmentofage50,theamountofthebenefitpayableshallbe$12,000.BeginningJuly1,1983,ifdeathoccurspriortoretirement,atage50orover,thebenefitof$12,000shallbe reduced $400 for each year (commencing on the fireman's attainment of age 50 andthereafteroneachsucceedingbirthdate)thatthefireman'sage,atdateofdeath,ismorethanage49,butinnoeventbelowtheamountof$6,000.BeginningJuly1,1983,ifthefireman'sdeathoccurswhileheisinreceiptofanannuity,thebenefitshallbe$6,000.(Source:P.A.83‐152.)Sec.6‐151.Dutydisabilitybenefit;child’sdisabilitybenefit.Anactivefiremanwhoisorbecomesdisabledonoraftertheeffectivedateastheresultofaspecificinjury,orofcumulativeinjuries,orofspecificsicknessincurredinorresultingfromanactoractsofduty,shallhavetherighttoreceivedutydisabilitybenefitduringanyperiodofsuchdisabilityforwhichhedoesnotreceiveorhavearighttoreceivesalary,equalto75%ofhis salary at the time thedisability is allowed.However, beginning January1, 1994,nodutydisability benefit that has beenpayable under this Section for at least 10 years shall be lessthan50%ofthecurrentsalaryattachedfromtimetotimetotherankandgradeheldbythefireman at the time of his removal from theDepartment payroll, regardless ofwhether thatremovaloccurredbeforetheeffectivedateofthisamendatoryActof1993.Whenever an active fireman is or becomes so injured or sick, as to require medical orhospitalattention, thechiefofficerof the firedepartmentof thecityshall file,orcause tobefiled, with the board a report of the nature and cause of his disability, together with thecertificate or report of the physician attending or treating, or who attended or treated thefireman,andacopyofanyhospitalrecordconcerningthedisability.Anyinjuryorsicknessnotreportedtotheboardintimetopermittheboard'sphysiciantoexaminethefiremanbeforehisrecovery, and any injury or sickness for which a physician's report or copy of the hospitalrecordisnotonfilewiththeboardshallnotbeconsideredforthepaymentofdutydisabilitybenefit.Such fireman shall also receive a child's disability benefit of $30 permonth on account ofeachunmarriedchild, the issueofthefiremanor legallyadoptedbyhim,whois lessthan18yearsofageorhandicappedanddependentuponthefiremanforsupport.Thetotalamountofchild'sdisabilitybenefitshallnotexceed25%ofhissalaryatthetimethedisabilityisallowed.

Thefirstpaymentofdutydisabilityorchild'sdisabilitybenefitshallbemadenotlaterthanonemonthafterthebenefitisgranted.Eachsubsequentpaymentshallbemadenotlaterthanonemonthafterthedateofthelatestpayment.Dutydisabilitybenefitshallbepayableduringtheperiodof thedisabilityuntil the firemanreaches the age of compulsory retirement. Child's disability benefit shall be paid to such afiremanduring the period of disability until such child or children attain age 18 ormarries,whichevereventoccursfirst;exceptthatattainmentofage18byachildwhoissophysicallyormentallyhandicappedas tobedependentuponthe fireman forsupport, shallnotrender thechildineligibleforchild'sdisabilitybenefit.ThefiremanshallthereafterreceivesuchannuityorannuitiesasareprovidedforhiminaccordancewithotherprovisionsofthisArticle.(Source:P.A.95‐279,eff.1‐1‐08.)Sec.6‐151.1.Occupationaldiseasedisabilitybenefits.TheGeneralAssembly findsanddeclares that service in theFireDepartmentrequires thatfiremen, in times of stress and danger,must perform unusual tasks; that by reason of theiroccupation, firemen are subject to exposure to great heat and to extreme cold in certainseasonswhileinperformanceoftheirduties;thatbyreasonoftheiremploymentfiremenarerequired to work in the midst of and are subject to heavy smoke fumes and carcinogenic,poisonous, toxic or chemical gases from fires; and that in the course of their rescue andparamedicdutiesfiremenareexposedtodisablinginfectiousdiseases,includingAIDS,hepatitisC, and stroke. The General Assembly further finds and declares that all the aforementionedconditionsexistandariseoutoforinthecourseofsuchemployment.Anyactivefiremanwhohascompleted7ormoreyearsofserviceandisunabletoperformhisduties in theFireDepartmentbyreasonofheartdisease, tuberculosis,anydiseaseof thelungsorrespiratorytract,AIDS,hepatitisC,orstrokeresultingfromhisserviceasa fireman,shallbeentitledtoreceiveanoccupationaldiseasedisabilitybenefitduringanyperiodofsuchdisabilityforwhichhedoesnothavearighttoreceivesalary.Anyactivefiremanwhohascompleted7ormoreyearsofserviceandisunabletoperformhisdutiesinthefiredepartmentbyreasonofadisablingcancer,whichdevelopsormanifestsitselfduringaperiodwhilethefiremanisintheserviceofthedepartment,shallbeentitledtoreceiveanoccupationaldiseasedisabilitybenefitduringanyperiodofsuchdisabilityforwhichhe does not have a right to receive salary. In order to receive this occupational diseasedisabilitybenefit,thetypeofcancerinvolvedmustbeatypewhichmaybecausedbyexposuretoheat,radiationoraknowncarcinogenasdefinedbytheInternationalAgencyforResearchonCancer.AnyfiremanwhoshallentertheserviceaftertheeffectivedateofthisamendatoryActshallbe examined by one or more practicing physicians appointed by the Board, and if thatexaminationdiscloses impairmentoftheheart, lungs,orrespiratorytract,or theexistenceofAIDS, hepatitis C, stroke, or cancer, then the fireman shall not be entitled to receive anoccupational diseasedisability benefit unless anduntil a subsequent examination reveals nosuchimpairment,AIDS,hepatitisC,stroke,orcancer.Theoccupationaldiseasedisabilitybenefitshallbe65%ofthefireman'ssalaryatthetimeofhisremovalfromtheDepartmentpayroll.However,beginningJanuary1,1994,nooccupationaldiseasedisabilitybenefitthathasbeenpayableunderthisSectionforatleast10yearsshallbelessthan50%ofthecurrentsalaryattachedfromtimetotimetotherankandgradeheldbythefiremanatthetimeofhisremovalfromtheDepartmentpayroll,regardlessofwhetherthatremovaloccurredbeforetheeffectivedateofthisamendatoryActof1993.Suchfiremanalsoshallhavearighttoreceivechild'sdisabilitybenefitof$30permonthonaccountofeachunmarriedchildwho is less than18yearsofageorhandicapped,dependentuponthefiremanforsupport,andeithertheissueofthefiremanorlegallyadoptedbyhim.Thetotalamountofchild'sdisabilitybenefitpayabletothefireman,whenaddedtohisoccupationaldiseasedisabilitybenefit,shallnotexceed75%oftheamountofsalarywhichhewasreceivingatthetimeofthegrantofoccupationaldiseasedisabilitybenefit.

