Foreword
Tianjin Second Urban Development and Environment Projects are the projects
using World Bank loan by Tianjin Municipal Government (TMG) to improve urban
infrastructure. The project has been started since 1998 and ready for appraisal through
efforts by many international and domestic specialists. This report is a Resettlement
Action Plan (RAP) for involuntary resettlement and land requisition during
implementation. It includes detailed investigation and description on the people
affected, applicable laws, compensation standard, organization structure for
resettlement, implementation plan, arrangement of capital and procedures etc. The
report shall be a guide and a base for implementation when the World Bank approves it.
Tianjin Second Urban Development and Environment Projects consist of three
parts: urban drainage, urban transport and township drainage; while each part consists
of a number of components. All those components with resettlement and land
requisition are dealt with in the report in detail.
Since many problems of the project need further study, final design scheme is not
available so far and we cannot accurately define impact of resettlement. This includes
bus priority project, Dagunan interchange and township drainage. A policy frame is,
therefore, developed to be followed during process of resettlement to solve encountered
problems. The policy frame is attached to the report.

1. Introduction
1. Brief DescriptionIn order to accelerate construction and perfection of Tianjin urban infrastructure to meetthe demand of industrial production and people's daily life, Tianjin city will use thesecond loan from the World Bank on its urban development and environment project.The project consists of two categories: environment component and transportationcomponent. Each component includes several works.
1.1 Environment Component

Fukanglu in the north, Binshuidao andHuanhuzhonglu in the south, HongQinanlu in the west, and Weijinnanlu.in the east. The total water catchingarea is 295.56 hectares. Thewastewater: Within the district, it is of150m of the southern Fukanglu in thenorth, Binshuidao and Shuishangbeiluin the south, Hongqinanlu in the west,and Weijinnanlu in the east. The totalservice area is 263.21 hectares. Thearea out of the wastewater projectcovers the western part of NankaiUniversity, several areas such asTiantuonan, Wangdingdi, Huayuan,Xihuayuan, and Huayuan IndustrialPark, etc., for the drainage of thewastewater. After the systems arecompleted, the service scope of thewastewater drainage system of thesouthern Fukanglu is of 1,256 ha.Storm water drains to Jin River,wastewater drains to XianyangluWWTP, which is financed by Japaneseloan, and then flows to Dagu DrainageCanal.

1.1.1 Tianjin Beicang WWTP
1.1. 1.1 Introductiona. Background
Beicang WWTP will be constructed by using ADB loan with a capacity of 100,000
m3 /day for phase I and 250,000 m3 /day in future to provide wastewater treatment
facility for Beicang area including a WWTP, pipeline network for sewage and a pump
station.
b. Investment
Planned total investment is RMB 350. 35 million, of which 188.41 million is from the
ADB loan and construction period is expected as 3 years.
1.1. 1.2. Project impact
Based on actual investigation, the project needs permanent land requisition for 409 mu
(27.2 hectares), temporary land using for 48 mu (3.2 hectares) impacting 5 villages and
9 households totaling 37 people. All the land occupation has no problems for
resettlement.
1.1.1.3 Law Frame

Resettlement action plan of the project shall follow Land Law of People's Republic of
China issued in 1998, Temporary Regulation on Management of Land Requisition in
Tianjin and Non-voluntary Resettlement Policy of ADB.
1.1.1.4 Principle for compensation
In accordance with Laws and rules of PRC and ADB, major principles for resettlement
action plan (RAP) are: (1) Works comparison should be economically, environmentally
and socially feasible to minimize impact on the people and villages; (2) ensure living
standard of the people impacted; (3) ensure that the RAP should follow laws, rules and
policies of PRC and ADB on land requisition and resettlement; (4) ensure that
compensation shall be paid to the villagers committee, and it is up to the villagers
committee and assembly to decide through discussion the use of the compensation
funds.
1.1.1.5 Standard for compensation
Based on law frame mentioned above, compensation standard for permanent land
requisition (which was formerly nursery) is RMB 29,750/mu consisting of
compensation (17,500/mu), compensation for crops (1,750/mu) and compensation for
resettling (10,500/mu). Compensation for temporary land using is 3500/mu. Calculation
is as follows:

