1. Keys evolutions since 1 year

Consequence of the accident occurred on August 4th 2007 to the «Fête des Loges», the French government decided to define a law on the safety of attractions.

This law n° 2008-136 has been made applicable in February 13th 2008 and is related to safety rides, machines and facilities for fun fairs and amusement parks.

At this date, the decree of application and decrees for Amusement parks and fun fairs are in preparation to define the technical inspections in operational modes.

2. Content of new regulation and limits

To summarize, these regulatory texts allow :

1. That all new attraction en service after the application of the decree (under finalization) must be in compliance with the EN 13814 norm (2007) .

2. Periodic technical inspections done by certified companies or qualified staff.

3. Any other part of an attraction (building, fire prevention, etc.) follows its specific regulatory requirements.

3. New assets – Coming projects

Conform to EN13814 after decree publishing

nb : no requirement on retrofit for existing attractions

From now on, we recommend to include this requirement in new contracts.

Specific attention that manufacturer will plan the receiving inspection during design, construction, installation and final test phases.

All these inspections and validation by certified control office need to be documented.

We recommend that inspections planned in operations need to be developed under manufacturer‘s responsibility (part of the document provided by manufacturer).

4. Impacts on existing attractions

What : Necessity to perform scheduled inspections on permanent facilities

Where : 3 categories of rides– Cat. 1: ride for children unsupervised by adult height less than1m40– Cat 2: ride other than Cat.1 with or without restraint systems corresponding to zone 1, 2 and 3 in paragraph 6.1.6.2.4.1 norm EN13814– Cat. 3: ride other than Cat. 1 with restraint systems corresponding to zone 4 and 5 in paragraph 6.1.6.2.4.1 norm EN13814.

When : Initial inspection when decrees will be enforced, then:– Every 3 years on Cat. 1 ride– Every 2 years on Cat. 2 ride– Yearly on Cat. 3 ride

4. Impacts on existing attractions

Who:– Inspection can be performed by the company Maintenance teams (according to specific criteria) or by independent certified control office.– Verification of these inspections need to be performed by a certified control office.

MAINTENANCE

Collects data from Manufacturer and fitter

Maintenance guidelines &Control instructions

QUALIFIED PERSON(as per decree)

Carries out or has carried out risk analyses of rides

mentioning critical issues Updates risk analyses

as per completed technical changes

Translates risk analyses into control plans which will serve as

basis to periodical controls

Makes sure that controls for which he isn’t qualified are carried out and supervises their compliance

Collects all control reports

Checks control reports compliance

Presents the equipment technical file to the certified control

office

Hands over certification to qualified authorities

Informs authorities of any incident occurred on equipment

STATE-CERTIFIED OFFICE

Rules on compliance andobservations resulting in

noncompliance

HOW:

Control carried out by a QUALIFIED PERSON, either a technical inspection office and/or by maintenance teams known as qualified (preferably as per certified control office)