The fireman thereafter shall receivesuchannuityorannuitiesasareprovidedforhiminaccordancewithotherprovisionsofthisArticle.(Source:P.A.93‐654,eff.1‐16‐04.)Sec.6‐151.2.Disabilitybenefits;terminallyill.NotwithstandinganyotherprovisionofSections6‐151,6‐151.1,and6‐154,anactivefiremanwho is certified to be terminally ill by a Board‐appointed physician may, upon suchcertification, make application with the Board for a determination that the participant iseligibletoreceiveadisabilitybenefit,eventhough,atthetime,theparticipanthastherighttoreceive salary. However, an active fireman may not receive any such disability benefitpaymentsatthesametimetheparticipantreceivessalary.(Source:P.A.95‐1036,eff.2‐17‐09.)Sec.6‐152.Ordinarydisabilitybenefits.Any fireman who is not eligible for minimum annuity, who becomes disabled after theeffectivedateas theresultofanycauseotherthantheperformanceofanactoractsofduty,shallhave a right to receiveordinarydisabilitybenefit duringanyperiodorperiodsof suchdisability,afterthefirst30daysofdisability.Paymentofsuchbenefitsshallnotexceed,intheaggregate, throughout the entire service of the fireman, a period equal to 1/2 of the totalservice renderedbyhimprior to the timehebecamedisabled,butnot to exceed5years. Incomputingsuchperiodofservice,thetimethatthefiremanreceivedordinarydisabilitybenefitshallnotbeincluded.Thefirstpaymentofthebenefitshallbemadenotlaterthanonemonthafterthebenefitisgrantedandeachsubsequentpaymentshallbemadenotlaterthanonemonthafterthetimewhenthelatestpaymentwasmade.Whenadisabledfiremanbecomeseligibleforminimumannuity,thedisabilitybenefitshallcease and he shall thereafter receive such annuity or annuities as are provided for him inaccordancewithotherprovisionsofthisArticle.Ordinary disability benefit shall be 50% of the fireman's salary at the time the disabilityoccurs.Beforeanypayment ismade,asumordinarilydeductedfromthefireman'ssalary forannuity purposes during a period of time equal to that forwhich such payment of ordinarydisabilitybenefitistobemadeshallbedeductedfromsuchpaymentandcreditedtohimasadeductionfromhissalaryforsuchperiod.Thesumssocreditedshallberegarded,forannuityandrefundpurposes,assumscontributedbythefireman.(Source:P.A.84‐11.)Sec. 6‐153. Proof of duty, occupational disease or ordinary disability; physicalexaminations.Proofofduty,occupationaldisease,orordinarydisabilityshallbefurnishedtotheBoardbyatleastonelicensedandpracticingphysicianappointedbytheBoard.IncaseswheretheBoardrequirestheapplicanttoobtainasecondopinion,theapplicantmayselectaphysicianfromalistofqualifiedlicensedandpracticingphysicianswhichshallbeestablishedandmaintainedbythe board. receivingaduty,occupationaldisease,orordinarydisabilitybenefitshallbeexaminedatleastonceayearor such longerperiodasdeterminedby theBoard,byoneormore licensedandpracticingphysiciansappointedbytheboard;howeversuchexaminationmaybewaivedbytheBoard if the appointed physician certifies in writing to the Board that the disability of thefiremanisofsuchanatureastorenderhimpermanentlydisabledandunableevertoreturntoservice.When the disability ceases, the Board shall discontinue payment of the benefit and thefiremanshallbereturnedtoserviceinhisproperrankorgrade.(Source:P.A.96‐727,eff.8‐25‐09.)Sec.6‐154.Administrationofdisabilitybenefits.IfafiremanwhoisgrantedanytypeofdisabilitybenefitunderthisArticlerefusestosubmitto examination by any physician appointed by the board, he shall have no further right toreceivethebenefit.Afiremanwhohaswithdrawnwhiledisabledandentereduponannuity,andwhore‐entersthe service on or after the date of withdrawal, and who has not served at least one yearsubsequenttothedateofsuchre‐entry,shallnotreceiveordinarydisabilitybenefitinexcessoftheamounthehaspreviouslyreceivedaspensiononaccountofdisability,orasannuity,foranequalperiodofdisability.Thisprovisionshallapplythroughoutthedurationofanydisabilityincurredbythefiremanwithinoneyearafterhisreinstatementresultingfromanycauseotherthantheperformanceofanactoractsofduty.Nodisabilitybenefitshallbepaidonaccountofanyformofdisabilityforanyperiodoftimeforwhich a disabled fireman has a right to receive any part of his salary, under any law orordinanceineffectinthecity.If a disabled fireman receives compensation from the city for such disability under theWorkers' Compensation Act or Occupational Diseases Act, the disability benefit providedhereinshallbereducedbyanyamountsoreceived,ifsuchamountislessthantheamountofthebenefit;andif theamountreceivedascompensationexceedstheamountofthedisabilitybenefit, the fireman shall not receive such disability benefit until the benefit payable,accumulated at the rate herein stated, equals the amount of such compensation withoutconsiderationofinterest.Ifthewidow,childorchildren,orparentorparents(oranyofthesepersons)ofanyfiremanwhosedeathresultsfromanactoractsofdutyreceivesanycompensationfromthecityundertheWorkers'CompensationActorOccupationalDiseasesAct,theannuitieshereinprovidedforsuchbeneficiariesshallbereducedbyanyamountssoreceived,ifsuchamountsarelessthanthe amountof the annuityor annuities. If the amountor amounts received as compensationexceedtheamountoramountsoftheannuityorannuitiesforthewidow,childorchildren,orparentorparents,theannuitiesshallnotbepayableuntiltheaccumulatedvalueoftheannuityor annuities at the rate herein stated equals the amount of such compensation withoutconsiderationof interest. Inmakingsuchadjustment, theannuity to thewidowshall firstbereduced.Disability pension or disability benefit shall not be paid to any fireman while he residesoutsidetheStateofIllinois,unlesssuchresidenceisbypermissionoftheboard.(Source:P.A.81‐992.)Sec.6‐155.Annuityafterwithdrawalwhiledisabled.A fireman who continues to be disabled beyond the maximum period of eligibility forordinarydisabilitybenefitsastheresultofanycauseotherthantheperformanceofanactoracts of duty, andwhowithdrawswhile still so disabled and before age 50, shall receive theannuity that may be provided from the amounts accumulated to his credit from salarydeductions and contributions by the city for his retirement annuity. The annuity shall becomputedasoftheageofthefiremanonthedateofhiswithdrawal.

Theannuitytowhichthewifeofanysuchfiremanhasarightfromthedateofhisdeathshallbe fixed as of her age on the date of his withdrawal. It shall be an amount provided on areversionary annuity basis from the entire amount to his credit for widow's annuity. Themaximumageof thewife for annuitypurposes shall notbemore than5 years less than thefireman'sage.Uponthedeathofa firemanafterhehasentereduponannuity,anyunmarriedchildofhisunder age 18, shall have a right to receive annuity under the conditions and of the amountspecifiedinthisArticleforachild'sannuity.(Source:P.A.81‐1536.)Sec.6‐156.Re‐entryofpensionerorannuitantintoservice.(a)Whenafiremanwhohaswithdrawnaftertheeffectivedatere‐enterstheservicebeforeage 63, any annuity previously granted to him and any annuity fixed for his wife shall becancelled.Thefiremanshallbecreditedwiththeactuarialvalueoftheannuitiescancelledforhimandhiswifeasoftheirrespectiveagesonthedateofhisre‐entryintoservice;provided,thatforpresentemployeesandfutureentrantswhoenteredservicepriortoJuly1,1953,themaximumageofawifeforthispurposeshallnotbemorethan5yearslessthanhisage,andforfutureentrantswhoenteredserviceafterJune30,1953,theage,forannuitypurposes,ofawifewho is older than her husband shall be assumed to be equal to his age. Such sums shall becreditedtothefiremantoprovideforannuitiesinthefuture.DeductionsfromsalaryandcontributionsbythecityforallpurposesofthisArticleshallbemade as provided herein, and upon subsequent retirement, new annuities based upon theamountthentohiscreditforannuitypurposesandtheentiretermofhisserviceshallbefixedforhimandhiswife.Ifsuchfireman'swife,forwhomannuityhasbeenfixedpriortohisre‐entranceintoservice,hasdied, or themarriagewasdissolvedbeforehe re‐entered service, nopart of any sumorsums to the credit of such fireman forwidow'sprior service annuity at the timeannuity forsuchwifewasfixedshallbecreditedtosuchfiremanatthetimeofre‐entry.Nopartofanysuchsumorsumsshallbeusedtoprovideannuityforanywifeofsuchfiremanwhoishiswifeatanytimeafterhisre‐entryintoservice.(b) If a fireman re‐enters service after age 63, payments of pension or annuity previouslygranted shall be suspended. When he again withdraws, payments upon such pension orannuity shall be resumed. If the firemandies in service, hiswidow shall receive the annuitypreviouslyfixedforher.(Source:P.A.81‐1536.)Sec.6‐157.Re‐entryoffiremannotinserviceondaypriortoeffectivedate.Afiremanwhowasnotinthefireserviceofthecityonthedaypriortotheeffectivedate,andwhowasinsuchservicepriortothatdayandwhore‐entersservicethereafterandbeforeage57 shall receiveno credit forprior service andwidow'sprior service annuity; provided thatsuchservicebeforetheeffectivedateshallbeincludedincomputingserviceforageandserviceannuityandwidow'sannuity.Deductionsfromsalaryandcontributionsbythecityforageandserviceannuityandwidow'sannuityshallbemadeuntilheattainsage57.Suchfiremanhasarighttoreceiveageandserviceannuity,fromthedateofhiswithdrawal,asofhisageonsuchdate,of theamountprovidedfromthecredits forsuchannuityonsuchdate.The annuity towhichhiswidowshall be entitled shall be fixed in accordancewith theprovisionsofthisArticlerelatingtoannuitiesforwidowsoffutureentrants.(Source:P.A.81‐1536.)