1.1.1.7 Measures for the recovery of living
Principally, villagers of the villages and towns are not living on fanning. Permanent
land acquisition will impact on those land contractors. Therefore, one of the targets of
plan for recovery of living is to offer opportunities for impacted contractors' choice.
Based on investigation, all the villager committees guarantee that besides cash
payment, the impacted contractors will be arranged to work in the village-run
enterprise in their own willing. Compensation for the land shall be used to produce the
value-added products to increase the villagers' income.
1.1.2 Introduction to Xianyanglu WWTP
1.1.2.1 Introduction
a. Background
Xianyanglu WWTP, a secondary sewage treatment plant with a capacity of 450,000
tons per day, will treat the sewage from Xianyanglu drainage system, one of the six
systems in Tianjin. The works includes a WWTP, pipeline network outside the plant
and sludge landfill site of 900 tons/day.
b. Total investment
The planned total investment of the project is RMB 1,199.72 million, of which RMB
256 million is from JBIC loan. The duration of the project is supposed to be four years
(2001-2004).
1.1.2.2 Project impact
Based on the preliminary design and actual investigation of the affected areas, the
project needs permanent land requisition for 1,100 mu, of which 240 mu are fish ponds,
40 mu are wastelands and 820mu are farm lands. The WWTP site will occupy the land
of Zhongbei village, Xibeixie village and Xingzhuangzi village, and the sediment
treatment zone will occupy the land of Zhongbei village and Xibeixie village. There are
no residential people in the lands to be occupied, with no problems for resettlement.

and Hubeilu.

Expansion of Nanjinlu is to reduce the greenbelt and MV-NMVseparator, re-organize road section in order to create 3.5 m widebus priority lanes at two sides of the road.As two bottlenecks in IRR, conditionts are similar with thecircular islands at Xinhualu and Hubeilu where there is a six-armand five-arm crossing respectively. The two sub-works are toremove circular islands and install traffic signal in order toimprove the traffic conditions.Includes 3 components: widening Beimalu for 6 lanes in doubledirection; foot bridge in Dongbeijiao intersection; channelizeXibeijiao intersection and improve transportation capacity.
Renovation of Beimalu Overall length of Beimalu is 1.6 km and current width is 40 mRenovation of Beimalu with 4 lanes in double direction. Sections of the road shall be
widened and cross section shall be re-arranged to wider motorvehicle way from 15 m to 21 m and add 1 more lane in eachdirection for bus.
c. Provision for Bus PriorityCorridors
The corridor is from around the crossing of HuangHedao andCorridor from HuangHedao MRR to crossing of NanMalu and DongMalu. The works is to re-to NarMalu fromHuangHedao organize road section, to change MV-NMV separating greenbeltto NanMalu into separation piers, to enlarge some road so as to create a bus
priority lane at two sides.The corridor starts from Tianjin railway station, and ends at the
LiuWeilu.ShiJingluJinTangl .crossing of JinTanglu and MRR. The works is to increase busLiuWedlu-Shoir glu-JinTanglu priority lanes through expanding JinTanglu and LiuWeilu, andCorridor improving the single direction system along ShiJinglu, QiWeilu
and LiuWeilu.The corridor is from HaiGuangsi to BaLitai. The works is to
WeiJinlu Corridor adjust road sections and optimize layout of crossings so as toprovide bus priority system.
d. Expansion of Traffic The works is to expand the traffic control area to include 300Control System crossings in MRR into the traffic control system.
1.3 Project Beneficial Scope and Socioeconomic Conditions
With all the works described above, the proposed World Bank financed project
characterizes in large number of beneficial area and people.
1.3.lTransportation Component
1.3.1.1 Middle Ring Road Improvement Works
The four sub-works under MRR improvement, which cover east, south and west
part of MRR, benefit areas along MRR including HeDong District, DongLi
District, HeXi District and NanKai District. The beneficial scope includes
important social and economic areas in Tianjin, such as AnShandao hi-tech zone;
FuKanglu culture and university zone; TongLou, Nanlou and Wenzhou commercial
zone; residential blocks at Xianyanglu and WangChuanchang; the Water Park;
Tianjin Entertainment Part; and BaiLitai university zone. MRR serves 1.85 million

