Each of us, as a REALTOR®, does so much more than “sell houses. We are trusted resources in an ever changing market, making it incumbent upon us that we keep up with, and when pos-sible, ahead of those changes. To that end, your Association sponsors classes, lunch and learns, membership breakfasts, night courts and other events which help us increase our knowledge. We have the op-portunity to take advantage of the exper-tise of speakers from NAR and VAR, and we have timely visits from our local police chiefs and mayors and chairs. But, we can only benefit from these opportunities if we attend. You owe it to yourselves and to your clients to take advantage of what your Association makes available.
Another important function of Your As-sociation is to advocate for home owners and home ownership. Our Public Policy Committee will once again be interview-ing local candidates in the coming year. With federal elections (perhaps you have already heard that we have a presiden-tial election in 2016,) NAR and VAR will also be vetting candidates, and making endorsements. As individuals we may be Republicans, Democrats, Libertarians,
Greens or Independents. As Realtors were are able, through our RPAC invest-ment, to be members of the Realtor Party, supporting those candidates who are sup-portive of our issues. These include both Democrats, and Republicans. The impor-tance of our involvement really hit home in early November when a candidate for a major party presidential nomination stated that would end the mortgage inter-est deduction.
As the year comes to a close, I would like to thank those of you who have been actively involved with VPAR in 2015, and would encourage every member to be-come more involved in 2016. I would also like to thank our affiliates and partners for all they do to allow us to present our programs and social events. Our Associa-tion is enriched by their involvement, and I encourage you to do business with our affiliates.

the City and American Legion Post 25, participated in the Veterans Day Remembrance at the Newport News Victory Arch. As part of this Veterans’ Day ceremony, the Virginia Peninsula Association of REALTORS Veterans’ Memorial Benches were dedicated. The Mayor and Members of City Council were joined by Delegate Mamye BaCote, Delegate Monty Mason, Delegate David Yancey, Delegate-elect Marcia Price, Sena-tor John Miller and Shannon Kendrick, District Office Director, from Congressman Scott Rigell’s office. VPAR’s Immediate Past President, Dewey Hutchins, delivered remarks and introduced keynote speaker John V. Quarstein. The benches were do-nated by VPAR to the City as part of a NAR Placemaking Grant.

LOCAL ISSUESNEWPORT NEWSOn November 11th, VPAR, along with
VPAR is reviewing the first draft of the housing needs report and market analysis study that Dr. Tom Hall from Christopher Newport University has prepared using funds from the NAR Housing Opportunity Program. Dr. Hall continues to tweak and add details to the report, so it is not in final form as of this publication. VPAR will meet with Dr. Hall and the Planning staff of the City of Newport News in early January to review the information jointly and to assess ap-propriate next steps.
The City’s Comprehensive Plan Com-munity Advisory Committee (CPCAC), after taking a few months off, re-upped in December. The CPCAC is reviewing a chapter in the Plan that focuses on ex-isting conditions in the City, looking at means of creating a sustainable, acces-sible and resilient City. The City hopes to create comprehensive plan that aligns with current best practices and results in a more strategic, cohesive and less volu-minous plan. Both Susan Gaston, VPAR’s Legislative Consultant, and VPAR Member Michael F. Carpenter, are on the CPCAC.
REGIONALEfforts to elevate the public awareness of and public support for Ft. Eustis continue to move forward, and VPAR remains an active partner. Additional discussions will take place this week among the leadership of the Eustis Civic Leaders Association. More to come.
STATE
The 2016 General Assembly of Virginia convenes on Wednesday, January 13, 2016 for a 60-day “long” session that will include consideration of a new bi-ennial budget for the Commonwealth. With new elected leaders in the mix, with both the House and the Senate remaining in Republican hands, with a Democratic Administration and with what will be a large volume of legislation, the Session is sure to be interesting….as they all are!
The REALTOR® Legislative Agenda is shaping up and will focus on the following issues: (Bill patrons are in play and will be finalized over the coming days.
HOA/POA AmendmentsVAR will seek legislation to make a number of changes to the Property Owners Association Act to include:• Further limits on fees that POA’s can
charge on renters or those owners who choose to rent their property;
• Prohibiting associations from evicting tenants
• Defining in the Code who are the purchasers’ and sellers’ designated agenda for the purposes of delivery of the disclosure packet;
• Defining in the Code that delivery of the packet is defined as the packet be-ing delivered to the purchasers’ des-ignated agents by one of the delivery methods outlined in the Code;