Sec.6‐158.Refund‐General.(a)Afiremanwhowithdrawsbeforeage50andafiremanwithlessthan10yearsofservicewhowithdrawsbeforeage57,oranyfiremanwhowithdrawsandenterstheserviceofanotherdepartmentofthecity,hasarighttoarefundoftheentireamounttohiscreditasofdateofwithdrawalforageandserviceannuityandwidow'sannuityfromdeductionsfromsalary.(b)Anysuchfiremanshallbeentitledtorefunduntilhere‐entersserviceoruntilhisannuityisfixed.(c)Afiremanwhoreceivesarefundforfeitsallrightstoanyannuityorbenefitfromthefund,for himself and for any other personwhomight benefit through himbecause of his service,providedheshallretaintherighttocreditforanysuchservice,forthepurposeofcomputinghis total service if he re‐enters servicebeforeage57,becomesabeneficiaryof the fundandmakesrepaymentoftherefundwithinterest.(d)Afiremancompleting10yearsofservicewhodoesnotreceivearefund,mayreceiveanannuityasprovidedinthisArticle.(e)Afiremancompletinglessthan10yearswhodoesnotreceivearefundhasarighttohaveallamountstohiscreditforannuitypurposesonthedateofwithdrawalimprovedbyinterestwhilehe isoutofserviceuntilage57only, forhisbenefitandthebenefitofanypersonwhomayhaveanyright toannuitythroughhim, ifhesubsequentlyreentersserviceandattainsarighttoannuity.(Source:Laws1965,p.2464.)Sec.6‐159.Refund‐Re‐entryintoservice‐Repaymentofrefund.A fireman who receives a refund, and who subsequently re‐enters the service, shall notthereafter receive, nor shall hiswidow or parent or parents receive, any annuity, benefit orpension under this Article unless he or his widow, or parent or parents, repays the refundwithin2yearsafterthedateofre‐entryintoserviceorbyJanuary1,2011,whicheverislater,withinterestattheactuariallyassumedrate,compoundedannually,fromthedatetherefundwas received to the date such amount is repaid. The change made in this Section by thisamendatoryActof1995applieswithout regard towhether the firemanwas inserviceonoraftertheeffectivedateofthisamendatoryActof1995.A firemanwhohas failed to repay any refund due to the Fundunder this Article after re‐enteringserviceshallbetreatedasanewemployeeandshallonlyreceiveservicecreditfromthedatethathehasre‐enteredserviceasanewemployee.(Source:P.A.96‐727,eff.8‐25‐09.)Sec.6‐160.Refund‐Widow'sannuitycontributions.When a fireman attains age 63 in service and is not thenmarried, orwhen an unmarriedfireman withdraws before age 63 and enters upon annuity, his contributions for widow'sannuityshallthenberefundedtohim,uponrequest.ArefundunderthisSectionmayberepaidasprovidedinSection6‐142(B).(Source:P.A.93‐654,eff.1‐16‐04.)Sec.6‐161.Refund‐Transferofcitycontributions.Wheneveranyamountsarerefunded,theaccumulatedcitycontributionsshallbetransferredtothepriorserviceannuityreserveuntilsuchtimeastheassetsofsaidreservebecomeequalto the liabilities thereof. Sec.6‐162.Refund‐Widowsandchildren.If the amount accumulated in the account of a deceased unmarried fireman from salarydeductionsforannuitypurposesaftertheeffectivedate,includinginterest,hasnotbeenpaidtohimor his parent or parents, and in the case of a deceasedmarried fireman to him and hiswidow,informofannuityorbenefitbeforethedeathofthelastsurvivorofsuchpersons,theremainingamountifany,withoutinterest,shallbepaidinthefollowingorderofprecedence:(a) to the administrator or executor of the fireman's estate; (b) for burial expenses of thefireman; and (c) to his heirs according to the law pertaining to administration of estates;provided, if anyofhis children less thanage18 survive, suchamountas isnecessary topaychildren's annuities shall not be refunded, but shall be transferred to the Child's AnnuityReserve,andusedforthepaymentofannuitiestochildren.(Source:P.A.81‐1536.)Sec. 6‐163. Annual salary for computing annuities and benefits‐Amount of dutydisabilitybenefitlimited.Forageandserviceannuity,theminimumannuitiesprescribedinSections6‐123and6‐128andfordisabilitybenefits,salaryasdefinedinSection6‐111shallbethebasisofcomputation.FordisabilitypensionanddutydisabilitybenefitunderthisArticle,itshallbeassumedthattheannualsalaryofafiremanistheamountsetoutandappropriatedfortherankorgradeheldbyhimintheannualbudgetorappropriationofthecity,andthatwhensalaryisappropriatedinalumpsumtobepaidonthebasisofadailywageforservicesasneeded,theannualsalaryistheamount ascertained bymultiplying the daily wage by 280; provided that (1) for computingminimum annuity, disability pension and duty disability benefits from and after January 1,1941, thesalaryshallbeassumedtobenot less thanthesalaryappropriated for therankorgradeheldbythefiremanconcernedonDecember31,1940;andthat(2)whentheamountofsalaryappropriatedforapositionisforadefiniteperiodoflessthan12monthsinanyoneyearsubsequenttoDecember31,1940,disabilitybenefitshallbecomputeduponthebasisofadailywageorsalarybydividingtheamountappropriatedforsuchdisabledpersonby365;and(3)theamountofdutydisabilitybenefit,eitherinitselforwhenaddedtochild'sdisabilitybenefit,shall not exceed the actual salary appropriated for the rank or grade held by the disabledpersonwhentherighttosuchdisabilitybenefitsaccrues.TheprovisionsofthissectionshallberetroactivetoJanuary1,1941,butshallnotapplytoany personwhose pension, annuity or disability benefit has been or shall be granted, baseduponorcomputedinaccordancewiththeprovisionsofanyActotherthanthisArticleorthe"Firemen'sAnnuityandBenefitFundoftheIllinoisMunicipalCode".(Source:Laws1967,p.3625.)Sec.6‐164.Automaticannualincrease;retirementafterSeptember1,1959.(a)AfiremanqualifyingforaminimumannuitywhoretiresfromserviceafterSeptember1,1959 shall, upon either the first of themonth following the first anniversary of his date ofretirementifheisage60(age55ifbornbeforeJanuary1,1955)oroveronthatanniversarydate,oruponthefirstofthemonthfollowinghisattainmentofage60(age55ifbornbeforeJanuary1,1955)ifthatoccursafterthefirstanniversaryofhisretirementdate,havehisthenfixedandpayablemonthlyannuityincreasedby11/2%,andsuchfirstfixedannuityasgrantedat retirement increased by an additional 1 1/2% in January of each year thereafter up to amaximumincreaseof30%.BeginningJuly1,1982forfiremenbornbeforeJanuary1,1930,andbeginning January 1, 1990 for firemen born after December 31, 1929 and before January 1,1940, and beginning January 1, 1996 for firemen born after December 31, 1939 but beforeJanuary1,1945,andbeginningJanuary1,2004,forfiremenbornafterDecember31,1944butbeforeJanuary1,1955,suchincreasesshallbe3%andsuchfiremenshallnotbesubjecttothe30%maximumincrease.Any firemanbornbefore January1,1945whoqualifies foraminimumannuityandretiresafterSeptember1,1967buthasnotreceivedtheinitialincreaseunderthissubsectionbefore

January1,1996isentitledtoreceivetheinitialincreaseunderthissubsectionon(1)January1,1996,(2)thefirstanniversaryofthedateofretirement,or(3)attainmentofage55,whicheveroccurslast.ThechangestothisSectionmadebythisamendatoryActof1995applybeginningJanuary 1, 1996 and apply without regard to whether the fireman or annuitant terminatedservicebeforetheeffectivedateofthisamendatoryActof1995.Any firemanbornbefore January1,1955whoqualifies foraminimumannuityandretiresafterSeptember1,1967buthasnotreceivedtheinitialincreaseunderthissubsectionbeforeJanuary1,2004isentitledtoreceivetheinitialincreaseunderthissubsectionon(1)January1,2004,(2)thefirstanniversaryofthedateofretirement,or(3)attainmentofage55,whicheveroccurs last. The changes to this Section made by this amendatory Act of the 93rd GeneralAssemblyapplywithoutregardtowhetherthefiremanorannuitantterminatedservicebeforetheeffectivedateofthisamendatoryAct.(b)Subsection(a)ofthisSectionisnotapplicabletoanemployeereceivingatermannuity.(c)Tohelpdefray thecostofsuch increases inannuity, thereshallbededucted,beginningSeptember1,1959, fromeachpaymentofsalary toa fireman,1/8of1%ofeachsuchsalarypaymentandanadditional1/8of1%beginningonSeptember1,1961,andSeptember1,1963,respectively, concurrentlywith and in addition to the salary deductions otherwisemade forannuitypurposes.Each suchadditional 1/8of 1%deduction fromsalarywhich shall, on September1, 1963,result in a total increase of 3/8 of 1%of salary, shall be credited to theAutomatic IncreaseReserve, tobeused, togetherwithcitycontributionsasprovidedinthisArticle, todefraythecostofthe11/2%annuityincrementshereinspecified.Anybalanceinsuchreserveasofthebeginningofeachcalendaryearshallbecreditedwithinterestattherateof3%perannum.The salary deductions provided in this Section are not subject to refund, except to thefiremanhimself,inanycaseinwhichafiremanwithdrawspriortoqualificationforminimumannuityandappliesforrefund,orappliesforannuity,andalsowhereatermannuitybecomespayable. In such cases, the total of such salary deductions shall be refunded to the fireman,withoutinterest,andchargedtotheaforementionedreserve.(d)NotwithstandinganyotherprovisionofthisArticle,themonthlyannuityofapersonwhofirstbecomesafiremanunderthisArticleonorafterJanuary1,2011shallbeincreasedontheJanuary1occurringeitheronoraftertheattainmentofage60orthefirstanniversaryoftheannuitystartdate,whichever is later.Eachannual increaseshallbecalculatedat3%orone‐halftheannualunadjustedpercentageincrease(butnotlessthanzero)intheconsumerpriceindex‐uforthe12monthsendingwiththeSeptemberprecedingeachNovember1,whicheverisless,oftheoriginallygrantedretirementannuity.Iftheannualunadjustedpercentagechangein the consumer price index‐u for a 12‐month period ending in September is zero or,whencomparedwiththeprecedingperiod,decreases,thentheannuityshallnotbeincreased.Forthepurposesofthissubsection(d),"consumerpriceindex‐u"meanstheindexpublishedbytheBureauofLaborStatisticsoftheUnitedStatesDepartmentofLaborthatmeasurestheaverage change in prices of goods and services purchased by all urban consumers, UnitedStates city average, all items, 1982‐84 = 100. The new amount resulting from each annualadjustmentshallbedeterminedbythePublicPensionDivisionoftheDepartmentofInsuranceandmadeavailabletotheboardsofthepensionfunds.(Source:P.A.96‐1495,eff.1‐1‐11.)Sec.6‐164.1.Automaticannualincrease;retirementonorbeforeSeptember1,1959.(a)Aretiredfireman,qualifyingforminimumannuityorwhoretiredfromservicewith20ormoreyearsofservice,onorbeforeSeptember1,1959,atage50orovershallhave,inJanuaryoftheyearfollowingtheyearheattainstheageof65,orinJanuary,1970,ifheisthenoverage65, his then fixed and payablemonthly annuity increased by an amount equal to 2%of theoriginalgrantofannuity,foreachyearhereceivedannuitypaymentsaftertheyearinwhichheattainsage65.Anadditional2% increase insuch fixedandpayableoriginalgrantedannuityshallaccrueineachJanuarythereafter.