people, 930 thousand working positions and one-fourths traffic volume of total
Tianjin urban area.
1.3.1.2 Inner Ring Road Improvement Works
The 9 sub-works, locating in the IRR, cover six urban districts. Main affected
communities are commercial zones at Dongbeijiao, XiaoBailou, BinJiangdao and
Tianjin municipal government office. The works will serve 520 thousand people
and 540 thousand working positions.
1.3.1.3 Provision for Bus Priority Corridors
The annual bus transportation volume in Tianjin is now 575 million person/time.
The works will increase bus speed, save travel time and improve bus service level.
With the implementation of the works, bus transportation volume is expected to
reach 800 million person/time within 5 years. The works will serve 1 million
people. The proposed 3 bus priority corridors will improve operating efficiency for
about 60 bus lines, which will benefit 50,000-80,000 passengers per day.
1.3.1.4 Expansion of Traffic Control System
The works will expand the current Area Traffic Control (ATC) system to have most
of the traffic signals combined in urban area. The works is expected to increase
road capacity by 10%, to increase average vehicle speed by 15%, to reduce waiting
time by 20%, to reduce vehicle stop rate by 35%, to lower traffic accident rate by
15%. Implementation oft he works will also contribute to reduce air pollution and
benefit all Tianjin people.
1.3.2 Environment Component
1.3.2.1 NanBeicang Drainage Works
Major beneficial scope of the works is XinCun St. and TianMu St. in BeiChen
District. As the political, commercial and industrial center of the district, this area
accommodates the district government office, tens of industrial enterprises, with
35919 residents, and 18132 people working here. Total built-up area is over 10,000
m2. Being close to Jingjin highway and enjoying sound traffic conditions, this area
will become an important center for Beichen District and enjoy rapid economic
growth while attracting more people living here.

1.3.2.2 FuKanglu Drainage Works
Major beneficial scope of this works is BaLitai of Nankai District, an area of
science, education, culture and entertainment. With about ten years' development,
this area has become one of the most attractive living communities with 31874
residents and 23304 people working here. Total built-up area of this community is
1.1 million m2 . The community includes 8 colleges and universities as NanKai
University, Tianjin College of Technology, Tianjin Norrnal University, Sino-
Germany High Technology College, Tianjin Television University, etc. The
community also includes manyscience research agencies and hotels such as Tianjin
Research Institute of Environmental Science, Tianjin Research Institute of Social
Science, XinHua News Agency Tianjin Branch. The Water Park and Tianjin Sports
Center in this community are main recreation and entertainment places in Tianjin.
1.3.2.3 NanJiaowai Drainage Works
The works serves one of Tianjin's major industrial zone - the ChenTangZhuang
Industrial Zone, including tens of medium and large enterprises such as North
China Oxygen Plant, ZhaoHe Cable Plant, Tianjin Sensitization Material
Company, No. 16 Research Institute of Electronic Ministry, Metal Material
Company, ChenTang Thermoelectricity Company, BoHai Radio Plant with 12139
people working here. The proposed works will greatly improve the environment of
this community and benefit 68437 people living in XiaoHaiDi residential block
and 8907 people working here.
1.3.2.4 Shuanglin Waste Water Treatment Plant
The works serves mainly the HeXi District covering an area of 2710 ha including
annex to control number of people to be resettled. All those residents and employees
within the scope before the deadline shall be subsidized or assisted rationally.
7.2 Principle of Compensation
* Compensation standard shall be defined for the property based on a principle of
repurchasing.
* All houses shall produce legal documents for the determination of compensation.
* A compensation of RMB200/household for moving will be issued to the residents.
* The buildings and their annex shall be pulled down after arrangement and
compensating. Land acquisition fee shall be paid within three months from the day that
resettlement program is approved.
* Compensation standard of Tianjin shall be carried out for compensation for non-
residential houses and materials moving cost. See for detail from Clause 30 and Clause 39 of
House Dismantling and Moving Management Statue of Tianjin.
* Compensation shall be calculated based on location, usage and floor area of the
house.
* Residential houses shall be mainly compensated in currency with ownership
exchanges.
* The people who got the currency for compensation shall buy satisfactory house in
market themselves.

* Loss due to temporary stop shall be deleted or minimized; compensation or other
assistance shall be given if it is inevitable. See for detail clause 52 and clause 53 of House

* The relocation of agencies shall be discussed and agreed upon by the agencies to be
moved away and their administrative bodies.
* The transition period may be ignored when the candidate settling house are
sufficient. Compensation for transition shall be issued if transition is unavoidable.
* The income of farmers whose farm land being acquired shall be recovered by land
adjustment and increased farming income.
* Land for temporary use should be returned on time. Land for cultivation should be
revered first and then returned; compensation payment should be made if using of the land is
going to be extended.
7.3 Policy for Compensation
7.3.1 Residential Houses
7.3. 1.1 Compensation mode
* In accordance with Detailed Rules for Management on Resettlement in Tianjin,
ownership exchange and cash compensation shall be used in resettlement.
* Houses to be pulled down shall be compensated at a repurchased price. And the
compensation standard will be determined according to different location and sort of the
houses as evaluated by real estate estimators.
* The people to be resettled may buy houses in market with the compensation cash. If
the cash is not sufficient to buy a house, he may apply for loan from the housing fund
management center or a bank.
* When the people do have difficulties for moving, they may be resettled in other
ways by getting certificate given by civil administration agency.
* Property may be exchanged for economically difficult households. When difficult
households hope to enlarge living space, the departments concerned may help to get the loan.
7.3.1.2 Users of Public Houses Who pay a standard rent (renter)
User of public houses to be resettled without enjoying favorable policy on buying a house
may release from rental contract and logout the property right. 20% of the compensation shall
be paid to the owner and 80% paid to the user, owner shall not offer a house for him and the