• Mirroring the POA to the Condomin-ium Owners Association in regards to a buyer being able to walk from a contract when the disclosure packet is not available;
• Clarifying that when multiple HOAs are involved in a transaction and mul-tiple disclosure packets are required, that the three-day right of revision does not begin until the last packet has been delivered;
• Increasing the timeframe that associa-tions can back-charge sellers for the cost of the packets to 90 days from the existing 45 days, to satisfy concerns regarding delayed closings with TILA-RESPA Integrated Disclosure (TRID)
Agency/Licensing Law RevisionsVAR will seek clarifications to the agency/licensing law that will include: • Authorizing the Virginia Real Estate
Board (VREB) to apply deferred judg-ments, allowing licensees to complete education or other remedial steps with out violations going on their permanent records;
• Clarifying that the requirement for written brokerage agreements only applies to residential transactions. Commercial transactions generally involve opposing parties that are each presented by counsel and are busi-ness persons families with real estate transactions. Also, often, national commercial firms form sub-agency re-lationships with Virginia firms for the
sale of Virginia property and refuse to sign Virginia brokerage agreements….thus killing “the deal.” This legislation also states that commercial transac-tions do not require a Disclosure of Brokerage Relationship
• Clarifying that the act of merely show-ing property does not require a writ-ten brokerage agreement
Home InspectionsVAR will seek legislation to require a DPOR license for anyone performing a home inspection as part of a real estate transaction
Housing Trust Fund – Earnest Money Deposits and Escrow FundsVAR will seek legislation to allow brokers to take stranded escrow funds and ear-nest money deposits, interplead them to General District Courts and then allow the judge to transfer those funds to the Virginia Housing Trust Fund.

FHFA Releases 2016 GSE Loan Limits On Nov. 25, 2015, the Federal Housing Finance Agency (FHFA) released the 2016 conforming Loan Limits for Fannie Mae and Freddie Mac. The national conform-ing loan limit remained at $417,000 while 39 additional counties were added as high cost areas which raises the limit up to $625,500 in the most costly areas. Congress Approves Five-Year Transpor-tation Package, G-Fees RemovedOn Dec. 3rd, the House approved HR. 22, Fixing America’s Surface Transportation Act (FAST Act) by a vote of 359-65. The Senate quickly followed with an approval vote of 83-16. President Obama is ex-pected to sign the bill into law prior to the December 4th deadline.
Passage of a five year surface transporta-tion program is a victory in many ways. In July 2015, the Senate proposed funding a portion of transportation with guarantee fees (g-fees) collected by Fannie Mae and Freddie Mac. NAR began an effective cam-
paign to remove g-fees as a pay-for in sur-face transportation projects. After weeks of negotiations between the House and Senate, the final legislation completely re-moved g-fees. Ultimately, Congress altered the Federal Reserve’s surplus account and dividends owed to large banks to pay for the bulk of transportation funding until 2020.
Additional victories stem from safety measures and livability programs. States receiving federal funding will now be en-couraged to adopt Complete Streets stan-dards. NAR has been a part of a coalition since 2008 working to establish a fed-eral Complete Streets standard. And the primary funding program for Safe Routes to School, and bicycling/walking facilities was retained within the final package.
NAR’s transportation advocacy efforts have focused on a long-term sustainable program. Although five years of consis-tency of federal transportation programs is a major success, funding after 2020 will need to be ironed out once more.

Urgent Alert: Sophisticated Email Scams Targeting the Real Estate Industry
December 15, 2015
Criminals are hacking into the email accounts of real estate agents or other persons involved in a real estate transaction and using information gained from the hack to dupe a party into a fraudulent wire transfer. The hackers often send an email that appears to be from an individual legitimately involved in the transaction, informing the recipient, often the buyer, that there has been a last minute change to the wiring instructions. Following the new instructions, the recipient will wire funds directly to the hacker’s account, which will be cleared out in a matter of minutes. The money is almost always lost forever.
In the next two weeks, real estate professionals will be contending with
high transactional volumes during year-end closings. This is a busy and hectic time for real estate professionals, and many millions of dollars will be sent and received via wire before the end of the year. This is exactly the environment in which online criminals seek to operate.
The National Association of REALTORS® urges its members and state and local REALTOR® associations to be on high alert for email and online fraud.
In May 2015, NAR issued an alert regarding a sophisticated email wire fraud hitting the real estate industry. Since then, the incidents of online scams targeting practitioners have continued to rise but the advice is the same.
Bottom line: Do not let your guard down. Start from the assumption that any email in your in-box could be a targeted attack from a criminal.