However, beginning January 1, 1996, the increases payable under this subsection (a) to afiremanbornbeforeJanuary1,1945shallbeattherateof3%oftheoriginallygrantedannuityamount,notwithstandingthatthefiremanterminatedservicepriortotheeffectivedateofthisamendatoryActof1995.(b)Theprovisionsofsubsection(a)ofthisSectionapplyonlytoaretiredfiremaneligibleforsuch increases in his annuity if he contributed to the fund a sum equal to 1% of the finalaveragemonthly salaryused in the computationof theannuity for each full yearof creditedserviceuponwhichhisannuitywascomputed.AllsuchsumscontributedshallbeplacedinaSupplementaryPaymentReserveandusedforthepurposesofsuchfundaccount.(c) Beginning with the monthly annuity payment due in July, 1982, the monthly annuitypaymentforanyfiremanwhoretiredfromtheservicebeforeSeptember1,1976atage50oroverwith 20 ormore years of service orwhowas granted duty disability benefits prior toSeptember1,1957andentitledtoanannuityordutydisabilitybenefitsonJuly1,1975shallbenotlessthan$400.(d)Thedifferenceinamountbetweentheminimummonthlyannuityspecifiedinsubsection(c)andtheminimummonthlyannuitytowhichthefiremanwasentitledbeforeJuly1,1975,inaccordancewiththeprovisionsofSection6‐128.1,shallbepaidasasupplementinthemannersetforthinsubsection(e).(e)TodefraytheannualcostoftheincreasesindicatedintheprecedingpartofthisSection,theannualincomeaccruingfrominvestmentsheldbythisfund,above4%ayear,totheextentnecessary and available to finance the cost of such increases for the following year, shall betransferred each year beginning with the year 1969 to a fund account designated as theSupplementaryPaymentReservefromtheInterestandInvestmentReservesetforthinSection6‐203.IfthemoneyintheSupplementaryPaymentReserveinanyyeararisingfrominterestincomeabove4%ayearasdefinedinthisSectionaccruingintheprecedingyear;andthecontributionsby retiredpersons, are insufficient tomake the total payments to all persons entitled to theannuityunder this Section; and any investment earningsover4%a yearbeginningwith theyear1969notpreviouslyused to financesuch increasesand transferred to thePriorServiceAnnuityReserve,maybeusedtotheextentnecessaryandavailabletoprovidesufficientfundsto financesuch increases for thecurrentyear.Suchsumsshallbe transferred fromthePriorServiceAnnuityReserve. If the totalmoneyavailable in theSupplementaryPaymentReservefromsuchsourcesare insufficient tomake the totalpayments toallpersonsentitled tosuchincreasesfortheyear,aproportionateamountcomputedastheratioofthemoneyavailabletothetotalofallthepaymentsspecifiedforthatyearshallbepaidtoeachpersonforthatyear.No part of any such increase under this Section is an obligation of the fund otherwiseestablishedunderthisArticle6.(Source:P.A.89‐136,eff.7‐14‐95.)Sec.6‐164.2.Paymentstocity.(a)For thepurposesof this Section, "city annuitant"meansaperson receivinganage andserviceannuity,awidow'sannuity,achild'sannuity,oraminimumannuityunderthisArticleasadirectresultofpreviousemploymentbytheCityofChicago("thecity").(b)Theboardshallpaytothecity,onbehalfoftheboard'scityannuitantswhoparticipateinanyofthecity'shealthcareplans,thefollowingamounts:(1)FromJuly1,2003throughJune30,2008,$85permonthforeachsuchannuitantwhoisnot eligible to receiveMedicare benefits and $55 permonth for each such annuitantwho iseligibletoreceiveMedicarebenefits.(2)BeginningJuly1,2008anduntilsuchtimeasthecitynolongerprovidesahealthcareplanforsuchannuitantsorDecember31,2016,whichevercomesfirst,$95permonthforeachsuch annuitantwho is not eligible to receiveMedicare benefits and $65 permonth for eachsuchannuitantwhoiseligibletoreceiveMedicarebenefits.ThepaymentsdescribedinthissubsectionshallbepaidfromthetaxlevyauthorizedunderSection6‐165;suchamountsshallbecreditedtothereserveforgrouphospitalcareandgroup

medicalandsurgicalplanbenefits,andallpaymentstothecityrequiredunderthissubsectionshallbechargedagainstit.(c)ThecityhealthcareplansreferredtointhisSectionandtheboard'spaymentstothecityunderthisSectionarenotandshallnotbeconstruedtobepensionorretirementbenefitsforthepurposesofSection5ofArticleXIIIoftheIllinoisConstitutionof1970.(Source:P.A.98‐43,eff.6‐28‐13.)Sec.6‐165.Financing;tax.(a)ExceptasexpresslyprovidedinthisSection,eachcityshall levyataxannuallyuponalltaxablepropertythereinforthepurposeofprovidingrevenueforthefund.Fortheyearspriorto theyear1960, the taxrate shallbeasprovided for in the "Firemen'sAnnuityandBenefitFundoftheIllinoisMunicipalCode".Thetax,fromandafterJanuary1,1968toandincludingthe year 1971, shall not exceed .0863% of the value, as equalized or assessed by theDepartmentofRevenue,ofall taxableproperty inthecity.Beginningwiththeyear1972andthrough2014,thecityshalllevyataxannuallyatarateonthedollarofthevalue,asequalizedor assessed by theDepartment of Revenue of all taxable propertywithin such city thatwillproduce,whenextended,nottoexceedanamountequaltothetotalamountofcontributionsbytheemployees to the fundmade in thecalendaryear2yearsprior to theyear forwhich theannualapplicabletaxislevied,multipliedby2.23throughthecalendaryear1981,andby2.26fortheyear1982andforeachyearthrough2014.Beginningin2015,thecitycouncilshalllevyataxannuallyatarateonthedollaroftheassessedvaluationofalltaxablepropertythatwillproducewhenextendedanannualamountthatisequalto(1)thenormalcosttotheFund,plus(2) an annual amount sufficient to bring the total assets of the Fundup to 90%of the totalactuarial liabilities of the Fund by the end of fiscal year 2040, as annually updated anddeterminedbyanenrolledactuaryemployedbytheIllinoisDepartmentofInsuranceorbyanenrolledactuaryretainedbytheFundorthecity.Inmakingthesedeterminations,therequiredminimumemployercontributionshallbecalculatedeachyearasalevelpercentageofpayrollovertheyearsremaininguptoandincludingfiscalyear2040andshallbedeterminedundertheprojectedunitcreditactuarialcostmethod.To provide revenue for the ordinary death benefit established by Section 6‐150 of thisArticle,inadditiontothecontributionsbythefiremenforthispurpose,thecitycouncilshallfortheyear1962andeachyear thereafterannually levya tax,whichshallbe inadditiontoandexclusiveof the taxes authorized tobe leviedunder the foregoingprovisionsof this Section,uponalltaxablepropertyinthecity,asequalizedorassessedbytheDepartmentofRevenue,atsuchratepercentofthevalueofsuchpropertyasshallbesufficienttoproduceforeachyearthesumof$142,000.The amounts produced by the taxes levied annually, together with the deposit expresslyauthorized in thisSection, shallbesufficient,whenadded to theamountsdeducted from thesalariesoffiremenandappliedtothefund,toprovideforthepurposesofthefund.(a‐5)ForpurposesofdeterminingtherequiredemployercontributiontotheFund,thevalueof theFund's assets shallbeequal to theactuarial valueof theFund's assets,which shallbecalculatedasfollows:(1)OnMarch30,2011,theactuarialvalueoftheFund'sassetsshallbeequaltothemarketvalueoftheassetsasofthatdate.(2)IndeterminingtheactuarialvalueoftheFund'sassetsforfiscalyearsafterMarch30,2011, any actuarial gains or losses from investment return incurred in a fiscal year shall berecognizedinequalannualamountsoverthe5‐yearperiodfollowingthatfiscalyear.(a‐7)IfthecityfailstotransmittotheFundcontributionsrequiredofitunderthisArticleformorethan90daysafterthepaymentofthosecontributionsisdue,theFundmay,aftergivingnoticetothecity,certifytotheStateComptrollertheamountsofthedelinquentpayments,andthe Comptroller must, beginning in fiscal year 2016, deduct and deposit into the Fund thecertified amountsor aportionof those amounts from the followingproportionsof grants ofStatefundstothecity:(1)infiscalyear2016,one‐thirdofthetotalamountofanygrantsofStatefundstothecity;