user may buy or rent a house himself. In case that the user to be resettled has another house
and enjoys favorable policy for buying a house, 80% of the compensation shall be paid to the
owner and 20% paid to the user,
7.3.1.3 Renter of Private Houses
* In the case of rented private houses to be demolished, if ownership exchange is to be
used, the original renting relationship will be maintained, and the renting contract may have to
be modified if needed; if cash compensation is to be used, the compensation shall be issued
after a new agreement is reached between the house owner and renter or after the completion
of the law suit if there is any dispute caused thereof.
7.3.2 Non-residential houses
7.3.2.1 Mode for resettlement
In accordance with Detailed Rule for Management on Resettlement in Tianjin, ownership
exchange, cash compensation or both shall be used.
7.3.2.2 Other compensation policy
Cost for moving of materials and equipment shall be compensated. The amount shall be
agreed upon by both parties.
7.3.3 Temporary buildings
For the temporary buildings to be acquired by the project, a compensation of RMB 12/m2
will be issued to the renters only.
A survey of the affected temporary buildings shows the following characteristics:
* Low in cost. Usually the investment is less than 10 thousand RMB and the owners
have recovered their investment.
* The owners are mostly government agencies or bodies.
* The buildings are mostly rented for use by others.
7.3.4 Land Requisition
* Cost for land requisition includes compensation, subsidy for resettlement and
cost for young plants.
* In accordance with Temporary Rules for Management on Land Requisition in
Tianjin, compensation for land shall be calculated in ten times of averaged production
value of three years before the requisition. See table 7-5 for production value standards of

various land.
* The laborers affected by permanent land requisition should be compensated. In
accordance with Temporary Rules for Management on Land Requisition in Tianjin,
compensation for resettlement shall be calculated in six times of averaged production
value of three years before the requisition.
* Payment for land compensation and subsidy for resettlement shall be used by
consent of two thirds of the villagers.
7.3.4 Attachment on ground and under ground
7.3.4.1 Owner of infrastructure

7.4 Compensation Standard
Prices of land in different urban areas are different. Therefore, price for compensation for
the houses of residents, shops and agencies in different areas are variable. Locations of the
components are shown in Table 7-1.

7.4.1 Residential Houses

The affected residential houses within the above-mentioned areas are of poorly-built brisk
bungalows (having been used for more than 15 years) without any supply of pipe water,

heating and gas, and the locations are adjacent to the city borders, thus low in price.
7.4.2 Non-residential houses
Based on calculation by Tianjin Real Estate Estimation Agent, compensation standard for
enterprises and government agencies is shown in Table 7-3.

7.4.3 Temporary Building
Compensation shall be done as stipulated.
7.4.4 Requisition of State-owned Land
All state-owned land acquired by the project is considered as governmental transfer free of
charge.
7.4.5 Requisition of Collective Land
To calculate the compensation standard for collective land requisition in accordance with
Law on Land Management in PRC and based on the land benefit. Table 7-4 shows the average
production value of previous three years for the affected land.

It is defined by project office and land authority that land compensation and subsidy for
resettlement for the land in suburban or county is calculated as 16 times of average production
value for the last three years. It is calculated as 5 times of averaged production value for
wasteland and 10 times for river way.
Besides land compensation and resettlement subsidy, other compensation standard is
shown in Table 7-5.