have all been targeted in these scams. You can also download and distribute NAR’s online fraud prevention handout, accessible here. • If possible, do not send sensitive infor-mation via email. If you must use email to send sensitive information, use encrypted email. • Immediately prior to wiring any money, the person sending the money must call the intended recipient to verify the wiring instructions. Only use a verified tele-phone number to make this call. • Do not trust contact information in un-verified emails. The hackers will recreate legitimate-looking signature blocks with their own telephone number. In addi-tion, fraudsters will include links to fake websites to further convince victims of their legitimacy. • Never click on any links in an unverified email. In addition to leading you to fake websites, these links can contain viruses and other malicious spyware that can make your computer – and your transac-tions – vulnerable to attack. • Never conduct business over unsecured wifi. • Trust your instincts. Tell clients that if an e-mail or a telephone call ever seems suspicious or “off,” that they should refrain from taking any action until the communication has been independently verified as legitimate.• Clean out your e-mail account on a regu-
lar basis. Your e-mails may establish pat-terns in your business practice over time that hackers can use against you. In ad-dition, a longstanding backlog of e-mails may contain sensitive information from months or years past. You can always save important e-mails in a secure location on your internal system or hard drive.• Change your usernames and passwords on a regular basis, and make sure your employees and licensees do the same.• Never use usernames or passwords that are easy to guess. Never, ever use the password “password.”• Make sure to implement the most up-to-date firewall and anti-virus technologies in your business.

Damage Control• If you believe your e-mail or any other account has been hacked, or that you or a client has otherwise been a victim of online fraud, you should take the follow-ing steps:• If money has been wired via false wiring instructions, immediately call all banks and financial institutions that could pos-sibly put a stop to the wire.• Contact your local police. • Contact any clients or other parties who may have been exposed during the at-tack so that they take appropriate action. Remind them not to comply with any requests from an unverified source.• Change all usernames and passwords associated with any account that you believe may have been compromised or otherwise made vulnerable by the attack.• Report any fraudulent activity to the Federal Bureau of Investigations via their Internet Crime Complaint Center. Defeated a 500% Increase We helped to defeat a budget amendment that would have increased the deductible that property owners, including
YOUR clients, pay to have their leaking underground oil tanks cleaned up and repaired by 500%. The current $500 deductible was proposed to go up to $2,500.
The petroleum tank increase was a budget amendment.
Prison time: 1 to 6 years We added a felony charge to any criminal who lures or entices a REALTOR® to a property with the intent to do harm.
The added felony will increase a criminal’s sentence by up to 6 years. The 1-6 years are the statutory sentencing guidelines.
Save $150 - $500/hr. on attorneys’ fees We continued to refine legislation that allows property managers to represent your clients in General District court
without needing an attorney. So, how much would your attorney charge per hour? Typically, attorney fees range from $150 - $500/hr.
$12,000 back to consumers Under a new law that VAR drafted, we have made it easier for Virginia consumers who have received a court judgment to
collect damages from the Real Estate Transaction Recovery Fund. The average claim is approximately $12,000. The $12,000 figure is an estimate by the DPOR finance staff on the average claim that comes before the Board.
Wiped out $200/per Sign Fines We worked with a state legislator to prevent a proposal creating daily fines of $200 for any sign in any public right of
way. How often do you use such signs for your listings? 10 days for 1 sign = $2,000 The $200 per sign was the language in the proposed bill VAR was able to stop.

Residential Sales Continue Growth Virginia experienced year-over-year increases in residential home sales and median sales price in November 2015, continuing a trend of market improve-ment. Year-to-date sales through No-vember 30, 2015, account for more than $32.02 billion in sales volume. Relative to the same year-to-date period for 2014, the value of sales transactions has in-creased by 11.7 percent. The number of sales closed in November 2015 was 3.3 percent higher than for that of the same month in 2014. November 2015 me-dian sales price ($251,500) was slightly higher than November 2014 ($250,000) and 2 percent higher than November 2013 ($245,000). As I drew in my head, and was turning around, Down the chimney St. Nicholas came with a bound.He was dressed all in fur, from his head to his foot, And his clothes were all tarnished with ashes and
soot; A bundle of toys he had flung on his back, And he looked like a pedler just opening his pack.
His eyes—how they twinkled! his dimples, how merry! His cheeks were like roses, his nose like a cherry! His droll little mouth was drawn up like a bow, And the beard on his chin was as white as the
snow; The stump of a pipe he held tight in his teeth, And the smoke, it encircled his head like a wreath; He had a broad face and a little round belly, that shook when he laughed, like a bowl full of jelly.
He was chubby and plump, a right jolly old elf, And I laughed when I saw him, in spite of myself; A wink of his eye and a twist of his head, Soon gave me to know I had nothing to dread; He spoke not