(2) in fiscalyear2017, two‐thirdsof the totalamountofanygrantsofState funds to thecity;and(3) in fiscal year 2018 and each fiscal year thereafter, the total amount of any grants ofStatefundstothecity.TheStateComptrollermaynotdeductfromanygrantsofStatefundstothecitymorethantheamountofdelinquentpaymentscertifiedtotheStateComptrollerbytheFund.(b)Thetaxesshallbeleviedandcollectedinlikemannerwiththegeneraltaxesofthecity,and shall be in addition to all other taxeswhich the citymay levyuponall taxablepropertytherein and shall be exclusive of and in addition to the amount of tax the citymay levy forgeneralpurposesunderSection8‐3‐1oftheIllinoisMunicipalCode,approvedMay29,1961,asamended,orunderanyotherlaworlawswhichmaylimittheamountoftaxwhichthecitymaylevyforgeneralpurposes.(c)Theamountsofthetaxestobeleviedineachyearshallbecertifiedtothecitycouncilbytheboard.(d)Assoonasanyrevenuederivedfromsuchtaxes iscollected, itshallbepaidtothecitytreasurerandheldforthebenefitofthefund,andallsuchrevenueshallbepaidintothefundinaccordancewiththeprovisionsofthisArticle.(e) If the funds available are insufficientduring anyyear tomeet the requirementsof thisArticle,thecitymayissuetaxanticipationwarrants,againstthetaxlevieshereinauthorizedforthecurrentfiscalyear.(f)Thevarioussums,hereinafterstated,includinginterest,tobecontributedbythecity,shallbetakenfromtherevenuederivedfromthetaxesorotherwiseasexpresslyprovided inthisSection.Exceptfordefrayingthecostofadministrationofthefundduringthecalendaryearinwhichacityfirstattainsapopulationof500,000andcomesundertheprovisionsofthisArticleandthefirstcalendaryearthereafter,anymoneyofthecityderivedfromanysourceotherthanthesetaxesorthesaleoftaxanticipationwarrantsshallnotbeusedtoproviderevenueforthefund, nor to pay any part of the cost of administration thereof, unless applied tomake thedepositexpresslyauthorizedinthisSectionortheadditionalcitycontributionsrequiredundersubsection(h).(g)InlieuoflevyingalloraportionofthetaxrequiredunderthisSectioninanyyear,thecitymaydepositwith the city treasurerno later thanMarch1of that year for thebenefit of thefund,tobeheldinaccordancewiththisArticle,anamountthat,togetherwiththetaxesleviedunderthisSection for thatyear, isnot less thantheamountof thecitycontributions for thatyearascertifiedbytheboardtothecitycouncil.Thedepositmaybederivedfromanysourcelegallyavailableforthatpurpose,including,butnotlimitedto,theproceedsofcityborrowings.ThemakingofadepositshallsatisfyfullytherequirementsofthisSectionforthatyeartotheextentoftheamountssodeposited.AmountsdepositedunderthissubsectionmaybeusedbythefundforanyofthepurposesforwhichtheproceedsofthetaxesleviedunderthisSectionmaybeused,includingthepaymentofanyamountthatisotherwiserequiredbythisArticletobepaidfromtheproceedsofthosetaxes.(h) In addition to the contributions requiredunder the other provisions of thisArticle, byNovember1of the followingspecifiedyears, thecityshalldepositwiththecity treasurer forthe benefit of the fund, to be held and used in accordance with this Article, the followingspecifiedamounts:$6,300,000in1999;$5,880,000in2000;$5,460,000in2001;$5,040,000in2002;and$4,620,000in2003.Theadditionalcitycontributionsrequiredunderthissubsectionareintendedtodecreasetheunfunded liability of the fund and shall not decrease the amount of the city contributionsrequired under the other provisions of this Article. contributions are not picked up, the amount that would have been picked up under thisamendatoryActof1980shallcontinuetobedeductedfromsalary.Ifemployeecontributionsare picked up they shall be treated as employer contributions in determining tax treatmentunder the United States Internal Revenue Code; however, the employer shall continue towithhold Federal and state income taxes based upon these contributions until the InternalRevenueServiceortheFederalcourtsrulethatpursuanttoSection414(h)oftheUnitedStatesInternal Revenue Code, these contributions shall not be included as gross income of theemployee until such time as they are distributed ormade available. The employer shall paytheseemployeecontributionsfromthesamesourceoffundswhichisusedinpayingsalarytotheemployee.Theemployermaypickupthesecontributionsbyareductioninthecashsalaryof the employee or by an offset against a future salary increase or by a combination of areduction in salary andoffset against a future salary increase. If employee contributions arepickeduptheyshallbetreatedforallpurposesofthisArticle6,includingSection6‐165,inthesamemannerandtothesameextentasemployeecontributionsmadepriortothedatepickedup.(Source:P.A.81‐1536.)Sec. 6‐166. Contributions for age and service annuities for present employees andfutureentrants.AftertheeffectivedateandpriortoJuly1,1953,31/2%,andafterJune30,1953,andpriortoSeptember1,1959,6%,andbeginningSeptember1,1959,71/8%ofeachpaymentofthesalaryofeachpresentemployeeand futureentrantshallbedeductedandcontributed to thefundforageandserviceannuity.Thedeductionsshallbemadeatthetimepaymentsofsalaryarepayableandshallcontinuewhiletheemployeeisinservice.Concurrentlywitheachsuchcontribution,thecityshallcontribute81/2%ofeachpaymentofsalary,butthecitycontributionsshallceaseforallemployeesupontheirattainmentofage63.Each contribution by the employee and the city shall be allocated to the account of andcredited totheemployee,andshallbe improvedby interestat theapplicablerateduringthetimeheisinserviceuntiltheageandserviceannuityisfixed.Anyaccretion,bywayofinterestorotherwise,uponsuchsumoranydeductionfromsalarymadeaftertheannuityisfixedforapresentemployeeorafterattainmentofage63byafutureentrantshallnotbecreditedtotheemployeeforageandserviceannuity.(Source:P.A.76‐1668.)Sec. 6‐167. Contributions for widow’s annuities for present employees and futureentrants.BeginningontheeffectivedateandpriortoSeptember1,1957,1%ofeachpaymentofsalaryof not more than $3,000 of each employee and beginning September 1, 1957, 1% of eachpaymentofsalaryofnotmorethan$6,000ofeachpresentemployeeandfutureentrantshallbe deducted and contributed to the fund forwidow's annuity. After September 1, 1967 andprior to January 1, 1976, 1%, and beginning January 1, 1976, 1 1/2% of salary withoutlimitation shall be deducted from the pay of each present employee and future entrant andcontributed to the fund for widow's annuity. Sec.6‐168.Contributionsfordeathbenefit.Todefraythecostoftheordinarydeathbenefit,eachfiremaninserviceonorafterJanuary1,1962, shall make contributions in addition to the contributions otherwise provided in thisArticle,intheamountof$2.50permonthlyperiod.Thiscontributionshallbeginwiththefirstpay period accruing after January 1, 1962, and shall be deducted from the salary of eachfiremanat thesametimeandwith thesame frequencyasdeductionsaremade for theotherpurposesofthisArticle.Contributionstowardsthisbenefitshallbemadeonlywhenthefiremanis inactiveserviceand in receipt of salary. Sec.6‐174.Boardcreated.A board of 8 members shall constitute a board of trustees authorized to administer theprovisionsofthisArticle.TheboardshallbeknownastheRetirementBoardoftheFiremen'sAnnuityandBenefitFundofthecity.Theboardshallconsistofthecitytreasurer,thecitycomptroller,thecityclerk,adeputyfirecommissionerdesignatedbythefirecommissionerofthecity,3firemenemployedbythecity,and 1 annuitant of the fund or a fireman pensioner of any prior firemen's pension fund inoperation, by authority of law, in the city. Children less than age 18 shall not be eligible formembership.ThemembersofaretirementboardholdingofficeatthetimethisArticlebecomeseffective,includingelectedandexofficiomembers,shallcontinue inofficeuntil theexpirationof theirrespectivetermsorappointmentanduntiltheirrespectivesuccessorsareelectedorappointed,andqualified.Inacitywhichfirstattainsapopulationofover500,000andcomesundertheprovisionsofthisArticle,theactivefiremenmembersoftheboardoftrusteesofanyfiremen'spensionfundthen in effect in such city and themember of such boardwhowas chosen from the retiredmembersofsuchfundshallbecomemembersoftheboardasfollows:(a)TheactivefiremanmemberforwhomthehighestnumberofvoteswascastandcountedatthemostrecentelectionforboardmembersshallbecomeamemberoftheretirementboardforatermwhichshallendonDecember1stofthethirdyearaftertheyearinwhichthisArticlecomesintoforceinthecity;thememberoftheboardforwhomthesecondhighestnumberofvoteswascastandcountedatsuchelectionshallbecomeamemberoftheretirementboardforatermwhichshallendonDecember1stofthesecondyearaftertheyearinwhichthisArticlecomesintoforceinthecity;andthememberoftheboardforwhomthethirdhighestnumberofvoteswascastandcountedatsuchelectionshallbecomeamemberoftheretirementboardforatermwhichshallendonDecember1stofthefirstyearaftertheyearinwhichthisArticlecomesintoforceinthecity.(b)The annuitantmember of thepension fund shall becomeamember of the board for atermwhichshallendonDecember1stofthesecondyearaftertheyear inwhichthisArticlecomesintoforceinthecity.Theboardshallconductregularelectionsannually,atleast30dayspriortotheexpirationofthetermoftheactivefiremanmemberoftheboardwhosetermnextexpires,fortheelectionofasuccessorforatermof3years.Theboardalsoshallconductregularelectionsbiennially,atleast 30 days prior to the expiration of the term of thememberwho is a pensioner of anypension fund formerly in effect in such city or an annuitant of the annuity and benefit fundhereinprovided,fortheelectionofasuccessortosuchmemberforatermof2years.Anymemberoftheboard,electedasaforesaid,shallcontinueinofficeuntilhissuccessoriselectedandqualified.Eachmemberoftheboard,beforeenteringuponthedutiesofhisoffice,shalltaketheoathprescribedby theConstitutionof thisState,whichoath shallbe filed in theofficeof the cityclerkofthecity.(Source:P.A.86‐273.)Sec.6‐175.Boardelections.The regular elections for members of the board shall be held by mail. The board shalldesignatenotlessthan2clerksofelectiontoconducttheelection.Theboardshallfurnishtheclerks of election with a list of firemen, pensioners and annuitants eligible to vote at theelection,andtallysheetstobeusedincountingthevote.Theclerksofelectionshallcountthevotescast,recordingonthetallysheetsprovidedatruecountofballotscastforeachcandidateandthecorrectnumberofunusedandspoiledballots.Immediatelyafterallballotsarecounted,theclerksofelectionshallcertifythetallysheetsbysigningthemattheplaceprovided,themarkedballotsshallbesealedanddeliveredtogetherwith all othermaterials used in the election to the office of the board, which shall cause adetailedreceipt tobe issued toeachclerkofelectionuponreceivingsuchmaterial.Not later