industry. Today, more than 20 industries have been formed as machinery, chemistry, light
industry, textile, building material, garment, foundry, metal products, electronic instruments,
and environmental protection equipment. There are 37 city or district-level group enterprises
and over 2100 industrial enterprises with total industrial production value of 10 billion RMB
in year 2000. The tertiary industry in the district grows rapidly; by the end of 1998 there are
altogether 16,500 enterprises in tertiary industry with employee of 47000 people and
production value of 1.64 billion which is 38.8% of the district's total GDP. The tertiary
industry of the district, characterized in large coverage, various fields and completed
categories, has been enjoying fast development during the years. JinNan District, with its
strong industrial basis, developed culture and education, sound investment environment and
favorable investment policies, offers good investment condition to investors in and out of
China. So far, more than 300 foreign invested enterprises with total investment of over 500
million US dollars have been set up in Jinnan District by investors from over 20 countries and
regions. In year 2000 total turnover of the foreign invested enterprises reached 2.2 billion,
with taxation of 126 million and export income of 180 million.
ShuangGang Town, where the JiTai village locates, is resided by JinNan Economic
Development Zone. The development zone, listed by Tianjin government as one of the city's
8 industrial areas, the pilot unit of Tianjin urban construction and modern agricultural
construction pilot unit, is of bright prospect. The famous township enterprise, GangTian
Motorcycle Company is also located in ShuangGang Town. The development zone is
approved to build by Tianjin government in 1997 with a planned area of 6 km2. The 5 km2 of
the first phase has been established. Since its set-up, the JinNan Economic Development Zone
has become one of the most popular areas of investment in Tianjin with its predominant
geographic position, sound investment environment, sound plan and layout, favorable tax
policies and low land price, efficient service and optimized management model.
The Shuanggang Town has prepared the tenth five-year plan to strengthen itself as a town
following the principle of being scientific, practical, easy to operation and completed. The2town is to be of 4 km , and JiTai village will be integrated into the future town.
Owing to its sound economic condition, large numbers of enterprises and huge demand
for labor force, the villagers to be affected by the project have plenty of opportunity' to find
new job with income no less than before. Therefore, the affected villagers' life will not be
worse.

8.5 Actions to reduce indirect impact by construction
Construction of roads shall inevitably impact the life of residents and operation of the shops.
Impacts such as dust and noise should be minimized through environment management.
Construction and maintenance of roads shall be done half by half to avoid stopping traffic.
When it is necessary to stop vehicle's passing, pedestrians and non-motor vehicles shall
continue. Only those large vehicles such as lorries and buses shall not be allowed to pass.
8.6 Selection of resettlement space, Preparation and Moving
8.6.1 Residents
8.6.1.1 Urban Residents
Housing market in Tianjin is well developed. And there are houses on sale near the region
affected. People may go there and make one's own choice. We additionally developed Table
8-1 to show the houses on sale adjacent to project area. From this table we can see the
replacement price is similar to the market price of housing.
8.6.2 Shops
Overall investigation shall be carried out to understand willingness of every shop and then
resettlement office and the owner discuss and agree on mode for resettlement based on
location. Table 8-2 shows the suggested modes for resettlement.
Suggested markets for the shops resettlement are Minquanmen and Dahutong markets.
Minquanmen Wholesale Market is located in Jinzhonghe St. adjacent to Hongxinglu. The
market is owned by Zhaoguli Brigade with more than 400 stalls, 85% of which were rented
out. The remainder is sufficient to receive the shops to be resettled for Jinzhonghe
Interchange. Averaged rental for the market stalls is 1000/month (20 square meters) and areas
of the stalls are some 8-50 square meters meeting demand from the resettlement.
Dahutong Commercial Town locates to a space between Beimalu and Nanyunhenanlu near the
shops to be resettled. The town is being developed by Tianjin Wanlong Real Estate Co. Ltd.
with many sorts of business. The town consists of 12 buildings, 2 of which are ready now
with 10% rented or sold out. The rental is 5-10/day x m2. Operators may still buy a shop at
price of RMB 60,000 -120,000. Demand for resettlement can be completely met.
Resettlement agencies shall issue the latest market information for the shops to be resettled to
select. Some of the market information for shops may be seen in table 8-3. Demand from re-
opening can be completely met.

