SURCHARGE FOR CALL OR DEMAND, PARATRANSIT, AND AIRPORT TRANSFER CARRIERS. Pennsylvania Public Utility Commission by its Fuel Cost Recovery Surcharge Order at special Permission Number 28209, ratified June 1, 2006, authorized call or demand, paratransit, and airport transfer carriers under the jurisdiction of this Commission to adjust rates and fares to offset significant increases in the cost of fuel. RECOMMENDATION that the Commission allow call or demand, paratransit, and airport transfer carriers to continue utilizing the Fuel Cost Recovery Surcharge at special Permission No. 28209 and that it be extended until midnight, June 30, 2009.

(Billing Dispute) By Initial Decision issued on March 20, 2008, ALJ Cocheres sustained the Complaint and ordered VSSI to make a refund plus interest at the legal rate, to the Complainant. VSSI filed Exceptions on April 9, 2008. RECOMMENDATION that the Commission grant VSSI’s Exceptions in part, deny them in part and reverse the ALJ’s Initial Decision, consistent with the proposed Opinion and Order.

OSA-0164* A-00120714C0602 PA PUC, BTS v. MILDRED A. KISSEL, t/a

KISSEL MOVING and STORAGE (Settlement Agreement) On April 18, 2008, BTS and Respondent filed a Settlement Agreement. BTS averred that Respondent had provided household goods transportation service, failed to charge the proper rate and requested a civil penalty. As part of the Settlement, Respondent agreed to comply with the Public Utility Code and the Commission’s Regulations and Policies in the future. BTS agreed to reduce the civil penalty. RECOMMENDATION that the Commission adopt the proposed Opinion and Order which approves the Settlement Agreement as filed.

COMPANY (Service Dispute) Complainant alleged that she was improperly removed from the Customer Assistance Program. ALJ Nguyen issued an Initial Decision on March 12, 2008 sustaining the Complaint. Exceptions were filed on April 1, 2008, by PECO RECOMMENDATION that the Commission adopt the proposed Opinion and Order granting PECO’s Exceptions.

OSA-0174* M-00072051 PA PUC, PROSECUTORY STAFF v. PECO

ENERGY COMPANY (Informal Investigation) On June 20, 2007, the Prosecutory Staff of the Law Bureau and the Bureau of Consumer Services initiated an informal investigation to determine whether PECO may have failed to provide the required 72-hour advance notice of termination to approximately 2,000 accounts and failed to restore service within 24 hours to accounts that had been terminated in error. By Order entered February 20, 2008, we issued the Settlement Agreement for Comment. No Comments were received. RECOMMENDATION that the Commission adopt the proposed Opinion and Order approving the Settlement Agreement.

OSA-0176* M-00051865 STANDARD APPLICATION FORMS for INTERCONNECTION REQUESTS The Commission’s Interconnection Standards Working Group has developed a set of standard Application Forms for use by Customer-Generators who wish to interconnect to an electric distribution company’s distribution network pursuant to 52 Pa. Code §§ 75.1 – 75.50. After several rounds of Comments, Staff advises that the Working Group has developed appropriate Application Forms which should be tentatively adopted by the Commission and formally issued for one additional round of Comments. RECOMMENDATION that the Commission tentatively adopt the Standard Interconnection Application Forms, consistent with the proposed Tentative Opinion and Order, to be published in the Pennsylvania Bulletin..

OSA-0177* P-00072338 Petition for Declaratory Order of RELIANT

ENERGY, INC. On October 9, 2007, Reliant filed a Petition for Declaratory Order regarding the Commission’s jurisdiction over Duquesne Light Company’s request to withdraw from PJM Interconnection, L.L.C. and to commence an investigation. On December 18, 2007, ALJ Colwell issued the Initial Decision which determined that the Commission did not have jurisdiction over DLC’s membership in PJM. Exceptions were filed by the OSBA. Reply Exceptions were filed by DLC and Dominion Retail, Inc. RECOMMENDATION that the Commission grant in part and deny in part, the OSBA’s Exceptions and modify the ALJ’s Initial Decision, consistent with the proposed Opinion and Order.

RECOMMENDATION that the Commission adopt the proposed Opinion and Order denying the relief requested by Respondent and adopting the Default Order as the final Order in this proceeding.

OSA-0183* M-00051865 Proposed Policy Statement: STANDARD

INTERCONNECTION APPLICATION FEES for use by Electric Distribution Companies when processing Interconnection Applications. The evolving nature of alternative generation systems, technology and markets indicate that the fee structure and amounts should be set forth in a Policy Statement to provide guidance for Electric Distribution Companies. Requests to deviate from the fees established in the policy statement will require an evidentiary showing. RECOMMENDATION that the Commission adopt the proposed Policy Statement, consistent with the proposed Opinion and Order to be published in the Pennsylvania Bulletin.