than 30 days prior to the elections, the retirement board shall publishwritten rules for theconduct of the elections in conformity herewith, including notification to eligible voters andprovision for poll watchers for candidates to be present at the places where the votes arecounted.Atanyelectionforactivefiremenmembers,allfiremenemployedbythecityatthetimetheelection is held and all firemen on occupational, duty or ordinary disability at the time theelectionisheldshallhavearighttovote.Atanyelectionforthepensionerorannuitantmember,allannuitantsandpensioners(exceptchildren less than age 18) and the legal guardian of any child annuitant or child pensionerwhosemotherorstepmothershallnotbeanannuitantorpensioner,shallhavearighttovote.Ballotstobeusedinsuchelectionsshallbeofasecretcharacter.Theboardshallmail,toeachpersonwhoisentitledtovote,aballotwhichpermitssuchpersontovotebymail.Theboardshallprovidebyitsrulessufficienttimebeforethedateofelectiontopermitthevotingbymailprovidedherein.Themailedballotsshallremainsealeduntiltheofficialtallyingisbegun,atwhichtimeallmailvotesshallbetalliedbynotlessthan2clerksofelectionattheofficeoftheboardashereinabovesetforth.Within72hoursafterthecloseofeachelection,theboardshallcauserecordspertainingtotheelection,includingalllistsofpersonseligibletovote,allballots,used,unusedandspoiled,andalltallysheetsusedinthecountingofvotes,tobedepositedwiththecityclerkwhoshallpreserveallsuchmaterialfor6monthsfromthedateofelection.(Source:P.A.83‐152.)Sec.6‐176.Vacancyonboard.A vacancy on the board owing to death, resignation or any other cause, shall be filled asfollows: if the vacancy is that of an ex‐officiomember, themayor of the city shall appoint apersontoserveuntilapersonqualifiedashereinbeforedescribedshallassumethedutiesofmember of the board. If the vacancy is of an active fireman member, or a pensioner orannuitant member, the successor shall be elected to serve during the remainder of theunexpiredtermataspecialelectiontobeheldbytheboardwithin30daysfromthedatethevacancyoccursandtobeconductedinthesamemannerastheregularannualelection.Amemberelectedbytheactivefiremenwhoresignsorisdischargedfromthefireserviceofthecityshallautomaticallyceasetobeamemberoftheboard.AnyElectivememberoftheboardshallbesubjecttorecallasfollows:Ifnotlessthan60%oftheactivefiremencontributorstothefund,ornotlessthan60%ofthepensioners and annuitants (minors under age 18 excepted), petition the board inwriting todeclarevacantthemembershipofanactivefiremanmemberorpensionerorannuitant,asthecase may be, the board, within 15 days after receipt of the petition shall declare suchmembership vacant. Amember of the board is not subject to recall more than once in anycalendaryearnorwithinoneyearafterapreviousrecallpetition.(Source:P.A.81‐854.)Sec.6‐177.Boardofficers.Assoonaspossibleaftertheboardmembershipisfirstcompleted,theboardshallmeetandfromamongitsmemberselectbyamajorityvoteofthememberswhovoteuponthequestion,apresident,avicepresident,andasecretary,whoshallserveuntiltheirrespectivesuccessorsareelected.AteachregularmeetinginDecemberthereafter,theboardshallelect,byamajorityvoteofthememberswhovoteuponthequestion,apresident,avicepresident,andasecretaryfromamongitsownmembers.Thesecretaryshallbechosenfromtheactivefiremenmembersoftheboard. nationalorStatebankortrustcompanyauthorizedtoconductatrustbusinessintheStateofIllinois.Investments shall be carried at cost or at a book value in accordance with accountingprocedures approved by the board. No adjustments shall be made in investment carryingvaluesforordinarycurrentmarketpricefluctuations;butreservesmaybeprovidedtoaccountforpossiblelossesorunrealizedgainsasdeterminedbytheboard.The book value of investments held by the pension fund in one or more commingledinvestmentaccountsshallbethecostofitsunitsofparticipationinsuchcommingledaccountoraccountsasrecordedonthebooksoftheboard.The board of trustees of any fund established under this Article may not transfer itsinvestmentauthority,nortransfertheassetsofthefundtoanyotherpersonorentityforthepurposeofconsolidatingormergingitsassetsandmanagementwithanyotherpensionfundorpublicinvestmentauthority,unlesstheboardresolutionauthorizingsuchtransferissubmittedforapprovaltothecontributorsandpensionersofthefundatelectionsheldnot lessthan30daysaftertheadoptionofsuchresolutionbytheboard,andsuchresolutionisapprovedbyamajorityofthevotescastonthequestioninboththecontributorselectionandthepensionerselection. Sec.6‐197.Annuitypaymentreserve.The following amounts shall be credited to this reserve: (1) amounts transferred from thecitycontributionreserveand fromthesalarydeductionreserve for thepaymentofannuitieswhichhavebeenfixed;(2)amountsdeductedfromthesalaryofafiremanaftertheamountofhisageandserviceannuityhasbeenfixed;and(3)amountstransferredto thisreserve fromtheinvestmentandinterestreserve.Allageandserviceannuitiesandallwidow'sannuitiesshallbechargedtothisreserve.AnyamounttoberefundedonaccountofsuchannuitiesunderSections6‐143,6‐160and6‐162ofthisArticleshallbechargedtothisreserve.If a firemanwhose annuity is fixed or grantedwithdraws from service and thereafter re‐enters service before age 63, an amount determined in accordancewith thisArticle shall bechargedtothisreserveandcreditedtohimforageandserviceannuityinthecitycontributionandsalarydeductionreserves,respectively.Suchamountshallbecreditedinsaidreservesintheratio inwhichtherespectiveamountstransferredfromsuchreservesforageandserviceannuityforthefiremanbeartoeachotheratthetimehisannuitywasfixed.Ifthewifeofsuchfiremanwhenhere‐entersservicewashiswifewhenannuityforhiswifewasfixed,anamounttobedeterminedasprovidedinthisArticleshallbetransferredfromthisreserveandcreditedto the fireman forwidow's annuity in the city contribution reserveand the salarydeductionreserve,respectively.Suchamountshallbecreditedinsaidreservesintheratioinwhichtherespectiveamountstransferredbeartoeachotherat thetimetheannuity for thewifeofthefiremanwasfixed.If at the end of any year the balance in the Annuity Payment Reserve is in excess of theliabilitieschargeabletheretoby15%thereof,theexcessshallbetransferredtotheInvestmentand Interest Reserve, Ordinary Disability Benefit Reserve, Expense Reserve, Prior ServiceAnnuityReserve,orCityContributionReserve in theordernamed, to removeanydeficiencythenexistinginsuchreserves.(Source:P.A.81‐1536.)Sec.6‐198.Priorserviceannuityreserve.Thefollowingamountsshallbecreditedtothisreserve:(1)Allcontributionsofthecityforpriorserviceannuityandwidow'spriorserviceannuity;(2)allothercontributionsofthecityto provide prior service annuities in accordance with this Article shall be credited to thisreserve; and (3) all assets of any firemen's pension fundwhichwere received by the boardunder "An Act to provide for a firemen's pension fund and to create a board of trustees toadministersaidfundincitieshavingapopulationexceedingtwohundredthousand(200,000)inhabitants",filedJune14,1917,asamended,insuchcityontheeffectivedate,asprovidedinSection10‐9‐53oftheFiremen'sAnnuityandBenefitFundActoftheIllinoisMunicipalCode.Allpriorserviceannuitiesandwidow'spriorserviceannuitiespayableunderthisArticleandthe"Firemen'sAnnuityandBenefitFundActoftheIllinoisMunicipalCode",andallannuities,benefitsandpensionswhichhavebeenorshallbegrantedundersaidAct,filedJune14,1917,asamended,andtherequirementsfortermannuities,shallbechargedtothisreserve.Ifatanytimethebalanceintheinvestmentandinterestreserveisnotsufficienttopermitatransfer fromthat reserve to theannuitypaymentreserveof suchamountsasarenecessaryaccordingtotheAmericanExperienceTableofMortalityandtheCombinedAnnuityTableandapplicable rates of interest, whichever table applies, to make the balance of the annuitypayment reserve equal to the liabilities chargeable thereto (including among such liabilities,andinadditiontoallotherliabilitiesofsuchreserve,thepresentvaluesofallannuitiesenteredupon, and of all annuities fixed and not entered upon to be charged to such reserve) anyamountnecessary for suchpurpose shall be transferred from this reserve to the investmentandinterestreserve.(Source:Laws1963,p.2034.)