Outside supervisor will supervise and track the process of the payment of compensation
currency to ensure the paying on time.
Resettlement agencies shall try to keep the original integration of shops with similar business
to ensure continuity of operation. The moving follows the compensation and resettlement so
that there will be no transition period and no loss from stopping the business.
8.6.3 Enterprises and government agencies
Technical and economical analysis shall be done on resettlement program for all the
enterprises to be resettled during investigation period. Reconstruction and re-operation should
be arranged locally if possible. However, if not, self demolish and self-construction should be
realized to avoid or minimize the loss due to shut down. Resettlement agencies and planning
agency shall offer at least two places for the enterprise to choose.
For the enterprises to be moved away, preparation and reconstruction should be started as
early as possible and meeting requirement of plan of the City.
Industrial enterprises should be arranged in accordance with the requirement of Tianjin's
overall plan. Those factories with pollution, interference to residents, huge transportation, as
well as those not suitable to develop in urban area shall be moved out of urban districts.
Enterprises of tertiary sector may select houses in Tianjin for the operation. The houses in
market are sufficient wit reasonable prices and good operational conditions. Requirements of
enterprises to re-start operation could be met completely.
Outside supervisor will supervise and track the process of the payment of compensation
currency to ensure the paying on time.
8.6.4 Resettlement of Women Affected by the Project
Female affected people in the project, 52% of the total affected people, come from removal of
residential house, permanent land acquisition and removal of non-residential house. Female
affected people from removal of residential house and permanent land acquisition accounts
for 50% of the total. The resettlement of female affected people is described in "Resettlement
of people affected by land acquisition in Shuanglin WWTP". The reason why female is the
majority of the affected people is most of the house to be demolished in the project are used
as tertiary industries that employs more female, such as restaurants, shops and so on. Once the
resettlement scheme is determined, the former businesses in this area will continue to run,
therefore the female affected people's life won't be affected heavily.

10 Environment Protection
10.1 The Necessity of Environment Protection
The environmental assessment for the main investment project that the resettlement
needed shall include the impacts for the environmental caused by the resettlement. The plan
of the resettlement must be combined with the environmental assessment. It is necessary to
limit the boundary of the resettlement zone, to calculate the increasing of population density
of the unit land area. In agricultural project, if the population of resettlement is more than the
original population in the area for the resettlement people, it will increase the environmental
problem such as cutting trees, excessive grazing, soil erosion, sanitation and pollution.
Therefore, the resettlement plan not only shall include the suitable mitigation measures
(including training for resettlement population), and also to allowed to select other places for
resettlement. Town's resettlement will lead some other problems that have very close
relationship with the density of population (such as transportation capacity, drinking water
sources, medicinal and health system and so on). A constructive environmental management
method will provide a good opportunity and profit for the people to be resettled and people in
the resettlement area. In the resettlement may cause an unacceptable result for environment,
and then it must to find other places for resettlement or to add places for resettlement.
10.2 Demolition, Remove and Clear away
All kinds of rubbishes from demolition of building and auxiliary constructions within the
area of the project should be disposed to the places pointed by Tianjin Environment and
Sanitation Administration Bureau.
All buildings, houses and walls within the boundary of the project should be demolished
and removed, and pollution sources within it should be cleared away and sterilized. The
deposited wastewater by industry enterprises within the boundary of the project should be
discharged according the regulations. Polluted waste residue will be moved to the pointed
places for landfill. For storage houses for chemicals, it is necessary to take toxin cleaning and
naturalization treatment to make the soil to reach sanitation standard.
10.3 Environmental Condition of Resettlement Zone
City dwellers to be relocated will select commercial houses within residential quarters
(zones) within Tianjin by their options. It is fully considered environment protection at

planning, design and construction of each residential quarter. Green planting areas of
residential quarters reached national standard, and residential quarters (zones) are with
beautiful environmental surroundings.
10.4 Environmental Condition of Resettlement Zone for Shops, Enterprises and
Institutions
Enterprises with pollutions will take measures to deal with and to control pollution by
this demolition and remove opportunity. Enterprises with pollutions that shall be completely
removed to other place will move to the pointed places according to Tianjin Municipal
General Plan, and to deal with and control the pollutions by the enterprises combining with
the sector's regulation, to reach the national standard for environment.
It will plant trees to green environment according to the city environment protection plan
when construction of shops, enterprises and institutions,

