STIPULATION REGARDING PUBLIC INPUT HEARINGS
To: Administrative Law Judges Charles E. Rainey, Jr., and Marlane R. Chestnut:
The Office of Trial Staff; Consumer Education & Protective Association, Tenant
Action Group (TAG), Action Alliance of Senior Citizens, The Association of Community
Organizations for Reform Now (ACORN) and John W. Long, Jr. ("CEPA et al."); Office
of Consumer Advocate; Office of Small Business Advocate; American Association of
Retired Persons (AARP); and PECO Energy Company submit the following stipulation
regarding public input hearings in the above-captioned proceeding.
At the request of Administrative Law Judge Rainey at the Second Prehearing
Conference, interested parties met to reach a common recommendation for dates,
times and locations of public input hearings. The above parties met and hereby agree:

1. That six public input hearings be^held; two in Center City Philadelphia and one in each of Chester, MontgonWyJDelaware and Bucks Counties (i.e.,

throughout PECO's service territory).
2. That one hearing be held in Center City Philadelphia in the evening on Wednesday August 13 or Thursday August 14 (scheduled at an appropriate time to allow travel after the conclusion of the technical hearing that day to the pubic input hearing).
3. That one hearing be held in one of the counties in the evening on Monday, August 18 (scheduled at an appropriate time to allow travel after the conclusion of the technical hearing that day to the pubic input hearing).
4. That one being be held in another county on the evening of Tuesday, August 19 (scheduled at an appropriate time to allow travel after the conclusion of the technical hearing that day to the pubic input hearing).
5. That one hearing be held during the day in Center City Philadelphia on Septembers, 9, or 10.
6. That one hearing be held during the day in another county on September 8, 9, or 10.
7. That one hearing be held during the day or evening in another county on September 8, 9, or 10.
8. To minimize travel for the parties, that the three public hearings scheduled in September be held either on September 8 and 9 or on September 9 and 10 (i.e., not on September 8 and 10).
9. That PECO be permitted to file written testimony, if it believes it necessary, in response and limited to expert or technical testimony or evidence presented at the public input hearings, and which testimony or evidence PECO had not previously addressed in its earlier testimony. PECO must file its responsive testimony in hand by 4:00 p.m. on Friday, September 12 (in-hand to the ALJs and by fax to the parties). If any party desires to conduct cross-examination on PECO's written testimony, it must so request in writing delivered to the ALJs and the parties by 4:00 p.m. on Monday, September 15. In the event such a request is timely received, the ALJs will notify the parties and will hold a telephonic hearing on Wednesday, September 17, 1997 at 10:00 a.m. for

cn This Motion to Intervene and Become a Party before the Pennsylvania Utility
Commission is respectfully submitted by the Delaware Valley Schools Energy/Utility Consortium. As grounds for said intervention, Movant avers as follows:
1. The Movant, the Delaware Valley Schools Energy/Utility Consortium (DVSEUC) has as its membership approximately seventy (70) school districts in the Montgomery, Delaware, Bucks, and Chester County areas. The overwhelming majority of the members of DVSEUC utilize electric services from the PECO Energy Company.
2. The matters with are the subject of this docket could have a substantial impact upon the DVSEUC and its members.
3. DVSEUC's intervention will serve the public interest by assisting in the establishment of observations and opinions relevant to the interests of the members of the Delaware Valley Schools Energy/Utility Consortium.