When amounts in excess of that required to pay any expenses,annuitiesorbenefitschargeabletothereservestowhichsuchsumshavebeentransferredshallbereceivedintosuchreserves,suchexcessamountsshallbetransferredtothereservesfromwhichanysuchsumswere takenuntil the full sum is returned to thereserves fromwhichatransfer was made. duringwhich a firemanwas in receipt of pension on account of disability from any pensionfundsupersededbythisfund.Incomputingtheservicerenderedbyafiremanonandaftertheeffectivedate,thefollowingperiodsshallbecountedinadditiontoallperiodsduringwhichheperformedthedutiesofhisposition,asperiodsofserviceforannuitypurposesonly:Allperiodsof(a)vacation,(b)leaveofabsence with whole or part pay, (c) leave of absence during which he was engaged in themilitaryornaval serviceof theUnitedStatesofAmerica, (d)disability forwhichhe receivesany disability benefit, (e) disability for which he receives whole or part pay, (f) leave ofabsence, or other authorized relief fromactive duty, duringwhichhe served as president ofThe Firemen's Association of Chicago, provided that for all leaves of absence or otherauthorizedreliefunderthisitem(f),includingthosebeginningbeforetheeffectivedateofthisamendatoryActofthe97thGeneralAssembly,thefiremancontinuestoremaininswornstatus,subject to the professional standards of the public employer or those terms established instatute,(g)periodsofsuspensionfromdutynottoexceedatotalofoneyearduringthetotalperiod of service of the fireman, and (h) a period of time not to exceed 23 days in 1980 inaccordance with an agreement with the City on a settlement of strike; provided that thefiremanelectstomakecontributionstotheFundforthevariousannuityandbenefitpurposesaccordingtotheprovisionsofthisArticleasthoughhewereanactivefireman,baseduponthesalaryattachedtothecivilservicerankheldbyhimduringsuchabsencefromduty,andifthefiremansoelects,thecityshallmaketheprescribedconcurrentcontributionsforsuchannuityand benefit purposes as provided in this Article, all to the end that such fireman shall beentitledtoreceivethesameannuitiesandbenefitsforwhichhewouldotherwisebeeligibleifhehadcontinuedasanactivefiremanduringtheperiodsofabsencefromduty.Incomputingserviceonandaftertheeffectivedateforordinarydisabilitybenefit,allperiodsdescribedintheprecedingparagraph,exceptanyperiodforwhichafiremanreceivesordinarydisabilitybenefit,shallbecountedasperiodsofservice.In computing service for any of the purposes of this Article, credit shall be given for anyperiodspriortoJanuary9,1997,duringwhichanactivefireman(orfireparamedic)whoisamemberoftheGeneralAssemblyisonleaveofabsenceorisotherwiseauthorizedtobeabsentfrom duty to enable him to perform his legislative duties, notwithstanding any reduction insalary forsuchperiodsandnotwithstanding that thecontributionspaidby the firemanwerebasedonsuchreducedsalaryratherthanthefullamountofsalaryattachedtohiscivilservicerank.IncomputingserviceforanyofthepurposesofthisArticle,nocreditshallbegivenforanyperiodduringwhichafiremanwasnotrenderingactiveservicebecauseofhisdischargefromthe service, unless proceedings to test the legality of the discharge are filed in a court ofcompetent jurisdiction within one year from the date of discharge and a final judgment isenteredthereindeclaringthedischargeillegal.No overtime or extra service shall be included in computing service of a fireman and notmorethanoneyearoraproperfractionalpartthereofofserviceshallbeallowedforservicerenderedduringanycalendaryear.(Source:P.A.97‐651,eff.1‐5‐12.)Sec.6‐210.Creditallowedforserviceinpolicedepartment.Servicerenderedbyafireman,asaregularlyappointedandswornpolicemanofthecityshallbeincluded,forthepurposesofthisArticle,asifsuchservicewererenderedasafiremanofthecity.Salaryreceivedbyafiremanforanysuchserviceasapolicemanshallbeconsidered,forthepurposesofthisArticle,assalaryreceivedasafireman.Anyannuitypayabletoafiremanunder this Article shall be reduced by any pension or annuity payable to him from anypolicemen'sannuityandbenefitfundinoperationinthecity,andanymemberenteringserviceafter January1, 2011 shall not be given service credit in this fund for anyperiod of time inwhich themember is in receipt of retirement benefits from any annuity and benefit fund inoperationinthecity.

Forserviceinanexemptpositionabovecareerservicerank,benefitcomputationsunderthisArticleshallbebasedontheactualfullsalaryattachedtotheexemptrankpositionheldbythefiremanifandonlyif:(1)employeecontributionshavebeenpaidontheactualfullsalaryattachedtotheexemptrank position held by the fireman for all service on or after January 1, 1994 in an exemptpositionabovecareerservicerank;(2)thefiremanhasheldoneormoreexemptpositionsforatleast5consecutiveyears(or,in the caseof a firemanwho retireddue to attainmentof compulsory retirement agebeforeDecember1, 2003, heldoneormore exemptpositions for a consecutiveperiodof at least3years and9months andmade thepayment requiredunder subsection (c) for aperiodof atleast5years)andhasheldtherankofbattalionchieforfieldofficerforatleast5years(atleast3years and9months in the caseof a firemanwho retireddue toattainmentof compulsoryretirementagebeforeDecember1,2003)duringtheexemptperiod;and(3)thefiremanwasbornbefore1955.(c) For service prior to the effective date of this amendatory Act of the 93rd GeneralAssemblyinanexemptpositionabovecareerservicerankforwhichcontributionshavebeenpaidonlyonthesalaryattachedtothefireman'spermanentcareerservicerank,afiremanmaymakethecontributionsrequiredundersubsection(b)bypayingtotheFundbeforethelaterofthedateof retirementor6monthsafter theeffectivedateof thisamendatoryAct,but innoevent later than July 1, 2005, an amount equal to the difference between the employeecontributionsactuallymadefor thatserviceandtheemployeecontributionsthatwouldhavebeenmade based on the actual full salary attached to the exempt rank position held by thefireman on or after January 1, 1994, plus interest thereon at the rate of 4% per year,compoundedannually, fromthedateof theservice to thedateofpayment (or to thedateofretirement if retirement isbefore theeffectivedateof this amendatoryAct). In the caseof afiremanwho retired in an exempt rankposition after January1, 1994andbefore January1,1999 and in the case of a firemanwho retired due to attaining compulsory retirement agebeforeDecember1,2003,thepaymentunderthissubsection(c)shallbeforaperiodofatleast5years.Ifafiremandieswhileeligibletomakethecontributionsrequiredundersubsection(b)butbeforethecontributionsarepaid,thefireman'swidowmayelecttomakethecontributions.(d)Subsection(e)ofSection6‐111andthechangesmadetothisSectionbythisamendatoryActofthe93rdGeneralAssemblyapplytoafiremanwhoretires(orbecomesdisabled)onorafterJanuary1,1994.InthecaseofabenefitpayableontheeffectivedateofthisamendatoryAct,theresultingincreaseinbenefitshallbegintoaccruewiththefirstbenefitpaymentperiodcommencingaftertherequiredcontributionsarepaid.(e)Ifafiremanorhissurvivorsdonotqualifytohavebenefitscomputedonthefullamountofsalaryreceivedforserviceinanexemptpositionasprovidedinsubsection(b),benefitsshallbecomputedon thebasisof thesalaryattachedto thepermanentcareerservicerank,andarefundofanyemployeecontributionspaidonthedifferencebetweentheactualsalaryandthesalary attached to the permanent career service rank shall be payable to the fireman uponterminationofservice,ortothefireman'swidoworestateuponthefireman'sdeath.(f) The tax levy computed under Section 6‐165 shall be based on employee contributions,including thepayments of employee contributionsunder subsections (a), (b), and (c) of thisSection6‐211.(g) The city shall pay to the Fund on an annual basis, in addition to the usual citycontributions,anamountatleastequaltothesumof(1)theincreaseinnormalcostresultingfromsubsection(e)ofSection6‐111andthechangesmadetothisSectionbythisamendatoryActof the93rdGeneralAssembly,plus (2)amortization (overaperiodof30years from theeffectivedateofthisamendatoryAct)oftheinitialunfundedliabilityresultingfromsubsection(e)ofSection6‐111andthechangesmadetothisSectionbythisamendatoryActofthe93rdGeneralAssembly.Thepaymentrequiredunderthissubsectionshallbenolessthan$400,000peryear.Paymentshallbeginwiththefirstcalendaryearcommencingaftertheeffectivedateof this amendatory Act and shall be in addition to the tax levy otherwise calculated under