11. Public Participation
11.1 Public Participation Strategy
In accordance with the state, provinces and municipal cities policies and laws about
demolition & remove and resettlement, it will make proper policies and detail executing
principals, to make up a proper resettlement plan, to make good executing organization
works, and to realize the target of proper resettlement to safeguard the resettled people and
demolished and removed units' legal rights and interests, to minimize grievances and
disputes. For this project, we will widely listen to the views of resettled people, and pay great
attention to the public participation during stages of making out resettlement policy,
resettlement plan, and resettlement executing.
During the feasibility study at the project preparation phase, the project office had
solicited opinions and suggestions about plan, demolition & remove and resettlement from
Tianjin municipal government, districts government, peoples conference, political
consultative conference, and mass organizations, residents, shops, enterprises and institutions
within the boundary of the project to be resettled and moved and related street government
and residential committees. Please refer to table 11-1 for the details.
11.2 The ways and measures for public participation
A. Representatives of resettled residents to join the resettlement work
Representatives of resettled residents selected by the residents in proportion will
combine with street government and residential committee to get views and requirements, to
listen to the seasonal suggestions and to exchange opinions widely from the residents.
For the executing of houses and auxiliaries demolition's investigation, compensation
rates fixing, agreement negotiation of demolition and resettlement, resettlement houses
construction and allotting, the residential committees and representatives of resettled residents
will join the above mentioned works to fully reflect the interests and opinions of the resettled
residents, and to guarantee the fair, rational and transparency of the project's resettlement
work.
B. To hold meetings for removing, to build policy announcement bulletin boards
It will establish temporary offices at demolition site. During demolition and removing,
staffs of the offices will spread propaganda among the affected people about resettlement

plan, compensation rates, and to find out the situations and special difficulties of the resettled
households, to answer their questions, and to make preparation for making up resettlement
plan and signing of resettlement compensation agreement.
C. To hold consultative meetings
6 months before the land acquisition and demolition, it is to hold meetings with
participations of resettled residents, shops, enterprises and institutions, residential
committees and women representatives (more than 30%), to introduce situations and to
listen to their opinions and suggestions further.
D. To issue an announcement about demolition and resettlement
Before the construction on each street, it will issue an official announcement. The content of
the announcement will include: the project rough information, the scope of land acquisition,
policy of resettlement (including compensation rates), implementation agency for
resettlement, time schedule for demolition and removing, rights and interests of the resettled
people, grievances and appeal, monitoring and evaluation and so on.
11.3 Appeal
Appeal procedure:
* If resettled people or unit has grievances about the settlement plan or settlement
implementation, they can express their grievances verbally or by written form to the related
districts (counties) resettlement office (implementation agency); the related departments
should settle the matters within 2 weeks. If there is a dispute about the house
uses/construction floor space, it will be determined by the municipal planning department and
the municipal real estate administration department. The above-mentioned departments
should give their determinations within 10 days after receiving the application.
* If resettled people or unit still dissatisfied with the treatment resolution of the stage
1, they may also appeal to the higher authorities.
* If resettled people or unit still dissatisfied with the treatment decision of the stage 2,
they may also appeal to the municipal resettlement and reconstruction office (houses
demolition monitoring and arbitration agency) or the municipal land management bureau (the
land acquisition monitoring and arbitration agency) after receiving of the treatment decision
made by the municipal resettlement department, to ask for a monitoring and arbitration

agencies' administrative arbitration. Administrative arbitration agencies should make an
arbitration decision within 10 days.
* If resettled people or unit still dissatisfied with the arbitration decision made by the
administrative arbitration agency, after receiving of the administrative arbitration decision, the
resettled people or unit can appeal to civil court for any matters about resettlement in
accordance with the law of administrative lawsuit.

12 Monitoring and Evaluation
12.1 Internal monitoring
The PMO will carry out an internal monitoring system to inspect resettlement action. The
PMO establishes a basic database of land acquisition, demolition and resettlement, and to use
the database to make up the resettlement plan and to monitor the resettlement of affected
people and unit, to make internal supervision and inspection for the whole phase of
preparation of resettlement and implementation of resettlement.
12.1.1 Implementation procedure
During implementation, the resettlement department of the PMO, the resettlement office
of the municipal investment management office and related districts/counties' resettlement
offices collect and record information about resettlement of residents, shops, enterprises and
institutions according to a monitoring template, and send the real-time activities record to the
PMO in time to keep a continuous implementation monitoring. The PMO will inspect
implementation situations periodically.
Within the above-mentioned system, it is to make up formed information tables (forms) to
realize a continuous information flow from resettlement offices of related districts/counties to
the municipal project leading group. The project leading group, the PMO, resettlement
department of the PMO, the resettlement office of the municipal investment management
office and related districts/counties' resettlement offices, as the important parts of the internal
monitoring system, will carry out inspection periodically.
It is necessary to make perfect tracing for acceptors (residents, shops, enterprises and
institutions) of resettlement by currency, the tracing will be undertaken by internal system and
external unit both. During the demolition and resettlement, resettlement offices of each sub-
project should record liaison methods of acceptors of currency resettlement without mistakes
and to carry out tracing and investigation after implementation of currency resettlement, to
guarantee the resettlement job is carried out properly.