The city may increase that tax levy by the amount of the payment requiredunderthissubsection,oritmayutilizeanyfundsappropriatedforthispurpose.(Source:P.A.93‐654,eff.1‐16‐04.)Sec.6‐212.Firemeninterritoryannexedtocity.Wheneveranyterritory isannexedtoacity,anypersonthenregularlyemployedasapaidfireman in the annexed territory, who is employed as a fireman by the city on the date ofannexation,shallautomaticallycomeundertheprovisionsofthisArticle.Serviceasafiremanrendered in such territory shall be considered, for the purposes of this Article, as servicerenderedinsuchcity.Anysuchfiremanshallbetreated,asofthedatewhensuchannexationshallcomeintoeffect,inthemannerspecifiedinthisArticleconcerningpresentemployeesorfutureentrantsofthecityonthedateuponwhichthisArticleshallcomeintoforceandeffectinsuchcity.(Source:Laws1963,p.161.)Sec.6‐213.Annuities,etc.,exempt.Allpensions,annuities,refundsanddisabilitybenefitsgrantedunderthisArticleandeveryportionthereof,areexemptfromattachmentorgarnishmentprocessandshallnotbeseized,taken, subjected to, detained, or levied upon by virtue of any judgment or any process orproceedingwhatsoeverenteredorissuedbyoroutofanycourtinthisState,forthepaymentandsatisfaction inwholeor inpartofanydebt,damage,claim,demand,or judgmentagainstanypensioner,annuitant,applicantforarefundorotherbeneficiaryhereunder.Nopensioner,annuitant,applicantforarefund,disabilitybeneficiaryorotherbeneficiaryhasarighttotransferorassignhisorherpension,annuity,refundordisabilitybenefitoranypartthereofbymortgageorotherwise,exceptthatanannuitantordisabilitybeneficiarymaydirectinwritingthatamonthlypaymentbemadetosuchassociationororganizationwithwhichheor his widowmay be affiliated by virtue of his fire service, or for hospitalization insurancepurposes.Anannuitantmayexecuteunderoathawrittenwaiverofhisrighttoreceivealloranypartofhis annuity. The waiver shall take effect upon being filed with the board and shall beirrevocable.Theannuityshallthereuponbepermanentlyreducedbytheamountwaived.Theboard, initsdiscretion,however,maypaytothewifeofanyabovestatedperson,suchproportionofherhusband'sannuity,pension,refundordisabilitybenefitasacourtmayorder,orsuchanamountastheboardmayconsidernecessaryforhersupportorforthesupportofherselfandthechildren,intheeventofhisfailuretoprovidesuchsupport.Theboardmayalsoretainoutofanyfutureannuity,pension,refundordisabilitybenefitpaymentsuchamountoramounts, as it may in its discretion set for the purpose of repayment into this fund of anymoneys paid to such person through misrepresentation, fraud or error. Any action hereinprovidedtobetakenbytheboardshall,whentaken,releasetheboardandthefundfromanyliabilityforanymoneysretainedorpaidoutashereinprovided.Whenever any annuity, pension, refund or disability benefit is payable to aminor or to apersonadjudgedtobeunderlegaldisability,theboardinitsdiscretionwhentotheapparentinterest of suchminor or personunder legal disabilitymaywaive guardianshipproceedingsand pay suchmoney to the person providing for or caring for suchminor and to the wife,parentorbloodrelativeprovidingorcaringforsuchpersonunderlegaldisability.Wheneverapensioner,annuitant,applicantforrefundordisabilitybeneficiarydisappearsorhiswhereaboutsareunknownand itcannotbeascertainedwhetherornothe is living, thereshallbepaidtohiswifeunderthissectiontheamountwhichwouldbepayabletoher intheevent her fireman husband had died on the date of his disappearance. Sec.6‐220.Examinationandreportbydirectorofinsurance.TheDirectorofInsurancebienniallyshallmakeathoroughexaminationofthefundprovidedforinthisArticle.HeorsheshallreporttheresultsthereofwithsuchrecommendationsasheorshedeemspropertotheGovernorfortransmittaltotheGeneralAssemblyandsendacopyto the board and to the city council of the city. employer contributions transferred to the Fund under Section 4‐108.6 and the amountsdeterminedbytheFundinaccordancewiththisSection,plusinterestonthatdifferenceattheactuarially assumed rate, compounded annually, from the date of service to the date ofpayment.The Fundmust determine the fireman's payment required to establish creditable serviceunder this Section by taking into account the appropriate actuarial assumptions, includingwithout limitation the fireman's service, age, and salary history; the level of funding of theFund; and any other factors that the Fund determines to be relevant. For this purpose, thefireman's required payment should result in no significant increase to the Fund's unfundedactuarial accrued liabilitydeterminedasof themost recentactuarialvaluation,basedon thesame assumptions and methods used to develop and report the Fund's actuarial accruedliability and actuarial value of assets under Statement No. 25 of Governmental AccountingStandardsBoardoranysubsequentapplicableStatement.(Source:P.A.96‐727,eff.8‐25‐09.)Sec.6‐228.ActionbyFundagainstthirdparty;subrogation.In those caseswhere the injuryordeath forwhich adisability ordeathbenefit is payableunderthisArticlewascausedundercircumstancescreatingalegalliabilityonthepartofsomepersonorentity (hereinafter"thirdparty") topaydamages to the fireman, legalproceedingsmaybetakenagainstsuchthirdpartytorecoverdamagesnotwithstandingtheFund'spaymentoforliabilitytopaydisabilityordeathbenefitsunderthisArticle.Insuchcase,however,iftheactionagainstsuchthirdpartyisbroughtbytheinjuredfiremanorhispersonalrepresentativeandjudgmentisobtainedandpaid,orsettlementismadewithsuchthirdparty,eitherwithorwithoutsuit,fromtheamountreceivedbysuchfiremanorpersonalrepresentative,thenthereshall be paid to the Fund the amountofmoney representing the death or disability benefitspaid or to be paid to the disabled fireman pursuant to the provisions of this Article. In allcircumstanceswheretheactionagainstathirdpartyisbroughtbythedisabledfiremanorhispersonalrepresentative,theFundshallhaveaclaimorlienuponanyrecovery,byjudgmentorsettlement, out of which the disabled fireman or his personal representative might becompensated from such thirdparty. The Fundmay satisfy or enforce any such claimor lienonlyfromthatportionofarecoverythathasbeen,orcanbe,allocatedorattributedtopastandfuturelostsalary,whichrecoveryisbyjudgmentorsettlement.TheFund'sclaimorlienshallnotbesatisfiedorenforcedfromthatportionofarecoverythathasbeen,orcanbe,allocatedor attributed to medical care and treatment, pain and suffering, loss of consortium, andattorney'sfeesandcosts.Where action is brought by the disabled fireman or his personal representative they shallforthwithnotifytheFund,bypersonalserviceorregisteredmail,ofsuchfactandofthenameofthecourtwheresuchsuitisbrought,filingproofofsuchnoticeinsuchaction.TheFundmay,atanytimethereafter,interveneinsuchactionuponitsownmotion.Therefore,noreleaseorsettlementofclaimfordamagesbyreasonofinjurytothedisabledfireman,andnosatisfactionof judgment in such proceedings, shall be validwithout thewritten consent of the Board ofTrusteesauthorizedbythisCodetoadministertheFundcreatedunderthisArticle,exceptthatsuchconsentshallbeprovidedexpeditiouslyfollowingasettlementorjudgment.Intheeventthedisabledfiremanorhispersonalrepresentativehasnotinstitutedanactionagainstathirdpartyatatimewhenonly3monthsremainbeforesuchactionwouldthereafterbebarredbylaw,theFundmay,initsownnameorinthenameofthepersonalrepresentative,commence a proceeding against such third party seeking the recovery of all damages onaccountofinjuriescausedtothefireman.Fromanyamountsorecovered,theFundshallpaytothepersonalrepresentativeofsuchdisabledfiremanallsumscollectedfromsuchthirdpartybyjudgmentorotherwiseinexcessoftheamountofdisabilityordeathbenefitspaidortobepaidunderthisArticletothedisabledfiremanorhispersonalrepresentative,andsuchcosts,attorney's fees, and reasonable expenses as may be incurred by the Fund in making thecollectionor inenforcingsuch liability.TheFund'srecovery,shallbesatisfiedonly fromthatportionofarecovery thathasbeen,orcanbe,allocatedorattributed topastand future lost

salary,whichrecoveryisbyjudgmentorsettlement.TheFund'srecoveryshallnotbesatisfiedfromthatportionoftherecoverythathasbeenorcanbeallocatedorattributedtomedicalcareandtreatment,painandsuffering,lossofconsortium,andattorney'sfeesandcosts.Additionally, with respect to any right of subrogation asserted by the Fund under thisSection,theFund,intheexerciseofdiscretion,maydeterminewhatamountfrompastorfuturesalaryshallbeappropriateunderthecircumstancestocollect fromtherecoveryobtainedonbehalfofthedisabledfireman.(Source:P.A.96‐727,eff.8‐25‐09.)Sec.6‐229.Provisionsapplicabletonewhires.(a)NotwithstandinganyotherprovisionofthisArticle,theprovisionsofthisSectionapplytoapersonwhofirstbecomesafiremanunderthisArticleonorafterJanuary1,2011.(b)Afiremanage55ormorewhohas10ormoreyearsofserviceinthatcapacityshallbeentitled at his option to receive a monthly retirement annuity for his service as a firemancomputedbymultiplying2.5%foreachyearofsuchservicebyhisorherfinalaveragesalary.Theretirementannuityofa firemanwho isretiringafterattainingage50with10ormoreyearsofcreditableserviceshallbereducedbyone‐halfof1%foreachmonththatthefireman'sageisunderage55.Themaximum retirement annuity under this subsection (b) shall be 75%of final averagesalary.For the purposes of this subsection (b), "final average salary"means the averagemonthlysalaryobtainedbydividingthetotalsalaryofthefiremanduringthe96consecutivemonthsofservicewithinthelast120monthsofserviceinwhichthetotalsalarywasthehighestbythenumberofmonthsofserviceinthatperiod.BeginningonJanuary1,2011,forallpurposesunderthisCode(includingwithoutlimitationthe calculationof benefits and employee contributions), the annual salarybasedon theplanyear of a member or participant to whom this Section applies shall not exceed $106,800;however, that amount shall annually thereafter be increased by the lesser of (i) 3% of thatamount,includingallpreviousadjustments,or(ii)one‐halftheannualunadjustedpercentageincrease(butnotlessthanzero)intheconsumerpriceindex‐uforthe12monthsendingwiththeSeptemberprecedingeachNovember1,includingallpreviousadjustments.(c) Notwithstanding any other provision of this Article, for a personwho first becomes afireman under this Article on or after January 1, 2011, the annuity to which the survivingspouse,children,orparentsareentitledunderthissubsection(c)shallbeintheamountof662/3%ofthefireman'searnedpensionatthedateofdeath.Notwithstandinganyotherprovisionof thisArticle, themonthlyannuityofa survivorofapersonwho first becomes a fireman under this Article on or after January 1, 2011 shall beincreasedontheJanuary1afterattainmentofage60bytherecipientofthesurvivor'spensionandeachJanuary1thereafterby3%orone‐halftheannualunadjustedpercentageincreaseinthe consumer price index‐u for the 12 months ending with September preceding eachNovember 1, whichever is less, of the originally granted survivor's annuity.