12.1.3 Internal monitoring report
Resettlement departments of districts/counties should draw an internal monitoring report
and submit it to the resettlement department of the PMO every 3 months. The PMO will
submit a demolition and resettlement time schedule to World Bank every 3 months, and
submit a internal monitoring report to World Bank every half a year.

12.2.1 Independent monitoring agency
Institute of Public Will Study of Tianjin Academy of Social SciencesThe Institute of Public Will Study of Tianjin Academy of Social Sciences (TASS), which
directly gives multilevel, multi-angles advisory services for local government, enterprises,
medium and other departments concerned, is one of the research institutes having important
position in study of public opinion and public will in Tianjin. There are 11 researchers in the
Institute, one senior research fellow, five associate research fellows, three assistant research
fellows and two other researchers. Some of them also have master and bachelor degree. Most
of the researchers have high skill of computer operation and English; meanwhile, some are
familiar with computer network.
Public will research is a new interdisciplinary research field rising in China in recent
years. The Institute of Public Will Study of TASS has been working on the hot spots of the
society concerned by the government, medium and common people, developing deeply the
research of public will and opinion and hot spots of economy and society. It's a relatively
independent research institute of social sciences. Basing on the sociology theory and others, it
makes interdisciplinary and comprehensive study. It not only makes a special effort to
investigate and study practical problems, but also stresses the study of theoretical problems
about academic construction.
In the aspect of providing advisory services of policy-decision for the government.:

In aspect of providing consulting service for enterprises. The main consulting projects

12.2.2 Responsibility
The independent monitoring and evaluation agency will make tracing monitoring and
evaluation on the resettlement actions periodically, monitor resettlement progress, quality and
funds, and put forward consultant opinions. The agency will make tracing monitoring on
resettlement houses' quality and standards of production and livelihood, and submit
monitoring and evaluation report to the project office and World Bank.
12.2.3 Monitoring procedure and content
1. Drafting of a monitoring and evaluation program

residents, shops, enterprises and institutions
4. Planning of design for sampling investigation
Scope of sampling: 10% of relocated resident households; 10-15% of shops; 20% of land
acquisition resettled households; 10% of affected enterprises and institutions.
5. Basic information investigation
Basic information needed by independent monitoring and evaluation for land acquisition
and resettlement resident households, shops enterprises and institutions of the project, to
get basic information about production and living levels (living, production, operation and
income levels) of relocated households and other units.
6. Building of a monitoring and evaluation information system
It is to build up a monitoring and evaluation information system, to build up a database

with all kinds of data involving resettlement monitoring and evaluation in classical, to
provide computer assistant for analysis and tracing monitoring.

efficiency of resettlement implementation agency.

to monitor the land for house construction for countryside relocated people, residence house
construction progress, paying of compensation funds, house construction quality and so on.
* Typical loss-land relocated household: to monitor resettlement compensation funds,
compensation for young crops, employment situation, income restoration, resettlement quality and
so on.
* Monitoring of typical shops: compensation funds paying for shops, houses for relocation,
moving progress, construction restoration, employees' income restoration, resettlement quality.
* Monitoring of typical enterprises and institutions: to monitor compensation funds paying,
new land acquisition, house construction, removing progress, construction restoration, employees'
income restoration, resettlement quality.
* Public facilities: to monitor paying of compensation funds, public facilities' function

12.4 Post-appraisal
After completion of the project, it will make a post-appraisal for the resettlement
activities by a project post-appraisal theory and method on the basic of monitoring and
evaluation. It is to appraise the successful experiences and lessons needed for drawing on
resettlement of residents, shops, enterprises and institutions and on other respects, to
provide experiences used for reference for other resettlement works in the future. The
agency, which will do the post-appraisal, should draw a post-appraisal work program and
build up an appraisal index system. It will make a social economy analysis investigation
and draw a "The report of post-appraisal on Tianjin municipal residents resettlement", to
submit the report to the project office and World Bank.
12.5 External monitoring report
Six months after demolition and removing implementation, the external monitoring agency
starts to prepare monitoring reports for PMO review. Two reviews shall be done in the first
year of construction, and a monitoring report shall be prepared every 6 months since then, i.e.
twice for 2003 and 2004; once for 2005 and 2006.

14 Implementation Plan
The implentation of the resettlement action of the project is expected to start in 2003 andend in 2005. Notification for land acquisition will be issued three months before actualimplementation. Two months before actual land acquisition, actual resettlement activities willbe started including resettlement, motivation, census, and publication of related compensationstandard and resettlement information. External supervision staff will track the above task allthrough.
